MARCH 4 , 1991 1 The Common Council of the City of Richmond, Indiana met in regular session on March 4, 1991 at the hour 2 of 7:30 P.M. in the Council Chambers in said City. President Hutton presided with the following 3 Councilmembers present: Elstro, Lundy, Brookbank, McBride, Parker, Morris and Paust. Absent: 4 Hankinson. Representatives of the following media were in attendance: WKBV/WFMG, WHON/WQLK and 5 Palladium Item. The following business was had to-wit: 6 7 PLEDGE OF ALLEGIANCE 8 9 SILENT DEVOTIONS 10 11 APPROVAL OF MINUTES OF FEBRUARY/ v 1991 12 13 Councilmember Brookbank moved to approve the minutes of the previous meeting as prepared, seconded 14 by Councilmember McBride and on unanimous voice vote the motion was carried. 15 16 COMMUNICATIONS FROM THE MAYOR 17 18 None were presented due to the absence of Mayor Waltermann. 19 20 PRESENTATION OF REMONSTRANCES. PETITIONS AND MEMORIALS 21 22 None were presented. 23 24 REPORTS FROM CITY DEPARTMENTS 25 26 Councilmember Brookbank requested a report be given at the next Council meeting by the Human Services 27 Coordinator on the functions and finances of the office. 28 29 President Hutton requested this report be held until the first meeting in April and be included with a quarterly 30 report from all offices and departments specifically financial. 31 32 REPORTS FROM OTHER OFFICES 33 34 None were presented. 35 36 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY 37 38 It was reported the City had been notified the report on National Road West and Toschlog was completed by 39 the State and would be forwarded to the City in writing in the near future. 40 41 Councilmember Elstro asked about the South L Street railroad and Mr. Metzger said the deadline for 42 response from the railroad was March 15, 1991 and he has heard nothing to date. 43 44 Councilmember Paust said he had received a petition from the Merchants in the 16th and East Main area to 45 look at resurfacing the alley and also for permission to place a sign in the right of way next to the Can Do 46 Shop with the names of the Merchants to notify people what businesses are located in that area. 47 48 REPORTS FROM SPECIAL COMMITTEES 49 50 None were presented. 51 52 REPORTS FROM STANDING COMMITTEES 53 54 Reid Hospital 55 56 Councilmember Brookbank reported that the Reid Hospital Board will hold a retreat on April 16 and 17, 57 1991. She said they show a positive balance and approved the purchase of blood analysis equipment. 58 59 Urban Enterprise Association 60 61 President Hutton reported that the Urban Enterprise Association appreciated the opportunity to meet with 62 Council. 63 64 REPORTS FROM SPECIAL COUNCIL COMMITTEES 65 66 None were presented. Common Council March 4, 1991 Page 2 1 MISCELLANEOUS BUSINESS 2 3 COMPASS-United Way 4 5 Councilmember Brookbank reminded the Council that they were a partner in the COMPASS project and that 6 the first meeting with preliminary information would be on March 7, 1991 at 7 PM in the Board of Works 7 Room. 8 9 Seminar Attendance 10 11 Councilmember Brookbank announced a seminar to be presented by Ashton Veramallay on March 26, 1991 12 from 12 noon to 5 PM and moved that the fees for any member of Council wishing to attend be approved for 13 expenditure from the Council budget, seconded by Councilmember Paust and on unanimous voice vote the 14 motion was carried. 15 16 GIS Update 17 18 Councilmember Brookbank reported that the GIS committee had met last Friday and requested Mr. Wiwi to 19 update the Council. 20 21 Mr. Robert Wiwi informed the Council they would be looking at a pilot area and the cost to arrive at any 22 decision on the the project. He said the pilot area would be one square mile and in an area that would 23 include both urban and rural. 24 25 Council Comments or Complaints 26 27 Abandoned Vehicles 28 29 Councilmember McBride asked about abandoned vehicles and who follows up those complaints. 30 31 Mr. Dooley explained that the Police Department has three officers involved. He said the inspectors in 32 Planning report the complaints to the Traffic Division for citation and towing. Mr. Dooley said the Police have 33 the authority to tow after thirty days from the citation. 34 35 Councilmember Elstro asked if this procedure was for both private and public properties and Mr. Dooley said 36 it was and abandoned vehicles can be reported to Planning or the Police Department. 37 38 Gym Floor at Senior Center 39 40 Councilmember Paust commented on the condition of the gym floor at the Senior Center and that he would 41 like to see a report on the floor and a cost estimate to refinish or replace. He said the condition of the floor 42 could be unsafe for the Senior Center for recreation purposes and the liability might be more expensive than 43 the replacement of the floor. 44 45 Leaf Pick-up Hearing 46 47 President Hutton reminded Council they would have a hearing for public input on the proposed leaf pick-up 48 program at the meeting of March 18, 1991 and at that time she would only like comments on the proposed 49 program. 50 51 RESOLUTIONS 52 53 None were presented for action. 54 55 ORDINANCES 56 57 ORDINANCES ON FIRST READING 58 59 None were presented. 60 61 ORDINANCES ON SECOND READING 62 63 Councilmember Parker moved to suspend the rules and bring Ordinance No. 98-1990 and Ordinances No. 64 4, 6, 7, 8 and 9-1991 from Plan Commission and place on second reading, seconded by Councilmember 65 Morris and on unanimous voice vote the motion was carried. 66 549 Common Council Minutes Cont'd March 4, 1991 Page 3 1 ORDINANCE NO.98-1990 2 3 The Clerk read on second reading Ordinance No. 98-1990 - AN ORDINANCE AMENDING CHAPTER 154 4 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE 5 ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA PROVIDING FOR THE REZONING OF 6 PROPERTY LOCATED IN THE 1800 BLOCK OF CHESTER BOULEVARD, ON THE WEST SIDE, FROM 7 R-2 SINGLE FAMILY RESIDENCE DISTRICT AND R-3 ONE TO EIGHT FAMILY RESIDENCE DISTRICT 8 TO R-3 SU ONE TO EIGHT FAMILY RESIDENCE SPECIAL USE DISTRICT AND AUTHORIZING THE 9 SPECIAL USE OF SAID PROPERTY AS A MEDICAL OFFICE. 10 11 Upon request of the petitioner, Councilmember Morris moved the item be stricken from the agenda, 12 seconded by Councilmember Paust and on unanimous voice vote the motion was carried. 13 14 ORDINANCE NO.4-1991 15 16 The Clerk read on second reading Ordinance No. 4-1991 - AN ORDINANCE AMENDING CHAPTER 154 17 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE 18 ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA PROVIDING FOR THE REZONING OF 19 PROPERTY LOCATED AT 910, 912, AND 914 MENDLESON DRIVE FROM R-2 SINGLE FAMILY 20 • RESIDENCE DISTRICT TO C-2 COMMERCIAL DISTRICT. 21 22 Councilmember McBride requested the Ordinance be held on second reading to allow time for all to 23 investigate the request. 24 25 President Hutton granted the request to hold the ordinance on second reading, but announced a public 26 hearing would be held this evening. 27 28 Speaking in favor of the ordinance was Mr. Larry Matson representing the developer Thorson. Mr. Matson 29 30 told Council they would like to put a motel on the property and shared brochures with Council regarding their motels. Mr. Matson told Council this motel would be a Fairfield Inn with 63 rooms and be a 1,500,000.00 31 investment. He said they would hire local contractors and would have ten employee with five being full time. 32 33 Mr. Matson gave Council information on other motels they had developed and operate and in particular one 34 in Fairfax, Illinois built in a similar situation bordering a residential neighborhood and that their relationship 35 was very good. 36 37 Mr. Matson told Council that if any street improvements were necessitated by the construction of the motel, 38 they would pay their share of any improvements. 39 40 Mr. Matson stated that the structure would be three story frame similar to a residential structure and if the 41 area would be rezoned there would be room for another motet or project to be added in the future as they 42 have done in other situations. 43 44 Mr. Matson said the project would be an improvement to the neighborhood, add jobs and taxes for the 45 community. He concluded his remarks by telling the Council that if they were unable to obtain the rezoning 46 they would not build in Richmond. 47 48 Councilmember Paust asked if this would be a standard Fairfield Inn and Mr. Matson said it would be. 49 50 Councilmember Paust asked if there would be central air and Mr. Matson said it would be separate units, but 51 they would blend in with the structure. 52 53 Councilmember Paust asked if they were denied the rezoning, would they be interested in submitting the 54 project as a Planned Unit Development and Mr. Matson they they would if they would qualify as a Planned 55 Unit Development. 56 57 Councilmember Morris asked how the decision was made to request rezoning rather that as a Planned Unit 58 Development and Mr. Robert Burton, Attorney at Law, 25 North 7th Street, informed Council that they had 59 considered a Planned Unit Development, but did not file for that because they were told they would not 60 qualify because there is a five acre minimum land requirement and they do not have that much property 61 involved. Mr. Burton said it would have taken a gross modification of the Planned Unit Development 62 standards for them to be able to apply and other modifications would also have to be done. Mr. Burton 63 added that the Plan staff felt this project would not qualify as a Planned Unit Development. 64 65 550 Common Council Minutes Cont'd March 4, 1991 Page 4 1 Councilmember Morris told Mr. Burton she was aware of his familiarity with the desire for US 27 North being 2 developed as Planned Unit Developments and also as a Planned Unit Development their could be 3 restrictions on parking and screening. 4 5 Mr. Burton agreed that the Planned Unit Development gives greater flexibility and conditions can be 6 attached, but if the current Zoning Ordinance is used as is and we are realistic, the project does not fit in the 7 Planned Unit Development category. 8 9 Councilmember Paust expressed his concerns that without planned development, we end up with a 10 hodgepodge and the Council should make certain this did not happen. He said they need to determine how 11 to develop this area in order to prevent another area like East Main Street. 12 13 Mr. Burton agreed that a new zoning ordinance was needed, but asked if this was a reason to stop this 14 project if they had a reasonable request. Mr. Burton said this was a cart and horse issue and if the use fits in 15 with what the Plan calls for that can be done in two acres, the request is reasonable and they should not 16 have to buy the whole street for their project. Mr. Burton quoted to the Council from a favorable editorial in 17 the Palladium Item regarding the rezoning request. 18 19 Councilmember Paust said he agreed with the project, but questioned how the Council would make sure that 20 US 27 be developed correctly. He aid US 27 was a fine corridor to the City and they need to look at it now in 21 conjunction with the state to control it. 22 23 Mr. Burton addressed traffic and access and reminded Council there would be no new curb cuts onto 27, but 24 they would use Mendleson Drive for access. He said that the Traffic Division determined this would not 25 create additional traffic and the developer would pay for street improvements if this were a problem. 26 27 Mr. Burton challenged the Council to deal with the zoning ordinance as it is now and felt that the developer 28 could deal with conditions placed by Council. Mr. Burton said the developer wanted to put in a sidewalk to 29 connect with Richard's Restaurant and use Green Acres as a source of employees. He said the location was 30 ideal from Interstate 70 and is consistent with long range planning for the City. He said the project should 31 not be put into limbo if we fit in with your version of what fits at this location. 32 33 Mr. Burton told Council the original petition was delayed one month for a sewer situation and other utility 34 problems and these concerns have been satisfied. He said the Council needs to consider the highest and 35 best use of the property and he suggested this was. Mr. Burton assured the Council that they could satisfy 36 their concerns and this is a very desirable use for the progress of the City. Mr. Burton also reminded the 37 Council that situations are already in existence in the City where motels join with residential areas. Mr. 38 Burton concluded with another quotation from the editorial in the Palladium Item regarding the highest and 39 best use of the property being commercial. 40 41 Councilmember Morris commented on the once proposed Super 8 project on 27 being done as a Planned 42 Unit Development and that Planned Unit Development does allow control of the property to prevent it being 43 used just anyway. 44 45 Mr. Burton agreed that a rezone to C-2 would be a minimal risk since it is not likely the developer would 46 resell the property. Mr. Burton said he did not feel the Council could say the project was not appropriate 47 even if it fits, because it was not a Planned Unit Development. He said there was not enough land in this 48 area for Planned Unit Developments and if the Council agrees the best use of the land is commercial, he did 49 not feel enough land was there for all projects to be Planned Unit Developments. 50 51 Councilmember Morris said the Master Plan land use reiterates the Planned Use Development philosophy 52 and US 27 is a commercial corridor of the City of Richmond and if we do it right we can get quality 53 development. 54 55 Mr. Burton reminded Council this project already has central access. 56 57 Councilmember Paust stated that he felt the developers willingness to share in the cost of street 58 improvements was commendable. He said he felt all developers should do that. 59 60 Mr. Charles Focht, one of the three residents petitioning for the rezoning, named all of the commercial 61 development already in that area. He also said their back yards abut I R 70 and it is already a noisy area. 62 Mr. Focht said the area all around was already commercial and he did not know why when a good project 63 was presented it would be turned down. 64 65 Mr.Allen Kennedy, District Manager of Richards Restaurant,told Council they looked forward to this 551 Common Council Minutes Cont'd March 4, 1991 Page 5 1 development since it would give them and others in the area additional employment and they encouraged 2 this type of development. Mr. Kennedy said the area will develop commercially and this is a good project. 3 4 Speaking in opposition was Mr. Ben Kovach, 900 Mendleson Drive, represented the residents of the area. 5 Mr. Kovach told Council that Mendleson Drive has only one entrance and exit onto US 27 and the area is 6 very dangerous. He said we who travel this area know know what a problem it is getting out of Mendleson. 7 Mr. Kovach told Council that this hazard needs to be looked at along with the cost to eliminate the hazard. 8 9 Mr. Kovach stated that the people using this street need to be given prime consideration and added that 10 there are no sidewalks. 11 12 Mr. Kovach also addressed storm water run off and that there is currently only one line handling this. Mr. 13 Kovach asked Council to consider all of this and also that Mendleson was not built to handle traffic. 14 15 Mr. Kovach stated that one half of the people living there are retired and their homes were an investment. 16 He said many of these homes were built before I R 70 and Green Acres and he would not like to see this 17 area grow by spot rezoning. 18 19 Mr. Kovach invited the people attending in opposition to stand and that this included nine homes and one 20 church. 21 22 Councilmember Morris asked if Green Acres opposed the development and Mr. Kovach stated they did. 23 24 Councilmember McBride said he was in the area today and that Green Acres is a manufacturing area and 25 there are semi-trucks up and down the street already. He said he felt it needed to be delayed for more input. 26 27 There being no further discussion offered, President Hutton announced the Ordinance would be held on 28 public hearing for the Council meeting of March 18, 1991. 29 30 ORDINANCE NO.6-1991 31 32 The Clerk read on second reading Ordinance No. 6-1991 - AN ORDINANCE AMENDING CHAPTER 154 33 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE 34 ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA PROVIDING FOR THE REZONING OF 35 PROPERTY LOCATED AT 906 NORTH I STREET FROM R-3 ONE TO EIGHT FAMILY RESIDENCE 36 DISTRICT TO C-1 LIMITED COMMERCIAL DISTRICT. 37 38 President Hutton announced the ordinance was on public hearing. 39 40 Councilmember McBride, Plan Commission representative,told Council he went to look at the area and felt it 41 would be an improvement. He said there were no current plans to build, but wanted the rezoning in case of 42 future need. 43 44 Mr. Dan Dooley told Council that the petitioner had the opportunity to add on where they were presently 45 located and are not certain of the future use of this property. He said that a C-1 use is appropriate for this 46 area and no one indicated any opposition. 47 48 Councilmember Lundy said there was no opposition because they felt what was proposed to be built was 49 appropriate. She said the residents may feel differently now and she did not like the idea of rezoning if they 50 do not know what will be built on the site. She suggested it be held for definite plans. 51 52 President Hutton announced she would hold the ordinance on public hearing for further input. 53 54 ORDINANCE NO.7-1991 55 56 The Clerk read on second reading Ordinance No. 7-1991 - AN ORDINANCE REPEALING ORDINANCE 57 NO. 42-1989 AND AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 58 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, 59 INDIANA PROVIDING FOR THE REZONING OF PROPERTY LOCATED ON THE NORTH SIDE OF DANA 60 PARKWAY, IN THE 2000 BLOCK, FROM M-2 GENERAL INDUSTRIAL DISTRICT TO M-2 GENERAL 61 INDUSTRIAL SPECIAL USE DISTRICT; AND ALSO AUTHORIZING THE SPECIAL USE OF SAID 62 PROPERTY AS A MANUFACTURER'S RETAIL OUTLET MALL DEVELOPMENT UNIT PROJECT. 63 64 It was noted the ordinance needed to be amended and Mr. Dooley explained the amendment changes the 65 site plan, reduces the acreage to 36 acres and allows one lot for future commercial development. 66 67 68 69 552 Common Council Minutes Canted March 4, 1991 Page6 1 Councilmember Brookbank moved to amend Ordinance No. 7-1991 per recommendation of the Plan 2 Commission, seconded by Councilmember Elstro and on unanimous voice vote the motion was carried. 3 4 President Hutton announced the ordinance was on public hearing. 5 6 There being no discussion.on the Ordinance, Councilmember Elstro moved for engrossment, seconded by 7 Councilmember Brookbank and on unanimous voice vote the motion was carried. 8 9 Councilmember Elstro moved to suspend the rules and move Amended Ordinance No. 7-1991 to third and 10 final reading and read by title only, seconded by Councilmember McBride and on unanimous voice vote the 11 motion was carried. 12 13 The Clerk read Amended Ordinance No.7-1991 on third and final reading by title only. 14 15 Amended Ordinance No.was adopted on the following call of the roll: 16 17 Ayes: Elstro, Lundy, Brookbank, McBride, Parker, Morris, Paust and Hutton (8) 18 Nays: None 19 Absent: Hankinson 20 21 ORDINANCE NO,8-1991 22 23 The Clerk read on second reading Ordinance No. 8-1991 -AN ORDINANCE AMENDING CHAPTER 154 OF 24 THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE ZONING 25 ORDINANCE OF THE CITY OF RICHMOND, INDIANA PROVIDING FOR THE REZONING OF PROPERTY 26 LOCATED AT 401 SOUTH Q STREET FROM R-3 ONE TO EIGHT FAMILY RESIDENCE DISTRICT TO 27 M-1 LIGHT INDUSTRIAL DISTRICT. 28 29 President Hutton announced the Ordinance was on public hearing. 30 31 Speaking in favor was Mr. Robert Wiwi, City Public Works Director. Mr. Wiwi presented the site plans to the 32 Council for a central garage complex for the City. He explained the present Police Garage and City Garage 33 are old and inefficient in operation. He said the present facilities are not adequate for all the needs and the 34 proposed location will provide 5.76 acres for a central complex that will allow the garages to be combined 35 along with Rose View Transit. 36 37 Mr. Wiwi told Council only the front portion of the proposed site needs to be rezoned with the balance of the 38 property being zoned M-1. Mr. Wiwi said a retention area for any run off will be included in the site and they 39 will meet all set back requirements and include screening. He added there would be adequate parking 40 spaces on the lot. 41 42 Councilmember Morris asked if there was just one occupied house in the area and Mr. Wiwi said that was 43 correct. 44 45 Councilmember Elstro asked about the retention area and Mr. Wiwi said that would go to the west to an 46 existing drainage ditch to carry the run off. He said all salt would be stored in a covered area and just normal 47 pollution would be allowed to leave the area. 48 49 Councilmember McBride stated that when presented to the Plan Commission there was nothing to indicate 50 the number of buses,trucks that would be in the area and there was an objection by the residents of the area 51 regarding increased traffic. 52 • 53 Mr. Wiwi said the peak flow of traffic would be at 7AM when employees were reporting for work and in the 54 evening after work. He said the additional parking spaces are for employees cars. 55 56 Mr. Wiwi informed Council that funds are now available for a bus barn and other buildings would be phased 57 in dependent on funds. 58 59 Speaking in opposition was Ms. Diane Hudson, 640 South 5th Street. Ms. Hudson said she did not receive 60 notification of the rezoning and felt due notice would be given. Ms. Hudson told Council that RP&L now 61 creates a bad smell in the area and the City does not take of property on South Q Street now. She objected 62 to having to tolerate both the smell and additional traffic. 63 64 President Hutton corrected Ms. Hudson regarding the South Q property and that it was not City owned. 65 66 55 3 Common Council Minutes Cont'd March 4, 1991 Page 7 1 Ms. Susie Robinson, 315/325 South Q Street, told Council she lives next door to the proposed site. She 2 said she had no objection to the project, just to it being next to her property. Ms. Robinson said the 3 proposed fence will run along their drive. Ms. Robinson said she did look at the Richmond Avenue property 4 and agreed a new garage was needed, but that the City has not maintained that area and there is junk 5 located there.
