1 The Common Council of the City of Richmond, Indiana met in regular session on July 15, 1991 at the hour
2 of 7:30 P.M. in the Council Chambers in said City. President Hutton presided with the following
3 Councilmembers present: Elstro, Lundy, Brookbank, Hankinson, McBride, Parker, and Paust. Absent:
4 Morris. Representatives of the following media were in attendance: WCTV CABLE 16, WKBV/WFMG,
5 WHON/WQLK and Palladium Item. The following business was had to-wit:

17 Councilmember McBride moved to approve the minutes of the previous meeting as prepared, seconded by
18 Councilmember Hankinson and on unanimous voice vote the motion was carried.

20 COMMUNICATIONS FROM THE MAYOR

22 Mayor Frank Waltermann reported on the 4th of July celebration and parade sponsored by Harry Ray Post
23 65 and the excellence of the events. He also thanked all the City departments involved and added that there
24 was good citizen participation at the events.

40 Ms. Carrie Hauptstueck reported to Council that the building on North 10th Street did have an unsafe order
41 issued and affirmed by the Board of Works. She said the next step was to file action in Court.

43 Ms. Hauptstueck informed Council that Mr. Metzger is working on fees and fee structures for support of
44 animal control and sheltering.

62 Councilmember Elstro asked about the rezoning ordinance that was vetoed by Mayor Waltermann and the
63 veto overturned by Council. He said he had received calls that Planning was stating the the rezoning was
64 not in effect.

66 Mr. Dan Dooley explained that the ordinance in question granted preliminary approval for a Planned Unit
Development and now the Council had to act on an ordinance for final approval for the Planned Unit

1 Development. Mr. Dooley said this is a two step procedure and will be acted on by Plan Commission later
2 this month and then returned to Council for final action.

4 Councilmember Brookbank commented on the new paving on South E Street and how grateful the residents
5 were.

7 Councilmember Parker commented on no sidewalk work starting yet and asked when the City would start
8 repairing sidewalks.
9
10 Mr. William Smith, Street Department Manager, informed Council they had been repairing sidewalks since
11 early spring.

13 Councilmember Parker requested a list of repairs and Mr. Smith said he would furnish that information.

17 Councilmember Brookbank moved to suspend the rules and read Resolution No. 13-1991 by title only,
18 seconded by Councilmember Lundy and on unanimous voice vote the motion was carried.

62 Speaking in favor was Mr. Mark Gasche, Assistant Park Superintendent. Mr. Gasche explained this was a
63 transfer of funds from Personal Services to Capital Equipment for mowing equipment for the non-park
64 mowing. He said they would be able to cover the cost of the labor from the seasonal budget and this will
65 provide the additional equipment.

30 Speaking in favor was Mr. Donald Simkin, 25 North 7th Street, Attorney at Law representing the petitioners
31 Rollie and Peggy North and Hubert and Helen Byrd. Mr. Simkin informed Council that the North's own the
32 house and the Byrd's own the vacant lot at the intersection of North 16th and A Streets and they propose to
33 sell the properties to Rick and Carol Webb for a Prudential Insurance Office. He said the house would be
34 used for office space and the lot for parking and asked the Council to approve the special use zoning for the
35 office and off street parking.

37 Mr. Simkin said they would only be using a portion of the house for the office and would improve the lot
38 complying with all regulations for parking lots.

40 Mr. Rick Webb informed the Council that he was available for questions. He said hie investment would
41 improve the property and it would be very nice looking when he was completed.

43 Mr. Hubert Byrd, 2501 Willow Drive, supported the commercial zoning and commented that he did not
44 understand why this property was residential when it was zoned commercial all around.

46 There being no further discussion, Councilmember Brookbank moved for engrossment, seconded by
47 Councilmember Elstro and on unanimous voice vote the motion was carried.

37 Councilmember Brookbank felt the ordinance was self explanatory, dealing with construction of the central
38 garage.

40 Councilmember Elstro inquired as to when they would be breaking ground on the project and Mayor
41 Waltermann said they currently have people working on the project awaiting the appropriation. He said they
42 also had to get approval from the State on the purchase of the property and had just received that approval.

3 Prior to discussion, Councilmember Brookbank thanked the persons responsible for preparation of the
4 ordinance and for putting it in the format requested by Council making it easily understandable.

6 Mayor Waltermann requested Council to adopt the ordinance as presented.
7
8 Councilmember Brookbank stated that it was wonderful having the Human Services functions broken down
9 for the Councilmembers, but felt it was unfortunate they did not have the information prior. She said the
10 information contained a lot of good material to explain how much work really goes into the jobs providing this
11 service.

13 Human & Environmental Services

15 Councilmember Elstro stated amendments to the ordinance by moving to reduce the Birth to Five Director
16 position by 3,000.00.

18 Councilmember Parker commented that the funds allocated for that position were grant dollars and asked for
19 an explanation of the salary as proposed.

21 Ms. Merchanthouse explained this was not the proposed pay, but rather a maximum amount of dollars as set
22 by the Birth to Five Board of Directors,for this position in 1992.

24 The motion died for lack of a second.

26 Finance Department

28 Councilmember Elstro moved to set the pay for 1992 for the Deputy Controller at 25,171., for the Payroll
29 Manager/Receipt Clerk at 17,673. and the Accounts Payable/Computer Operator at 16,538. Councilmember
30 Brookbank seconded the motion.

32 Councilmember Paust asked for comment from the Department Head.

34 Ms. Sweet explained that she had requested the positions in her office be re-evaluated because of
35 vacancies she was experiencing. She said the reclassifications were the recommendation of the firm doing
36 the personnel evaluations.

38 Councilmember Paust asked specifically about the Deputy and if that persons assumes the Controller's
39 duties in her absence.

41 Ms. Sweet told Council that position was currently not filled and that one of her staff and one temporary
42 person were assisting with that work. She said she had not had time to adequately analyze the needs of the
43 position and also was complying with the directive of the Mayor to not spend excess funds this budget year,
44 due to the budget deficits.

46 Councilmember Paust asked if a qualified applicants could be found at the 25,000.00 rate and Ms. Sweet
47 said she felt it would be hard to find someone qualified for that amount.

49 Councilmember Parker asked about the Computer Programmer ad Ms. Sweet said that position had not
50 been filled in 1991 because she was waiting on the outcome of the GIS program and would like to find
51 someone capable of handling all the City's computer needs.

53 Councilmember Parker asked how these needs were currently being addressed and Ms. Sweet explained
54 through contracted services already budgeted. She tried again to explain to Council the need to not spend
55 dollars approved for expenditure in 1991 due to the budget deficit.

57 Mayor Waltermann told Council that the City has committed to the GIS system and that the County and
58 RP&L are also interested in participating in the GIS. He asked Councilmember Brookbank for an update on
59 the project.

61 Councilmember Brookbank told Council there is a Pilot Program now being operated for the GIS system.

63 Councilmember Parker said he hated to fund a position not being used.

1 Ms. Sweet said if the position is not filled the funds can be transferred to where they are needed.

3 Mayor Waltermann commented that he felt the GIS system would be on line shortly after the first of the year.

5 Councilmember Lundy asked how responsibilities were being met for the unfilled positions and Ms. Sweet
6 said other staff were sharing those responsibilities.

8 Councilmember Lundy asked if that could continue and Ms. Sweet commented that was not fair to the rest of
9 her staff.

11 Councilmember Lundy asked why these positions had not been filled and Mayor Waltermann stated that Ms.
12 Sweet was not filling the positions due to budget restraints and also due to the election this year and not
13 knowing the future of a person holding the position of Deputy Controller she felt it advisable to leave it open.

15 Councilmember Elstro said he felt the city employees should go back to a 40 hour week.
16
17 Councilmember Paust asked that each position be given individual consideration and not lumped together in
18 one motion.
19
20 Councilmember Elstro agreed to that and the motion and second to reduce salaries in the Finance Office
21 were withdrawn.

23 Councilmember Elstro moved to set the salary for the Deputy Controller at 25,171., seconded by
24 Councilmember Brookbank and on the following call of the roll the motion was passed.

37 Councilmember Elstro moved to set the salary for the Accounts Payable/Computer Operator at 16,538.,

40 Planning, Permits and Inspections

42 Councilmember Brookbank moved to set the salary for the Senior Building Inspector at 25,171. The motion
43 was seconded by Councilmember McBride.

45 Mayor Waltermann explained to the Council that this position and the Secretary position should have been
46 paid at this rate in 1991, but due to the lateness of the request he did not allow the inclusion in the 1991
47 salary ordinance. Mayor Waltermann said these positions have now been properly handled and the request
48 for the rate increase handled in a timely fashion and he supports these increase in rates for 1992.

50 Councilmember McBride stated that a developer had called him and complained about the Planning
51 Department being the worse in the area and that he was getting very little cooperation.

53 Mayor Waltermann stated that our Planning Department does have integrity and will not break laws even
54 when they have been asked to do so. Mayor Waltermann added he refuses to have his employees break
55 any laws. -

57 Councilmember Brookbank said she also received a call from a developer regarding the inspectors being
58 uncooperative.

60 Mayor Waltermann said the City must stick to the letter of the law or become liable. He said other
61 communities tend to be very lax and developers must adapt to changes in codes.

63 The motion to reduce the salary of the Senior Building Inspector was passed by unanimous voice vote.

65 Councilmember Elstro moved to set the salary for the Secretary at 16,001.00, seconded by Councilmember
66 Lundy and on unanimous voice vote the motion was carried.

1 Councilmember Elstro asked about temporary salaries and Ms. Sweet explained she put it in this ordinance
2 in total form and it will be shown in the budget ordinance by department.

4 Police Department

6 Councilmember Elstro moved to delete one of the positions of Dispatcher. Councilmember Parker seconded
7 the motion.
8
9 Councilmember Paust asked for comment from Chief Rice prior to vote.
10
11 Chief Rice explained to Council about the need for an additional dispatcher due to vacation times and the
12 need sometime to work a dispatcher twelve hours a day. He said that in the first six months of this year
13 17,471 calls were handled by the dispatchers with 14,347 of those being E911 calls. Chief Rice explained
14 the continuos stress level for a dispatcher and there were times they were not even able to take a lunch or
15 bathroom break. He told Council it was important for their well being to have another dispatcher.

17 Councilmember Paust asked about the cooperation between the City and the County and Chief Rice
18 explained that he had spoken with Sheriff Andrews about his people being certified for the IDACs system
19 since the Richmond Dispatchers are now the only ones certified to make the computer entries. He did state
20 that the Council dispatchers are very good with the City dispatchers.

22 Councilmember Elstro said he would be comfortable allowing either the dispatcher or animal control officer
23 as a new position,but not both.

25 Chief Rice informed Council that the Police could continue to do animal control at a cost of 27,000.00
26 annually in salaries or pay a civilian 17,000.00 annually in salaries.

28 Councilmember Elstro commented that the City went to 911 to save time and people and Chief Rice
29 suggested the criminals be told they were not allowed to commit crimes this year since there was no money.

31 Councilmember Paust stated that since we do pay 60% of the county taxes we should ask the County to
32 provide an additional person from the County.

34 Chief Rice said he was not certain the Sheriff would pay for a city employee.

36 Councilmember Paust suggested our time on the IDACs system for the County be reimbursed.

38 The motion to delete one dispatcher position was defeated on the following call of the roll:

46 Councilmember Elstro moved to delete the position of Special Events Coordinator, seconded by
47 Councilmember McBride and on unanimous voice vote the motion was carried.

49 The position of Bookkeeper was questioned and Ms. Sweet explained that has been a full time position and
50 the ordinance is reflecting it correctly as full time.

52 Department of Transportation

54 Councilmember Elstro moved to delete the position of Director of Department of Transportation, seconded
55 by Councilmember McBride and on unanimous voice vote the motion was carried.

57 Airport

59 Councilmember Elstro moved to set the salary for the Administrative Manager at 19,017. Councilmember
60 Brookbank seconded the motion.

62 Prior to vote, Councilmember Parker explained that the Manager's position had been split into positions who
63 handle the duties with total dollars allocated for pay being less. -

1 Councilmember Lundy asked for further explanation and Mayor Waltermann told Council the Airport Board
2 had made the decisions on staffing requirements and eliminated the positions of manager and secretary and
3 created the two new positions at a cost of 33,778.00 verses 50,667.00. He said there will be a 20,000.00
4 savings and still be manned with four persons.
5
6 Councilmembers Elstro and Brookbank withdrew their motion and second to reduce the pay of the
7 Administrative Manager.
8
• 9 Councilmember McBride moved to set the salaries of the Administrative Manager and the Operations
10 Manager at 19,017 for both positions. The motion was seconded by Councilmember Brookbank and was
11 defeated on the following call of the roll:

17 Temporary Help

19 Councilmember Elstro moved to set the total rate for Temporary Help at the 1991 rate. The motion died for
20 lack of a second.

22 Economic Development

24 Councilmember Brookbank moved to delete the position of Secretary. The motion was seconded by
25 Councilmember McBride.

27 Councilmember Brookbank pointed out that the position was not currently filled.

29 Councilmember Hankinson stated that the position had not been filled for the past three weeks and was still
30 not filled. He said it has only been filled for a very short time and the employee holding the position had
31 recently taken another job after discussion of her work performance.

33 Mr. Metzger clarified that the current secretary left that position because she accepted the position as
34 Manager of the Credit Union and there had been a persons prior that left the position because her husband

40 Councilmember Hankinson commented that the Board had not discussed the elimination of the job, and had
41 not made up their minds if the position should be filled or not.

43 Mr. Metzger told Council that the Department is now using temporary help since no one is currently in the
44 position and they are planning to fill the position prior to the end of the year.

46 Councilmember Hankinson said he believed the temporary help had been hired for a special project.

48 Being no further discussion,the motion to delete the Secretary position carried with Councilmember McBride
49 voting no.

51 Councilmember Brookbank moved for engrossment of Amended Ordinance No. 36-1991, seconded by
52 Councilmember Hankinson and on unanimous voice vote the motion was carried.

54 Councilmember Brookbank moved to suspend the rules and move Amended Ordinance No. 36-1991 to third
55 and final reading and read by title only,seconded by Councilmember Elstro and on unanimous voice vote the
56 motion was carried.
