HomeMy Public PortalAbout10-16-1989 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, OCTOBER 16, 1989 1 The Common Council of the City of Richmond, Indiana met in regular session October 16, 1989 at the hour 2 of 7:30 P.M. in the Council Chambers in said City. President Hutton presided with the following 3 Councilmembers present: Elstro, Lundy, Brookbank, Hankinson, McBride, Parker, and Morris. Absent: 4 Paust. Representatives of the following media were in attendance: WKBV/WFMG, WHON/WQLK and 5 Palladium Item. The following business was had to-wit: 6 7 PLEDGE OF ALLEGIANCE 8 9 SILENT DEVOTIONS 10 11 APPROVAL OF MINUTES OF OCTOBER 2.1989 12 13 Councilmember Brookbank moved to approve the minutes of the previous meeting as prepared, seconded 14 by Councilmember Hankinson and on unanimous voice vote the motion was carried. 15 16 COMMUNICATIONS FROM THE MAYOR 17 18 Mayor Frank H. Waltermann reported to the Council that the last two weeks had been very historic for the 19 City of Richmond. He spoke of the Folk Troop visiting from Serpukhov, Richmond's Sister City, and their 20 excellent presentations. Mayor Waltermann said he has been asked how Richmond can be so involved in 21 these activities when other larger cities do not even have these opportunities. The Mayor thanked the host 22 families and other businesses and individuals in the community for their support. 23 24 Mayor Waltermann shared the recent events of the S.U.R.E. Conference held in the Richmond/Wayne 25 County Area this past week and that it had representatives from all over the United States working on the 26 conference and participating in the Conference. He said locally the City of Richmond, Wayne County, the 27 Chamber of Commerce and Ball State University were participants and there were meetings held in 28 Richmond, Centerville, Hagerstown and Muncie and much excellent information came from the conference. 29 30 Mayor Waltermann commented that if the activities keep going, the City could house a Sustainable 31 Enterprise Institute and be a model for other communities to follows. : 32 33 Mayor Waltermann said the Sustainable Urban Rural Enterprise conference touched the lives of all and 34 showed how to take the first step to protect the environment. He thanked all that participated in the 35 Conference, especially Mr. Matt Stegall for his assistance. 36 37 Mayor Waltermann said past two weeks have been certainly memorial with both the visitors from the USSR 38 and the SURE conference and that both events were unique and the City can be very proud of their 39 participation in the events. 40 41 President Hutton relayed a written message from Councilmember Paust, who was unable to be in 42 attendance, about the City looking into purchasing a property on the east side of the first block of North 10th 43 Street,located between two city operated facilities for the possible purchase and additional parking. 44 45 Mayor Waltermann said that may be worth looking at since there is a desperate need for parking in that 46 area. 47 48 PRESENTATION OF REMONSTRANCES, PETITIONS AND MEMORIALS 49 50 REPORTS FROM CITY DEPARTMENTS 51 52 Purchasing Office 53 54 Ms. Rita Stout, Purchasing Director, announced to the Council that she had turned in her resignation to 55 Mayor Waltermann on October 13, 1989. She said she had accepted a similar position with Imperial 56 Products here in Richmond. 57 58 Ms. Stout told the Council she wanted to publicly thank Mayor Waltermann for giving her the opportunity to 59 be the first Purchasing Director for the City and thanked the Council for their support and working with 60 Mayor Waltermann to set up the office. 61 62 REPORTS FROM OTHER OFFICES 63 64 None were presented. 65 66 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Common Council Minutes Cont'd October 16, 1989 Page 2 1 Ms. Carrie Hauptstueck, President of the Board of Public Works and Safety, informed the Council that she 2 had investigated the complaints filed by Councilmember Elstro regarding unsafe properties. Ms. 3 Hauptstueck told the Council that 232 SW 2nd Street was not considered an unsafe property and is secured. 4 She said the inspectors will see about getting trash hauled away from the premises. 5 6 Ms. Hauptstueck reported on 741 South 5th Street and that the outside of the premises had been repaired 7 and for the repair order to be completed it still needed a furnace and some electrical work. 8 9 Ms. Hauptstueck reported on b30 South 14th Street and that the owner Ms. Clara Hall had obtained repairs 10 estimates and was working with the bank on having the property reappraised to increase the loan amount 11 for the needed repairs. She said the bank would provide the loan information within ten days. 12 13 Ms. Hauptstueck reported to Councilmember McBride that the Planning Department had done all possible 14 without legal action on the property on NW L Street, but they would contact the Sheriff to see about removal 15 of the junk vehicles. 16 17 Ms. Hauptstueck told the Council that she had spoken with the Traffic Division regarding safe crossing of 18 National Road from SW 1st tc SW 16th Street. She said that they did not feel the area would warrant a 19 traffic light. 20 21 Councilmember Morris said her concern was to see safe crossing for school children in the area and Ms. 22 Hauptstueck said they could consider petitioning the state for an approved crosswalk and then provide a 23 crossing guard. 24 25 Councilmember Parker said he believed a study had been done in that area when the State looked into a 26 temporary light at College Avenue and this should be available to present again in this regard. He said there 27 was a need for safety for childr^n in the area. 28 29 President Hutton suggested t' at not allowing turn on red at the National Road and SW 5th intersection 30 would help with the problem. 31 32 Councilmember Morris commented that she felt the need for assistance was already demonstrated and the 33 issue needed to be addressed with some urgency. 34 35 Ms. Hauptstueck said that Captain Farmer had indicated this was the third request for a traffic signal in that 36 area and the Board would cont,nue to pursue the issue. 37 38 Councilmember Elstro said th,t there were some neighbors from the South 14th Street area in attendance 39 that would like to make comment to the Council. 40 41 Mr. Marion House, 442 South 14th Street, told the Council that there were two city dumps, one on New 42 Paris Pike and one at 430 South 14th Street. He said that the place is vacant, but had cats and dogs living 43 in there. 44 45 Ms. Hauptstueck stated that Ms. Hall, owner of record, seems to do well if someone is working with her to 46 get the job completed and that the Human Services Office is now working with her to see if she can get the 47 repairs made. 48 49 Councilmember Elstro asked •-rhat happened if a litter ticket had been issued and the litter was still not 50 removed. 51 52 Mayor Waltermann said the p:. mises could be re-ticketed and asked for an address. Councilmember Elstro 53 stated it was in the 800 Block of South 10th Street. 54 55 Councilmember McBride addrel that there was still litter in the 600 Block of South 10th also. 56 57 Councilmember McBride commented on the fact that he did not believe the City was any cleaner even with 58 the litter tickets being issued . d said he had 60 pictures of litter that he had taken on the west side of town. 59 60 Mayor Waltermann commented that he felt the City was cleaner now that it ever had been and there had 61 been a positive effect from the .icketing efforts. 62 63 Councilmember McBride asked about the status of Police Chief Joseph Nimitz and Mayor Waltermann said 64 he was still currently on administrative leave. 65 66 007 Common Council Minutes Cont'd October 16, 1989 Page 3 1 REPORTS FROM SPECIAL COMMITTEES 2 3 Committee of the Whole 4 5 REPORTS FROM STANDING COMMITTEES 6 7 None were presented. - 8 9 REPORTS FROM SPECIAL COUNCIL COMMITTEES 10 11 None were presented. 12 13 MISCELLANEOUS BUSINESS 14 15 Police Merit Commission Appointment 16 17 President Hutton noted there was a need for the Council to make an appointment to the Police Merit 18 Commission from the field of education and it needed to be made at the next meeting of the Council for a 19 term beginning on November 16, 1989. 20 21 RESOLUTIONS 22 23 None were presented. 24 25 ORDINANCES 26 27 President Hutton requested Ordinance No. 69-1989 be allowed on the Agenda by a suspension of the rules 28 of Council. This was necessary since the Council had stricken an ordinance earlier this year dealing with the 29 same subject matter. 30 31 Councilmember Morris moved to suspend the rules and allow Ordinance No. 69-1989 be added to the 32 Agenda,seconded by Councilmember Brookbank and on a unanimous voice vote the motion was carried. 33 34 ORDINANCES ON FIRST READING 35 36 Councilmember Morris moved to suspend the rules and read Ordinances No. 69 and 70-1989 on first reading 37 by title only,seconded by Councilmember McBride and on unanimous voice vote the motion was carried. 38 39 ORDINANCE NO. 69-1989 - 40 41 The Clerk read on first reading by title only Ordinance No. 69-1989 - AN ORDINANCE RATIFYING THE 42 PROFESSIONAL NEGOTIATION AGREEMENT BETWEEN THE RICHMOND PROFESSIONAL 43 FIREFIGHTERS, INC., LOCAL 1408 AND THE CITY OF RICHMOND; PROVIDING FOR LONGEVITY PAY 44 FOR THE FIREFIGHTERS; AND AMENDING ORDINANCE NO. 33-1988 TO SET SALARIES FOR 45 CERTAIN APPOINTED OFFICERS AND EMPLOYEES. 46 47 Councilmember Elstro moved to suspend the rules and move Ordinance No. 69-1989 to second reading, 48 seconded by Councilmember Brookbank and on unanimous voice vote the motion was carried. 49 - 50 The Clerk read Ordinance No. 69-1989 on second reading. 51 52 President Hutton announced the ordinance was on public hearing. 53 54 There being no public comment, Councilmember Hankinson moved for engrossment of Ordinance No. 55 69-1989,seconded by Councilmember Brookbank and on unanimous voice vote the motion was carried. 56 57 Councilmember Morris moved to suspend the rules and move Ordinance No. 69-1989 to third and final 58 reading and read by title only, seconded by Councilmember McBride and on unanimous voice vote the 59 motion was carried. 60 61 The Clerk read Ordinance No. 69-1989 on third and final reading by title only. 62 63 Ordinance No.69-1989 was adopted on the following call of the roll: 64 65 Ayes: Elstro, Lundy, Brookbank, Hankinson, McBride, Parker, Morris, and Hutton (8) 66 Nays: None Absent: Paust 08 Common Council Minutes Contd October 16, 1989 Page 4 1 ORDINANCE NO. 70-1989 2 3 he Clerk read on first reading by title only Ordinance No. 70-1989 - AN ORDINANCE RATIFYING THE 4 PROFESSIONAL NEGOTIA ION AGREEMENT BETWEEN THE RICHMOND PROFESSIONAL 5 FIREFIGHTERS, INC., LOCAL 1408 AND THE CITY OF RICHMOND; PROVIDING FOR LONGEVITY PAY 6 FOR THE FIREFIGHTERS; AND AMENDING ORDINANCE NO. 44-1989 TO SET SALARIES FOR 7 CERTAIN APPOINTED OFFICERS AND EMPLOYEES. 8 9 Councilmember Morris moved to suspend the rules and move Ordinance No. 70-1989 to second reading, 10 seconded by Councilmember Brookbank and on unanimous voice vote the motion was carried. 11 12 The Clerk read Ordinance No.'i'0-1989 on second reading. 13 14 President Hutton announced th?.ordinance was on public hearing. 15 16 There being no public comm::nt, Councilmember Hankinson moved for engrossment of Ordinance No. 17 70-1989,seconded by Councilmember Brookbank and on unanimous voice vote the motion was carried. 18 19 Councilmember Elstro moved to suspend the rules and move Ordinance No. 70-1989 to third and final 20 reading and read by title only seconded by Councilmember McBride and on unanimous voice vote the 21 motion was carried. 22 23 The Clerk read Ordinance No.70-1989 on third and final reading by title only. 24 25 Ordinance No. 70-1989 was ac;opted on the following call of the roll: 26 27 Ayes: Elstro, Lundy, Brookbank, Hankinson, McBride, Parker, Morris, and Hutton (8) 28 Nays: None 29 Absent: Paust 30 31 ORDINANCES ON SECOND READING 32 33 None were presented. 34 35 ORDINANCE ON THIRD READING 36 37 None were presented. 38 39 UNFINISHED BUSINESS 40 41 RESOLUTION NO. 23-1989 42 43 President Hutton reminded the Council that Resolution No. 23-1989 was scheduled for a public hearing by 44 the Council on October 24, 198'9 at 7:00 PM in the Community Room. 45 46 PETITION BY MAYOR ON SEPARATION OF POWERS 47 48 Councilmember Elstro asked Mayor Waltermann if he was going to dismiss the petition filed against the 49 Council since the contracts had been settled with the Fire Department. 50 51 Mayor Waltermann reminded Councilmember Elstro that the contract with the Fire Department was not the 52 issue to be decided by the Courts, that issue being separation of powers. He stated that still remains 53 unsettled and the hearing is set for November 1, 1989 at 1:30 pm in the Wayne Circuit Court. 54 55 ADJOURNMENT 56 57 There being no further busin.3ss., on a motion duly made, seconded and passed, the meeting was 58 adjourned. 59 60 61 62 Sarah L.
