DECEMBER 17. 1990 1 The Common Council of the City of Richmond, Indiana met in regular session on December 17, 1990 at the 2 hour of 7:30 P.M. in the Council Chambers in said City. President Brookbank presided with the following 3 Councilmembers present: Elstro, Lundy, Hankinson, McBride, Parker, Hutton, Morris and Paust. Absent: 4 None. Representatives of the following media were in attendance: WKBV/WFMG, WHON/WQLK and 5 Palladium Item. The following business was had to-wit: 6 7 PLEDGE OF ALLEGIANCE 8 9 SILENT DEVOTIONS 10 11 APPROVAL OF MINUTES OF DECEMBER 3. 1990 12 13 Councilmember McBride moved to approve the minutes of the previous meeting as prepared, seconded by 14 Councilmember Hutton and on unanimous voice vote the motion was carried. 15 16 COMMUNICATIONS FROM THE MAYOR 17 18 Mayor Waltermann informed the Council that the City Controller, Marge Sweet, had been successful with the 19 430,00.00 tax appeal. The Mayor also informed Council that he had secured two appraisals on the property 20 on South 5th Street adjacent to the current Police Garage for a central garage. He said the appraisals were 21 105,000.00 and 140,000.00 and he would like to know if the Council wanted him to pursue this location 22 further. 23 24 Mayor Waltermann spoke with the Council regarding the 1991 shortfall in taxes and the impact on this 25 community. He said Department heads have been cautioned to break down their spending into twelve parts 26 and do monthly spending due to projections. 27 28 Ms. Sweet informed the Council the 1991 budget was still 240,000.00 short of the original budget. 29 30 Councilmember Elstro asked if the old Magaw property had been looked at for a central garage and he felt it 31 had good office space and storage and looked half way decent. 32 33 Mayor Waltermann said they had looked at that property and it was for sale at 450,000.00. He said they 34 were looking at the South 5th Street property because it was contiguous with already owned property. 35 Mayor Waltermann said he questioned the office complex at Magaw since they City needed storage space 36 rather than office space. 37 38 Mayor Waltermann said the Street Garage on Richmond Avenue was appraised at 140,000.00, but he was 39 not certain if there would be a buyer interested at this price. 40 41 Mayor Waltermann told the Council there was 350,000.00 currently in the CCDF and they could use lease 42 purchase also and get the facilities built. 43 44 Councilmember Elstro suggested they take a better look at the Magaw property. 45 46 Councilmember McBride asked about the property rezoned for Glazer across from the Magaw property and 47 if that had been looked into and Mayor Waltermann said they had, but they are trying to sell that property as 48 a whole track and the City only needs three(3)acres. 49 50 Councilmember McBride mentioned the old Jackson Perkins property at State Rd. 38 and 35 and Mayor 51 Waltermann said they were looking at something more centralized with street equipment, motor pool and 52 buses to be located there. He said they would like to get all equipment under roof and be able to heat the 53 mechanics area. 54 55 PRESENTATION OF REMONSTRANCES. PETITIONS AND MEMORIALS 56 57 None were presented. 58 59 REPORTS FROM CITY DEPARTMENTS 60 61 None were presented. 62 63 REPORTS FROM OTHER OFFICES 64 65 None were presented. 66 518 Common Council December 17, 1990 Page 2 1 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY 2 3 Councilmember McBride commented on calls he had received regarding a 4-way stop at North 17th and C 4 Street and with this street being used as a cut across from North E to Main and the school in the area, it 5 might be a good idea. He asked it be referred to the City Engineer. 6 7 REPORTS FROM SPECIAL COMMITTEES 8 9 None were presented. 10 11 REPORTS FROM STANDING COMMITTEES 12 13 Reid Hospital 14 15 President Brookbank reported they had passed the 1991 budget. She also shared that they had allocated 16 dollars for new procedures for gall bladder surgery. 17 18 Community Services Council 19 20 President Brookbank announced that the City's Human Services Office was involved in the AIDS Task Force 21 and they are meeting every 3rd Wednesday at St. Paul's Episcopal Church. She said their mission was 22 education and prevention. 23 24 REPORTS FROM SPECIAL COUNCIL COMMITTEES 25 26 None were presented. 27 28 MISCELLANEOUS BUSINESS 29 30 Authorization for Appraisals of 11.13.15 North 10th Street 31 32 Councilmember Elstro moved to authorize Mayor Waltermann to receive two appraisals for the property 33 located at 11,13,15 North 10th Street along with the cost of demolition, seconded by Councilmember Paust 34 and on unanimous voice vote the motion was carried. 35 36 Sludge Conference 37 38 President Brookbank requested Councilmember Paust to report on the conference on sludge he recently 39 attended. 40 41 Councilmember Paust informed the Council that the conference had come up with other names for sludge 42 such as regulated organic nutrients. He said there were only three councilmembers in attendance from all 43 over the United States, with about 100 people in attendance. He said the other Councilmembers attending 44 were involved due to situation much like ours where they had dealt with the matter and denied it. 45 46 Councilmember Paust said the major problem is the educational problem with sludge and that this is a waste 47 product being used for a resource. He said all in attendance were in agreement that the sludge application is 48 safe under regulated conditions. Councilmember Paust encourage all to get informed and offered to share 49 material with the Council. He added they had ordered some brochures to share with Council. 50 51 Council Comments or Complaints 52 53 None were presented. 54 55 RESOLUTIONS 56 57 Councilmember Morris moved to suspend the rules and read Resolutions No. 30, 31, and 32-1990 by title 58 only, seconded by Councilmember Parker and on unanimous voice vote the motion was carried. 59 60 RESOLUTION NO.30-1990 61 62 The Clerk read Resolution No. 30-1990 by title only - A RESOLUTION REPLACING RESOLUTION NO. 63 8-1984 APPROVING RATES AND CHARGES IN CONNECTION WITH THE OPERATION OF OFF STREET 64 PARKING FACILITIES OWNED OR LEASED BY THE CITY OF RICHMOND, INDIANA. 65 66 519 Common Council Minutes Cont'd December 17, 1990 Page 3 1 Ms. Merchanthouse explained to the Council this resolution was to ratify rates and charges for all parking 2 facilities as established by the Board of Works. She said the increase was 2.00 per month for renters and 3 .25 cents per hour for hourly rates with two hours remaining free and this is the first increase since 1984. 4 5 There being no further questions, Councilmember Paust moved for adoption, seconded by Councilmember 6 Morris and on unanimous voice vote the motion was carried. 7 8 RESOLUTION NO.31-1990 9 10 The Clerk read by title only Resolution No.31-1990 -A RESOLUTION APPROVING THE STATEMENT OF 11 BENEFITS APPLICATION OF CERTAIN FIRMS INSTALLING NEW MANUFACTURING EQUIPMENT 12 AND/OR CONSTRUCTION IMPROVEMENTS ON REAL ESTATE IN ECONOMIC REVITALIZATION 13 AREAS IN THE CITY OF RICHMOND, INDIANA. 14 15 Councilmember Parker reported the Committee had met and all met the legal requirements. He stated the 16 Committee is looking at how much the tax abatements cost the tax payers and they will present this 17 information to Council at a later date. 18 19 Councilmember Parker said there was a problem with confidentiality and if they can say how much was 20 spend on real estate and how much on machinery, but they can report total dollars. 21 22 Councilmember Elstro asked if the dollar amount of the cost to the public would be available and Ms. Sweet 23 clarified that the Tax Commission sets the abatement amount. 24 25 There being no further comment, Councilmember Morris moved for adoption, seconded by Councilmember 26 Parker and on unanimous voice vote the motion was carried. 27 28 RESOLUTION NO.32-1990 29 30 The Clerk read by title only Resolution No. 32-1990 - A RESOLUTION APPROVING THE TRANSFER OF 31 CERTAIN REAL ESTATE BY THE CITY OF RICHMOND TO THE RICHMOND REDEVELOPMENT 32 AUTHORITY. 33 34 Councilmember Elstro reported to the Council this was more of the red tape necessary for the bond sale for 35 TIF financing and the bonds should be sold by December 21, 1990. 36 37 Mayor Waltermann said they were able to get an excellent interest rate of 6.8% and with the sale of the 38 bonds,the funds will be transferred to Star Bank as the trustee. 39 40 There being no further comment, Councilmember McBride moved for adoption, seconded by 41 Councilmember Hankinson and on unanimous voice vote the motion was carried. 42 43 ORDINANCES 44 45 ORDINANCES ON FIRST READING 46 47 Councilmember Elstro moved to suspend the rules and read Ordinances No. 99, 100, 101, and 102-1990 on 48 first reading by title only, seconded by Councilmember McBride and on unanimous voice vote the motion 49 was carried. 50 51 ORDINANCE NO.99-1990 52 53 The Clerk read on first reading by title only Ordinance No. 99-1990 - AN ORDINANCE AMENDING 54 CERTAIN PROVISIONS OF THE POLICE MERIT COMMISSION OF THE CITY OF RICHMOND. 55 56 President Brookbank announced the ordinance would be advertised for public hearing. 57 58 TRANSFER ORDINANCE NO. 100-1990 59 60 The Clerk read on first reading by title only Ordinance No. 100-1990 - AN ORDINANCE TO TRANSFER 61 WITHIN THE PARK FUND. 62 63 Councilmember Morris moved to suspend the rules and move Ordinance No. 100-1990 to second reading, 64 seconded by Councilmember Hankinson and on unanimous voice vote the motion was carried. 65 The Clerk read Ordinance No. 100-1990 on second reading. Common Council Minutes Cont'd December 17, 1990 Page4 1 President Brookbank announced the ordinance was on public hearing. 2 111 3 There being no comments or questions, Councilmember Elstro moved for engrossment, seconded by 4 Councilmember Hutton and on unanimous voice vote the motion was carried. 5 6 Councilmember Elstro moved to suspend the rules and move Ordinance No. 100-1990 to third and final 7 reading and read by title only, seconded by Councilmember Hankinson and on unanimous voice vote the 8 motion was carried. 9 10 The Clerk read Ordinance No. 100-1990 on third and final reading by title only. 11 12 Transfer Ordinance No. 100-1990 was adopted on the following call of the roll: 13 14 Ayes: Elstro, Lundy, Hankinson, McBride, Parker, Hutton, Morris, Paust and Brookbank (9) 15 Nays: None 16 17 ORDINANCE NO.101-1990 18 19 The Clerk read on first reading by title only Ordinance No. 101-1990 - AN ORDINANCE AMENDING 20 AMENDED ORDINANCE NO. 37-1990 (1991 SALARY ORDINANCE FOR THE CITY OF RICHMOND, 21 INDIANA FOR THE FISCAL YEAR BEGINNING JANUARY 1, 1991 AND ENDING DECEMBER 31, 1991). 22 23 Councilmember Morris moved to suspend the rules and move Ordinance No. 101-1990 to second reading, 24 seconded by Councilmember Parker and on unanimous voice vote the motion was carried. 25 26 The Clerk read Ordinance No. 101-1990 on second reading. 27 28 President Brookbank announced the ordinance was on public hearing. 29 30 Speaking for the ordinance was Mr. Dan Dooley, Planning, Permits and Inspection. Mr. Dooley spoke to two 31 positions in the ordinance in the Planning Department. He told Council he had experienced several 32 personnel changes over the past several months and they are now making changes in the functions of these 33 personnel. Mr. Dooley said these two positions have been refactored by the City's personnel consultant due 34 to new responsibilities, but he was unable to present them in time for the 1991 salary ordinance. 35 36 Mr. Dooley explained one of his inspectors had more field experience and was assisting with training of the 37 other inspectors along with all final inspections and issuance of occupancy certificates. He also explained 38 the Office Manager was now taking on the responsibility of issuing permits and the collection of all money 39 coming into the department which was done by the assistant in the past. Mr. Dooley added that no 40 additional funds would be necessary to accommodate the raises. 41 42 Councilmember Elstro asked how they could be funded and Mr. Dooley said the PAT II positions were not 43 being paid at a maximum rate, but they would receive increases based on achievement, so the additional 44 dollars would be available. 45 46 Councilmember McBride questioned when Council approved the addition of personnel for code enforcement 47 and they were now busy with construction and no time for enforcement. 48 49 Mr. Dooley said he felt the Department was now in position to manage complaints with no longer handling 50 housing programs. He told Council the housing person would now be responsible for complaint 51 management and the staff would be sufficient. 52 53 Councilmember Elstro stressed the Council continues to get complaint calls not being addressed and Mr. 54 Dooley said he did not anticipate the construction increase when he asked for additional staff. He said with 55 the new functions assigned,one person would be managing complaints and doing follow up. 56 57 Councilmember Elstro said the Council had spent hours on the salary ordinance and he did not intend to go 58 along with this amendment. 59 60 Also speaking for the Ordinance was Ms. Sweet. Ms. Sweet told Council that the LTC position is the Street 61 Department Mechanic and she forgot to include the position in the original ordinance. 62 63 Mayor Waltermann explained that the Executive position was the Department of Transportation Systems 64 department head and the PAT III positions were the Airport Administrative Manager and Operations Manager 65 as requested by the Airport Board. He said the drivers were the Senior/Disabled drivers brought up to the same pay the Rose View Transit Drivers. 21+ Common Council Minutes Cont'd December 17, 1990 Page 5 1 Councilmember McBride commented this ordinance was funding positions in a department not yet created. 2 3 Councilmember Hutton asked the total dollar figure and where the funds were coming from and Mayor 4 Waltermann explained the 11,000.00 additional dollars would be from the UMPTA grant with no new burden 5 on tax payers. He said the total cost to tax payers would probably be lower with additional state and federal 6 dollars available. 7 8 Councilmember McBride asked that Ordinance No. 101 be tabled because101 and 102 were out of order. 9 10 Ms.Sweet commented that she needed the LTC and Drivers positions approved. 11 12 Mayor Waltermann suggested the Council hold 101 until they act on 102 and asked for an explanation of 13 why it was necessary to table the ordinance. 14 15 Mr. Metzger explained to the Council he would feel more comfortable seeing the LTC position and the 16 Drivers pay approved prior to the new year and was uncomfortable paying positions without authority of an 17 ordinance. 18 19 Mayor Waltermann informed the Council he had provided them with all the information they had requested 20 regarding the Department of Transportation Systems and had asked for their questions. He said the 21 information was in everybody's hands early. 22 23 Councilmember Lundy asked if Council could hold out the two positions necessary to be acted upon and Mr. 24 Metzger said they could amend the Ordinance or set it aside for action after 102 is acted upon. 25 26 Mayor Waltermann explained to the Council that Ordinance No. 102 for the Department of Transportation 27 Systems was assigned the higher number because they were waiting on the Airport Board Resolution prior 28 to presentation of the ordinance and this was late coming in. 29 • 30 Councilmember McBride moved to amend Ordinance No. 101-1990 by deleting all positions except the LTC 31 and the Drivers,seconded by Councilmember Elstro and on a voice vote the motion was carried. 32 33 There being no further questions, Councilmember Parker moved for engrossment, seconded by 34 Councilmember McBride and on unanimous voice vote the motion was carried. 35 36 Councilmember Elstro moved to suspend the rules and move Ordinance No. 101-1990 to third and final 37 reading and read by title only, seconded by Councilmember McBride and on unanimous voice vote the 38 motion was carried. 39 40 The Clerk read Ordinance No. 101-1990 on third and final reading by title only. 41 42 Amended Ordinance No. 101-1990 was adopted on the following call of the roll: 43 44 Ayes: Elstro, Lundy, Hankinson, McBride, Parker, Hutton, Morris, Paust and Brookbank (9) 45 Nays: None 46 47 ORDINANCE NO.102-1990 48 49 The Clerk read on first reading by title only Ordinance No. 102-1990 - AN ORDINANCE AMENDING 50 AMENDED ORDINANCE NO. 39-1990 ESTABLISHING A DEPARTMENT OF TRANSPORTATION 51 SYSTEMS FOR THE CITY OF RICHMOND,WAYNE COUNTY, INDIANA. 52 53 Councilmember Morris moved to suspend the rules and move Ordinance No. 102-1990 to second reading, 54 seconded by Councilmember Parker and on unanimous voice vote the motion was carried. 55 56 The Clerk read Ordinance No. 102-1990 on second reading. 57 58 President Brookbank announced the ordinance was on public hearing. 59 60 Speaking in favor was Mr. Cliff Wagner, Chairman of the Board of Aviation Commissioners. Mr.Wagner told 61 the Council that the Airport Board had expressed concerns over a lack of information in the past regarding 62 their inclusion in the DOTS. He said the proper mechanisms are now in place for their inclusion and he no 63 longer opposes the inclusion of the Airport in the Department of Transportation Systems. 64 65 Councilmember McBride asked who appointed the Airport Board and Mr. Wagner said the Mayor did and it 66 was now straightened out who appointed the Manager. 67 68 Councilmember Elstro asked if the Board set salaries and Mr. Wagner said they could, but do not with the 69 City personnel policies. Common Council Minutes Cont'd December 17, 1990 Page6 1 Mayor Waltermann explained the Airport Board works out the classification and descriptions and they are 2 paid up to the maximum allowable in the appropriate category. 3 • 4 President Brookbank asked who hired Airport personnel and Mayor Waltermann said to date the Airport 5 Board has and they will continue to do the hiring and firing at the Airport. 6 7 Mr. Metzger informed the Council that State Law says the Mayor appoints the Department Head subject to 8 approval by the Board. 9 10 Councilmember Lundy asked if Council approved this ordinance can they come back and amend the salary 11 ordinance for the 1991 budget. 12 13 Ms. Sweet said the budget ordinance did not need to be amended since there were not additional tax dollars 14 required. 15 16 Councilmember Morris moved for engrossment, but the motion died for lack of a second. 17 18 Councilmember Hankinson stated he was still confused how the City could have a Department of 19 Transportation and only include less than 10%of all transportation within the City. 20 21 Councilmember Hankinson recommended the ordinance be referred to the Committee of the Whole for a 22 detailed analysis and final disposition, seconded by Councilmember McBride and on a voice vote the motion 23 was carried. 24 25 Councilmember Paust asked who would do a detailed analysis and Councilmember Hankinson said whoever 26 wants the ordinance. 27 28 Mayor Waltermann explained the ordinance for the DOT was taken from Indiana Code allowing the formation 29 of a Transportation System including bus, rail, air and waterways. He said this was what he was basing his 30 premises on. Mayor Waltermann said he was trying to provide for local cost effective government in light of 31 loss of revenue. 32 33 Councilmember Hutton set January 3, 1990 at 7:00 PM for a Committee of the Whole for further discussion 34 of the Department of Transportation Systems. 35 36 Councilmember Hutton requested members of Council to get their questions to the appropriate person in 37 advance of the meeting. 38 39 ORDINANCES ON SECOND READING 40 41 None were presented. 42 43 ORDINANCES ON THIRD READING 44 45 None were presented. 46 47 ADJOURNMENT 48 49 There being no further business, on a motion duly made, seconded and passed, the meeting was 50 adjourned. 51 52 53 54 55 56 Jane R.
