PROCEEDINGS OF THE COMMON COUNCIL OF THE
CITY OF RICHMOND, INDIANA, OCTOBER 3, 1988
1 The Common Council of the City of Richmond, Indiana met in regular session October 3,1988 at the hour of
2 7:30 P.M. in the Council Chambers in said City. President Morris presided with the following Councilmembers
3 present: Elstro, Williams, Hankinson, McBride, Parker, Hutton, and Paust. Absent: Brookbank. The
4 following business was had to-wit:

12 President Morris announced that Councilmember Brookbank was part of a delegation visiting the USSR and
13 should be returning this evening.

15 APPROVAL OF MINUTES OF SEPTEMBER 19 1988

17 Councilmember Hankinson moved to approve the minutes of the previous meeting as prepared, seconded
18 by Councilmember McBride and on unanimous voice vote the motion was carried.

20 COMMUNICATIONS FROM THE MAYOR

22 Mayor Frank H.Waltermann read the following Proclamation from Governor Orr:
23
24 To all who shall see these presents. Greetings: -
25
26 Whereas, It is my desire to recognize those efforts which further the cause of international
27 friendship and understanding between the citizens of the State of Indiana and the peoples from
28 throughout the world;and
29
30 Whereas, The City of Richmond, Indiana has achieved distinction for the development of
31 outstanding economic, cultural and educational ties with their Sister City in the Soviet Union,
32 Serpukhov; and
33
34 Whereas, It is apropos that the City of Richmond be honored for their exemplary efforts in
35 international cooperation and understanding through citizen involvement and community
36 participation; and
37
38 Whereas, those things which contribute to the betterment of our human society merit recognition
39 and award;
40
41 Now,Therefore, I Robert D. Orr, Governor of the State of Indiana,do hereby commend the officials
42 and citizens of the City of Richmond for the mutually-shared benefits this exchange brings to
43 educational and cultural awareness as well as commercial and professional development in our
44 great Hoosier state.

48 Councilmember Hutton asked about mowing of weeds and Mayor Waltermann said the budget is depleted,
49 but there will be volunteers assisting with some mowing.

51 Councilmember Paust asked if this included the clean up of the South 9th and 10th median in the Service
52 Drive and Mayor Waltermann explained that the man that had cleaned this area up had died and he would be
53 looking for a replacement.

55 REPORTS FROM OTHER OFFICES

57 Human Services Office - John Guffy
58
59 Mr. John Guffy, Ombudsman for the Human Services Office, spoke to the Council regarding the problem of
60 homeless in Richmond. Mr. Guffy explained that he had worked with the Home Equity Program and found
61 that to be addressing the concerns of the elderly homeowner, but in his capacity most problems being
62 brought to his attention are homeless conditions. He said the lack of affordable, safe housing is a real
63 problem and his cases are mostly mothers and children without housing. Mr. Guffy stressed the need to
64 bring agencies and people together and address the problem.

1 President Morris asked if there was a need for transitional housing and Mr. Guffy said there was and also
2 support services were needed.

4 Councilmember Hankinson asked what the Church's were doing to address the problem and Mr. Guffy
5 explained they were doing very little.

7 President Morris stated the Church's might take care of one or two families within their congregation.

9 Councilmember Elstro asked about the Housing Authority and their ability to issue additional Section 8
10 certificates and Mr. Guffy said that the Authority had stopped accepting applications for Section 8 since
11 they had no available units and a waiting list. He said he was currently looking into Section 8 rules.

13 Councilmember Paust said the Housing Authority has more capabilities of looking into the problem and they
14 are getting funding to address the problem. He said if the need is catching up,they are the established body
15 to address the issue. •

17 Mary Merchanthouse, City Clerk, stated that six to ten people are in her office weekly looking for housing.
18 She said there is very little available and that the Housing Authority is making referrals to the City, along with
19 other agencies such as the Trustee,Welfare and Community Action. She also said there was a need for
20 transitional housing.

22 Councilmember Williams reminded the Council of the upcoming Housing Authority meeting and asked that
23 other members of the Council come and express their concerns.

25 Mayor Waltermann told the Council that he had promised an Ordinance controlling absentee landlords and
26 the conditions of rental properties in the community, but has been unable to act on that promise due to the
27 number of homeless and the fact that condemning buildings will only put more persons on the streets. He
28 said he currently is looking at using manufactured housing on vacant properties to offer transitional housing
29 and also reasonably priced permanent housing. The Mayor explained that Federal legislation recently
30 passed will now allow federal funds to be used for manufactured housing.

32 Councilmember Elstro agreed there was a problem and a need, but felt the Housing Authority should be
33 working on the problem.

35 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY

37 Councilmember Paust asked about the South 9th Street complaint and Mr. Barden said the proceedings are
38 now being handled through a law suit and are supposed to be final within 45 days.

40 Councilmember Elstro asked if the person could be fined if he did not comply with the zoning regulations and
41 Mr. Barden explained there were no fines in the Zoning Ordinance, and he can still use the accessory
42 building in a commercial manner if he uses it properly. He said the law suit can make him come into
43 compliance and the person is taking the necessary steps and feel he will have all the appropriate paperwork
44 in 45 days. It is necessary to get a variance and meet State Building regulations and if he does not,then the
45 City can take further action.

47 Councilmember Paust asked if the State plans had to address fumes and Mr. Barden said they would include
48 the proper guidelines for proper enclosures. Councilmember Paust also asked about sanding at 11:00 and
49 12:00 at night and Mr. Dan Dooley said the was not aware of the hours of operation,but the City does have a
50 Noise Control Ordinance that could address that problem.

52 Mr. Barden added that he would be meeting with his attorney and would mentioned the working late at night.

54 Mr. Barden also informed the Council that Ms. Carrie Hauptstueck had been appointed to the Board to
55 replace Mr.John Brown who had resigned.

57 Councilmember Paust asked about the East Main Street Project and if the City could hurry the project along
58 by writing to the State. Mr. Barden said that he had spoken with the Highway Commission and they are
59 proceeding with the purchase of right of way. He said they have purchased 93 parcels and have seven staff
60 members working on that project currently. He added that all requirements on the land acquisition have to
61 be met before any bidding of the project can proceed.

17 RICHMOND TO MAKE FULL APPLICATION FOR AN INVESTMENT INCENTIVE PROGRAM GRANT,AND
18 AUTHORIZING THE MAYOR TO SIGN AND SUBMIT SUCH APPLICATION TO THE INDIANA DEPARTMENT
19 OF COMMERCE, EXECUTE THE GRANT AGREEMENT AND TO EXPEND THE GRANT FUNDS, IN
20 ACCORDANCE WITH THE PROVISIONS OF THE GRANT AGREEMENT.

22 Economic Development Director,Jim Kinnett explained the grant was for Landis Plactics and the purchase of
23 equipment.

31 RICHMOND TO MAKE APPLICATION FOR THE PURPOSE OF BORROWING NINETY THOUSAND AND
32 00/100 DOLLARS ($90.000) FROM THE STATE OF INDIANA INDUSTRIAL DEVELOPMENT LOAN FUND;
33 AND AUTHORIZES THE MAYOR OF THE CITY OF RICHMOND, FRANK H.WALTERMANN,TO ACT AS THE
34 AUTHORIZED REPRESENTATIVE OF THE CITY OF RICHMOND, INDIANA FOR THE PURPOSE OF
35 SECURING SAID LOAN;AND,THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA HEREBY

48 SISTER CITIES DAY IN RICHMOND, INDIANA.

50 Ms. Eleanor Turk, President of the Sister Cities Committee, spoke of celebrating the 5th anniversary of
51 launching the Sister Cities Program in Richmond. She said they will be using this event to encourage
52 community support of the program and asked for the support of the Common Council.

43 Speaking for Ordinance No. 70-1988 was Mr. Dean Bostrom, Park Superintendent. Mr. Bostrom explained
44 they were requesting an amendment to the salary ordinance in accordance with the Park Master Plan and
45 the move to make the Park provide more people services. He said they would be using two unfilled positions
46 to accomplish this for the balance of 1988.

19 THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE ZONING
20 ORDINANCE OF THE CITY OF RICHMOND, INDIANA, PROVIDING FOR THE REZONING OF THE
21 PROPERTY LOCATED AT 2200 U.S. HIGHWAY 27 SOUTH, FROM R-2 SINGLE FAMILY RESIDENCE
22 DISTRICT TO C-2 COMMERCIAL DISTRICT.

24 President Morris noted that the Ordinance was the companion ordinance for No. 63 and established
25 allowable uses for an expansion of Belden.

27 The Council noted that the title of the Ordinance needed to be amended to read 2000 and not 2200 to
28 correspond with the body of the ordinance. Councilmember Hankinson so moved, seconded by
29 Councilmember Elstro and on unanimous voice vote the motion was carried.

31 President Morris announced Amended Ordinance No. 64-1988 was on public hearing.

33 Speaking for Ordinance No. 64-1988 was Mr. Gayle Gardner, Attorney at Law, representing Cooper
34 Industry, Inc. and Belden. Mr.Gardner explained that the zoning was to allow a technical research center to
35 be located in Richmond and would employ 75 new persons. He said it would be a 69 sq.ft. addition to the
36 existing building and additional parking and would be a 4,500,000. project. Mr.Gardner said this was a good
37 positive opportunity for the City and that Mr. Ken Lear was in attendance if the Council had further
38 questions.

41 Councilmember Williams and on unanimous voice vote the motion was carried.

43 Councilmember Hankinson moved to suspend the rules and move Amended Ordinance No. 64-1988 to third

45 motion was carried.

1 Speaking for Ordinance No. 68-1988 was Mr. David Carter, representing the Fraternal Order of Police. Mr.
2 Carter informed the Council that the FOP supported the changes the Ordinance made to the Merit
3 Commission.

5 There being no further questions, Councilmember Hankinson moved for engrossment, seconded by
6 Councilmember Parker and on unanimous voice vote the motion was carried.
