PROCEEDINGS OF THE COMMON COUNCIL OF THE
CITY OF RICHMOND. INDIANA. APRIL 1. 1991
1 The Common Council of the City of Richmond, Indiana met in regular session on April 1, 1991 at the hour of
2 7:30 P.M. in the Council Chambers in said City. President Hutton presided with the following
3 Councilmembers present: Elstro, Lundy, Brookbank, Hankinson, McBride, Parker, Morris and Paust.
4 Absent: None. Representatives of the following media were in attendance: WKBV/WFMG, WHON/WQLK
5 and Palladium Item. The following business was had to-wit:

11 APPROVAL OF MINUTES OF MARCH 18 AND MARCH 25. 1991

13 Councilmember McBride moved to approve the minutes of the previous meeting as prepared, seconded by
14 Councilmember Hankinson and on unanimous voice vote the motion was carried.

16 COMMUNICATIONS FROM THE MAYOR

18 Mayor Frank Waltermann announced the hiring of a new Park Superintendent to start her position with the
19 City on April 22, 1991.

21 Mayor Waltermann informed the Council that the Redevelopment Commission and the Redevelopment
22 Authority had met and are moving forward on financing for the FOCUS Project. He said a public hearing is
23 scheduled for April 15, 1991 for that bond issue and there are questions regarding the inclusion of the
24 200,000.00 for the acquisition and demolition of the property at 11-13-15 North 10th Street. Mayor
25 Waltermann asked that Councilmembers be present at the hearing to support the issue.

27 Mayor Waltermann also told Council proceedings for the Central Garage are moving forward.

29 Councilmember Elstro commented that he would like to see the public hearing of the Redevelopment
30 Commission start at 3:30 rather than 4:30 since he felt it would be a long meeting.

32 Mayor Waltermann said this is a regular published meeting,but he could check with other members.

34 Councilmember Elstro agreed with Mayor Waltermann to the need of Councilmembers to be in attendance
35 because of questions of the Redevelopment Commission regarding the 200,000.00 for the acquisition of this
36 property.

38 Councilmember Parker asked about East Main construction and the congestion with no left turn signals
39 operational.

41 Mayor Waltermann said that Chief Rice has looked at the situation and feels there is room for left turn lanes
42 to help and he will be speaking with the State. He said he also suggested Chief Rice make the merchants
43 aware that there could be the possibility of off duty officers for hire to assist in this situation. Mayor
44 Waltermann said the City was very aware of the congestion and was working on it.

46 Councilmember Parker commented on calls he is receiving about not picking up grass clippings and ask
47 Mayor Waltermann to speak with the Sanitary District to provide a means of getting rid of grass clippings.

57 President Hutton announced this item would be held until the meeting of April 15, 1991 since the quarter just
58 ended and the Controller needs time to prepare the report.

66 Councilmember Brookbank reported that she had received a letter regarding accidents at the intersection of

1 16th and South E the past week-end.

3 Ms. Hauptstueck stated there was an accident on Saturday and she feels the warning groves might be a
4 good idea to improve the intersection and help prevent driver error.

6 Councilmember Hankinson said all the members of Council had received the letter. He said he drives the
7 street daily and as of yet not even had a close call.
8
9 Ms. Hauptstueck reported on the requests from the North 16th Street Merchants and that their request for
10 signage must go the State for approval and Mr.Wiwi will be working with them on the request.

12 Councilmember Elstro asked about the South L Street railroad and Mr. Metzger said he had not heard
•13 anything from the railroad.

15 Councilmember Parker asked if the City had received any final work on the National Road West and
16 Toschlog Road intersection and Ms. Hauptstueck said they had not received anything in writing and Mr. Wiwi
17 is keeping in touch with the State.

19 Councilmember Paust asked that the stop sign at North 16th and A Streets be looked at because he felt it
20 was too high and needed to be lowered.

22 Councilmember Elstro asked about paving the alley north of 16th Street and Councilmember Paust said that
23 was also in the request for the signage and Mr.Wiwi is handling the request.

33 Councilmember Brookbank reported Reid Hospital had a positive cash balance and had hired a new
34 ophthalmoligist. She also commented on the new article on the gall bladder surgery being well done.

42 Council Comments or Complaints

44 Councilmember Lundy asked about a call she received with regard to someone removing an old hitch for
45 horses that was located in a City easement on North 22nd Street and if that could be done.

47 Mr. Metzger said the question was who placed the hitch there originally,the City or a private individual.

49 Councilmember Brookbank reported on a sludge conference she attended in Carmel, Indiana and also an
50 economic seminal by Ashton Veramally.

35 Ms. Marge Sweet explained to the Council that the transfer from the the Mayor's Capital Equipment Account
36 to Board of Works for street lights to cover the deficit in the 1991 budget. She said they would still be
37 80,000.00 short and would need those additional dollars by September.

39 There being no further comments, Councilmember Brookbank moved for engrossment, seconded by
40 Councilmember Hankinson and on unanimous voice vote the motion was carried.

43 reading and read by title only, seconded by Councilmember Hankinson and on unanimous voice vote the

34 APPROVAL TO A COMMERCIAL DEVELOPMENT UNIT PROJECT IN AN R-2 SINGLE FAMILY
35 RESIDENCE DISTRICT AND A C-2 COMMERCIAL DISTRICT ON PROPERTY LOCATED IN THE 3400
36 AND 3600 BLOCKS OF EAST MAIN STREET ON THE SOUTH SIDE, PURSUANT TO ARTICLES 45 AND
37 48 OF CHAPTER 154 OF THE CODE OF ORDINANCES, COMMONLY KNOWN AS THE ZONING
38 ORDINANCE OF THE CITY OF RICHMOND, INDIANA.

40 President Hutton announced the ordinance was on public hearing.

42 Speaking in favor of the ordinance was Mr. Robert Burton,Attorney at Law, 25 North 7th Street, representing
43 the petitioners Charles Lanier, Richmond D&K Company, Inc., and Dorothy Thorman, owners of the
44 property. Mr. Burton explained to the Council this property adjoined the Wal-Mart project to the west. Mr.
45 Burton shared the site plans with Council.

47 Mr. Burton explained that the front portion of the property is zoned commercial and the Z-Bart property is all
,48 zoned commercial with the rest being residential. Mr. Burton said this is being presented as a Planned Unit
49 Development and with the Council's approval final approval would be requested of Council for the specific
50 development. Mr. Burton stated that a Planned Unit Development required a minimum of 10 acres and even
'51 this is only 8.9 acres it is close to that requirement and if considered an integral part of the Wal-Mart project it
52 would exceed the 10 acres. Mr. Burton said they also are asking for a 20 ft. setback rather that the 50 ft.
53 setback,but added this would be buffered and fenced.

55 Mr. Burton reported that the utilities are acceptable and there would be no greater run off from the property
56 than there now is.

58 Mr. Burton told Council if the preliminary is approved the final plan would be more specific with all conditions
59 deemed necessary.

61 President Hutton asked about residents being affected and Mr. Burton said the calls received by Planning
62 were from property owners adjoining First Federal on 34th Street and the area to their properties is already
63 zoned commercial.

65 Councilmember Paust said he was in favor of the project, but had the same questions he had with the Wal-

1 Mart project and that was traffic. He said the City has the responsibility to solve the traffic issue before the
2 problems start. He said there will be a large number of cars and greater traffic and now is the time to plan
3 I for traffic control.

5 Councilmember Hankinson agreed with Councilmember Paust on the traffic problem.

7 Mr. Burton said they envision their entrance between the Z-Bart and gas station and have held discussions
8 with the state regarding signals, but he hoped this would not hold up the project when it was the state that
9 was responsible for signalization.

11 Councilmember Paust said he wanted to see the solutions to the traffic problems with the final plans for the
12 development including the Wal-Mart project. He said developers are creating traffic and they expect the City
13 to resolve the traffic problems.

15 Mr. Burton asked if Mr. Paust was expecting the answers with the final application and Councilmember
16 Paust said he hoped the developers of this project, the Wal-Mart project and the City would have plans to
17 handle the traffic at that time.

19 Councilmember McBride said that the Plan Commission did discuss the traffic issue, but are unaware how to
20 determine how the final flow will be when the five lanes are completed on East Main. He said they approved
21 on the theory that the East Main improvements will help with the traffic situation and the City is at the mercy
22 of the State regardless.

24 Councilmember Paust commented he did not want to depend on the State.

26 Councilmember Morris commented on the importance of the Planned Unit Development. She said she felt
27 the modifications requested were very reasonable and that with preliminary approval, Council approves in
28 concept with details being address in the final application.

30 Mr.Jay Stein, Sandar Development, told Council that Wal-Mart was no longer interested in pursuing a light
31 at the Wendy's area because they have been informed it is too close to the Elks Road light. He said they will
32 be closing off more curb cuts than they will open and will assist with funds for road improvements if the City
33 can proceed with the extension of Elks Road. Mr.Stein added they also have an access to get to the Kroger
34 property and that light.

36 Mr. Stein said current plans were not to try to get another signal, but to keep access to a few larger ones and
37 get as much traffic as possible to the lights as they exist. He told Council that Wal-Mart makes certain that
38 traffic works right to service their customers.

40 Councilmember Paust commended the idea of closing the little curb cuts and ask if they will retain the cut at
41 Wendy's.

43 Mr. Stein said there were plans to have entrances at Elks Road, Wendy's and Z-Bart into the shopping
44 complex area.

46 Councilmember Paust asked how much traffic would be generated and Mr. Stein said he would provide
47 those figures.

49 There being no further comments, Councilmember Morris moved for engrossment, seconded by
50 Councilmember Parker and on unanimous voice vote the motion was carried.
