APRIL 20.1987 1 The Common Council of the City of Richmond, Indiana met in regular session April 20, 1987 at the hour of 2 7:30 P.M. in the Council Chambers in said City. President Brookbank presided with the following 3 Councilmembers present: Elstro, Williams, Hankinson, Whitesell, Parker, Hutton, Morris and Theobald. 4 Absent: None. The following business was had to-wit: 5 6 APPROVAL OF MINUTES OF APRIL 6,1987 7 8 Councilmember Morris moved to approve the minutes of the previous meetings as prepared, seconded by 9 Councilmember Hutton and on unanimous voice vote the motion was carried. 10 11 COMMUNICATIONS FROM THE MAYOR 12 13 Mayor Frank H. Waltermann informed the Council that the neighborhood clean up in the Holsapple area had 14 been a tremendous success. He said two other neighborhoods had contacted him regarding the same 15 activity in their areas and schedules have been set for Fairview area on April 25, 1987 and Mortons Lake 16 area on May 2, 1987. Mayor Waltermann stated the clean ups will continue as requested preferably in 17 smaller neighborhood areas. 18 19 Mayor Waltermann indicated the trip to Washington on the tariffs to be imposed on imports from Japan has 20 been very successful and had good media coverage. He thanked James Rush and Randy Hodges for their 21 assistance in the efforts and said the City will assist any business or corporation needing help. 22 23 Councilmember Hutton asked what for an explanation of what was going on with the sewer project on 24 National Road West and Mayor Waltermann stated the City was following state guidelines to barricade the 25 area. He said they were hoping to be able to open up the two north lanes of traffic to better accommodate 26 the traffic. 27 28 Councilmember Hutton indicated the situation was dangerous and additional traffic enforcement was needed 29 in the area. 30 31 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY 32 33 EOC Center 34 35 Councilmember Elstro commented on the tour of the Police Department and the EOC Center. He said in his 36 opinion the center is wet and moldy . He said there will be hundreds of thousands of dollars of equipment 37 moved into the center with central dispatch and he hates to see it moved over there with the wet conditions. 38 39 Councilmember Whitesell said he had talked with Max Smith, Wayne County Commissioner and had been 40 informed that they had changed the float level in the pump system and a drainage system had been added. 41 He said they feel the problem will be solved and the project will be completed within thirty days. 42 43 Councilmember Elstro said he noticed underground seeping and leaking in the walls and it will take 44 continuous pumping and dehumidification with back up generation. 45 46 Councilmember Whitesell indicated there was an auxiliary generator for emergency power. 47 48 Councilmember Morris stated the annex was built on an aquifer and the equipment to be placed there was 49 very sensitive to moisture. She added it would be irresponsible to move the equipment there without an 50 independent study on the conditions. 51 52 Unsafe Buildings 53 54. Councilmember Whitesell asked Mr. Barden about the procedure for unsafe buildings when owners cannot 55 be notified. ' 56 • 57 Mr. Barden stated there were other means of making notification on unsafe structure. He said they can file 58 in court to gain entry and also can legally advertised hearings. 59 60 Mr. Dan Dooley informed the Council that the unsafe premises at 400 Kinsey was an example and they have 61 been unsuccessful in making contact by mail service. He said it had been legally advertised, but since they 62 were able to locate the owner at the last minute,they were obligated to make service with the owne 63 64 REPORTS FROM SPECIAL COMMITTEES 65 Common Council Minutes Cont'd April 20, 1987 Page 2 1 COMMITTEE OF THE WHOLE 2 3 Councilmember Whitesell stated that both the Police Department and Housing Authority tours were very 4 good and informative. He said the Park tour on April 18, 1987 had been cancelled because of lack of 5 attendance. 6 7 Park Superintendent, Nancy MacCartney suggested it could be a late afternoon tour during the week and 8 the tour would take three to four hours. 9 10 It was decided by the Council to schedule the Park tour for April 29, 1987 at 4:30 P.M. 11 12 Scheduled tours are: 13 14 Park Department-April 29, 1987 at 4:30 (Park Office) 15 Fire Department-May 11, 1987 at 7:00 P.M. 16 17 REPORTS FROM OTHER COUNCIL COMMITTEES 18 19 CAPITAL EQUIPMENT 20 21 Councilmember Morris stated the Capital Equipment Committee had met and made recommendations and 22 prioritized department requests for Revenue Sharing in the amount of 84,000.00. 23 24 HUMAN RELATIONS ORDINANCE 25 26 Councilmember Morris stated there would be a meeting of the Citizens Committee for the Human Relations 27 Ordinance on April 30, 1987 at 7:00 P.M. in the Board of Works Room. 28 29 MISCELLANEOUS BUSINESS 30 31 Holsapple Clean up 32 33 Councilmember Whitesell reported the neighborhood clean up in Holsapple went well and he asked Mayor 34 Waltermann to extend his thanks to the street crews assisting with the clean up. 35 36 President Brookbank welcomed the high school government students in attendance. 37 38 RESOLUTIONS 39 40 RESOLUTION NO.2-1987 41 42 Councilmember Morris moved to suspend the rules and read Resolution by title only, seconded by 43 Councilmember Williams and on unanimous voice vote the motion was carried. 44 45 The Clerk read by title only Resolution No.2-1987-A RESOLUTION AMENDING RESOLUTION NO. 10-1987 46 BY ADDING A NEW SECTION DETERMINING THE TIME PERIOD ALLOWED FOR A DEDUCTION FROM THE 47 ASSESSED VALUE OF REAL PROPERTY. 48 49 Mr. Dan Dooley informed the Council that Tax Abatement had been established in 1984 with Resolutions 9 50 and 10. He said the resolutions has set out six revitalization area making tax abatement eligibility for new 51 investments. Mr. Dooley explained that there was originally a ten year time period allowed and now the state 52 has given the choice of time periods. Mr. Dooley said this resolution proposes to uniformly allow the time 53 period of ten years in all six designations. Mr. Dooley added this was on the recommendation of citizens 54 who felt it did not make sense to establish separate time periods in each area. 55 56 Councilmember Parker asked how many companies take advantage of the tax abatement and Mr. Dooley 57 stated it varies, but averages ten to fifteen. 58 59 Councilmember Whitesell asked if there was a conflict with the Enterprise Zone and Mr. Dooley explained 60 that was an independent program and one of the six designated-areas. 61 62 Economic Development Director, Bill McDermott said they had met with businesses and discussed the time 63 options and the recommendations was to leave it at the ten year period. 64 65 There being no further discussion, Councilmember Elstro moved for adoption of Resolution No.2-1987, e719'9 Common Council Minutes Cont'd April 20,1987 Page 3 1 seconded by Councilmember Morris and on unanimous voice vote the motion was carried. 2 3 ORDINANCES 4 5 ORDINANCES ON FIRST READING 6 7 Councilmember Elstro moved to suspend the rules and read Ordinances No. 17, 18 and 19-1987 on first 8 reading by title only, seconded by Councilmember Parker and on unanimous voice vote the motion was 9 carried. 10 11 ORDINANCE NO.17-1987 12 13 The Clerk read on first reading by title only Ordinance No. 17-1987-AN ORDINANCE OF THE COMMON 14 COUNCIL OF THE CITY OF RICHMOND, INDIANA RATIFYING THE RESOLUTION OF THE RICHMOND CITY 15 PARK AND RECREATION BOARD TO EXERCISE ITS OPTION TO RENEW THE LEASE ON THE 16 MIDDLEFORK RESERVOIR FOR TWO ADDITIONAL TEN YEAR TERMS. 17 18 Councilmember Morris moved to suspend the rules and move Ordinance No 17-1987 to second reading, 19 seconded by Councilmember Hutton and on unanimous voice vote the motion was carried. 20 21 The Clerk read Ordinance No. 17-1987 on second reading. 22 23 President Brookbank announced Ordinance No. 17-1987 was on public hearing. 24 25 Speaking for Ordinance No. 17-1987 was Park Superintendent, Nancy MacCartney. Ms. MacCartney 26 explained that the twenty-five year lease was up in 1992, but the in order to receive a 56,000.00 grant from 27 the State of Indiana they needed to be in control of the facility for the life expectancy of the facilities funded 28 with the grant money. Ms. MacCartney stated the funds would be used for 37 new docks with a life 29 expectancy of twenty years. 30 31 Ms. MacCartney indicated the Indiana American Water Company was not very restrictive with the lease other 32 than controlling the speed of boats and being included on new ideas for the reservoir. She said it was a good 33 working partnership and they only really requested it be maintained in a safe way. 34 35 Councilmember Parker asked if the present lease was good until 1992 with two addition options, why did it 36 have to be done now. 37 38 Ms. MacCartney explained that the was only way the state would grant the funds and she did not feel there 39 would be problems renewing the lease at the end of the twenty years. 40 41 Mr. Barden also explained that both he and the water company had approached the state, but they did not 42 want it as it was currently. 43 44 There being no further discussion, Councilmember Elstro moved for engrossment of Ordinance No. 17-1987, 45 seconded by Councilmember Williams and on unanimous voice vote the motion was carried. 46 47 Councilmember Morris moved to suspend the rules and move Ordinance No. 17-1987 to third and final 48 reading and read by title only, seconded by Councilmember Hutton and on unanimous voice vote the motion 49 was carried. 50 51 The Clerk read Ordinance No. 17-1987 on third and final reading by title only. 52 53 Ordinance No. 17-1987 was adopted on the following call of the roll: 54 55 Ayes: Elstro,Williams, Hankinson,Whitesell, Parker, Hutton, Morris,Theobald and Brookbank (9) 56 Nays: None. 57 58 APPROPRIATION ORDINANCE NO.18-1987 59 60 The Clerk read on first reading by title only Ordinance No. 18-1987-AN ORDINANCE TO APPROPRIATE 61 WITHIN THE FEDERAL REVENUE SHARING FUND. 62 63 President Brookbank announced Appropriation Ordinance No. 18-1987 was to be advertised for public 64 hearing. 65 .SO - -s rioa=Gouneil-Miaates-Cont'd April20, 1987 Page 4 • 1 ORDINANCE NO.19-1987 2 3 The Clerk read on first reading by title only Ordinance No. 19-1987 - AN ORDINANCE OF THE CITY OF 4 RICHMOND AUTHORIZING THE CONSENT OF THE CITY TO THE ASSIGNMENT OF A CERTAIN LEASE,A 5 PART OF FINANCING AGREEMENT UNDER WHICH RICHMOND ECONOMIC DEVELOPMENT FIRST 6 MORTGAGE REVENUE BONDS,SERIES 1973, (FARMHAND, INC.,)WERE ISSUED AND SOLD. 7 8 Councilmember Morris moved to suspend the rules and move Ordinance No. 19-1987 to second reading, 9 seconded by Councilmember Parker and on unanimous voice vote the motion was carried. 10 ' 11 The Clerk read Ordinance No. 19-1987 on second reading by title only. 12 13 President Brookbank announced Ordinance No. 19-1987 was on public hearing and there were persons 14 available in the audience if the Council had any questions. 15 16 There being no comment, Councilmember Elstro moved for engrossment of Ordinance No. 19-1987, 17 seconded by Councilmember Hankinson and on unanimous voice vote the motion was carried. 18 19 Councilmember Williams moved to suspend the rules and move Ordinance No. 19-1987 to third and final 20 reading and read by title only,seconded by Councilmember Hutton and on unanimous voice vote the motion 21 was carried. 22 23 The Clerk read Ordinance No. 19-1987 on third and final reading by title only. 24 25 Ordinance No. 19-1987 was adopted on the following call of the roll: 26 27 Ayes: Elstro,Williams, Hankinson,Whitesell, Parker, Hutton, Morris,Theobald and Brookbank (9) 28 Nays: None. 29 30 ORDINANCES ON SECOND READING 31 32 ORDINANCE NO 7-1987 33 34 The Clerk read on second reading Ordinance No.7-1987-AN ORDINANCE AMENDING CERTAIN SECTIONS 35 OF CHAPTER 97 OF THE RICHMOND CODE AS ADOPTED BY AMENDED ORDINANCE 47-1986 , 36 REGULATING THE PLANTING, MAINTENANCE, CARE AND REMOVAL OF TREES WITHIN THE PUBLIC 37 RIGHT-OF-WAY. 38 39 President Brookbank announced Ordinance No. 7-1987 was on public hearing. 40 41 Councilmember Whitesell moved to amend Ordinance No. 7-1987 by excluding all but the following: 42 43 Section 96.06 subparagraph 2(b)to read: 44 45 The Street Tree Commission may remove, prune, or cause to be removed, all trees shrubs, or 46 plants that are planted on the public right-of-way or municipal property, when in its discretion the 47 pruning or removal will be beneficial to the peace, health and safety of the public and public 48 improvement where trees, shrubs or plants are detrimental to the growth of adjacent trees.
