RESOLUTION OF THE BOROUGH OF CARTERET, IN THE COUNTY
OF MIDDLESEX APPROVING AGREEMENT REGARDING SPECIAL _
IMPROVEMENT DISTRICT PAYMENTS
WHEREAS, Kinder Morgan, owner of the property designated as Block 503, Lot 3
the Borough's tax map (the `Property"), agreed to make Special Improvement District payout
to the Borough in connection with the Property, for tax years 2014 and 2015, as set forth in i
certain letter, dated April 28, 2015, from Drinker Biddle & Reath, LLP, counsel to Kin
Morgan addressed to McManimon, Scotland & Baumann, LLC, counsel to the Borough
"Letter Agreement "); and
WHEREAS, the Borough desires to approve the execution of the Letter Agreement.
NOW, THEREFORE, BE AND IT IS HEREBY RESOLVED by the Mayor and
Council of Borough of Carteret, in the County of Middlesex and the State of New Jersey, as
follows:
Section 1. The aforementioned recitals are incorporated herein as though fully set
forth at length.
Section 2. The Borough hereby authorizes the Mayor to execute the Letter
Section 3. This resolution shall take effect irmnediately.
