PROCEEDINGS OF THE SPECIAL MEETING
OF COMMON COUNCIL OF THE
CITY OF RICHMOND, INDIANA, MARCH 251991
1 The Common Council of the City of Richmond, Indiana met in special session March 25, 1991 at the hour of
2 7:00 P.M. in the Council Chambers in said City. President Hutton presided with the following
3 Councilmembers present: Elstro, Lundy, Brookbank, Hankinson, Parker, Morris and Paust. Absent:
4 McBride. Representatives of the following media were in attendance: WKBV/WFMG, WHON/WQLK and
5 Palladium Item. The following business was had to-wit:

11 Councilmember Morris moved to suspend the rules and read Resolution No. 5-1991 by title only, seconded
12 by Councilmember Hankinson and on unanimous voice vote the motion was carried.

14 The Clerk read by title only Resolution No. 5-1991-A RESOLUTION REGARDING THE CONSTRUCTION
15 AND IMPROVEMENT OF INDUSTRIES ROAD/DANA PARKWAY AND THE FINANCING OF SUCH
16 CONSTRUCTION AND IMPROVEMENTS.

18 City Attorney, Bruce Metzger explained this Resolution has come about with regard to the Factory Outlet
19 Mall (FOCUS) Development and the extension of Industries Rd./Dana Parkway for access to the site.This is
20 an initial step to construct that road using Tax Increment Funds through the Redevelopment Commission.

22 This is not a commitment by the City, only a concept. The City and FOCUS will enter into an agreement
23 relating to their intent concerning the development. This Resolution is not a necessary step in the process
24 but rather a comfort for the Developer and the banker.

26 Mr. Metzger stated that the Redevelopment Commission will take ownership of the road and lease it to the
27 City. There is a June 15, 1991 timetable for the Developer to begin construction or the City is free to drop
28 the project and collect$50,000 in an escrow account from FOCUS.

30 Councilmember Parker questioned whether the agreement would be approved by Council. Mr. Metzger
31 stated that the Council will not see the agreement but will approve the lease at its April 15, 1991 meeting.
32 The Mayor, City Attorney, Bond Council, Engineering, Planning will approve the agreement. Mr. Metzger
33 stated the City cannot enter into a binding agreement.

35 Councilmember Paust questioned if a traffic light at Dana Parkway and Williamsburg Pike would be the
36 Citys jurisdiction or the State also a deceleration lane. Mr. Metzger stated the State has waived jurisdiction
37 to the City for a traffic signal.

39 Councilmember Morris questioned if traffic signal cost was included in the financing plan. Mr. Metzger
40 stated it is.

42 There being no further comment, Councilmember Morris moved to adopt Resolution No. 5-1991, seconded
43 by Councilmember Hankinson and on unanimous voice vote the motion was carried.

48 There being no further business, on a motion duly made, seconded and passed, the meeting was
49 adjourned.
