OCTOBER 2, 1989 1 The Common Council of the City of Richmond, Indiana met in regular session October 2, 1989 at the hour of 2 7:30 P.M. in the Council Chambers in said City. President Hutton presided with the following 3 Councilmembers present: Elstro, Lundy, Brookbank, Hankinson, McBride, Parker, Morris and Paust. 4 Absent: None. Representatives of the following media were in attendance: WKBV/WFMG, WHON/WQLK 5 and Palladium Item. The following business was had to-wit: 6 7 PLEDGE OF ALLEGIANCE 8 9 SILENT DEVOTIONS 10 11 APPROVAL OF MINUTES OF SEPTEMBER 18.1989 12 13 Councilmember Morris moved to approve the minutes of the previous meeting as prepared, seconded by 14 Councilmember Hankinson and on unanimous voice vote the motion was carried. 15 16 COMMUNICATIONS FROM THE MAYOR 17 18 Mayor Frank H. Waltermann reported to the Council that a new lane for two way traffic was being 19 constructed by the City for Romark Industries and work was being done for American Metal Door for 20 additional truck traffic. Mayor Waltermann spoke of the Downtown Renovation Project and that the Elder 21 Beerman Parking lot had been paved. 22 23 Mayor Waltermann asked the Council to study and ask questions regarding the TIF information that was 24 included with their Council packets. He said this is a financing tool for programs without using taxes. 25 26 Mayor Waltermann gave information about the truck that was recently stuck under the Conrail Bridge on 27 Main Street and the amount of truck traffic coming into the City due to the 1-70 construction. He said the 28 State had sent an engineer to do a study on a new bridge and it will be up to the Council to decide on the 29 future of the existing Main Street Bridge after the study is received from the State. 30 31 PRESENTATION OF REMONSTRANCES, PETITIONS AND MEMORIALS 32 33 REPORTS FROM CITY DEPARTMENTS 34 35 None were presented. 36 37 REPORTS FROM OTHER OFFICES 38 39 None were presented. 40 41 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY 42 43 No report was presented but Councilmember Elstro asked about unsafe properties located at 430 South 44 14th, South 5th and H Streets and 232 SW 2nd Street. 45 46 The Clerk reported that 430 South 14th was under a demolition or repair order with 120 days to complete the 47 repairs as was the property at South 5th and H Streets. The address at 232 SW 2nd will be forwarded to the 48 Planning Department for action. 49 50 Councilmember McBride asked about the Gilmer property on NW L Street and what was being done to 51 remove the debris. Councilmember McBride was reminded the property was not in the City limits and that 52 the Planning Office had sent correspondence to the owner asking it be cleaned up as part of the jurisdiction 53 of the two mile fringe zoning area. 54 55 Councilmember Elstro reminded Mayor Waltermann that he had requested a list of city vehicles being taken 56 home by departments and Mayor Waltermann said he would furnish them immediately. 57 58 Councilmember Morris expressed her concerns over the dangerous conditions on National Road West 59 between SW 1st and SW 16th for school children crossing the street. She asked that the Traffic Division 60 might do an evaluation in this area. 61 62 President Hutton asked about the proposed signal at College Avenue and Mayor Waltermann said the State 63 had denied that request even on a temporary basis. 64 65 REPORTS FROM SPECIAL COMMITTEES 66 9 02 ' Common Council Minutes Cont'd October 2, 1989 Page 2 1 Committee of the Whole 2 3 Councilmember Brookbank reminded the Council of the Committee of the Whole meetings set for October 5, 4 1989 for a tour of the park facilities and on October 10, 1989 for discussion of the Litter Ordinance and 5 sample landlord registry ordinance. 6 7 REPORTS FROM STANDING COMMITTEES 8 9 Reid Hospital 10 11 Councilmember Brookbank reported that the financial status of the Hospital was good and they were getting 12 closer to budget projections. 13 14 Plan Commission 15 16 Councilmember Morris announced a special meeting of the Plan Commission on October 5, 1989 at 7:00 17 PM to review the Redevelopment Plan. She stated that the firms of Bakers and Daniels and Umbaugh and 18 Associates would be present to answer questions on the plan. 19 20 REPORTS FROM SPECIAL COUNCIL COMMITTEES 21 22 None were presented. 23 24 MISCELLANEOUS BUSINESS 25 26 Appointment to Human Rights Commission -James Murray 27 28 Councilmember Brookbank moved to appoint Mr. James Murray for a one year appointment to the Human 29 Rights Commission retroactive to January, 1989, seconded by Councilmember McBride and on unanimous 30 voice vote the motion was carr:ad. 31 32 Councilmember Morris reminded the Council that a Soviet Folk Troop would be visiting the City from the 33 Sister City of Serpukhov and she would like any member of the Council wanting to participate in any of the 34 events to make reservations. 35 36 RESOLUTIONS 37 38 Councilmember Morris moved '.o suspend the rules and read Resolutions No. 27 and 28-1989 by title only, 39 seconded by Councilmember Parker and on unanimous voice vote the motion was carried. 40 41 RESOLUTION NO.27-1989 42 43 The Clerk read by title only Resolution No. 27-1989 -A RESOLUTION APPROVING THE STATEMENT OF 44 BENEFITS APPLICATION OF CERTAIN FIRMS INSTALLING NEW MANUFACTURING EQUIPMENT 45 AND/OR CONSTRUCTION IMPROVEMENTS ON REAL ESTATE IN ECONOMIC REVITALIZATION 46 AREAS IN THE CITY OF RICHMOND, INDIANA. 47 48 All applicants met the guidelirr4 s and were approved by the Committee for tax abatement. 49 50 Councilmember Paust moves' for adoption of Resolution No. 27-1989, seconded by Councilmember 51 Brookbank and on unanimous•"ice vote the motion was carried. 52 53 RESOLUTION NO.28-1989 54 55 The Clerk read by title only Resolution No. 28-1989 - A RESOLUTION SUPPORTING THE SUBMISSION 56 OF AN APPLICATION TO THE PARTNERSHIP LEVEL OF THE INDIANA MAIN STREET PROGRAM. 57 58 Mr.Jim Kinnett, Economic Development Director, explained that the City was eligible to move up in the Main 59 Street Program to the Partnership Level since a full time director had been hired through the Richmond 60 Community Development Corporation. He said this level would allow more input and benefits. 61 62 Councilmember Brookbank rn.ved for adoption of Resolution No. 28-1989, seconded by Councilmember 63 Paust and on unanimous voica vote the motion was carried. 64 65 ORDINANCES 66 :) Common Council Minutes Cont'd October 2, 1989 Page 3 1 ORDINANCES ON FIRST READING 2 3 Councilmember Morris moved to suspend the rules and read Ordinances No. 67 and 68-1989 on first reading 4 by title only, seconded by Councilmember Paust and on unanimous voice vote the motion was carried. 5 6 ORDINANCE NO. 67-1989 7 8 The Clerk read on first reading by title only Ordinance No.67-1989-AN ORDINANCE TO REDUCE WITHIN 9 THE POLICE PENSION FUND. 10 11 City Controller Marge Sweet told the Council the reduction ordinances were part of the budget process in 12 order to reduce the budget to 530,000. over levy and she was comfortable going into hearing that amount 13 over. She explained that these were funds allocated for 1989 for all that were eligible to retire, but had not 14 been spent since all eligible had not retired. 15 16 Councilmember Morris moved to suspend the rules and move Ordinance No. 67-1989 to second reading, 17 seconded by Councilmember Parker and on unanimous voice vote the motion was carried. 18 19 The Clerk read Ordinance No. 67-1989 on second reading. 20 21 President Hutton announced the ordinance was on public hearing. 22 23 There being no public comment, Councilmember Hankinson moved for engrossment of Ordinance No. 24 67-1989,seconded by Councilmember Parker and on unanimous voice vote the motion was carried. 25 26 Councilmember Morris moved to suspend the rules and move Ordinance No. 67-1989 to third and final 27 reading and read by title only, seconded by Councilmember McBride and on unanimous voice vote the 28 motion was carried. 29 30 The Clerk read Ordinance No. 67-1989 on third and final reading by title only. 31 32 Ordinance No.67-1989 was adopted on the following call of the roll: 33 34 Ayes: Elstro, Lundy, Brookbank, Hankinson, McBride, Parker, Morris, Paust and Hutton (9) 35 36 ORDINANCE NO. 68-1989 37 38 The Clerk read on first reading by title only Ordinance No. 68-1989 -AN ORDINANCE TO REDUCE WITHIN 39 THE FIRE PENSION FUND. 40 41 Councilmember Elstro asked about where the money goes when the funds are reduced and Ms. Sweet 42 explained that the monies are not going anywhere,but the fund itself is being reduced. 43 44 Councilmember commented about past complaints that the funds were transferred to the General Fund and 45 interest was collected and Ms. Sweet said now the funds go to a trust fund and are no longer transferred to 46 the General Fund. 47 48 Councilmember Morris moved to suspend the rules and move Ordinance No. 68-1989 to second reading, 49 seconded by Councilmember Parker and on unanimous voice vote the motion was carried. 50 51 The Clerk read Ordinance No. 68-1989 on second reading. 52 53 President Hutton announced the ordinance was on public hearing. 54 55 There being no public comment, Councilmember Hankinson moved for engrossment of Ordinance No. 56 68-1989,seconded by Councilmember Brookbank and on unanimous voice vote the motion was carried. 57 58 Councilmember Morris moved to suspend the rules and move Ordinance No. 68-1989 to third and final 59 reading and read by title only, seconded by Councilmember Parker and on unanimous voice vote the motion 60 was carried. 61 62 The Clerk read Ordinance No. 68-1989 on third and final reading by title only. 63 64 Ordinance No.68-1989 was adopted on the following call of the roll: 65 66 Ayes: Elstro, Lundy, Brookbank, Hankinson, McBride, Parker, Morris, Paust and Hutton (9) p°B J4' Common Council Minutes Cont'd October 2, 1989 Page 4 1 ORDINANCES ON SECOND READING 2 3 APPROPRIATION ORDINANCE NO.65-1989 4 5 The Clerk read on second reading Appropriation Ordinance No. 65-1989 - AN ORDINANCE TO 6 APPROPRIATE WITHIN THE CUMULATIVE CAPITAL DEVELOPMENT FUND. 7 8 The Proof of Publication was examined and found to be in order. Councilmember Morris moved to accept 9 and file the Proof of Publication, seconded by Councilmember McBride and on unanimous voice vote the 10 motion was carried. 11 12 President Hutton announced the Ordinance was on public hearing. 13 14 Mr.Jim Kinnett, Economic Development Director, explained to the Council that the appropriation was for the 15 purchase of property a part of the obligations for the Hills Pet Products to locate in Richmond. 16 17 There being no further discussion, Councilmember Hankinson moved for engrossment, seconded by 18 Councilmember Brookbank and on unanimous voice vote the motion was carried. 19 20 Councilmember Brookbank moved to suspend the rules and move Ordinance No. 65-1989 to third and final 21 reading and read by title only, seconded by Councilmember Hankinson and on unanimous voice vote the 22 motion was carried. 23 24 The Clerk read Appropriation Ordinance No. 65-1989 on third and final reading by title only. 25 26 Appropriation Ordinance No. 65-1989 was adopted on the following call of the roll: 27 28 Ayes: Elstro, Lundy, Brookbank, Hankinson, McBride, Parker, Morris, Paust and Hutton (9) 29 Nays: None 30 31 ORDINANCE ON THIRD READING 32 33 None were presented. 34 35 ADJOURNMENT 36 37 There being no further business, on a motion duly made, seconded and passed, the meeting was 38 adjourned. 39 40 41 42 Sarah L.
