AUGUST 19, 1991 1 The Common Council of the City of Richmond, Indiana met in regular session on August 19, 1991 at the 2 hour of 7:30 P.M. in the Council Chambers in said City. President Hutton presided with the following 3 Councilmembers present: Elstro, Lundy, Brookbank, Hankinson, Parker, Morris and Paust. Absent: 4 McBride. Representatives of the following media were in attendance: WCTV CABLE 16, WKBV/WFMG, 5 WHON/WQLK and Palladium Item. The following business was had to-wit: 6 7 PLEDGE OF ALLEGIANCE 8 9 SILENT DEVOTIONS 10 11 EXCUSED ABSENCE OF COUNCILMEMBER 12 13 It was reported that Councilmember McBride was absent due to illness. 14 15 APPROVAL OF MINUTES OF AUGUST 5, 1991 16 17 Councilmember Brookbank moved to approve the minutes of the previous meeting as prepared, seconded 18 by Councilmember Lundy and on unanimous voice vote the motion was carried. 19 20 COMMUNICATIONS FROM THE MAYOR 21 22 Mayor Frank Waltermann commented on the nice press coverage on the City painting the Main Street 23 railroad bridge. He said he had tried for over a year to work with the railroad and get to paint the bridge and 24 finally the city assumed the responsibility. 25 26 Mayor Waltermann told Council that Mike Allen, Chamber Beautification Committee, indicated they would 27 like to assist our Planning Department with peer pressure for weeds, etc with their members. The Mayor 28 added that government also needs to clean up their own property. 29 30 Councilmember Hankinson thanked Mayor Waltermann for the fast action in getting the new curb at 27th 31 and Reeveston Road and hoped now the street would get paved. 32 33 President Hutton asked about leaf removal and what people are supposed to be doing with leaves. 34 35 Mayor Waltermann said the city will be leasing two new leaf vacs to see how they work. He said leaf 36 removal will be limited to a 45 day period for pick up depending on need and they would have to be bagged 37 before and after the pick up period. 38 39 PRESENTATION OF REMONSTRANCES, PETITIONS AND MEMORIALS 40 41 None were presented. 42 43 REPORTS FROM CITY DEPARTMENTS 44 45 None were presented. 46 47 REPORTS FROM OTHER OFFICES 48 49 None were presented. 50 51 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY 52 53 President Hutton noted that Ms. Hauptstueck was unable to be in attendance, but did provide the Council 54 with a written report. She asked any questions be directed to the Clerk for Board action. 55 56 REPORTS FROM SPECIAL COMMITTEES 57 58 None were presented. 59 60 REPORTS FROM STANDING COMMITTEES 61 62 None were presented. 63 64 65 66 24 Common Council Aug. 19, 1991 Page 2 1 REPORTS FROM SPECIAL COUNCIL COMMITTEES 2 3 Redevelopment Commission 4 5 Councilmember Elstro reported on the TIF meeting held today and asked Mr. Metzger to further explain the 6 procedures. 7 8 Mr. Metzger told Council that the Redevelopment Commission and Redevelopment Authority had taken 9 another step today toward the bonds on the Focus project and that the City has now received the 100,000.00 10 for escrow for the project. 11 12 MISCELLANEOUS BUSINESS 13 14 Council Comments or Complaints 15 16 Councilmember Parker addressed the proposed Housing Code and that he would like Council to be aware 17 he did not feel the ordinance as presented was workable and he would not support it. 18 19 President Hutton asked Councilmember Parker if he offered suggestions on how to make it enforceable and 20 he said he did make comments to make the ordinance more suitable, but did not feel in its present state it 21 would be enforceable. 22 23 Councilmember Elstro agreed with Councilmember Parker and said he has received many calls in opposition 24 to the ordinance. 25 26 Councilmember Elstro also commented on the weeds at the Depot and that they have not yet been cut even 27 though Mr. Foley said he had hired someone to cut them. He also spoke on having to have cars towed away 28 that park in the area and wondered if there could not be some kind of control for parking so the area would 29 be open for vendors. 30 31 Mayor Waltermann said he had spoken with Mr. Foley about getting the weeds cut also. 32 33 Councilmember Morris asked if someone could contact Mr. Springer, Market Master, and ask him to 34 barricade around the portico because the ceramic facade was falling from the roof with the rain. She also 35 noted that one of the windows was accessible. 36 37 RESOLUTIONS 38 39 Councilmember Brookbank moved to suspend the rules and read Resolution No. 15-1991 by title only, 40 seconded by Councilmember Morris and on unanimous voice vote the motion was carried. 41 42 RESOLUTION NO. 15-1991 43 44 The Clerk read by title only Resolution No. 15-1991 - A RESOLUTION OF THE COMMON COUNCIL OF 45 RICHMOND, INDIANA APPROVING THE TRANSFER OF CERTAIN INTERESTS IN REAL ESTATE BY 46 THE CITY OF RICHMOND TO THE RICHMOND REDEVELOPMENT AUTHORITY. 47 48 Mr. Metzger explained this was a step in the bond process and that the Redevelopment Authority retains title 49 to the road and improvements and they issue the bonds and leave it back to the Redevelopment 50 Commission. 51 52 President Hutton asked what would happen if the Focus project does not happen and the City does not get 53 the outlet mall and Mr. Metzger said they would retain bond funds after the sale and if the project does not 54 go,they do not have th build the road. He said there is also other development in the TIF area to back up the 55 bond sale and they could build the road in the future or redeem the bonds. Mr. Metzger said the city was not 56 out any money and the bond proceeds can be invested for the same rate of interest as sold or for a higher 57 rate for the first three years. 58 59 Councilmember Parker said he would like to see the road build on the same schedule as the mall was being 60 built. 61 62 Mr. Metzger said the project has to start by October 10, 1991 and the city could not move any quicker than 63 that on the road construction. 64 65 There being no further questions or comments, Councilmember Brookbank moved for adoption,seconded by 66 Councilmember Morris and on unanimous voice vote the motion was carried. -25 Common Council Minutes Con't Aug. 19, 1991 Page 3 1 ORDINANCES 2 3 ORDINANCES ON FIRST READING 4 5 Councilmember Brookbank moved to suspend the rules and read on first reading by title only Ordinances 6 No.42, 43, 44 and 45-1991, seconded by Councilmember Parker and on unanimous voice vote the motion 7 was carried. 8 9 ORDINANCE NO.42-1991 10 11 The Clerk read on first reading by title only Ordinance No. 42-1991 - AN ORDINANCE AMENDING 12 ORDINANCE NO. 71-1986 AUTHORIZING THE RICHMOND SANITARY BOARD TO ESTABLISH A FEE 13 FOR DISPOSAL OF LIQUID WASTE FROM SEPTIC TANKS AND GREASE TRAPS AND BEING PART OF 14 CHAPTER 53 OF THE RICHMOND CITY CODE. 15 16 The Council requested an explanation and Mr.Jerald Judge, Sanitary District Administrator,told Council that 17 there was an additional 2.00 per hundred gallons in the first two categories under liquid waste and the third 18 category was new because of Hills Pet Products. He said there were no changes in the grease trap 19 charges. 20 21 President Hutton asked how companies would know about the charges without it being advertised for 22 hearing and Mr.Judge said the Sanitary District would notify them. 23 24 Councilmember Lundy asked why it would be advertised after adoption rather than before and Mr. Judge 25 explained the Council was only acting upon a Resolution of the Sanitary Board that had been duly advertised 26 for public hearing. 27 28 Councilmember Elstro moved to suspend the rules and move the ordinance to second reading, seconded by 29 Councilmember Brookbank and on unanimous voice vote the motion was carried. 30 31 The Clerk read the ordinance on second reading. 32 33 President Hutton announced the ordinance was on public hearing. 34 35 There being no additional comments, Councilmember Brookbank moved for engrossment, seconded by 36 Councilmember Parker and on unanimous voice vote the motion was carried. 37 38 Councilmember Brookbank moved to suspend the rules and move Ordinance No. 42-1991 to third and final 39 reading and read by title only, seconded by Councilmember Elstro and on unanimous voice vote the motion 40 was carried. 41 42 The Clerk read Ordinance No.42-1991 on third and final reading by title only. 43 44 Ordinance No.42-1991 was adopted on the following call of the roll: 45 46 Ayes: Elstro, Lundy, Brookbank, Hankinson, Parker, Morris, Paust and Hutton (8) 47 Nays: None 48 Absent: McBride 49 50 ORDINANCE NO.43-1991 51 52 The Clerk read on first reading by title only Ordinance No. 43-1991 - AN ORDINANCE TO TRANSFER 53 WITHIN THE MOTOR VEHICLE HIGHWAY FUND. 54 55 Councilmember Morris moved to suspend the rules and move the ordinance to second reading,seconded by 56 Councilmember Brookbank and on unanimous voice vote the motion was carried. 57 58 The Clerk read the ordinance on second reading. 59 60 President Hutton announced the Ordinance was on public hearing. 61 62 Street Department Manager, William Smith, explained the transfer was to provide funds to leave two new 63 style leaf vacs for the fall leaf pick up. 64 65 There being no additional comments, Councilmember Elstro moved for engrossment, seconded by Councilmember Brookbank and on unanimous voice vote the motion was carried. 26 • Common Council Minutes Cont'd Aug. 19, 1991 Page 4 1 Councilmember Elstro moved to suspend the rules and move Ordinance No. 43-1991 to third and final 2 reading and read by title only, seconded by Councilmember Brookbank and on unanimous voice vote the 3 motion was carried. 4 5 The Clerk read Ordinance No.43-1991 on third and final reading by title only. 6 7 Ordinance No.43-1991 was adopted on the following call of the roll: 8 9 Ayes: Elstro, Lundy, Brookbank, Hankinson, Parker, Morris, Paust and Hutton (8) 10 Nays: None 11 Absent: McBride 12 13 ORDINANCE NO.44-1991 14 15 The Clerk read on first reading by title only Ordinance No. 44-1991 - AN ORDINANCE TO TRANSFER 16 WITHIN THE LOCAL ROAD AND STREET FUND. 17 18 Councilmember Brookbank moved to suspend the rules and move the ordinance to second reading, 19 seconded by Councilmember Hankinson and on unanimous voice vote the motion was carried. 20 21 The Clerk read the ordinance on second reading. 22 23 President Hutton announced the Ordinance was on public hearing. 24 25 Mr. Smith explained the funds were for Phase II of the street paving project. 26 27 Councilmember Parker asked how much of the funds were for materials and Mr. Smith indicated all of them 28 were for materials. 29 30 There being no additional comments, Councilmember Brookbank moved for engrossment, seconded by 31 Councilmember Hankinson and on unanimous voice vote the motion was carried. 32 33 Councilmember Brookbank moved to suspend the rules and move Ordinance No. 44-1991 to third and final 34 reading and read by title only, seconded by Councilmember Hankinson and on unanimous voice vote the 35 motion was carried. 36 37 The Clerk read Ordinance No.44-1991 on third and final reading by title only. 38 39 Ordinance No.44-1991 was adopted on the following call of the roll: 40 41 Ayes: Elstro, Lundy, Brookbank, Hankinson, Parker, Morris, Paust and Hutton (8) 42 Nays: None 43 Absent: McBride 44 45 ORDINANCE NO.45-1991 46 47 The Clerk read on first reading by title only Ordinance No. 45-1991 - AN ORDINANCE AMENDING THE 48 RICHMOND CITY CODE BY ENACTING AN ARTICLE TO BE ENTITLED "AMUSEMENT ARCADES"; 49 PROVIDING A STATEMENT OF PURPOSE; PROVIDING DEFINITIONS; REGULATING THE MANNER OF 50 OPERATION OF"AMUSEMENT ARCADES". 51 52 President Hutton announced the ordinance would be advertised for public hearing on September 3, 1991 53 and if the Council had further questions it would be put in the Committee of the Whole. 54 55 ORDINANCES ON SECOND READING 56 57 ORDINANCE NO.39-1991 58 59 The Clerk read on second reading Ordinance No. 39-1991 - AN ORDINANCE FOR APPROPRIATIONS 60 AND TAX RATES. (1992 BUDGET) 61 62 The Proof of Publication was presented and found to be in order. 63 64 Councilmember Morris moved to accept and file the Proof of Publication, seconded by Councilmember 65 Brookbank and on unanimous voice vote the motion was carried. 2.:'/: Common Council Minutes Cont'd Aug. 19, 1991 Page 5 1 President Hutton announced the Ordinance was on public hearing and would be held for final adoption on 2 September 3, 1991. 3 4 Mayor Frank H. Waltermann spoke in favor of the budget as presented and asked that Council adopt it in its 5 present form. 6 7 Councilmember Brookbank asked if this was the best budget the Mayor had ever presented and Mayor 8 Waltermann commented that the budget was fair and equitable and not as restrictive as the 1991 budget, 9 thereby making it easier for the new administration. He said ample funds had been included for street 10 repairs. 11 12 There being no further comments, Councilmember Hankinson congratulated Mayor Waltermann and so 13 moved for engrossment of the ordinance, seconded by Councilmember Brookbank and on unanimous voice 14 vote the motion was carried. 15 16 Final adoption of Ordinance No.39-1991 will be on September 3, 1991. 17 18 ORDINANCES ON THIRD READING 19 20 None were presented. 21 22 NEW BUSINESS 23 24 Boogie at Municipal Airport 25 26 Mayor Waltermann announced the Annual Boogie at the Airport set for Labor Day Weekend and invited all to 27 participate. 28 29 September Council Meeting 30 31 President Hutton reminded the Council the next regular meeting will be Tuesday, September 3, 1991 due to 32 the Labor Day Holiday. 33 34 ADJOURNMENT 35 36 There being no further business, on a motion duly made, seconded and passed, the meeting was 37 adjourned. 38 39 40 41 42 43 Sarah Hutton, President 44 45 46 • 47 48 ATTEST: 49 Mary Merchanthouse, City Clerk 50 51 52 53 54 55 56 57 58 59 60 61 62 63 64 65 28
