INDIANA, SEPTEMBER 16. 1991 1 The Common Council of the City of Richmond, Indiana met in regular session on September 16, 1991 at the 2 hour of 7:30 P.M. in the Council Chambers in said City. President Hutton presided with the following 3 Councilmembers present: Elstro, Lundy, Brookbank, Hankinson, McBride, Parker, Morris and Paust. 4 Absent: None. Representatives of the following media were in attendance: WCTV CABLE 16, 5 WKBV/WFMG,WHON/WQLK and Palladium Item. The following business was had to-wit: 6 7 PLEDGE OF ALLEGIANCE 8 9 SILENT DEVOTIONS 10 11 APPROVAL OF MINUTES OF SEPTEMBER 3. 1991 12 13 Councilmember Brookbank moved to approve the minutes of the previous meeting as prepared, seconded 14 by Councilmember McBride and on unanimous voice vote the motion was carried. 15 16 COMMUNICATIONS FROM THE MAYOR 17 18 Mayor Frank Waltermann withheld any comments for presentation of guests later in the Agenda. 19 20 PRESENTATION OF REMONSTRANCES. PETITIONS AND MEMORIALS 21 22 None were presented. 23 24 REPORTS FROM CITY DEPARTMENTS 25 26 None were presented. 27 28 REPORTS FROM OTHER OFFICES 29 30 None were presented. 31 32 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY 33 34 None was presented. 35 36 REPORTS FROM SPECIAL COMMITTEES 37 38 None were presented. 39 40 REPORTS FROM STANDING COMMITTEES 41 42 None were presented. 43 44 REPORTS FROM SPECIAL COUNCIL COMMITTEES 45 46 None were presented. 47 48 MISCELLANEOUS BUSINESS 49 50 Appointment to Street Tree Commission 51 52 Councilmember Brookbank moved to appoint Mr.James Parliment for a term ending September 30, 1993 to 53 replace Mr. Steve Helmich and to reappoint Mr. Ken Hendricks for a three year term to expire 9-30-94, 54 seconded by Councilmember Hankinson and on unanimous voice vote the motion was carried. 55 56 Introduction of Russian Delegation 57 58 Councilmember Morris presented Mr. Alexander Popov, Mr. Yevgeni Galoaki and Boris Kasminin, 59 representing Serpukhov. Councilmember Morris informed Council this was the first time since 1988 that an 60 official delegation had been able to be in attendance at a meeting of the Council. 61 62 Gifts were presented to the Council and the new Flag of Russia was presented to Mayor Waltermann as a 63 sign of friendship and love. 64 65 66 _ 36 Common Council September 16, 1991 Page 2 1 RESOLUTIONS 2 3 Councilmember Brookbank moved to suspend the rules and read Resolutions No. 18 and 19-1991 by title 4 only, seconded by Councilmember McBride and on unanimous voice vote the motion was carried. 5 6 RESOLUTION NO.18-1991 7 8 The Clerk read by title only Resolution No. 18-1991 -A RESOLUTION AUTHORIZING AN APPEAL TO THE 9 STATE TAX COMMISSIONERS FOR RELIEF FROM PROPERTY TAX RELIEF. 10 11 There being no questions or comments, Councilmember Brookbank moved for adoption, seconded by 12 Councilmember McBride and on unanimous voice vote the motion was carried. 13 14 RESOLUTION NO.19-1991 15 16 The Clerk read by title only Resolution No. 19-1991 - A RESOLUTION OF THE CITY OF RICHMOND, 17 INDIANA AUTHORIZING THE SUBMITTAL OF PROGRAM INCOME APPLICATION TO THE INDIANA 18 DEPARTMENT OF COMMERCE AND ADDRESSING RELATED MATTERS. 19 20 Councilmember Lundy asked for an explanation and Mayor Waltermann explained this was to use program 21 income in the Revolving Loan Fund that has to be spent before the City can be eligible for other grants, to 22 purchase the property on North lath Street. 23 24 Councilmember Elstro asked what would be the procedure after this is passed and Mayor Waltermann 25 explained that the Resolution would be forwarded to Department of Commerce for approval to use the 26 program income for this purpose. He said the City has an offer to purchase the property contingent upon 27 funds being available. 28 29 There being no further questions or comments, Councilmember Brookbank moved for adoption,seconded by 30 Councilmember Paust and on unanimous voice vote the motion was carried. 31 32 ORDINANCES_ 33 34 ORDINANCES ON FIRST READING 35 36 Councilmember Morris moved to suspend the rules and read on first reading by title only Ordinances No.52, 37 53, 54, and 55-1991, seconded by Councilmember McBride and on unanimous voice vote the motion was 38 carried. 39 40 TRANSFER ORDINANCE NO.52-1991 41 42 The Clerk read on first reading by title only Ordinance No. 52-1991 - AN ORDINANCE TO TRANSFER 43 WITHIN THE GENERAL FUND-FIRE DEPARTMENT. 44 45 Councilmember Morris moved to suspend the rules and move the ordinance to second reading, seconded by 46 Councilmember McBride and on unanimous voice vote the motion was carried. 47 48 The Clerk read the ordinance on second reading. 49 50 President Hutton announced the ordinance was on public hearing. 51 52 Assistant Chief Joe Pierce explained the transfer was for overtime and education for the Master Fire 53 category. 54 55 Councilmember Parker asked if the funds for overtime were for the balance of the year or do we already owe 56 this and Assistant Chief Pierce said this would be for the balance of the year. 57 58 There being no comments, Councilmember Brookbank moved for engrossment, seconded by 59 Councilmember Parker and on unanimous voice vote the motion was carried. 60 61 Councilmember Brookbank moved to suspend the rules and move Ordinance No. 52-1991 to third and final 62 reading and read by title only, seconded by Councilmember Hankinson and on unanimous voice vote the 63 motion was carried. 64 65 The Clerk read Ordinance No.52-1991 on third and final reading by title only. 66 37 Common Council Minutes Con't September 16, 1991 Page 3 111 1 Ordinance No.52-1991 was adopted on the following call of the roll: 2 3 Ayes: Elstro, Lundy, Brookbank, Hankinson, McBride,Parker,Morris, Paust and Hutton (9) 4 Nays: None 5 Absent: None 6 7 TRANSFER ORDINANCE NO.53-1991 8 9 The Clerk read on first reading by title only Ordinance No. 52-1991 - AN ORDINANCE TO TRANSFER 10 WITHIN THE GENERAL FUND-POLICE DEPARTMENT. 11 12 Councilmember Morris moved to suspend the rules and move the ordinance to second reading,seconded by 13 Councilmember Hankinson and on unanimous voice vote the motion was carried. 14 15 The Clerk read the ordinance on second reading. 16 17 President Hutton announced the ordinance was on public hearing. 18 19 Chief Dennis Rice explained the transfer was for gasoline for the operation of the police cruisers. He said 20 with the eight additional officers now on the streets that had been in training, the use of vehicles has 21 increased and that prices of gasoline are also up. 22 23 There being no comments, Councilmember Elstro moved for engrossment, seconded by Councilmember 24 Brookbank and on unanimous voice vote the motion was carried. 25 26 Councilmember Elstro moved to suspend the rules and move Ordinance No. 53-1991 to third and final 27 reading and read by title only, seconded by Councilmember McBride and on unanimous voice vote the 28 motion was carried. 29 30 The Clerk read Ordinance No.53-1991 on third and final reading by title only. 31 32 Ordinance No.53-1991 was adopted on the following call of the roll: 33 34 Ayes: Elstro, Lundy, Brookbank, Hankinson, McBride,Parker, Morris, Paust and Hutton (9) 35 Nays: None 36 Absent: None 37 38 ORDINANCE NO.54-1991 39 40 The Clerk read on first reading by title only Ordinance No. 54-1991 - AN ORDINANCE AMENDING 41 CHAPTER 97 OF THE RICHMOND CITY CODE WITH REGARD TO THE STREET TREE COMMISSION. 42 43 President Hutton announced the Ordinance would be advertised for public hearing. 44 45 46 ORDINANCE NO.55-1991 47 48 The Clerk read on first reading by title only Ordinance No.55-1991 -AN ORDINANCE VACATING CERTAIN 49 UTILITY EASEMENTS LOCATED ON PROPERTY IN THE 1800 BLOCK OF SOUTH I STREET AND 50 ALONG THE COMMON LOT LINES OF LOT 43, 44, 45, AND 46 IN THE REPLAT OF THE FAIRFIELD 51 PARK FIRST ADDITION. 52 53 President Hutton announced the Ordinance would be assigned to the Plan Commission for public hearing 54 and recommendation and also be advertised for public hearing by Council. 55 56 ORDINANCES ON SECOND READING 57 58 59 ORDINANCE NO.40-1991 60 61 The Clerk read on first reading by title only Ordinance No. 49-1991 - AN ORDINANCE AMENDING 62 CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, COMMONLY KNOWN 63 AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA PROVIDING FOR THE 64 REZONING OF PROPERTY LOCATED 1800 BLOCK OF SOUTH L STREET, ON THE SOUTH SIDE, 65 FROM R-2 SINGLE FAMILY RESIDENCE DISTRICT TO C-2 SU COMMERCIAL SPECIAL USE DISTRICT; AND ALSO AUTHORIZING THE SPECIAL USE OF SAID PROPERTY AS A COMMERCIAL DEVELOPMENT UNIT PROJECT. 38 Common Council Minutes Cont'd September 16, 1991 Page 4 1 President Hutton announced the Ordinance would be assigned to the Plan Commission for public hearing 2 and recommendation. 3 4 ORDINANCE NO.50-1991 5 6 The Clerk read on first reading by title only Ordinance No. 50-1991 - AN ORDINANCE AMENDING 7 CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, COMMONLY KNOWN 8 AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA PROVIDING FOR THE 9 REZONING OF PROPERTY LOCATED AT 911 SOUTH L STREET, FROM R-3 ONE TO EIGHT FAMILY 10 RESIDENCE DISTRICT TO R-3SU ONE TO EIGHT FAMILY RESIDENCE SPECIAL USE DISTRICT AND 11 AUTHORIZING THE SPECIAL USE OF SAID PROPERTY FOR THE ESTABLISHMENT OF AN OFF 12 STREET PARKING FACILITY. 13 14 President Hutton announced the Ordinance was on public hearing. 15 16 Speaking in favor was Mr. Richard Freeman, 1010 South A Street. Mr. Freeman reminded the Council that a 17 preliminary Planned Unit Development had been approved by Council two years ago for this property north 18 of Prestwick Square and they are now asking for final approval of the first phase of the development. He 19 explained that they had requested the ordinance be held in order to redesign the area because the Plan 20 Commission determined the Veterinary office needed to be 100 ft. from the residential area, not 100 ft. from 21 the residential building. 22 23 Mr. Freeman shared the revised drawing with Council and felt this arrangement was better and would 24 provide for adequate landscape and buffering. 25 26 Councilmember Brookbank moved to amend the ordinance per recommendation of the Plan Commission, 27 seconded by Councilmember Elstro and on unanimous voice vote the motion was carried. 28 29 There being no comments, Councilmember Elstro moved for engrossment, seconded by Councilmember 30 Brookbank and on unanimous voice vote the motion was carried. 31 32 Councilmember Elstro moved to suspend the rules and move Ordinance No. 40-1991 to third and final 33 reading and read by title only, seconded by Councilmember Brookbank and on unanimous voice vote the 34 motion was carried. 35 36 The Clerk read Amended Ordinance No.40-1991 on third and final reading by title only. 37 38 Amended Ordinance No.40-1991 was adopted on the following call of the roll: 39 40 Ayes: Elstro, Lundy, Brookbank, Hankinson, McBride,Parker, Morris, Paust and Hutton (9) 41 Nays: None 42 Absent: None 43 44 ORDINANCES ON THIRD READING 45 46 None were presented. 47 48 ADJOURNMENT 49 50 There being no further business, on a motion duly made, seconded and passed, the meeting was 51 adjourned. 52 53 54 55 56 57 Sarah Hutton, President 58 59 60 61 62 ATTEST: 63 Mary Merchanthouse, City Clerk 64 65
