NOVEMBER 4. 1991 1 The Common Council of the City of Richmond, Indiana met in regular session on November 4, 1991 at the 2 hour of 7:30 P.M. in the Council Chambers in said City. President Hutton presided with the following 3 Councilmembers present: Elstro, Lundy, Brookbank, Parker, Morris and Paust. Absent: Hankinson and 4 McBride. Representatives of the following media were in attendance: WCTV CABLE 16, WKBV/WFMG, 5 WHON/WQLK and Palladium Item. The following business was had to-wit: 6 7 PLEDGE OF ALLEGIANCE 8 9 SILENT DEVOTIONS 10 11 APPROVAL OF MINUTES OF OCTOBER 21. 1991 12 13 Councilmember Brookbank moved to approve the minutes of the previous meeting as prepared, seconded 14 by Councilmember Elstro and on unanimous voice vote the motion was carried. 15 16 COMMUNICATIONS FROM THE MAYOR 17 18 Mayor Frank Waltermann presented the Council an article from Public Works magazine that he felt 19 explained the GIS systems in easy to understand language. He said the GIS was discussed at the Greater 20 Richmond Progress Committee meeting today with the County Commissioners. 21 22 Mayor Waltermann told Council that with the colder weather, the number of calls coming into the Human 23 Services regarding disconnects on utilities has increased. 24 25 Mayor Waltermann addressed Council about No. 1 Fire Station and their boiler problem. He said they will 26 probably need to use CCDF funds already appropriated to make the necessary repairs and while they are 27 doing this to go ahead and move the offices to make them handicapped accessible and make certain the 28 heating system is configured properly for the new office arrangement. The Mayor felt the project might cost 29 around $50,000.00. 30 31 Councilmember Elstro asked if there were funds left in the Fire Department budget and Mayor Waltermann 32 said they were spending at the percent they should be and if they use CCDF funds these can be replaced 33 out of the 1992 capital budget. 34 35 WELCOME OF GUESTS 36 37 President Hutton welcomed the students from Mr.Zinkens classes at Richmond High School. - 38 39 PRESENTATION OF REMONSTRANCES. PETITIONS AND MEMORIALS 40 41 None were presented. 42 43 REPORTS FROM CITY DEPARTMENTS 44 45 None were presented. 46 47 REPORTS FROM OTHER OFFICES 48 49 None were presented. 50 51 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY 52 53 Mr. Metzger reported that Ms. Hauptstueck had asked him to relay that the State has requested additional 54 information from the Police Department regarding the concerns of the City with traffic and pedestrian 55 problems on National Road West and US 27 North. 56 57 REPORTS FROM SPECIAL COMMITTEES 58 59 COMMITTEE OF THE WHOLE 60 61 Councilmember Lundy announced there would be a Committee of the Whole on November 12, 1991 at 7PM 62 for Ordinance No.63-1991. 63 64 65 66 REPORTS FROM STANDING COMMITTEES 5: Common Council November 4, 1991 Page 2 1 Reid Hospital 2 3 Councilmember Brookbank reported they were researching a pension plan and also changing the corporate 4 identity to Reid Hospital and Healthcare Services. 5 6 Councilmember Brookbank announced the retirement of Dr. Ebbinghouse and that Dr. Jim Johnson was 7 leaving the City,but they are working to recruit new doctors. 8 9 REPORTS FROM SPECIAL COUNCIL COMMITTEES 10 11 None were presented. 12 13 MISCELLANEOUS BUSINESS 14 15 Police Merit Commission 16 17 President Hutton announced that the Council needed to make an appointment to the Police Merit 18 Commission at the next meeting and the person would represent the professional community and needs to 19 be Republican by political affiliation. 20 21 RESOLUTIONS 22 23 Councilmember Brookbank moved to suspend the rules and read Resolutions No. 24 and 25-1991 by title 24 only, seconded by Councilmember Morris and on unanimous voice vote the motion was carried. 25 26 RESOLUTION NO. 24-1991 27 28 The Clerk read by title only Resolution No. 24-1991 - A RESOLUTION APPROVING THE REWARD OF 29 DAMAGES BY THE BOARD OF PUBLIC WORKS AND SAFETY FOR THE ACQUISITION OF CERTAIN 30 LANDS AND STRUCTURES, AND AUTHORIZING THE APPROPRIATION OF MONEY FOR THE 31 ACQUISITION. 32 33 Mr. Metzger told Council that the Resolution approves the process of Board of Works for the acquisition of 34 right of way for Industries Road. He asked that the Council amend the Resolution to delete reference to Elks 35 Road and In-Fill Housing since they will be completed later in the month. 36 37 Councilmember Brookbank moved to amend Resolution No. 24-1991 to delete reference to Elks Road and 38 In-Fill Housing, seconded by Councilmember Lundy and on unanimous voice vote the motion was carried. 39 40 There being no questions or comments, Councilmember Elstro moved for adoption, seconded by 41 Councilmember Parker and on unanimous voice vote the motion was carried. 42 43 RESOLUTION NO. 25-1991 44 45 The Clerk read by title only Resolution No. 25-1991 - A RESOLUTION AUTHORIZING THE CITY OF 46 RICHMOND TO MAKE FULL APPLICATION FOR SMALL CITIES COMMUNITY BLOCK GRANT FUNDS, 47 AND AUTHORIZING THE MAYOR TO SIGN AND SUBMIT SUCH APPLICATION TO THE INDIANA 48 HOUSING FINANCE AUTHORITY, COMMIT THE MATCHING FUNDS, EXECUTE THE GRANT 49 AGREEMENT AND TO EXPEND THE GRANT FUNDS, IN ACCORDANCE WITH THE PROVISIONS OF 50 THE GRANT AGREEMENT. 51 52 It was explained this was formality to submit a housing rehabilitation grant to the state. 53 54 There being no further questions or comments, Councilmember Elstro moved for adoption of Resolution No. 55 25-1991,seconded by Councilmember Brookbank and on unanimous voice vote the motion was carried. 56 57 ORDINANCES 58 59 ORDINANCES ON FIRST READING 60 61 Councilmember Morris moved to suspend the rules and read on first reading by title only Ordinance No. 62 64-1991,seconded by Councilmember Brookbank and on unanimous voice vote the motion was carried. 63 64 65 66 ORDINANCE NO.64-1991 Common Council Minutes Con't November 4, 1991 Page 3 1 The Clerk read on first reading by title only Ordinance No. 64-1991 -AN ORDINANCE ESTABLISHING AN 2 ENFORCEMENT AID FUND,A NON-REVERTING FUND. 3 4 President Hutton announced the Ordinance would be advertised for public hearing. 5 6 ORDINANCES ON SECOND READING 7 8 ORDINANCE NO.50-1991 9 10 The Clerk read on second reading Ordinance No. 50-1991 - AN ORDINANCE AMENDING CHAPTER 154 11 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE 12 ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA PROVIDING FOR THE REZONING OF 13 PROPERTY LOCATED AT 911 SOUTH L STREET, FROM R-3 ONE TO EIGHT FAMILY RESIDENCE 14 DISTRICT TO R-3SU ONE TO EIGHT FAMILY RESIDENCE SPECIAL USE DISTRICT AND 15 AUTHORIZING THE SPECIAL USE OF SAID PROPERTY FOR THE ESTABLISHMENT OF AN 16 ACCESSORY OFF STREET PARKING FACILITY. 17 18 President Hutton announced the Ordinance was on public hearing. 19 20 There being no one addressing the ordinance, Councilmember Brookbank moved for engrossment, 21 seconded by Councilmember Parker and on unanimous voice vote the motion was carried. 22 23 Councilmember Elstro moved to suspend the rules and move Ordinance No. 50-1991 to third and final 24 reading and read by title only, seconded by Councilmember Brookbank and on unanimous voice vote the 25 motion was carried. 26 27 Ordinance No.50-1991 was adopted on the following call of the roll: 28 29 Ayes: Elstro, Lundy, Brookbank, Parker, Morris, Paust and Hutton (7) 30 Nays: None 31 Absent: Hankinson and McBride (2) 32 33 ORDINANCE NO.55-1991 34 35 The Clerk read on second reading Ordinance No. 55-1991 - AN ORDINANCE VACATING CERTAIN 36 UTILITY EASEMENT LOCATED ON PROPERTY IN THE 1800 BLOCK OF SOUTH I STREET AND 37 ALONG THE COMMON LOT LINES OF LOTS 43, 44, 45 AND 46 IN THE REPLAT OF THE FAIRFIELD 38 PARK FIRST ADDITION. 39 40 President Hutton announced the Ordinance was on public hearing. 41 42 There being no one addressing the ordinance, Councilmember Elstro asked if Mr. Jennings owned the 43 house on South 10th Street that burned and Mr. Dooley said he was and he has cleaned up some of the 44 area and has committed to repair the structure within sixty days. 45 46 Councilmember Elstro announced he intended to hold this ordinance on second reading to see what Mr. 47 Jennings was going to do with that property. 48 49 The Ordinance was held on second reading. 50 51 ORDINANCE NO.57-1991 52 53 The Clerk read on second reading Ordinance No. 57-1991 -AN ORDINANCE AMENDING CHAPTER 154 54 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE 55 ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA PROVIDING FOR THE REZONING OF 56 PROPERTY LOCATED AT 1751 SHERIDAN STREET, FROM M-2 GENERAL INDUSTRIAL DISTRICT TO 57 M-2SU GENERAL INDUSTRIAL SPECIAL USE DISTRICT AND AUTHORIZING THE SPECIAL USE OF 58 SAID PROPERTY FOR THE ESTABLISHMENT OF A PHYSICAL FITNESS FACILITY. 59 60 President Hutton announced the Ordinance was on public hearing. 61 - 62 Ms. Carman Mauer, 2819 Willow Drive, told Council she was the property manager for Sanyo and was 63 representing this request for a company called Muscles in Motion. She would be willing to answer 64 questions. 65 There being no questions or comments, Councilmember Morris moved for engrossment, seconded by -.54 Common Council Minutes Cont'd November 4, 1991 Page 4 1 Councilmember Brookbank and on unanimous voice vote the motion was carried. 2 3 Councilmember Brookbank moved to suspend the rules and move Ordinance No. 57-1991 to third and final 4 reading and read by title only, seconded by Councilmember Parker and on unanimous voice vote the motion 5 was carried. 6 7 Ordinance No.57-1991 was adopted on the following call of the roll: 8 9 Ayes: Elstro, Lundy, Brookbank, Parker, Morris, Paust and Hutton (7) 10 Nays: None 11 Absent: Hankinson and McBride (2) 12 13 ORDINANCE NO. 58-1991 14 15 The Clerk read on second reading Ordinance No.58-1991 -AN ORDINANCE AMENDING CHAPTER 96 OF 16 THE RICHMOND CITY CODE REGARDING STREET EXCAVATIONS. 17 18 The Proof of Publication was presented and found to be in order. Councilmember Morris moved to accept 19 and file the Proof of Publication, seconded by Councilmember Brookbank and on unanimous voice vote the 20 motion was carried. 21 22 President Hutton announced the ordinance was on public hearing due to having been advertised, but 23 Councilmember McBride had requested it be held on public hearing in his absence. 24 25 There was no public comment. 26 27 Councilmember Morris asked if the utility companies had made comment and Mr. Metzger said he was not 28 aware of any,but would follow up. 29 30 The Ordinance will be held for continued public hearing at the next regular meeting of Council. 31 32 ORDINANCES ON THIRD READING 33 34 None were presented. 35 36 ADJOURNMENT 37 38 There being no further business, on a motion duly made, seconded and passed, the meeting was 39 adjourned. 40 41 42 43 44 45 Sarah Hutton, President 46 47 48 49 50 ATTEST: 51 Mary Merchanthouse,City Clerk 52 53 54 55 56 57 58 59 60 61 62 63 64 65
