PROCEEDINGS OF THE COMMON COUNCIL OF THE
CITY OF RICHMOND,INDIANA,JUNE 1 .1987
1 The Common Council of the City of Richmond, Indiana met in regular session June 1, 1987 at the hour of
2 7:30 P.M. in the Council Chambers in said City. President Brookbank presided with the following
3 Councilmembers present: Elstro, Williams, Hankinson, Whitesell, Parker, Hutton Morris and Theobald.
4 Absent: None. The following business was had to-wit:

12 Councilmember Hankinson moved to approve the minutes of the previous meetings as prepared, seconded
13 by Councilmember Elstro and on unanimous voice vote the motion was carried.

15 COMMUNICATIONS FROM THE MAYOR
16
17 Mayor Frank H.Waltermann informed the Council that in anticipation of the E 9-1-1 and central dispatch,the
18 Police Department with assistance from General Telephone, would be moving equipment radio equipment
19 from the City Building to the EOC on June 7, 1987. He said the move would be during the hours of 11:00 PM
20 to 8:00 AM and they would be dispatching with the assistance of the County Sheriff. Mayor Waltermann
21 commented the project was right on target.

23 Mayor Waltermann also spoke to the Council regarding the number of vacant and unsafe structures within
24 the community. He said the structures were a detriment to other properties and if such vacant structures
25 are determined as nuisances;he would be requested the Board of Public Works and Safety to have them
26 removed within thirty (30)days.

28 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY

30 President Susan Silberstein reported the Board had affirmed an Order to wreck and remove an unsafe
31 structure at 400 Kinsey Street, approved the hiring of Probationary Police Officer Gloria Brown and
32 executed the agreement to provide fire services to Spring Grove. Ms. Silberstein said the Board had
33 approved and executed a Consent to Assignment for Clearview Cable and released them from default on the
34 assignment issue.

36 Ms. Silberstein added the Board had approve the addition of four fire hydrants and scheduled inoperable
37 vehicles hearings for June 18, 1987. Ms. Silberstein also said that a report had been filed with the Board
38 showing that 115 owners had been contacted regarding weeds and the City had cut 24 of the lots and that 58
39 notices had been sent on inoperable vehicles with 35 being removed and ten complaints being filed with the
40 Board.

46 Councilmember Whitesell reported that hearings will be set on the budget and he would let the Council know
47 the schedule within the next two weeks.

51 HUMAN RELATIONS ORDINANCE

53 Councilmember Morris reported the Citizen Advisory Committee for the Human Relations Ordinance would be
54 met on May 28 1987 and heard from Mary Gardner, Director of the Muncie Human Rights Commission. She
55 said the Committee had received good information and they will be meeting every week for the next several
56 weeks to hear speakers on the subject.

13 Councilmember Whitesell moved to suspend the rules and move Ordinance No.31-1987 to second reading,
14 seconded by Councilmember Williams and on unanimous voice vote the motion was carried.

18 President Brookbank announced Ordinance No.31-1987 was on public hearing.

20 Speaking for Ordinance No. 31-1987 was Ms. Janet Sams, Manager of Rose View Transit. Ms. Sams
21 explained to the Council the ordinance established an operations manager for the bus lines. She said that in
22 prior years the bus lines had three or four persons in the office and the Planning Office did all the grants and
23 budgets. She said that she now does all the grants, budgets and supervision of drivers.

25 Ms. Sams explained the bus lines operates six days a week along with doing charters. She said during the
26 time she had managed the bus lines ridership has increased 27%and revenues have also increased to the
27 point that the City match the first quarter of 1987 was only 49.00.

29 Ms. Sams commented that with the addition of an operations manager to do the driver and route supervision,
30 she will have more time to spend on increasing revenues, etc. She added the cost to the City for the
31 position will be approximately 10.00 per year.

33 Councilmember Hankinson asked how many routes there were and Ms. Sams stated there were ten routes
34 and eleven drivers.

36 Councilmember Hankinson commented he felt 16,000. was a great amount of money to pay for the
37 supervision of ten routes and eleven drivers.

39 Ms. Sams explained the persons would be in charge of all personnel and would work staggered hours along
40 with driving in emergencies and being present at all shift changes.

42 Councilmember Hankinson asked how the salary compares to that of the Chief Mechanic and Ms. Sams
43 stated the mechanic makes 18,000. and will be under the supervision of the operations manager.

45 Councilmember Brookbank asked who drivers report to when ill and Ms. Sams indicated at present it was
46 her, but would be the operations manager and they need to report in two hours in advance of their scheduled
47 time.

49 Councilmember Morris commented that if there is a weakness in the bus line, it is not blowing their horn
50 enough. She indicated the City was in jeopardy of loosing public transportation four years ago and now they
51 are doing well.

53 Ms. Sams stated the federal funds have not increased, but with proper budget management and increased
54 revenues they are financially better. She added that the lines was rated in the lower three of Section 18 in
55 the State and now they are in the top five of Sectio 18 in the State.

57 Ms. Sams said Rose View is planning to expand the services to other cities on a demand responsive basis
58 and will add other services along with increasing revenues.

23 President Brookbank announced Ordinance No. 13-1987 was on public hearing.

25 Councilmember Whitesell informed the Council that the ordinance had been assigned to the Public Safety
26 Committee and they were requesting it be continued and placed on the table until September 15, 1987 for
27 more input and for all implications to be considered.

29 Councilmember Whitesell moved to table Ordinance No 13-1987 to September 15, 1987, seconded by
30 Councilmember Williams and on unanimous voice vote the motion was carried.

37 Mr. Barden examined the Proof of Publication and found it to be in order. Councilmember Whitesell moved to
38 accept and file the Proof of Publication, seconded by Councilmember Hutton and on unanimous voice vote
39 the motion was carried.

41 President Brookbank announced Ordinance No.21-1987 was on public hearing.

43 Mayor Waltermann told the Council the fund is necessary for the City. He said a major use of the fund will be
44 repair of facilities and many of the Cities' buildings, etc. are in need of major repairs. He said the fund can
45 also be used for emergency needs such as sewer repairs and equipment purchases. The Mayor reminded
46 the Council that they approve all expenditures out of the fund.

48 Councilmember Whitesell asked if approved does it remain forever and Mr. Barden stated he believed it
49 would need to be approved every three years.

51 Mayor Waltermann added that it will be readopted at the .15 maximum levy and 90,000.00 is generated from
52 every nickel.

54 Councilmember Morris commented this ordinance just reestablishes an existing fund.

36 Mr. Barden examined the Proof of Publication and found it to be in order. Councilmember Parker moved to

38 vote the motion was carried.

40 President Brookbank announced Ordinance No.24-1987 was on public hearing.

42 Councilmember Parker asked about the Class A and B permits and if it was necessary to have both types
43 since it seemed most persons would purchase the 5.00 permit for unlimited park and load.

45 Mr. Barden explained that with unlimited usage you have to show cause to have the permit, whereas the
46 Class B permit is for designated special deliveries. He said there have been many abuses in the past of
47 loading permits and that permits now are 10.00 per year per location. Mr. Barden said the permits will be
48 distinguishable by color making enforcement easy to handle.

50 Councilmember Morris asked what problems it addresses and Mr. Barden explained not all businesses
51 comply and this is designed to clarify what is permitted and what is not.

53 Councilmember Morris asked if it would permit certain behavior such as bad parking behavior and Mr. Barden
54 stated the parking laws would be enforced.

56 Councilmember Hankinson asked if it applied to trucks parking where ever they want to stop and blocking
57 traffic and other parking.

59 Mr.Barden said they will be told where and how to park and will not be allowed to double park.

61 Councilmember Parker commented he felt it would require more loading zones designated.

63 Mr. Barden stated it would and existing ones would be remarked and violations posted.

24 Speaking for Ordinance No.26-1987 was Mr.Jerald Judge. Mr.Judge explained there had been a transition
25 in the Maintenance Department and a position being enhanced to supervise maintenance in both sewer and
26 plant maintenance. He said it entails one less persons with salary increases.

28 THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE ZONING
29 ORDINANCE OF THE CITY OF RICHMOND, INDIANA, PROVIDING FOR THE REZONING OF PROPERTY
30 LOCATED AT 1 EAST MAIN STREET, RICHMOND, INDIANA FROM 0-1 GREENBELT TO C-4 GENERAL
31 BUSINESS DISTRICT.

33 President Brookbank announced Ordinance No.29-1987 was on public hearing.

35 Councilmember Morris noted the Plan Commission had recommended the Ordinance be amended to change
36 the C-4 designation to C-2 through out the entire Ordinance and so moved to make the amendments,
37 seconded by Councilmember Whitesell and on unanimous voice vote the motion was carried.

39 Speaking for Amended Ordinance No. 29-1987 was Mr. Gregg O'Maley, Attorney at Law, 200 West End
40 Federal Savings and Loan Building. Mr. O'Maley informed the Council he was representing the Gennett
41 Investment Company, Inc. and Jack and Cathy Dennison requesting part of the property located at 1 East
42 Main be rezoned. He said the Dennison's intend to utilize an existing steel pole structure for a battery
43 dealership. Mr.O'Maley said the Plan Commission unanimously recommended adoption as amended.

45 Mr. O'Maley explained the original petition was for a larger area of property and for C-4 zoning, but after
46 working with the Plan staff and evaluating the Park Master Plan for the Gorge area, the area was reduced
47 and the zoning changed to C-2. Mr.O'Maley added the area has historically been commercial.

49 Mr. O'Maley stated the appraiser concluded the highest and best use of the property was commercial and
50 the property sits at Main Street grade level and if a logical extension of the downtown area.

52 Councilmember Elstro asked how many acres were involved and Mr. O'Maley stated 1.3 acres.

54 Councilmember Elstro asked if some of the existing buildings would be coming down since they were shabby
55 and Mr. O'Maley explained they intended to use the steel structure and remove other buildings and level the
56 area. The buildings included do not include the Mr. Pizza area.

58 Councilmember Elstro commented it was hard to believe they would just let the rest of the land sit and not
59 use for commercial purposes.

61 Mr. O'Maley stated they have addressed those concerns by reducing the area to be rezoned and have also
62 visually tested the area from the Gorge.

64 Councilmember Whitesell asked if the business would just be distribution and Mr. O'Maley stated it was
65 strictly distribution with delivery trucks in the area, but no service or other activities.

1 Mr. Dan Dooley informed the Council that Mr. O'Maley had presented a fair representation of the Plan
2 Commission meeting. He informed the Council that the Plan Department was currently doing a title search for
3 an Unsafe Building Order to be issued to repair or demolish the structures in bad repair.

5 Councilmember Elstro asked what was allowed in C-2 and Mr. Dooley said retail and service oriented
6 businesses are allowed.

8 Councilmember Elstro commented the zoning was hedging into Greenbelt area and the Council has been
9 burnt on Sim Hodgin with other Greenbelt areas being rezoned.

11 Mr. Dooley stated the Plan Commission discussed the Gorge and the Greenbelt zoning and took the Park
12 Master Plan into consideration. He said the Park has indicated they were interested in purchasing the
13 property for access to the Gorge and the rezoning will not prevent future sale of the property.

15 Councilmember Elstro asked if the property was sold in the future could the zoning be abused and Mr. Dooley
16 said the C-2 was the same as the downtown area and the Ordinance on the zoning can be enforced.

18 Councilmember Morris commented the Plan Commission also requested the Pizza King owners to rezone to
19 C-2.

21 Speaking against Ordinance No. 29-1987 was Mr. Al Gentry of 404 South 22nd Street representing the
22 Whitewater Gorge Park Committee. Mr.Gentry stated he did not get to the Plan Commission meeting and he
23 would like to see the Park Department and Gorge Committee given time to consider the impact on the park.
24 He said they were opposed to unrestricted commercial development in the Gorge Park, but not opposed to
25 development if it was consistent with the Park Master Plan. He said they had assumed the area was
26 protected from commercial development by the zoning being Greenbelt and the Gorge Committee had
27 worked ten years with the Common Council, administrations and citizens to establish the Gorge Park. He
28 said they had planned to acquire the Gennett property, including the Pizza King when funds allowed.

30 Mr. Gentry reminded the Council the Gorge Park was part of the All America City Award and nominated for
31 Project '88 and he would prefer it not be zoned commercial, but maybe the Council could consider non-
32 conforming. He said the Gorge Park has been a long term project and people are very much enthused. Mr.
33 Gentry added that Park Superintendent Nancy MacCartney and the Gorge Committee had been caught on
34 short notice, but they had felt the Greenbelt zoning was protected and also included in the Park Master Plan.

36 Councilmember Morris asked what the timetable was for development of the area and Mr.Gentry stated they
37 would hope to have funds available within the next two or three years.

39 Councilmember Morris stated part of the property was an eyesore and the demolition costs would be
40 20,000.00.

42 Mr.Gentry commented the metal structure is a good building and he would recommend they go with a special
43 use arrangement for a short term basis.

45 Councilmember Whitesell asked Mr. Dooley about a special use and Mr. Dooley stated the existing
46 businesses were there on a non-comforming use which allows the owners to continue using the buildings for
47 commercial purposes.

49 Councilmember Whitesell asked if a new business could take over on the same non-comforming use and Mr.
50 Dooley stated they could ask the BZA for a variance, but the existing use has allowed a heating and air
51 conditioning fabricating business in the building. He said the petitioner asked to rezone rather than the non-
52 comforming as the only viable vehicle for the proper zoning. He added the Plan staff worked with the
53 petitioner to reduce the impact on the Gorge Park.

55 Councilmember Elstro said the Ordinance makes the top of the hill C-2 and down the hill into the Gorge
56 Greenbelt and Mr. Dooley said that was essentially what they were doing since they own 3.5 acres and are
57 rezoning 1.3 acres.

59 Mr.O'Maley commented they are only requesting to rezone the area that is grade level with Main Street and
