PROCEEDINGS OF THE COMMON COUNCIL OF THE
CITY OF RICHMOND. INDIANA.OCTOBER 19.1987
1 The Common Council of the City of Richmond, Indiana met in regular session October 19, 1987 at the hour of
2 7:30 P.M. in the Council Chambers in said City. President Brookbank presided with the following
3 Councilmembers present: Elstro, Williams, Hankinson, Whitesell, Parker, Hutton,and Morris. Absent:
4 Theobald. The following business was had to-wit:

12 Councilmember Hankinson moved to approve the minutes of the previous meetings as prepared, seconded
13 by Councilmember Whitesell and on unanimous voice vote the motion was carried.

15 COMMUNICATIONS FROM THE MAYOR

17 Mayor Frank H. Waltermann spoke to the Council regarding the E 9-1-1 and the importance of persons
18 returning their information cards so the information can be entered into the data base to assist in getting the
19 proper emergency assistance. He requested the media to assist in getting the message to the public.

21 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY

23 Vice President John Brown reported the Board had awarded the bid for the Fire Department Rescue Vehicle
24 and the Bus Bench Advertising with the contract going to the Indiana Football Hall of Fame.

26 Mr. Brown stated the Board had also signed the contract with Firefighters Local 1408 for the year 1988 and
27 would be presenting an ordinance to council soon to ratify both the Police and Fire Contracts.

29 Mr. Brown said the Board had received notice the Sanitary Wastewater Plant had been awarded the Plant of
30 the Year Award in their class.

32 Councilmember Parker asked about a water problem in the alley behind SW 4th Street stemming from the
33 alley behind of Cox's. He said the alley has cracks and absorbing water which is filling up basements in the
34 area. Councilmember Parker said the alley between SW 3rd and SW 4th had been paved and now we need to
35 pave this alley.

37 Councilmember Hutton stated she had spoken with Mr. Hillard and the alley will be paved next year.

39 Councilmember Elstro reminded the Board he was still concerned with the condition of the C&O tracks on L,
40 M, N, etc.

47 Councilmember Whitesell reported the Public Works and Safety Committee had met on Ordinance No. 54-
48 1987 and will be meeting again on October 23, 1987 at 12:00 noon for the discussion of amendments in
49 order that the ordinance can be re-written and presented to Common Council at its meeting of November 16,
50 1987.

56 Councilmember Brookbank reported the Humanity in Medicine Award had been presented to Olin Wiland.

60 President Brookbank welcomed the Richmond High School government students in attendance.

62 Sister City Contract

64 Ms. Eleanor Turk, 712 S.W. 18th Street spoke to the Council regarding the contract for a Sister City program
65 with Serpukov, USSR. Ms.Turk is the Chairman of the Richmond-Serpukov Sister City Committee and

1 reminded the Council they were acting under a Resolution passed in December of 1983 for the sister city
2 relations to be pursued.

4 Ms. Turk presented the Council a draft of a contract brought back by the Richmond delegation that had
5 visited in August and commented the program would strengthen peace and friendship worldwide.

7 Ms. Turk announced the Serpukov delegation will hopefully visit Richmond in May and will be presented to
8 the Common Council at that time.
9
10 Ms.Jewell Spears told the Council she was pleased to be a part of the Richmond delegation to Serpukov and
11 found the people warm and friendly.

13 Mr. Ed Brumbaugh told of the educational value of the visit and that many stereotypes had been destroyed.
14 He also spoke of business opportunities.

16 Mr. Wayne Vincent told the Council the arts are forwarding and have a lot of state support. He said he is
17 very proud of the relationship, but he would expect that of Richmond.

19 Ms. Turk invited all the Council to look at the displays at the library and added that the Museum will do a
20 Sunday program. Ms.Turk said they will be incorporating as a formal Sister City Committee.

24 Councilmember Morris moved to suspend the rules and read Resolutions No. 11 and 12-1987 by title only,
25 seconded by Councilmember Elstro and on unanimous voice vote the motion was carried.

29 The Clerk read by title only Resolution No. 11-1987-A RESOLUTION OF THE COMMON COUNCIL OF THE
30 CITY OF RICHMOND. (ECONOMIC DEVELOPMENT BONDS)

32 Speaking for Resolution No. 11-1987 was Mr.Andrew Cecere of Bowen and Cecere, 101 South 10th Street,
33 representing Primex in the issuance of bonds for expansion. Mr. Cecere said this was a reaffirmation of a
34 decision made in 1979 to locate in this City. Mr. Cecere said they would be expanding their facility in our
35 community and are requesting authorization for the sale of 4,000,000.00 in bonds.

37 Mr.Cecere informed the Council of the improvements made to the area around North F and 15th Streets and
38 the fact that the expansion will add 60 new jobs with one million a year in additional payroll. He introduced
39 Mr. Paul Bertsch to the Council.

41 Councilmember Williams stated they have been a good neighbor in the area and the additional jobs will be an
42 asset to the community.

44 Councilmember Parker agreed with Councilmember Williams and asked if there were other similar producers
45 in the community.

47 Mr. Bertsch stated the only competition was in Texas and Canada.

49 Councilmember Parker asked about the Economic Development Resolution having a preliminary finding on
50 any adverse effect and Mr. Cecere explained the public hearing requirements for the bonds and time
51 limitations for publication excluded making a final finding and this will be presented in the hearing for the
52 Ordinance to presented on the sale of the bonds.

54 There being no further discussion, Councilmember Elstro moved for adoption of Resolution No. 11-1987,
55 seconded by Councilmember Parker and on unanimous voice vote the motion was carried.

59 The Clerk read by title only Resolution No. 12-1987 - A RESOLUTION AUTHORIZING THE CITY OF
60 RICHMOND TO MAKE FULL APPLICATION FOR AN INVESTMENT INCENTIVE PROGRAM GRANT,AND
61 AUTHORIZING THE MAYOR TO SIGN AND SUBMIT SUCH APPLICATION TO THE INDIANA DEPARTMENT
62 OF COMMERCE.

64 Mayor Waltermann explained the Resolution was to meet State requirements to submit a grant application
65 for infrastructure improvements.

24 Mr.Jay Mikesell,Airport Manager, informed the Council the transfer was to pay additional insurance costs to
25 cover the increase in liability insurance.

27 Councilmember Elstro moved for engrossment of Ordinance No. 59-1987, seconded by Councilmember
28 Whitesell and on unanimous voice vote the motion was carried.

20 Councilmember Parker asked about contracting for the mowing and Ms. Sweet explained the City cannot
21 enter into a contract with city employees.

42 The Clerk read on second reading Ordinance No.51-1987-AN ORDINANCE AMENDING CHAPTER 97 OF
43 THE RICHMOND CITY CODE TO CREATE A STREET TREE COMMITTEE AS A PERMANENT STANDING
44 COMMITTEE OF THE RICHMOND PARKS AND RECREATION BOARD.

46 The Clerk examined the Proof of Publication and found it to be in order. Councilmember Parker moved to
47 accept and file the Proof of Publication, seconded by Councilmember Morris and on unanimous voice vote
48 the motion was carried.

50 The Ordinance was requested to be striken following discussion with the Park Board.

52 Councilmember Elstro moved to strike Ordinance No. 51-1987, seconded by Councilmember Morris and on
53 unanimous voice vote the motion was carried.

58 VICIOUS DOGS.

60 President Brookbank stated the Ordinance would be held on second reading for the meeting of November
61 16, 1987, but the advertised public hearing will be held tonight.

63 Councilmember Morris presented the Council with a petition in favor of the Ordinance containing 285
64 signatures.

1 The Clerk examined the Proof of Publication and found it to be in order. Councilmember Williams moved to
2 accept and file the Proof of Publication, seconded by Councilmember Parker and on unanimous voice vote
3 the motion was carried.

5 Speaking for the Ordinance was a person residing in the Meadowbrook area. She stated she would like to
6 have pit bulls specifically included in the ordinance. She said since March the persons residing in that area
7 had been unable to get out in the neighborhood because of the dangers of pit bulls located there. She
8 reported she had seen the dogs attack other animals and had witnessed the dogs being hung from trees fro
9 time to time. She said the owners are irresponsible and have taken away their right to feel safe.

11 Another neighbor also spoke for the ordinance saying that pit bulls are bread specifically for aggressive
12 behavior and she would like to see them named specifically in this ordinance.

14 Another neighbor reported to the Council about an article on deaths attributed to pit bulls and that they are
15 more likely to inflict damage since they are likely to tear flesh. She added they feel their rights have been
16 taken away from them to enjoy their homes and neighborhood.

18 An individual living in Meadow Park told the Council about pit bulls in their area that she had the Humane
19 Society looking into.

21 Another resident of the Meadowbrook area told the Council that families with young children are terrified and
22 frustrated not only with the dogs, but with the owners also. She ask Council to move as quickly as possible
23 and that November 16, 1987 seemed a long time away for these young mothers.

25 Councilmember Hankinson asked if there was a vet in the audience and was informed that Dr. Blakey had
26 requested it be held in order that she could be in attendance.

28 Councilmember Hankinson asked when viciousness develops in dogs or should the Council be looking at the
29 owners and the training of the animals.

31 President Brookbank added that Dr. Blakey had stated that any dog with its adrenaline pumping could be
32 vicious.

34 Ms.Carol Kimbrough informed the Council she was a new resident of Richmond and was very impressed with
35 the Sister City Program and the progressive atmosphere of the City. She said she is a breeder and trainer of
36 dogs and she felt for the neighbors involved. She said any dog improperly taken care of can be dangerous,
37 but breeders do breed for certain qualities and she felt uncomfortable with saying that proper neutering could
38 undo breeding. Ms. Kimbrough said that the ordinance needs penalties for owners and trainers, but don't
39 discount breeding. She complimented the counsel for their concern.

41 A member of the Meadowbrook neighborhood informed the Council that they had been the dogs off the
42 property and had seen the dog attack with no provocation.

44 Another Meadowbrook resident said he would not have moved into the area if he had known the situation and
45 he felt he would not be able to control the dogs to get off a child if one was attacking.

47 Councilmember Parker said they do have a real problem and asked for a show of support from persons in
48 attendance.

50 Councilmember Morris said no issue has frustrated her more and she is unable to protect the people and the
51 Council must pass an aggressive ordinance.

53 Councilmember Williams said he has had some complaints in his district with pit bulls getting out, breaking
54 chains and windows. He asked if this could be investigated with the animal control officer and find out the
55 varieties of dogs involved in bites and attacks.

5 Councilmember Hutton reported this subject had been addressed at the Park Board and there had been a
6 delegation in attendance with several ideas and plans. They will be returning at the next meeting to discuss
7 a location and the Park Board was pleased with their presentation and will hopefully be able to assist.
