HomeMy Public PortalAbout06-18-1990 4-)7 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA,JUNE 18, 1990 1 The Common Council of the City of Richmond, Indiana met in regular session June 18, 1990 at the hour of 2 7:30 P.M. in the Council Chambers in said City. President Brookbank presided with the following 3 Councilmembers present: Elstro, Lundy, Hankinson, McBride, Parker, Hutton, Morris and Paust. Absent: 4 None. Representatives of the following media were in attendance: WKBV/WFMG, WHON/WQLK and 5 Palladium Item. The following business was had to-wit: 6 7 PLEDGE OF ALLEGIANCE 8 9 SILENT DEVOTIONS 10 11 APPROVAL OF MINUTES OF JUNE 4,1990 12 13 Councilmember McBride moved to approve the minutes of the previous meeting as prepared, seconded by 14 Councilmember Hankinson and on unanimous voice vote the motion was carried. 15 16 PRESENTATION OF REMONSTRANCES, PETITIONS AND MEMORIALS 17 18 None were presented. 19 20 COMMUNICATIONS FROM THE MAYOR 21 22 Mayor Frank H. Waltermann offered his congratulations to the Richmond High School Boy's Baseball team 23 and their excellent play throughout the recent tournament. He said this team even maintained the field to 24 insure it quality for the games. 25 26 Mayor Waltermann reported on the Moonlight Parade, invited all to the Vietnam Wall which would be in 27 Richmond through June 26, 1990 and to the Rose Parade on June 24, 1990. 28 29 30 Mayor Waltermann reported that the past two weeks Richmond hosted the AAU Basketball tournaments up to 14 years of age and with Earlham's graduation all hotel room in the City had been filled. 31 32 Mayor Waltermann congratulated Ms. Barbara Gray for the excellent job she had done in coordinating the 33 efforts to get the Vietnam Moving Wall in Richmond and thanked all the sponsors and other volunteers 34 involved in the project. 35 36 Mayor Waltermann also announced that the opening for South L Street would be this week. 37 38 Mayor Waltermann shared correspondence with the Council for the South Central Mayor's Conference. He 39 said the City would be hosting a meeting of the group on June 21, 1990 at Highland Lake Golf Course and 40 invited the members of Council to participated in the activities. 41 42 Councilmember Elstro asked what plans there were for areas like SW G where there were no sidewalks and 43 if there were no plans to construct could the residents of the area do it through Community Improvement 44 Funding. 45 46 Mayor Waltermann said it could be done through the Community Improvement Fund process and agreed 47 there was a need for curbs and sidewalks in the arear around the high school. 48 49 President Brookbank asked about the trimming of the canopy of trees on South 23rd Street and if that was 50 done to use 23rd as an alternate routes for trucks to use South L Street. 51 52 Mayor Waltermann said no trucks would be allowed on South L Street and the City would be monitoring that 53 situation. 54 55 REPORTS FROM CITY DEPARTMENTS 56 57 None were presented. 58 59 REPORTS FROM OTHER OFFICES 60 61 None were presented. 62 63 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY 64 65 Ms. Hauptstueck reported to the Council that action was being taken on their inquiry about handicapped 66 parking at the license branch. She said Traffic was doing an investigation to report to the Board at its next meeting. 408 Common Council June 18, 1990 Page 2 1 Ms. Hauptstueck stated that the City Engineer has been instructed to contact the Indiana Department of 2 Transporation regarding the South L Street railroad crossing. She said the railroad is in the process of 3 selling the line and the City will continue to investigate the liability problems with the crossing. 4 5 Ms. Hauptstueck also reported that the Engineer was also investing the request of the Council for 6 signalization on 27 North in addition to National Road West and will make a report in order that a joint 7 resolution can be prepared to be forwarded to the State. 8 9 Councilmember Morris asked that the Board investigate the intersection of South E and 16th. She said 10 another accident happened there this weekend and feels it needs to be reinvestigated for safety factors. 11 12 Councilmember Elstro said that nothing had been done about the complaints he had turned in at South 13th 13 and F and 603 South 13th Street. He also reported a weed lot at 416 South I Street. 14 15 REPORTS FROM SPECIAL COMMITTEES 16 17 None were presented. 18 19 REPORTS FROM STANDING COMMITTEES 20 21 Committee of the Whole 22 23 Councilmember Hutton reminded the Council of the Committee of the Whole to be held on June 21, 1990 at 24 7:00 PM with the Director of Public Works,Street Department, Sanitary District and the Mayor regarding solid 25 waste pick up and problems with grass clippings, etc. She also announced the Committee of the Whole on 26 June 27, 1990 at 5:00 PM for a bus tour of problem areas of the City. 27 28 REPORTS FROM SPECIAL COUNCIL COMMITTEES 29 30 None were presented. 31 32 MISCELLANEOUS BUSINESS 33 34 Parking Problems on South 22rd Street-George Lynch 35 36 Mr.George Lynch of 126 South 22nd Street,spoke with the Council regarding parking in the Test Field area. 37 Mr. Lynch said that on Tuesdays and Thursdays when the Richmond High School Marching Band practices 38 there is a real problem. He said parking is only allowed on one side of the street and people disregard signs, 39 driveways, drive across sidewalks and in the grass on the field. He asked for some assistance with this 40 problem. 41 42 President Brookbank asked Mayor Waltermann direct the Police Department to get to the root of the 43 problem. 44 45 Councilmember Lundy said there have been concerns expressed over emergency vehicles being able to 46 access the area. 47 48 Mr. Lynch also spoke with the Council over people who walk their dogs and allowing them to "do their 49 business"without cleaning up after them. He asked this also be looked into. 50 51 Councilmember Elstro stated that the City had painted yellow curbs around the Hibbard School area and felt 52 that might help solve the problem at Test. 53 54 RESOLUTIONS 55 56 Councilmember Morris moved to suspend the rules and read Resolution No. 13-1990 by title only, seconded 57 by Councilmember Parker and on unanimous voice vote the motion was carried. 58 59 RESOLUTION NO.13-1990 60 61 The Clerk read by title only Resolution No. 13-1990 - A RESOLUTION OF THE COMMON COUNCIL OF 62 THE CITY OF RICHMOND, INDIANA. 63 64 Councilmember Hutton noted this was the companion resolution for the one adopted by the RP&L Board for 65 the loan of 850,000.00 to the City and Section 3 needed to be amended to reflect the pay back date of 66 December 31, 1990. Councilmember Hutton so moved, seconded by Councilmemer Morris and on unanimous voice vote the motion was carried. 409 Common Council Minutes Cont'd June 18, 1990 Page 3 1 iCouncilmember Morris moved for adoption of Amended Resolution No. 13-1990, seconded by 2 Councilmember McBride and on unanimous voice vote the motion was carried. 3 4 ORDINANCES 5 6 ORDINANCES ON FIRST READING 7 8 Councilmember Elstro moved to suspend the rules and read Ordinance No.35, 36, 37, 38, 39, and 40-1990 9 on first reading by title only, seconded by Councilmember McBride and on unanimous voice vote the motion 10 was carried. 11 12 ORDINANCE NO.35-1990 13 14 The Clerk read on first reading by title only Ordinance No. 35-1990 - AN ORDINANCE RATIFYING THE 15 PROFESSIONAL NEGOTIATON AGREEMENT BETWEEN THE AMALGAMATED TRANSIT UNION, 16 LOCAL 1474 AND THE CITY OF RICHMOND, AMENDING ORDINANCE NO. 44-1989 TO SET 17 SALARIES FOR CERTAIN APPOINTED OFFICERS AND EMPLOYEES. 18 19 Councilmember Morris moved to suspend the rules and move Ordinance No. 35-1990 to second reading, 20 seconded by Councilmember Paust and on unanimous voice vote the motion was carried. 21 22 The Clerk read Ordinance No.35-1990 on second reading. 23 24 Councilmember Elstro asked if the drivers worked a 40 hours week and Ms. McFarland explained that was 25 correct and they had one/half hour paid lunch for a total of 8 1/2 hours a day and 1/2 hour off for lunch. 26 27 Councilmember Elstro asked if they get three presonal days off along with their holidays and Mayor 28 Waltermann said they do since their paid holidays are only seven and other city employees have ten 29 holidays. 30 31 There being no further questions, Councilmember Hankinson moved for engrossment, seconded by 32 Councilmember Parker and on unanimous voice vote the motion was carried. 33 34 Councilmember MOrris moved to suspend the rules and move Ordinance No. 35-1990 to third and final 35 reading and read by title only, seconded by Councilmember Hankinson and on unanimous voice vote the 36 motion was carried. 37 38 The Clerk read Ordinance No.35-1990 on third and final reading by title only. 39 40 Ordinance No.35-1990 was adopted on the following call of the roll: 41 42 Ayes: Elstro, Lundy, McBride, Hankinson, Parker, Hutton, Morris, Paust and Brookbank (9) 43 Nays: None 44 45 ORDINANCE NO.36-1990 46 47 The Clerk read on first reading by title only Ordinance No. 36-1990 - AN ORDINANCE RELATING TO 48 RESERVED RESIDENTIAL PARKING. 49 50 President Brookbank announced the Ordinance needed to be advertised. 51 52 Councilmember Hankinson noted the ordinance needed to be amended to reflect a fine of$50.00 in Section 53 VI (E) instead of$25.00 and so moved, seconded by Councilmember McBride and on unanimous voice vote 54 the motion was carried. 55 56 ORDINANCE NO.37-1990 57 58 The Clerk read on first reading by title only Ordinance No. 37-1990 - AN ORDINANCE SETTING TOTAL 59 REGULAR WAGES AND POSITIONS FOR APPOINTED OFFICERS AND EMPLOYEES OF THE CITY OF 60 RICHMOND, INDIANA EXCEPT FOR MEMBERS OF THE POLICE AND FIRE COLLECTIVE BARGAINING 61 UNITS, FOR THE FISCAL YEAR BEGINNING JANUARY 1, 1991 AND ENDING DECEMBER 31, 1991, 62 APPROVING THE ADDITIONAL COMPENSATION TO CERTAIN APPOINTED OFFICIALS OF THE CITY, 63 OTHER THAN GOVERNMENTAL, WHO PERFORM SERVICES FOR THE CITY, WHICH SERVICES ARE 64 CONNECTED WITH THE OPERATION OF THE MUNICIPALLY OWNED UTILITY OR FUNCTIONS. 65 410 Common Council Minutes Cont'd June 18, 1990 Page 4 1 Councilmember Elstro asked the Ordinance be placed in the Committee of the Whole for discussion. 2 Councilmember Parker suggested Ordinance No. 30-1990 also be put in Committee of the Whole for the 3 same meeting. 4 5 Councilmember Hutton suggested they be incorporated into the meeting scheduled for June 21, 1990 and if 6 the Council wants specific information they should make that request now so people are prepared. 7 8 Councilmember Elstro asked about three additional people in the Police Department and Mayor Waltermann 9 explained they would be adding civilian employees to handle certain jobs and freeing up officers that can be 10 returned to duty. 11 12 Councilmember asked if that was additional bodies and money and Mayor Waltermann stated that was 13 correct. 14 15 ORDINANCE NO.38-1990 16 17 The Clerk read on first reading by titly only Ordinance No. 38-1990 - AN ORDINANCE TO APPROIRIATE 18 WITHIN THE FEDERAL REVENUE SHARING TRUST FUND. 19 20 President Brookbank announced the Ordinance would be advertised for public hearing. 21 22 ORDINANCE NO.39-1990 23 24 The Clerk read on first reading by title only Ordinance No. 39-1990 - AN ORDINANCE AMENDING 25 AMENDED ORDINANCE NO. 1-1984 TO ESTABLISH A DEPARTMENT OF TRANSPORATION FOR THE 26 CITY OF RICHMOND,WAYNE COUNTY, INDIANA. 27 28 Councilmember Morris moved to suspend the rules and move Ordinance No. 39-1990 to second reading, 29 seconded by Councilmember Paust and on unanimous voice vote the motion was carried. 30 31 The Clerk read Ordinance No.39-1990 on second reading. 32 33 President Brookbank announced that Ordinance No.39-1990 was on public hearing. 34 35 Councilmember Elstro informed the Council that he intended to hold up the ordinance at this meeting and 36 would like to see figures, names and salaries on the department. He also commented that the Airport Board 37 does not report to anybody. 38 39 Mayor Waltermann explained that the flow chart accompanying the ordinance listed the Airport Board at the 40 bottom as is done in all cases of Boards having administrative control over departments. He added that the 41 salary information was on the back side of the flow chart. 42 43 Councilmember Hutton asked about the Senior Transportation drivers becoming union if they are 44 incorporated with Rose View and Mayor Waltermann explained the Senior Transportation would remain a 45 separate function and all operations of the divisions would remain the same. 46 47 Councilmember Elstro asked about the color of uniforms of the Senior Transportation drivers and if they 48 would wear the same color as Rose View drivers. 49 50 Mayor Waltermann commented that the uniforms now assigned to the Senior Transportation drivers were 51 Park Department uniforms and those decisions will be made in the future. 52 53 Councilmember Parker said he had been questioned by an Airport Board member about authority and felt 54 they would have to be in charge of the decisions made at the Airport, not take direction from a department 55 head. 56 57 Mayor Waltermann stated that was already understood. 58 59 Councilmember Hankinson asked who the personnel in the various divisions would report to and Mayor 60 Waltermann stated they would report to their Operations Supervisors who in turn reports to the Department 61 Head. He said the operations would be similar to the Department of Public Works which has the various 62 divisions reporting to a Department Head. 63 64 Councilmember Hutton asked why the Airport would be placed under a Director of Transportation when that 65 person would have no authority and Mayor Waltermann explained the Director of Transportation would be in a position similar to the Airport Manager reporting to the Airport Board. 11 Common Council Minutes Cont'd June 18, 1990 Page 5 1 Councilmember Hankinson commented that other departments of the City drive trucks, etc. and why were 2 they all not under transporation. 3 4 Councilmember McBride asked if the Park budget would be reduced and Mayor Waltermann explained they 5 would still be operating the Senior Transportation through the Park, it would just receive additional funds 6 through UMPTA. 7 8 Councilmember Lundy commented that the flow chart was not in the same format she originally saw at the 9 Committee meetings and Mayor Waltermann explained that it had been redesigned at the suggestion of the 10 Council Transportation Committee. 11 12 Councilmember Parker, a member of the Transportation Committee, stated he had no problem with the 13 Department of Transportation as long as the Airport operates as it now does. He said his only other concern 14 was the salary of the Director and he felt the main issue related to additional federal funds to assist with the 15 various transportation in the City. 16 17 Councilmember Paust, member of the Transportation Committee, said the total purpose of the Department 18 of Transporation was to get federal funds to maintain the services and there needs to be a reorganization t 19 do this. He said he felt this was going in the right direction. Councilmember Paust commented that he sees 20 no problem in looking for answers for the various questions so when this project is completed additional 21 funds will be available. 22 23 Councilmember Hankinson asked if additional federal funds were the only reason for the Department of 24 Transportation and Councilmember Paust stated it would allow for more efficiency and more funding. 25 26 Mayor Waltermann said the immediate concern was to save the Senior/Disabled Transportation. 27 28 Councilmember Elstro asked why the Airport had been included in the re-organization and Mayor 29 30 Waltermann said based on federal guidelines, the Airport is considered a department of transportation and the organization was based on the federal guidelines. 31 32 Councilmember Elstro asked how the funds would be "jiggled" around to the first of the year to fund the 33 Department and Ms. Sweet explained all divisions would retain their separate budgets as they now do. 34 35 Councilmember Hutton asked where the office would be located and Mayor Waltermann said probably at the 36 Street Garage until such time as other central garage facilities can be located. 37 38 Ms. Sweet informed the Council that there is a need to have this reorganization completed by July 1, 1990 in 39 order that additional funds can be secured to assist in keeping the Senior Transportation running. 40 41 Councilmember Elstro said he felt it wasn't fair that the Council be expected to pass this ordinance in one 42 night. 43 44 Councilmember McBride asked why all at once the Senior Tranportation was in financial trouble and Ms. 45 Sweet explained it was not all at once and the various city officials had been working on a solution all year. 46 47 Councilmember Morris asked the Council if they had specific questions that could be answered. 48 49 Councilmember Elstro stated that the administration had fooled around with the project for four weeks and 50 he would say no to the Council passing it in one night. 51 52 Mayor Waltermann told the Council that he had tried to maintain good communications with the Council by 53 utilizing the Council Transportation Committee to help with the reorganization for the Department of 54 Transportation. 55 56 Councilmember Lundy, also a member of the Transportation Committee, told the Council that the original 57 58 meeting they discussed central garage, Airport and a director and assistant director. She said they were informed about the financial problems with the Senior Transportation and the main questions were with 59 regard to the Airport. She felt the other questions had been resolved. 60 61 Councilmember McBride asked how the central garage would be financially supported and Mayor 62 Waltermann said the City was saving in anticipation of going to central garage. He said they are now 63 investigating two locations and they have to do something. Mayor Waltermann told the Council that OSHA 64 was mandating the old street garage be upgraded and the City had no choice but to try and use CCDF funds 65 for the upgrade. Mayor Waltermann said a modern efficient facility would allow the City to use the combined 66 talents of the various mechanical staffs and give the City a better facility. He added that any reference to 67 central garage would only include the repair of vehicles. 412 Common Council Minutes Cont'd June 18, 1990 Page 6 1 President Brookbank announced that she had invited Mr. Cliff Wagner, President of the Airport Board,to be 2 in attendance this evening,but he was not. 3 4 Mayor Waltermann stressed to the Council that no state laws would be violated with regard to the authority of 5 the Airport Board. 6 7 Councilmember Parker again stated he only had two problems and that being to make certain the Airport will 8 continue to operate as it is now and that the Mayor and Council monitor the salary for the director. He added 9 that is there is a conflict with the Airport, the Council would have the option to do away with the Department 10 of Transportation. 11 12 President Brookbank invited Ms. Janet McFaland, Grants Administrator, to make comment regarding the 13 proposed Department of Transportation. 14 15 Ms. McFarland explained to the Council the investigations for the reorganization started when it became 16 necessary to locate additional funds for the Senior Transportation. She said she had met with Indiana 17 Department of Transportation and by combining Rose View and the Senior Transportation, a grant 18 amendment can be done for an additional 36,000.00 to assist the Senior Transportation the balance of 1990. 19 She said the opportunity for this funding will prevent lay off of the Senior Transportation drivers and keep the 20 service operable. She told the Council a lot of issued are still unanswered and even the unionization of the 21 Senior Transportation drivers is not a major concern since there is only 500.00 difference in the existing 22 salaries. 23 24 Ms. McFarland said she had forwarded a letter of intent to the Department of Transportation for the balance 25 of 1990 and for 1991 funding. She said that with funding through UMPTA the total city match required will be 26 reduced from 100,000.to 57,000.00 and could even be less with revenue increasing. 27 28 Councilmember Lundy asked if the departments involved gave any feed back and Mayor Waltermann said 29 he had met with the departments and also with the Rose View Union and there were no problems. 30 31 There being no further comments, Councilmember Morris moved for engrossment, seconded by 32 Councilmember Paust and on a voice vote the motion was carried. 33 34 Councilmember Morris moved to suspend the rules and move Ordinance No. 39-1990 to third and final 35 reading and read by title only, seconded by Councilmember Parker and on a voice vote with two no votes the 36 motion was defeated. 37 38 Ordinance No.39-1990 will return on third and final reading on July 2, 1990. 39 40 ORDINANCE NO.40-1990 41 42 The Clerk read on first reading by title only Ordinance No. 40-1990 - AN ORDINANCE AMENDING 43 AMENDED ORDINANCE NO. 44-1989 (1990 SALARY ORDINANCE FOR THE CITY OF RICHMOND, 44 INDIANA FOR THE FISCAL YEAR BEGINNING JANUARY 1, 1990 AND ENDING DECEMBER 31, 1990). 45 46 Ordinance No. 40-1990 was assigned to the Committee of the Whole for discussion on June 21, 1990 and 47 will return for public hearing on July 2, 1990. 48 49 ORDINANCES ON SECOND READING 50 p 51 ORDINANCE NO.j*-1990 52 53 The Clerk read on second reading Ordinance No. %&-1990 - AN ORDINANCE FIXING THE ANNUAL 54 SALARIES OF ALL ELECTED OFFICERS OF THE CITY OF RICHMOND, INDIANA. 55 56 The Proof of Publication was presented and found to be in order. Councilmember Parker moved to accept 57 and file the Proof of Publication, seconded by Councilmember Paust and on unanimous voice vote the 58 motion was carried. 59 60 President Brookbank announced the Ordinance was on public hearing. 61 62 No public discussion was had and the Ordinance was assigned to the Committee of the Whole for discussion 63 on June 21, 1990 and continued on public hearing on July 2, 1990. 64 65 ADJOURNMENT There being no further business, on a motion duly made, seconded and passed, the meeting was adjourned.
