HomeMy Public PortalAbout09-05-1989 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, SEPTEMBER 5. 1989 1 The Common Council of the City of Richmond, Indiana met in regular session September 5, 1989 at the hour 2 of 7:30 P.M. in the Council Chambers in said City. President Hutton presided with the following 3 Councilmembers present: Elstro, Lundy, Brookbank, Hankinson, McBride, Parker, Morris and Paust. 4 Absent: None. Representatives of the following media were in attendance: WKBV/WFMG, WHON/WQLK 5 and Palladium Item. The following business was had to-wit: 6 7 PLEDGE OF ALLEGIANCE 8 9 SILENT DEVOTIONS 10 11 APPROVAL OF MINUTES OF AUGUST 21.1989 12 13 Councilmember Brookbank moved to approve the minutes of the previous meeting as prepared, seconded 14 by Councilmember McBride and on unanimous voice vote the motion was carried. 15 16 COMMUNICATIONS FROM THE MAYOR 17 18 None were presented at this time. 19 20 PRESENTATION OF REMONSTRANCES. PETITIONS AND MEMORIALS 21 22 None 23 24 REPORTS FROM CITY DEPARTMENTS 25 26 None were presented. 27 28 REPORTS FROM OTHER OFFICES 29 30 None were presented. 31 32 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY 33 - 34 No report was presented, but the following questions were presented by the Councilmembers. 35 36 Councilmember Elstro asked about tractor/trailers being parked on city streets and specifically mentioned 37 South 7th Street. It was requested a memo be forwarded to the Police Department about enforcing vehicles 38 being too wide to park on city streets. 39 40 Councilmember Elstro also commented about about the recent effort to clean up the City and admitted he 41 was the first to admit that an effort needed to be made. He did express his concerns about automatically 42 writing tickets without a warning. He suggested a warning be given with a week to clean up and them the 43 ticket be issued. 44 45 Councilmember Paust said he had received a complaint from a person on South 8th Street about getting a 46 ticket and the trash not belonging to the property ticketed, but rather coming from side properties. He did 47 say that enforcement was good and would like to have a copy of the policy so he could answer questions 48 that might be asked. Councilmember Paust also asked that the alley in the first block between 10th and 11th 49 be checked since trash had not been picked up there since last Friday and there being an accumulation. He 50 wondered if another dumpster might not be wise. 51 52 Councilmember Elstro volunteered to work with the City inspectors regarding enforcement of the litter 53 ordinance, but would only be available in the evening. 54 55 Councilmember McBride asked what had been done with the Gilmer property on NW L Street and Mr. dan 56 Dooley, Director of Planning, Permits and Inspection,stated that a letter had been sent to the property owner 57 58 and there is a week left on the time allotted for clean up. Mr. Dooley said that since the property is not within the City limits,they will need to turn the matter over to the Law Department for litigation if they cannot get the 59 cooperation of the owner. 60 61 Councilmember Paust commented on back fill in utility cuts not being adequate and the cuts caving in within 62 a day of being repaired. He asked that this be corrected. 63 64 Councilmember Morris stated she felt the litter in the community was a bad problem and and when the 65 inspectors have to continually reissue warnings, there is no other recourse than to ticket. She said the 66 inspectors will work people and there is a contact number in the letter accompanying the ticket. 990 Common Council Minutes Cont'd September 5, 1989 Page 2 1 Councilmember Elstro said he would still feel better if a ticket was issued and if the property was not cleaned 2 up within five days,then they would have to pay the fine. 3 4 REPORTS FROM SPECIAL COMMITTEES 5 6 Committee of the Whole 7 8 President Hutton announced a joint meeting of the City Council and the County on September 27, 1989. 9 10 Councilmember Brookbank announced a Committee of the Whole meeting on October 5, 1989 at 5:15 PM 11 to tour the Park system to see the improvements from the bond issue. The tour will leave from the Park 12 Office. 13 14 REPORTS FROM STANDING COMMITTEES 15 16 Reid Hospital 17 18 Councilmember Brookbank reported that Reid Hospital showed a positive cash flow and they toured the 19 newly renovated 7th floor. She also said a room had been dedicated in memory of Mr. Ken Spoon. 20 21 Plan Commission 22 23 Councilmember Morris announced that Ms. Sara Braxton replaced Mr. Dennis Bronston in the Planning 24 Department and would be glad to assist Councilmembers with complaints. 25 26 REPORTS FROM SPECIAL COUNCIL COMMITTEES 27 28 None were presented. 29 30 MISCELLANEOUS BUSINESf 31 32 None was presented. 33 34 RESOLUTIONS 35 36 Councilmember Morris moved :o suspend the rules and read Resolutions No. 25 and 26-1989 by title only, 37 seconded by Councilmember 1 lstro and on unanimous voice vote the motion was carried. 38 39 RESOLUTION NO.25-1989 40 41 The Clerk read by title only Resolution No. 25-1989 - A RESOLUTION TAKING FINAL ACTION TO 42 CONFIRM RESOLUTION NO.24-1989 43 44 The Proof of Publication was examined and found to be in order. Councilmember Morris moved to accept 45 and file the Proof of Publication, seconded by Councilmember Parker and on unanimous voice vote the 46 motion was carried. 47 48 President Hutton announced the Resolution was open for public hearing. 49 50 Speaking for the Resolution as Mr. Richard Freeman, Freeman Planning and Design at 33 South 9th 51 Street. Mr. Freeman explaine.i to the Council that he was representing MP Realty Group and this was the 52 Resolution to confirm the Resolution designating the property on South L Street an Economic Revitalization 53 Area and it was necessary to amend the original resolutions to correct the legal description. 54 55 There being no comment, Councilmember Elstro moved for adoption of Resolution No. 25-1989, seconded 56 by Councilmember Morris and on unanimous voice vote the motion was carried. 57 58 RESOLUTION NO.26-1989 59 60 The Clerk read by title only Re olution No. 26-1989-A RESOLUTION AUTHORIZING AN APPEAL TO THE 61 STATE TAX COMMISSIONEF'S FOR RELIEF FROM PROPERTY TAX LEVY LIMITATIONS. 62 63 President Hutton announced the Resolution was open for public hearing. 64 65 It was explained to the Council the Resolution was a formality to allow the City to appeal for relief from the 66 limitations of the frozen levy for excessive need. 91 Common Council Minutes Cont'd September 5, 1989 Page 3 1 There being no comment, Councilmember Elstro moved for adoption of Resolution No. 26-1989, seconded 2 by Councilmember Brookbank and on unanimous voice vote the motion was carried. 3 4 ORDINANCES 5 6 ORDINANCES ON FIRST READING 7 8 Councilmember Elstro moved to suspend the rules and read Ordinances No. 65, and 66-1989 on first reading 9 by title only,seconded by Councilmember Hankinson and on unanimous voice vote the motion was carried. 10 11 APPROPRIATION ORDINANCE NO.65-1989 12 13 The Clerk read on first reading by title only Appropriation Ordinance No. 65-1989 - AN ORDINANCE TO 14 APPROPRIATE WITHIN THE CUMULATIVE CAPITAL DEVELOPMENT FUND. 15 16 President Hutton announced the Ordinance would be advertised for public hearing. 17 18 TRANSFER ORDINANCE NO.66-1989 19 20 The Clerk read on first reading by title only Ordinance No. 66-1989 - AN ORDINANCE TO TRANSFER 21 WITHIN THE AIRPORT FUND. 22 23 Councilmember Morris moved to suspend the rules and move Ordinance No. 66-1989 to second reading, 24 seconded by Councilmember Brookbank and on unanimous voice vote the motion was carried. 25 26 The Clerk read Ordinance No. 66-1989 on second reading. 27 28 President Hutton announced Ordinance No.66-1989 was on public hearing. 29 30 Speaking for Ordinance No. 66-1989 was Purchasing Director, Rita Stout. Ms. Stout explained the transfer 31 was for additional dollars for the purchase of a fuel truck at the Airport. She said they were unable to locate a 32 used vehicle, but they were looking at buying a used chassis and a new fuel tank. 33 34 Councilmember Parker asked who owned the fuel truck used during the Parachute meet at the Airport this 35 past weekend and Ms. Stout said she would find out that information. 36 37 Councilmember Parker also commented on the wonderful turn out of people at the Airport over the weekend. 38 39 There being no further questions or comments, Councilmember Elstro moved for engrossment, seconded by 40 Councilmember Parker and on unanimous voice vote the motion was carried. 41 42 Councilmember Elstro moved to suspend the rules and move Ordinance No. 66-1989 to third and final 43 reading and read by title only, seconded by Councilmember Brookbank and on unanimous voice vote the 44 motion was carried. 45 46 The Clerk read Ordinance No. 66-1989 on third and final reading by title only. 47 48 Ordinance No.66-1989 was adopted on the following call of the roll: 49 50 Ayes: Elstro, Lundy, Brookbank, Hankinson, McBride, Parker, Morris, Paust and Hutton (9) 51 Nays: None 52 53 ORDINANCES ON SECOND READING 54 55 ORDINANCE NO.36-1989 56 57 The Clerk read on second reading Ordinance No. 36-1989 - AN ORDINANCE AMENDING CHAPTER 154 58 OF THE MUNICIPAL CODE, BEING ORDINANCE NO.2325-1968, COMMONLY KNOWN AS THE ZONING 59 ORDINANCE OF THE CITY OF RICHMOND, INDIANA PROVIDING FOR THE REZONING OF PROPERTY 60 LOCATED IN THE 1900 BLOCK OF STRAIGHTLINE PIKE ON THE WEST SIDE, FROM R-2 SINGLE 61 FAMILY RESIDENCE DISTRICT TO C-2 COMMERCIAL DISTRICT. 62 63 Councilmember Morris explained that the Plan Commission recommended denial of the petition for reasons 64 of traffic safety and a continuing drainage problem. He also stated that the adjacent lot has a modular home being placed on it and the Plan Department 57 is unable to regulate modular homes any differently than single family dwellings. He said they have 58 requested the owner to survey he lot and stake it to see if the placement was too close to the property line. 59 Mr. Dooley said if the placement if too close to the property line the owners could seek a remedy through 60 the Board of Zoning Appeals by showing a hardship. Mr. Dooley did not feel a hardship existed since the 61 problem would have been created by the owner. He said if the appeal was denied, they would be able to 62 order the removal of the found^tion and the property be filled and graded. 63 64 Mr. Mike Lupe, 803 South 17th told the Council he was a new resident of the community and he would like 65 to see the area be maintained s it is,with uniform lots. � Common Council Minutes Cont'd September 5, 1989 Page 5 1 Mr. Charles Veal, 1704 South G Street, asked how the owners were able to get a permit to place the 2 foundation if they needed to go before two boards for approval. 3 4 Mr. Dooley explained again that this was a modular home, not a manufactured home, and would be treated 5 as any single family dwelling. 6 7 Mr. Veal asked how soon the surveying would be done and Mr. Dooley said it was to be done by the end of 8 this week and that the property had been surveyed once,but they were unable to locate the monuments. 9 10 Mr. Veal shared pictures of the neighborhood and the property in question with the Council. 11 12 Ms. Annette Hall of 948 South 18th Place asked for a clarification on what would happen if the zoning were 13 to be passed and if the other lots owned by the petitioner would have to be rezoned for the placement of 14 manufactured homes or if the one rezoning was sufficient. 15 16 Mr. Dooley said if the zoning were approved,they would be allowed to place one manufactured home on the 17 one lot only,others would also have to be rezoned. 18 19 Ms. Hall asked if the only effect was the placement of the manufactured home or would the rezoning affect 20 the required lot size and Mr. Dooley said the ordinance would not change any requirements on the size of 21 residential lots. 22 23 Ms. Hall asked about the placement of the manufactured home and if it would need a crawl space or a slab 24 and Mr. Dooley said the proposal was to place it on a crawl space and they would fall under the State 25 Building Code for the permanent installation of a manufactured home. 26 27 Ms. Hall asked if the citizens of the area would have recourse if the modular home was not properly installed 28 and Councilmember Morris stated that they job would be inspected while it was being constructed. 29 30 Ms. Hall asked if the manufactured home would withstand high winds like a regular dwelling and Mr. Dooley 31 felt if it were installed properly there would be no problem. 32 33 Ms. Hall asked if once the wheels were removed, could it be removed and Mr. Dooley said it would have to 34 be done in the same fashion as a house. 35 36 Ms. Hall asked about the placement of a garage being structurally sound if adjacent to manufactured or 37 modular homes and Mr. Dooley said it would be fine with the modular home, but a manufactured home 38 would have to be specially designed for that purpose. 39 - 40 Ms. Hall concluded her remarks to Council and requested the neighborhood stay as it is and the placement 41 of the manufactured home not be allowed. 42 43 President Hutton requested a show of hands from those opposed to the rezoning. 44 45 There being no further comments and no one speaking in favor of the Ordinance, Councilmember Brookbank 46 moved for engrossment, seconded by Councilmember Elstro and on unanimous voice vote the motion was 47 carried. 48 49 Councilmember Brookbank moved to suspend the rules and move Ordinance No. 55-1989 to third and final 50 reading and read by title only, seconded by Councilmember Hankinson and on unanimous voice vote the 51 motion was carried. 52 53 The Clerk read Ordinance No.55-1989 on third and final reading by title only. 54 55 Prior to vote, Councilmember Elstro apologized for not being able to return all the phone calls he had 56 received on this issue. 57 58 Councilmember McBride asked what will happen if the zoning is rejected and Mr. Dooley explained that the 59 owners would need to wait one year to petition to rezone this lot again, but they could petition to rezone other 60 lots or place modular homes on the lots. 61 62 Ordinance No.55-1989 was defeated on the following call of the roll: 63 64 Ayes: None. 65 Nay: Elstro, Lundy, Brookbank, Hankinson, McBride, Parker, Morris, Paust and Hutton (9) (a 94 Common Council Minutes Cont'd September 5, 1989 Page 6 1 ORDINANCE NO.58-1989 2 3 The Clerk read on second reading Ordinance No. 58-1989 - AN ORDINANCE VACATING A CERTAIN 4 PUBLIC WAY WITHIN THE CITY OF RICHMOND, INDIANA BEING THAT PORTION OF AN ALLEY 5 RUNNING SOUTH OFF OF NORTH A STREET BETWEEN NORTH 15TH AND NORTH 16TH STREETS. 6 7 The Proof of Publication was examined and found to be in order. She said the request was necessary to get the correct legal description and size of 29 the property sold by Wernle to MP Realty for the low to moderate income housing project on South L Street. 30 She said the only affect was to move the project closer to South L. 31 32 President Hutton announced the Ordinance was on public hearing. 33 34 Mr. Richard Freeman, Freeman Planning and Design, representing MP Realty told the Council that 35 Councilmember Morris did a good job representing the petition and he was available for any questions. 36 37 There being no questions or comments, Councilmember Elstro moved for engrossment, seconded by 38 Councilmember Hankinson and on unanimous voice vote the motion was carried. 39 40 Councilmember Elstro moved to suspend the rules and move Ordinance No. 64-1989 to third and final 41 reading and read by title only, seconded by Councilmember Hankinson and on unanimous voice vote the 42 motion was carried. 43 44 The Clerk read Ordinance No. 64-1989 on third and final reading by title only. 45 46 Ordinance No. 64-1989 was adopted on the following call of the roll: 47 48 Ayes: Elstro, Lundy, Brookbank, Hankinson, McBride, Parker, Morris, Paust and Hutton (9) 49 Nays: None 50 51 ORDINANCE ON THIRD READING 52 53 None were presented. 54 55 COMMENTS FROM THE MAYOR 56 57 Councilmember Elstro asked about the extension of South L Street and Mayor Waltermann the project was 58 on schedule and the bid had been awarded to a local contractor with an anticipated completion time of one 59 year. 60 61 Councilmember Hankinson said the construction signs had gone up today. 62 63 Councilmember Paust asked if there had been any more discussion on further extension of South L Street to 64 Main Street and Mayor Waltermann said there was interest in extending it from Hodgin to Industrial Parkway, 65 but the extension to Main to meet Elks road was not now an active proposal. Z� Common Council Minutes Cont'd September 5, 1989 Page 8 1 Councilmember Paust commented that a lot of the land needed for that extension was now farm land, but 2 the area is experiencing a lot of growth and development. He encouraged the City to take a look at the 3 extension now before further development in the area. He said he would like to see decisions made now, 4 rather than reacting to situations. 5 6 Mayor Waltermann said the Master Plan would be addressing the need for roads and additional 7 infrastructure. 8 9 Mayor Waltermann apologized to the Council for his late attendance at the meeting and explained he had 10 been with Governor Bayh and Ms. Janet McFarland, Grants Administrator. He told the Council the City and 11 Ms. McFarland had received an award for the Most Improved Transit System in the State of Indiana for 1988 12 and this was the first time this award had ever been presented to a rural transit system. 13 14 Mayor Waltermann reminded the Council that in 1983 the transit system was on its last legs and in danger of 15 being dropped as a city service. He said within a short period of time the system came from being a 16 laughing stock to the best in the State. Mayor Waltermann said that Ms. McFarland and Rose View have 17 also been nominated for a National Award. 18 19 Mayor Waltermann spoke of the parachute event at the Airport over the Labor Day Weekend and told the 20 Council that the fuel truck they questioned earlier had been a loaner from the gasoline supplier. He said the 21 transfer and appropriation passed by Council this evening will allow the Airport to replace a 32 year old 22 truck. Mayor Waltermann said that 5,000 gallons of fuel had been pumped over the past three days and the 23 group had asked to come back to the City next year. He added this group of parachuters had come from all 24 over the United Stated and the world and all were professional skydivers. 25 26 Mayor Waltermann announced the appointment of James Sticco as Fire Chief. He also spoke to the litter 27 violations being issued and that they were in response to complaints from Council regarding the filthy 28 conditions of the City. He said the litter ordinance allows for a ticket to be issued immediately and all tickets 29 are accompanied by a photograph and mailed to the property owners by certified mail. He complimented the 30 inspectors on the good job they are doing and that there was a noticeable improvement in a short period of 31 time. 32 33 Mayor Waltermann presented the Council information on the Main Street Bridge and what has transpired to 34 date on the surveys for a new bridge and the disposition of the existing bridge. He told the Council there had 35 been discussion between the County and City over the maintenance of the existing bridge when the State 36 vacates the structure. He added that he had informed the County Commissioners that City Council and the 37 Park Board would be involved in any decisions on the future of the bridge and the City's commitment to the 38 maintenance of the bridge. 39 40 Mayor Waltermann further added that the arches of the bridges in the River Gorge make up part of the 41 Gorge Park and he felt with all working together that a solution could be developed. 42 43 Mayor Waltermann said he would be meeting with the Indiana Department of Highways on September 19, 44 1989 along with Mr. Dooley and Mr. Wiwi with reference to the existing bridge and the conditions of Route 45 40. He said that Route 40 is now overburden with the 1-70 construction and the State prefers to build a new 46 bridge in a different location to alleviate the number of turns involved in the current routing. 47 48 Mayor Waltermann asked the Council to give consideration to the disposition of the old bridge and in light of 49 the statement of the County regarding not wanting to maintain the bridge, to try and impress upon the 50 County that the residents of the City of Richmond are still residents of Wayne County. 51 52 Mayor Waltermann complimemed the Council on their scheduled tour of the Park system and the upgrading 53 accomplished by the bond issJ �. 54 55 ADJOURNMENT 56 57 There being no further businass, on a motion duly made, seconded and passed, the meeting was 58 adjourned. 59 60 61 62 Sarah L.
