INDIANA.OCTOBER 5. 1987 • 1 The Common Council of the City of Richmond, Indiana met in regular session October 5, 1987 at the hour of 2 7:30 P.M. in the Council Chambers in said City. President Brookbank presided with the following 3 Councilmembers present: Elstro, Williams, Hankinson, Whitesell, Parker, Hutton, Morris and Theobald. 4 Absent:None. The following business was had to-wit: 5 6 PLEDGE OF ALLEGIANCE 7 8 SILENT DEVOTIONS 9 10 APPROVAL OF MINUTES OF SEPTEMBER 21.1987 11 12 Councilmember Hankinson moved to approve the minutes of the previous meetings as prepared, seconded 13 by Councilmember Hutton and on unanimous voice vote the motion was carried. 14 15 COMMUNICATIONS FROM THE MAYOR 16 17 Mayor Frank H. Waltermann informed the Council that he had met with the new Mr. Tom Ehrlich, newly 18 appointed President of Indiana University. He said they asked for support of the local campus and were 19 interested in expanding programs locally. Mayor Waltermann said he was pleased to met Mr. Ehrlich and 20 hear the goals for the entire eight campus system. 21 22 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY 23 24 President Susan Silberstein reported the Board had set the date for hearings on unsafe properties located 25 at 321 North 13th,901 North I and 444 South 7th. The hearings will be October 22, 1987. 26 27 Ms. Silberstein told the Council the Board had approved an additional handicapped parking space on North 28 9th Street and received bids for the Fire Department Rescue Unit. 29 30 Ms. Silberstein reported that the insulation problem at Glazers will be removed and no additional insulation 31 will be placed there. 32 33 Mr. Elstro asked the conditions of the railroad crossings on South L, M, N and 0 be looked into and Ms. 34 Silberstein said the Board would investigate. 35 36 REPORTS FROM SPECIAL COMMITTEES 37 38 PUBLIC SAFETY 39 40 Councilmember Whitesell reported the Public Works and Safety Committee had met on Ordinance No. 54- 41 1987 and will meet for further discussion on October 16, 1987 at 12:00 noon in the Community Room. 42 43 REPORTS FROM STANDING COMMITTEES 44 45 FREID HOSPITAL 46 47 Councilmember Brookbank reported that the previous month had been profitable for Reid Hospital and they 48 were now asking the staff to look at budgetary matters with the current profitable status. The Board will also 49 be looking at new appointments. 50 51 URBAN ENTERPRISE ZONE 52 53 There will be a meeting of the Urban Enterprise Zone on October 6, 1987 at 7:30 PM in the Board of Works 54 Room in the Municipal Building. 55 56 MISCELLANEOUS BUSINESS 57 58 Mr. David Greene of 535 Commerce Road spoke to the Council regarding seeing a City employee erecting 59 political signs. 60 61 Mr. Greene also requested the Council to investigate the possibility of insurance for Reserve Officers and 62 added he had spoken with the City's insurance carrier and had been informed insurance was available at a 63 premium of 269.00 to 272.00 per man. 64 65 Mr. Elstro commented that the employee in question had taken vacation days off to help in the campaign. .O(9— Common Council Minutes Cont'd October 5, 1987 Page 2 1 Mayor Waltermann also commented that this employee was taking time off due extra time worked in the 2 recent week end neighborhood clean up. 3 4 Councilmember Williams commented that the Board of Works would control the reserve officers and the 5 insurance problem, not the Common Council. 6 7 Mr. Barden stated he had heard some rumors regarding information from his office. He asked Mr. Greene 8 who he talked with at the insurance company and stated he felt they needed more facts in order to give out 9 accurate information on insurance for reserve officers for the City of Richmond. 10 11 Mr. Greene commented that Mayor Waltermann had stated if insurance was available for the reserves,the 12 City would get the insurance. 13 14 Mr. Barden commented the facts need to be considered regarding cost vs. benefits and if the insurance is 15 feasible to obtain. 16 17 Mr.Greene said the savings in overtime for the Police Department would outweigh the cost of the insurance. 18 19 Appointments to Street Tree Commission 20 21 President Brookbank announced the Council needed to make two appointments to the Street Tree 22 Commission to fill an unexpired term and to replace a one year appointment. 23 24 Councilmember Morris moved to appoint Lorrie Foust to the Street Tree Commission to fill the unexpired two 25 year term of David Stevens, seconded by Councilmember Elstro and on unanimous voice vote the motion 26 was carried. 27 28 Councilmember Hutton moved to nominate Kenny Hendricks as the one year appointment to the Street Tree 29 Commission,seconded by Councilmember Morris and on unanimous voice vote the motion was carried. 30 31 Councilmember Parker requested Mr. Barden to get information regarding the cost of the insurance for 32 reserve officers. 33 34 Mr. Barden stated he was not personally pleased with the insurance the City currently has because of a very 35 high deductible. He said the insurance for the City is handled by an Insurance Committee, but he will find out 36 the information. 37 38 RESOLUTIONS 39 40 Councilmember Morris moved to suspend the rules and read Resolutions No. 9 and 10-1987 by title only, 41 seconded by Councilmember Whitesell and on unanimous voice vote the motion was carried. 42 43 RESOLUTION NO.9-1987 44 45 The Clerk read by title only Resolution No. 9-1987-A RESOLUTION AUTHORIZING AN APPEAL TO THE 46 STATE BOARD OF TAX COMMISSIONERS FOR RELIEF FROM PROPERTY TAX LEVY LIMITATIONS. 47 48 Speaking for Resolution No. 9-1987 was City Controller, Marge Sweet. Ms. Sweet stated this was a formality 49 to appeal for excess levy and would be based on the water rate increase. 50 51 Councilmember Elstro moved for adoption of Resolution No. 9-1987, seconded by Councilmember Williams 52 and on unanimous voice vote the motion was carried. 53 54 RESOLUTION NO.10-1987 55 - 56 The Clerk read by title only Resolution No. 10-1987-A RESOLUTION OF THE COMMON COUNCIL OF THE 57 CITY OF RICHMOND AUTHORIZING THE CITY OF RICHMOND TO CARRY INSURANCE ON BEHALF OF THE 58 RICHMOND URBAN ENTERPRISE ASSOCIATION AND THE GREATER RICHMOND PROGRESS 59 COMMITTEE AND TO NAME THOSE INSTITUTIONS AS ADDITIONAL INSUREDS ON ALL CITY OF 60 RICHMOND INSURANCE POLICIES. 61 62 Mr. Barden explained the Resolution would add no cost to the insurance premium of the City, but was only to 63 give the insurance company something in writing to add these two entities to our policy since they are 64 corporate entities on their own. 65 ,57-`5 Common Council Minutes Cont'd October 5, 1987 Page 3 1 Councilmember Elstro moved for adoption of Resolution No. 10-1987, seconded by Councilmember Hutton 2 ad on unanimous voice vote the motion was carried. 3 4 ORDINANCES 5 6 ORDINANCES ON FIRST READING 7 8 Councilmember Morris moved to suspend the rules and read Ordinance No. 57 and 58-1987 on first reading 9 by title only,seconded by Councilmember Parker and on unanimous voice vote the motion was carried. 10 11 ORDINANCE NO.57-1987 12 13 The Clerk read on first reading by title only Ordinance No.57-1987-AN ORDINANCE AMENDING CHAPTER 14 154 OF THE MUNICIPAL.CODE, BEING ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE 15 ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA PROVIDING FOR THE REZONING OF 16 PROPERTY LOCATED AT 2906 EAST MAIN STREET FROM R-3 ONE-TO-EIGHT FAMILY RESIDENCE 17 DISTRICT AND R-2 SINGLE FAMILY RESIDENCE TO R-3 SU AND R-2 SU AND PROVIDING FOR THE 18 SPECIAL USE OF SAID PROPERTY AS AN ACCESSORY OFF-STREET PARKING FACILITY. 19 20. President Brookbank announced Ordinance No.57-1987 would be assigned to Plan Commission. 21 22 ORDINANCE NO.58-1987 23 24 The Clerk read on first reading by title only Ordinance No.58-1987-AN ORDINANCE AUTHORIZING THE 25 SALE OF CERTAIN LAND IN GLEN MILLER PARK TO NORFOLK AND WESTERN RAILWAY COMPANY. 26 27 Councilmember Elstro moved to suspend the rules and move Ordinance No. 58-1987 to second reading, 28 seconded by Councilmember Morris and on unanimous voice vote the motion was carried. 29 30 The Clerk read Ordinance No.58-1987 on second reading. 31 32 President Brookbank announced Ordinance No.58-1987 was on public hearing. 33 34 Mr. Barden explained to the Council that the property would be sold to the railroad for drainage 35 improvements. He said it was 1/10th of an acre and the sale price was 1,500.00. The area is an old dumping 36 site for the park and not used for recreation. 37 38 There being no public comment, Councilmember Hankinson moved for engrossment of Ordinance No. 58- 39 1987,seconded by Councilmember Hutton and on unanimous voice vote the motion was carried. 40 41 Councilmember Whitesell moved to suspend the rules and move Ordinance No. 58-1987 to third and final 42 reading and read by title only,seconded by Councilmember Parker and on unanimous voice vote the motion 43 was carried. 44 45 Ordinance No.58-1987 was adopted on the following call of the roll: 46 47 Ayes: Elstro,Williams, Hankinson,Whitesell, Parker, Hutton, Morris,Theobald and Brookbank (9) 48 Nays: None 49 50 ORDINANCES ON SECOND READING 51 52 ORDINANCE NO.52-1987 53 54 The Clerk read on second reading Ordinance No.52-1987-AN ORDINANCE AMENDING SECTION 74.99 OF 55 THE RICHMOND CITY CODE AS IT APPLIES TO CERTAIN PENALTIES. 56 57 Mr. Barden examined the Proof of Publication and fond it to be in order. Councilmember Parker moved to 58 accept and file the Proof of Publication, seconded by Councilmember Hankinson and on unanimous voice 59 vote the motion was carried. 60 61 President Brookbank announced Ordinance No.52-1987 was on public hearing. 62 63 Councilmember Parker asked about the fine regarding riding bicycles against the flow of traffic and 64 commented that children are also taught to ride and walk against traffic for safety reasons. 65 h, Common Council Minutes Cont'd October 5, 1987 Page 4 1 Mr. Barden stated that State Law requires they go with the flow of traffic because of the wobbliness of the 2 bicycle. 3 4 Councilmember Parker stated he felt the ordinance setting violations was not a good ordinance and 5 penalized persons for being safe. 6 7 Mr. Barden said the section was included in this Ordinance to allow officers to ticket for 5.00 instead of 2.00 8 and was not intended of a higher evaluation of state law. 9 10 Councilmember Parker said he also questioned the section regarding riding on sidewalks since in some 11 instances that was also a safety measure. 12 13 Councilmember Morris asked if the intent was not mostly to keep bicycles off the promenade and Mr. Barden 14 said that was the biggest offending area and if the Council would like he would look at the violation 15 ordinance, but recommended passage of this ordinance since it deals with fees. 16 17 There being no further comment, Councilmember Hankinson moved for engrossment of Ordinance No. 53- 18 1987,seconded by Councilmember Elstro and on unanimous voice vote the motion was carried. 19 20 Councilmember Elstro moved to suspend the rules and move Ordinance No. 52-1987 to third and final 21 reading,seconded by Councilmember Parker and on unanimous voice vote the motion was carried. 22 23 The Clerk read Ordinance No.52-1987 on third and final reading by title only. 24 25 Ordinance No.52-1987 was adopted on the following call of the roll: 26 27 Ayes: Elstro,Whitesell, Parker,Hutton,Morris,Theobald and Brookbank (7) 28 Nays: Williams and Hankinson (2) 29 30 ORDINANCE NO.53-1987 31 32 The Clerk read on second reading Ordinance No.53-1987-AN ORDINANCE AMENDING SECTION 70.23 OF 33 THE RICHMOND CITY CODE AS IT APPLIES TO USE OF SKATEBOARDS,ROLLER SKATES AND SIMILAR 34 DEVICES. 35 36 Mr. Barden examined the Proof of Publication and found it to be in order. Councilmember Morris moved to 37 accept and file the Proof of Publication, seconded by Councilmember Whitesell and on unanimous voice 38 vote the motion was carried. 39 40 President Brookbank announced the Ordinance was on public hearing. 41 42 Councilmember Whitesell asked for an explanation for the benefit of three young men in attendance. 43 44 Mr. Barden stated it only applied to the promenade area and public streets. 45 46 Speaking against Ordinance No. 53-1987 was Mr. Marty Belcher, 336 North 21st. Mr. Belcher informed the 47 Council that the sidewalks are all bumpy and more dangerous than the streets. 48 49 Mr. Van Pelt of 3025 Backmeyer Road told the Council that if they are not permitted to ride on the streets, 50 then the City should consider providing an area in which to ride skateboards. 51 52 Councilmember Parker stated they had a valid point and sound like something to investigate. 53 54 Mr. Barden stated that both the Police Departments and the Park Departments requested the Ordinance. 55 56 Mr. Ralph Willis of 3812 Oakview Drive said there are areas without sidewalks and the City cannot afford to 57 build these sidewalks. He said the City should consider marking designated areas and broaden the 58 shoulders of certain city streets to accommodate bicycles and skateboards. 59 60 Councilmember Morris commented on the dangerous of skateboards in certain traffic areas. 61 62 There being no further public comment, Councilmember Hankinson moved for engrossment, seconded by 63 Councilmember Elstro and on a voice vote the motion was carried. 64 65 Councilmember Morris requested the Ordinance be held for third and final reading since she felt it had not .57.E Common Council Minutes Cont'd October 5, 1987 Page 5 1 been looked at closely enough. She suggested that persons with comments should contact the 2 Councilmembers. 3 4 Councilmember Hutton also suggested contacting the members of the Park Board since they were having a 5 meeting next Wednesday. 6 7 ORDINANCE NO.55-1987 8 9 The Clerk read on second reading Ordinance No.55-1987-AN ORDINANCE AMENDING SECTION 70.21 OF 10 THE RICHMOND CITY CODE TO PROVIDE FOR VIOLATIONS OF INFRACTIONS RATHER THAN 11 VIOLATIONS OF MISDEMEANORS. 12 13 Mr. Barden examined the Proof of Publication and found it to be in order. Councilmember Morris moved to 14 accept and file the Proof of Publication , seconded by Councilmember Parker and on unanimous voice vote 15 the motion was carried. 16 17 President Brookbank announced the Ordinance was on public hearing. 18 19 Speaking for Ordinance No. 55-1987 was Mr. Barden. Mr. Barden explained this was a housekeeping 20 ordinance in compliance with state law. 21 22 There being no further comment, Councilmember Morris moved for engrossment, seconded by 23 Councilmember Theobald and on unanimous voice vote the motion was carried. 24 25 Councilmember Morris moved to suspend the rules and move Ordinance No. 55-1987 to third and final 26 reading and read by title only, seconded by Councilmember Whitesell and on unanimous voice vote the 27 motion was carried. 28 29 The Clerk read Ordinance No.55-1987 on third and final reading by title only. 30 31 Ordinance No.55-1987 was adopted on the following call of the roll: 32 33 Ayes: Elstro,Williams, Hankinson,Whitesell, Parker, Hutton, Morris,Theobald and Brookbank (9) 34 Nays: None 35 36 APPROPRIATION ORDINANCE NO.56-1987 37 38 The Clerk read on second reading Ordinance No. 56-1987-AN ORDINANCE TO APPROPRIATE WITHIN 39 THE LOCAL ROAD AND STREET FUND. 40 41 Mr. Barden examined the Proof of Publication and found it to be in order. Councilmember Morris moved to 42 accept and file the Proof of Publication,seconded by Councilmember Whitesell and on unanimous voice vote 43 the motion was carried. 44 45 President Brookbank announced the Ordinance was on public hearing. 46 47 Councilmember Morris asked if this 60,000.00 was in addition to the original 40,000.00 appropriated and Mr. 48 Willis indicated it was additional funds. 49 50 Councilmember Whitesell asked if this would be spent for right of way conclusion and Mr.Willis explained the 51 original funds requested were based on an appraisal by person not pre-qualified by the State and some 52 persons also promised right of way at no cost to the City. Mr. Willis said the State rules have now changed 53 and the City must now have qualified appraisers and property originally thought to be free would now cost 54 28,000.00. - 55 56 Mr.Willis said they were operating on the premises that the original appraisals were valid,but now they must 57 set aside additional funds in order that they are available prior to making gestures to purchase of condemn. 58 He added that if certain guidelines are not met,the City will not qualify for the 75%match. 59 60 There being no further public comment, Councilmember Elstro moved for engrossment, seconded by 61 Councilmember Parker and on unanimous voice vote the motion was carried. 62 63 Councilmember Whitesell moved to suspend the rules and move Ordinance No. 56-1987 to third and final 64 reading and read by title only, seconded by Councilmember Elstro and on unanimous voice vote the motion 65 was carried. v,. sfir Common Council Minutes Cont'd October 5, 1987 Page 6 1 Councilmember Morris stated that nothing has changed from the original project to make her change her 2 mind. She is still in opposition due to four lanes of traffic going past two schools and the accelerated cost of 3 the project. 4 5 Councilmember Williams stated he was in opposition to the original project, but since some changes have 6 been made, he will support this Ordinance. 7 Appropriation Ordinance No.56-1987 was adopted on the following call of the roll: 8 9 Ayes: Elstro,Williams, Hankinson,Whitesell, Parker, Hutton,Theobald and Brookbank (8) 10 Nays: Morris (1) 11 12 MISCELLANEOUS BUSINESS 13 14 Councilmember Williams commented he did not feel it appropriate for persons to use the Common Council to 15 make personal attacks, such as Mr. Greene had done.
