NOVEMBER 20. 1989 1 The Common Council of the City of Richmond, Indiana met in regular session November 20, 1989 at the 2 hour of 7:30 P.M. in the Council Chambers in said City. President Hutton presided with the following 3 Councilmembers present: Elstro, Lundy, Brookbank, Hankinson, McBride, Parker, Morris and Paust. 4 Absent: None. Representatives of the following media were in attendance: WKBV/WFMG, WHON/WQLK 5 and Palladium Item. The following business was had to-wit: 6 7 PLEDGE OF ALLEGIANCE 8 9 SILENT DEVOTIONS 10 11 APPROVAL OF MINUTES OF NOVEMBER 6,1989 12 13 Councilmember Brookbank moved to approve the minutes of the previous meeting as prepared, seconded 14 by Councilmember Hankinson and on unanimous voice vote the motion was carried. 15 16 COMMUNICATIONS FROM THE MAYOR 17 18 Mayor Frank H.Waltermann thanked the Scouts that had assisted with the tree planting this past Saturday. 19 He said that 60 plus trees had been planted. Mayor Waltermann reported that volunteers had also assisted 20 with the installation of 40,000.of playground equipment at Springwood Park this past Saturday. 21 22 Mayor Waltermann said he had attended an open house at the National Guard Armory and commented on 23 their input back to the community. 24 25 Mayor Waltermann reported to the Council that the Find Center Parking Lot was now being operated as an 26 off street parking facility through a cooperative agreement between the City and the Richmond Community 27 School adding an additional 60 parking spaces in that area. He also told the Council that the new equipment 28 is installed and operable in the North 7th Street parking lot. 29 30 Councilmember Paust said that he understood that the Mayor had taken a look at the property on North lath 31 Street for possible purchase to operate as additional parking in that area and moved to authorize Mayor 32 Waltermann to meet with the realtor representing the property on North 10th between the two City operated 33 parking lots and further investigate for funding for the purchase, seconded by Councilmember Morris and on 34 unanimous voice vote the motion was carried. 35 36 37 President Hutton announced that she and Councilmember Paust would be serving on the Committee to act 38 as a liaison between the Council and Mayor Waltermann. 39 40 Mayor Waltermann said projects such as these must continue to assist with creating new jobs within our 41 community. 42 43 PRESENTATION OF REMONSTRANCES.PETITIONS AND MEMORIALS 44 45 None were presented. 46 47 REPORTS FROM CITY DEPARTMENTS 48 49 Fire Department-Report on Chimney Spark Arrestors 50 51 Fire Chief James Sticco reported to the Council that he had investigated the use of spark arrestors and if any 52 other cities have ordinances controlling this. He said that no other cities have even heard of such a code 53 being enacted. He presented a letter from John Meredith, operating a chimney sweep business, explaining 54 spark arrestors and what they were used for. Chief Sticco also presented Mr. Dave Barker with Barkers Fire 55 Place Shop to answer any questions of the Council. 56 57 Councilmember Elstro asked if it would be acceptable for sparks coming from a chimney to be reported to 58 the Battalion Chief on duty for his investigation and then possibly a letter written to the owner with the 59 chimney emitting sparks and Chief Sticco said they could be done. Chief Sticco told the Council that sparks 60 very seldom cause fires. 61 62 Councilmember Elstro asked Mr. Barker what the cost would be to put a screen or spark arrestor on a 63 chimney and Mr. Barker said it would depend on the the style and materials used to make them with. He felt 64 that between 50.00 and 100.00 would cover aluminum for cap or screen. 65 66 Councilmember Elstro asked if that would solve the problem and Mr. Barker stated that sparks could still Common Council Minutes Cont'd November 20, 1989 Page 2 1 come out the side. He said the changes of a spark causing a fire on a roof was seldom and that the caps 2 are good for keeping out rain and animals, but even screening had to have holes large enough to not clog 3 up and that would let sparks out. 4 5 Councilmember Brookbank commented on flue" fire being the most hazardous and Mr. Barker said the 6 danger of a flue fire was when it heated through the masonry and there would be damage to floors, walls 7 and roofs. 8 9 Councilmember McBride asked Mr. Barker if he recommended the caps and Mr. Barker stated to keep water 10 and animals out of the chimney, but not for retaining sparks. 11 12 REPORTS FROM OTHER OFFICES 13 14 None were presented. 15 • 16 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY 17 18 Councilmember Elstro asked about the property at 430 South 14th and was informed it was now under new 19 ownership and the new owner would cooperate in getting the exterior repaired as a priority. 20 21 Councilmember Morris asked that the Board look into school buses parked between J and L around 22 Southview Apartments. She said the Police have been notified and are confused as to their obligation and 23 asked that they be advised. 24 25 Councilmember Elstro said there were also tractor/trailers parked on city streets that needed to be attended 26 to also. 27 28 REPORTS FROM SPECIAL COMMITTEES 29 30 None were presented. 31 32 REPORTS FROM STANDING COMMITTEES 33 34 None were presented. 35 36 REPORTS FROM SPECIAL COUNCIL COMMITTEES 37 38 None were presented. 39 40 MISCELLANEOUS BUSINESS 41 42 None was presented. 43 44 RESOLUTIONS 45 46 Councilmember Morris moved suspend the rules and read Resolution No. 29-1989 by title only, seconded 47 by Councilmember Parker and on unanimous voice vote the motion was carried. 48 49 RESOLUTION NO.29-1989 50 51 The Clerk read on first reading by title only Resolution No. 29-1989 - A RESOLUTION APPROVING THE 52 STATEMENT OF BENEFITS APPLICATION OF CERTAIN FIRMS INSTALLING NEW MANUFACTURING 53 EQUIPMENT AND/OR CONSTRUCTION IMPROVEMENTS ON REAL ESTATE IN ECONOMIC 54 REVITALIZATION AREAS IN THE CITY OF RICHMOND, INDIANA. 55 56 Councilmember Elstro asked what and how much and Councilmember Parker said it was abatement on a 57 new building and equipment for Richmond Baking Company and was job retention for 63 people. He said it 58 did meet all the requirements. 59 60 Councilmember Paust moved for adoption of Resolution No. 29-1989, seconded by Councilmember Morris 61 and on unanimous voice vote the motion was carried. 62 - 63 ORDINANCES 64 65 ORDINANCES ON FIRST READING 66 Common Council Minutes Cont'd November 20, 1989 Page 3 1 Councilmember Morris moved to suspend the rules and read Ordinances No. 78, 79, and 80-1989 on first 2 reading by title only, seconded by Councilmember Parker and on unanimous voice vote the motion was 3 carried. 4 5 ORDINANCE NO. 78-1989 6 7 The Clerk read on first reading by title only Ordinance No. 78-1989 -AN ORDINANCE TO ANNEX TO THE 8 CITY OF RICHMOND, INDIANA CERTAIN CONTIGUOUS TERRITORY ADJACENT AND ABUTTING 9 THERETO, DESCRIBING THE SAME, PROVIDING FOR THE PUBLICATION THEREOF, FIXING THE 10 TIME WHEN THE SAME SHALL TAKE EFFECT AND ASSIGNING SAID TERRITORY TO A 11 COUNCILMANIC DISTRICT IN THE CITY OF RICHMOND, INDIANA. 12 13 President Hutton announced that Ordinance No. 78-1989 could be passed this evening and would be 14 advertised after passage for remonstrances to be filed. 15 16 Councilmember Elstro moved to suspend the rules and move Ordinance No. 78-1989 to second reading, 17 seconded by Councilmember Brookbank and on unanimous voice vote the motion was carried. 18 19 The Clerk read Ordinance No.78-1989 on second reading. 20 21 President Hutton announced the ordinance was on public hearing. 22 23 Speaking as the agent for the property owners was Mr. Frank Otto. Mr.Otto told the Council they would like 24 to have the property annexed in order to proceed with the subdivision planned for that area. 25 26 Councilmember Paust asked that Mr.Otto explain area included for a possible road from Hodgin to Main and 27 Mr.Otto said the original subdivision was 27 acres and they have now purchased six more acres adjacent to 28 the easement for a new road if and when it would go through. 29 30 There being no further public comment, Councilmember Hankinson moved for engrossment of Ordinance 31 No. 78-1989,seconded by Councilmember Brookbank and on unanimous voice vote the motion was carried. 32 33 Councilmember Elstro moved to suspend the rules and move Ordinance No. 78-1989 to third and final 34 reading and read by title only, seconded by Councilmember Brookbank and on unanimous voice vote the 35 motion was carried. 36 37 The Clerk read Ordinance No. 78-1989 on third and final reading by title only. 38 39 Ordinance No.78-1989 was adopted on the following call of the roll: 40 41 Ayes: Elstro, Lundy, Brookbank, Hankinson, McBride, Parker, Morris, Paust and Hutton (9) 42 Nays: None 43 44 TRANSFER ORDINANCE NO. 79-1989 45 46 he Clerk read on first reading by title only Ordinance No. 79-1989 - AN ORDINANCE TO TRANSFER 47 WITHIN THE GENERAL FUND POLICE DEPARTMENT. 48 49 Councilmember Morris moved to suspend the rules and move Ordinance No. 79-1989 to second reading, 50 seconded by Councilmember Brookbank and on unanimous voice vote the motion was carried. 51 52 The Clerk read Ordinance No. 79-1989 on second reading. 53 54 President Hutton announced the ordinance was on public hearing. 55 56 Speaking for the Ordinance was Major Jack Myers. Major Myers told the Council the transfer was for 57 gasoline for the balance of the year. Major Myers told the Council that the transfer was to 21 purchase 17 portable radio units to replace the units that are now six years old and only having a life 22 expectancy of two years. He said they are now having problems getting repair parts. He said they also 23 need the transfer to purchase the mini cassettes that are used for reports. 24 25 Councilmember Parker asked about the life expectancy of the new radios and Major Myers said there was a 26 five year warranty. 27 28 Councilmember Parker asked if they were compatible with old radios and Major Myers said they were and 29 would also be able to use the old ones as stand by units. 30 31 There being no further public comment, Councilmember Brookbank moved for engrossment of Ordinance 32 No.80-1989, seconded by Councilmember Elstro and on unanimous voice vote the motion was carried. 33 34 Councilmember Morris moved to suspend the rules and move Ordinance No. 80-1989 to third and final 35 reading and read by title only, seconded by Councilmember McBride and on unanimous voice vote the 36 motion was carried. 37 38 The Clerk read Ordinance No. 80-1989 on third and final reading by title only. 39 40 Ordinance No. 80-1989 was adopted on the following call of the roll: 41 42 Ayes: Elstro, Lundy, Brookbank, Hankinson, McBride, Parker, Morris, Paust and Hutton (9) 43 Nays: None 44 45 ORDINANCES ON SECOND READING 46 47 ORDINANCE NO.77-1989 48 49 The Clerk read on second reading Ordinance No. 77-1989 - AN ORDINANCE AMENDING ORDINANCE 50 NO. 1-1988 AUTHORIZING THE RICHMOND SANITARY DISTRICT TO REVISE CERTAIN LANDFILL FEE 51 COLLECTION. 52 53 The Proof of Publication was presented and found to be in order. Councilmember Morris moved to accept 54 and file the Proof of Publication, seconded by Councilmember Brookbank and on unanimous voice vote the 55 motion was carried. 56 57 President Hutton announced Ordinance No.77-1989 was on public hearing. 58 59 Speaking for the ordinance was Mr.Jerald Judge, Sanitary District Administrator. Mr. Judge told the Council 60 that the average cost of landfill fees in Indiana was 11.00 and that those fees would rise dramatically with the 61 old permits run out and the landfills are operated by the new regulations. He said the additional fees will 62 also assist with the replacement of equipment which is averaging 200,000.00 annually. 63 64 Mr.Judge stated that the charges only affect 30%of those using the landfill with the balance being residents 65 of the district and not charged fees. • Common Council Minutes Cont'd November 20, 1989 Page 5 1 Councilmember Paust asked if the 30% included persons dumping from out of state and Mr. Judge said 2 'there were, but nothing significant. He said they do get calls and they request all inquiries be forwarded to 3 the Board in writing and they are seldom followed up on. 4 5 Councilmember Paust commented that if 1/3 of the trash being dumped comes from outside the area he felt 6 there was a major problem. He said they should look at the Richmond area when considering services or 7 ;the life of the landfill could only be ten years instead of the anticipated twenty years. He said that maybe the 8 Board would need to take a look at the overall picture and see if they even want trash from outside the area. 9 10 Mr.Judge stated that was a good point and one the Board was considering. 11 12 Councilmember Morris commented that it was becoming more and more difficult to site a landfill anywhere 13 i and if they were getting 1/3 of their trash from outside Wayne County',there could really be a problem. 14 15 Mr.Judge explained that the 1/3 was not just from outside Wayne County, but the charge was for all outside 16 the Sanitary District. 17 18 Councilmember Morris said it was very difficult to have a City/County venture and she would like to see the 19 fees raised even more. 20 21 Councilmember Parker asked how often the fees were reviewed and Mr. Judge said they had been 22 reviewing once a year,but feel they could do it every six months or as often as the Board liked. 23 24 Councilmember Parker requested Mr. Judge to relay the concerns of the Council to the Board and that they 25 would like to see the fees reviewed at least every six months. 26 27 Councilmember Elstro asked about a prior comment by Mr. Judge regarding tonnage dumped by Rumpke 28 and Mr. Judge clarified that it was 300 to 400 ton a week dumped and that the Recycling Center was about 29 the same. 30 31 There being no further comment, Councilmember Brookbank moved for engrossment of Ordinance No. 32 77-1989,seconded by Councilmember Paust and on unanimous voice vote the motion was carried. 33 34 Councilmember Brookbank moved to suspend the rules and move Ordinance No. 77-1989 to third and final 35 reading and read by title only, seconded by Councilmember Parker and on unanimous voice vote the motion 36 was carried. 37 38 The Clerk read Ordinance No. 77-1989 on third and final reading by title only. 39 40 i Ordinance No.77-1989 was adopted on the following call of the roll: 41 42 Ayes: Elstro, Lundy, Brookbank, Hankinson, McBride, Parker, Morris, Paust and Hutton (9) 43 Nays: None 44 i 45 ORDINANCE ON THIRD READING 46 47 None were presented. 48 49 SPECIAL BUSINESS 50 51 Councilmember Parker requested the Clerk to forward the information on spark arrestors to Mr. Childress 52 since it addressed many of his concerns. 53 54 ADJOURNMENT 55 56 There being no further business, on a motion duly made, seconded and passed, the meeting was 57 adjourned. 58 59 60 61 62 63 Sarah L.
