HomeMy Public PortalAbout04-06-1987 '4/ I PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND,INDIANA,APRIL 6,1987 1 The Common Council of the City of Richmond, Indiana met in regular session March 16, 1987 at the hour of 2 7:30 P.M. in the Council Chambers in said City. President Brookbank presided with the following 3 Councilmembers present: Elstro, Williams, Hankinson, Whitesell, Parker, Hutton, Morris and Theobald. 4 Absent: None. The following business was had to-wit: 5 6 APPROVAL OF MINUTES OF MARCH 16,1987 7 8 Councilmember Hankinson moved to approve the minutes of the previous meetings as prepared, seconded 9 by Councilmember Hutton and on unanimous voice vote the motion was carried. 10 11 COMMUNICATIONS FROM THE MAYOR 12 13 Mayor Frank H.Waltermann told the Council that he had the opportunity to see the Richmond High School 14 Boys Basketball Team become the State Runner up Champions. He said Richmond was represented in the 15 highest quality. The Mayor said he had also enjoyed the 100th Birthday celebration of the Greater Second 16 Missionary Baptist Church and felt of all the speakers he heard, Marion Williams was the most eloquent. 17 18 Mayor Waltermann informed the Council that he had been involved in a paradoxical situation this day. He 19 said he had attended the opening of the Hands Reaching Out shelter which provides emergency food, 20 clothing and shelter to those in need. He said he is ashamed the Community is in need of such shelters and 21 it behooves us to strive for full employment. Mayor Waltermann then stated the City has also become 22 involved in an international setting with the decision of President Reagan to place 100%tariffs on certain 23 products imported from Japan. He said the tariffs are being instituted over semi-conductors and computer 24 chips, but one of the tariff items is condensers used locally by Sanyo. He said that if the trade sanctions are 25 enforced, Richmond could possibly be penalized because Sanyo may have to temporarily close down due to 26 the compressors. He said national level politics are having a direct effect on our economy. He said the 27 community had worked hard to get jobs and now there is the possibility of loosing jobs over something we 28 cannot control. 29 30 Mayor Waltermann asked support by watching for news developments and letting persons in Washington 31 know how the section on refrigeration will affect Richmond. He said Sanyo uses 70%American made parts 32 in their products and only 30% produced outside and the tariff will place them in an unfair competitive 33 situation. 34 35 President Brookbank stated she had already discussed this situation with Senator Lugar and he is well 36 aware of what is happening. 37 38 Mayor Waltermann said if it was necessary, Richmond will send representatives to Washington to testify. 39 40 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY 41 42 Board President, Susan Silberstein reported to the Council that the Board had Unsafe Building Hearings on 43 properties located at 1109 Parry Street, 602 North 12th Street, 300 South 3rd Street and 419 South 4th 44 Street. She said the Board has hearing dates set for 1 and 7 Main Street for unsafe structures. 45 46 Ms. Silberstein stated the Board awarded bids for mini trucks, the pool filtration system, street and 47 bituminous materials and a cab and chassis. She said dates were set to receive bids for Police Department 48 computer, a bus for Rose View and certain paving projects. 49 50 Ms. Silberstein said the Board had sold two (2) properties belonging to the City that had been the source of 51 many complaints and ratified the contract with General Telephone for the E 9-1-1 equipment. 52 53 Ms. Silberstein reported the Board had approved and executed the Agreement for Fire Services with Wayne 54 Township and had voted to support a proposal from Indiana University East for a traffic signal at their 55 entrance off of Chester Boulevard. 56 57 Councilmember Williams asked if 602 North 12th Street was the corner house and said there were also two 58 properties across the street from that address and one at North 12th and I which needed attention. 59 60 Ms. Silberstein said she would investigate those properties. 61 62 Councilmember Hankinson asked about 302-304 North 22nd Street and Mr. Dan Dooley said he has been in 63 contact with the owners and ask for a schedule of repairs to be submitted. Mr. Dooley said if they did not 64 receive the repair schedule, he would institute an Unsafe Building Hearing. 65 ibkr. Common Council Minutes Cont'd April 6, 1987 Page 2 1 REPORTS FROM SPECIAL COMMITTEES 2 3 PUBLIC SAFETY 4 5 President Brookbank requested a report from the Public Safety Committee regarding Ordinance No. 13- 6 1987. Councilmember Whitesell stated the City Attorney has suggested they wait for review of the 7 Ordinance until after the State Legislature is finished and have a work session in late May if necessary. 8 9 COMMITTEE OF THE WHOLE 10 11 Councilmember Whitesell announced the following tentatively set meetings of the Committee of the Whole to 12 tour various City Departments and review their operations: 13 14 Police Department-April 13, 1987 at 7:00 P.M. 15 Housing Authority-April 16, 1987 at 7:00 P.M.at Sycamore Square 16 Park Department-April 18, 1987 at 9:00 A.M. 17 Fire Department-May 11, 1987 at 7:00 P.M. 18 19 Councilmember Whitesell gave the Council the Agenda for the Police Department tour and asked the 20 Council to please follow the format presented. 21 22 REPORTS FROM STANDING COMMITTEES 23 24 REID HOSPITAL 25 26 President Brookbank reported on a Long Range Planning Retreat and a Board meeting on March 23, 1987. 27 She said the Medicare regulations have been made easier for Reid as a referral center and the admissions 28 are up over 20%. She said there also is a new side presentation developed for marketing purposes. 29 30 ENTERPRISE ZONE 31 32 President Brookbank announced a regular meeting on April 7, 1987 at 7:30 P.M. 33 34 REPORTS FROM OTHER COUNCIL COMMITTEES 35 36 HUMAN RELATIONS ORDINANCE 37 38 Councilmember Morris gave the Council a list of persons appointed to serve on the Citizen Committee 39 developed for the consideration of the proposed Human Relations Ordinance. She said their first meeting 40 will be April 8, 1987 at 7:00 P.M. in the Board of Works Room. 41 42 MISCELLANEOUS BUSINESS 43 44 Street Tree Commission Report on Ordinance No. 7-1987 45 46 Mr. Carl Reynolds, Chairman of the Street Tree Commission, reported to the Council that the problem had 47 been worked out and amendments could be offered to Ordinance No. 7-1987 in order that it could be 48 approved. 49 50 Master Plan Update 51 52 Councilmember Lynn Morris, President of the Plan Commission, reported to the Council on the progress of 53 the Master Plan. She said they have completed selection of a Central Committee consisting of 55 members 54 and are meeting in a retreat on May 15, 16, and 17th to set goals. Councilmember Morris stated she was 55 very pleased with the appointments to the Committee and they represent persons with varying interests and 56 backgrounds. She said they had sent out 100 letters inviting persons to serve and had over 75 responses. 57 Councilmember Morris stated that Mr. Dooley was now gathering census information and with the Master 58 Plan Steering Committee a Mission Statement had been developed. 59 60 Councilmember Morris stated they are proceeding in a different fashion by using the Consultant to guide the 61 Master Plan, but for the plan to be the plan of the citizens. 62 63 Mr. Dooley informed the Council they would be making periodic update to the Common Council on the Master 64 Plan since it must be adopted by the Common Council. He said they were excited over what has happened 65 to date. He said the plan developed under this structure will be meaningful for the community and it has y9.3 Common Council Minutes Cont'd April 6, 1987 Page 3 1 been over twenty (20)years since the last Master Plan update. Mr. Dooley stated they will be emphasizing 2 the citizen participation and tap the talented resources of our community. Mr. Dooley said the Plan should 3 show the pride and spirit in what the community has. 4 - 5 Mr. Dooley went over the points of the Mission Statement with the Council and explained the levels of the 6 Committee involved in the Master Plan. He also acknowledged the help of the task force of the Greater 7 Richmond Progress Committee. 8 9 Mr. Dooley reported that Mr.Warren Ziegler will be helping with the retreat to set the goals and he is nationally 10 known working on projects with goal setting and future envisioning. 11 12 Mr. Dooley also informed the Council that they have encumbered 7,300.00 of the original appropriation and 13 will need to return to Council to reappropriate funds. 14 15 Councilmember Morris informed the Council that they will be needed in the Master Plan and she asked if they 16 were willing to serve on sub-committees within their particular interest or knowledge. 17 18 ORDINANCES 19 20 ORDINANCES ON FIRST READING 21 22 Councilmember Elstro moved to suspend the rules and read Ordinance No. 16-1987 on first reading by title 23 only,seconded by Councilmember Williams and on unanimous voice vote the motion was carried. 24 25 ORDINANCE NO.16-1987 26 27 The Clerk read on first reading by title only Ordinance No. 16-1987 - AN ORDINANCE OF THE CITY OF 28 RICHMOND, INDIANA AUTHORIZING THE CONSENT OF THE CITY TO THE WAIVING OF RESTRICTIONS 29 ON MORTGAGING OF PROJECT REAL ESTATE,A PART OF THE FINANCING AGREEMENT UNDER WHICH 30 CITY OF RICHMOND ECONOMIC DEVELOPMENT REVENUE BONDS, SERIES A AND B (CARDON III 31 PROJECT)WERE ISSUED. 32 33 Councilmember Elstro moved to suspend the rules and move Ordinance No 16-1987 to second reading, 34 seconded by Councilmember Morris and on unanimous voice vote the motion was carried. 35 36 The Clerk read Ordinance No. 16-1987 on second reading. 37 38 President Brookbank announced Ordinance No. 16-1987 was on public hearing. 39 40 Speaking for Ordinance No. 16-1987 was Andrew Cecere, Attorney at Law, 101 South 10th Street. Mr. 41 Cecere informed the Council they had approved a bond issue for Cardon III (Cherish Nursing Center) in 1984 42 and a provision of the loan agreement that the bond issuer could not make subsequent loans without the 43 waiver by the issuer and bond owners. Mr. Cecere said the First National Bank is involved in an additional 44 loan and has consented to a second mortgage. Mr. Cecere said the Council must approve the waiver and 45 give permission for the Mayor and City Clerk to execute the waiver for the second mortgage to be placed on 46 the property. Mr. Cecere added that the City Attorney has approved the project. 47 48 There being no further discussion, Councilmember Elstro moved for engrossment of Ordinance No. 16-1987, 49 seconded by Councilmember Morris and on unanimous voice vote the motion was carried. 50 51 Councilmember Morris moved to suspend the rules and move Ordinance No. 16-1987 to third and final 52 reading and read by title only. 53 54 The Clerk read Ordinance No. 16-1987 on third and final reading by title only. 55 56 Ordinance No. 16-1987 was adopted on the following call of the roll: 57 58 Ayes: Elstro,Williams, Hankinson,Whitesell, Parker, Hutton, Morris,Theobald and Brookbank (9) 59 Nays: None. 60 61 ORDINANCES ON SECOND READING 62 63 ORDINANCE NO 10-1987 64 65 The Clerk read on second reading Ordinance No. 10-1987-AN ORDINANCE AMENDING CHAPTER 154 OF y,v -irTutes-C.ri d April 6, 1987 Page 4 1 THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE ZONING 2 ORDINANCE OF THE CITY OF RICHMOND, INDIANA, PROVIDING FOR THE REZONING OF PROPERTY 3 LOCATED AS 1201 NORTH "E" STREET FROM M-1 LIGHT INDUSTRIAL DISTRICT TO M-1 SU AND 4 PROVIDING FOR THE SPECIAL USE OF SAID PROPERTY AS A COMBINATION SERVICE STATION, 5 ' CONVENIENCE STORE AND CAR WASH. 6 7 President Brookbank announced Ordinance No. 10-1987 was on public hearing. 8 9. Councilmember Whitesell noted the Plan Commission had recommended an amendment be made to Section 10 3 of the Ordinance and moved to add part b. All lights on the property shall be directed away from any 11 residences in the area, seconded by Councilmember Morris and on unanimous voice vote the motion 12 carried. 13 14 Councilmember Morris explained that all remonstrators at the public hearing were concerned with the lights 15 and this would address their concerns. 16 17 There being no further discussion, Councilmember Hankinson moved for engrossment of Ordinance No. 10- 18 1987,seconded by Councilmember Parker and on unanimous voice vote the motion was carried. 19 20 Councilmember Williams moved to suspend the rules and move Ordinance No. 10-1987 to third and final 21 reading and read by title only, seconded by Councilmember Morris and on unanimous voice vote the motion 22 was carried. 23 24 The Clerk read Ordinance No. 10-1987 on third and final reading by title only. 25 26 Amended Ordinance No. 10-1987 was adopted on the following call of the roll: 27 28 Ayes: Elstro,Williams, Hankinson,Whitesell, Parker, Hutton, Morris,Theobald and Brookbank (9) 29 Nays: None. 30 31 ORDINANCE NO.11-1987 32 33 The Clerk read on second reading Ordinance No. 11-1987-AN ORDINANCE TO ANNEX TO THE CITY OF 34 RICHMOND, INDIANA CERTAIN CONTIGUOUS TERRITORY, ADJACENT AND ABUTTING THERETO, 35 DESCRIBING THE SAME PROVIDING FOR THE PUBLICATION THEREOF,AND FIXING THE TIME WHEN 36 THE SAME SHALL TAKE EFFECT. 37 38 President Brookbank announced Ordinance No. 11-1987 was on public hearing. 39 40 Councilmember Morris stated she thought a representative would be at the meeting regarding the Hunter's 41 Pointe Subdivision expansion. 42 43 Mr. Dooley said he felt a representative would also be present and they had been unable to attend the last 44 meeting of the Council. Mr. Dooley said it was a voluntary annexation involving thirteen (13) acres off 45 Hodgin Road. He said the petitioner owns all the property and the annexation is needed for sewer 46 connection. - 47 48 Councilmember Morris stated the City would assume the responsibility for maintaining a drainage ditch in the 49 addition to the sub division. 50 51 Councilmember Parker asked if the maintenance of the ditch could not be a part of the planned unit 52 development and an escrow account provided to maintain the ditch. 53 54 Mr. Dooley stated that in a sub division where lots change hands improvements usually become the City's 55 responsibility. He said formal recommendation or approval has not been given on the drainage and it is still 56 under consideration, but it was agreed by the Plan Commission the ditch be a part of the public 57 improvements. 58 59 Councilmember Whitesell asked about fire hydrants and Mr. Dooley,indicated the Water Company would bear 60 the cost of installation and the City bear the cost of maintenance. 61 62 Councilmember Whitesell said he recalled discussion in the Board of Works regarding the hydrants and if 63 they were a part of the planned unit development. 64 65 Mr. Dooley explained they become a part of the City services and the placement is a function of the Fire 4�9'S Common Council Minutes Cont'd April 6, 1987 Page 5 1 Chief. 2 3 Councilmember Parker questioned the need for hydrants in a residential area. 4 5 Fire Chief Trotter stated he will recommend to the Board of Works the hydrants be accepted for maintenance. 6 He said because of the distance and the large homes it is not advisable to depend solely on trucked water. 7 8 Councilmember Parker stated he had been told before that perhaps the City does not need all the hydrants. 9 He said we need to find out what the proper number of hydrants would be and the distance necessary for 10 safety due to the expense of the hydrants. 11 12 Chief Trotter stated he would like to see additional hydrants placed in certain areas. 13 14 Mr. Barden asked when was the last time ISO audited for insurance ratings and Chief Trotter said it had been 15 nine years ago. 16 17 Mr. Barden suggested the City could check with them on standards. 18 19 Councilmember Parker said he would like to see a plan for hydrants included in the Master Plan and make a 20 planning effort in the future. 21 22 Councilmember Elstro said he would like a report on how many hydrants are in the City and the cost and 23 possibly establish a committee to determine the need. 24 25 President Brookbank asked Chief Trotter to prepare a report to be presented in the near future. 26 27 Mr. Barden said he would check with ISO to see if he could get some information. 28 29 Councilmember Elstro asked if there would be other costs with the proposed sub division other than the ditch 30 maintenance and hydrants. 31 32 Mr.Richard Knight of 809 South 17th Street asked how big the ditch would be. 33 34 Mr.Dooley explained it would handle all storm water from the streets and lots in the area and would not create 35 a problem for future development downstream. Mr. Dooley added other costs to the City would be roadway 36 and other standard public improvements which are offset by the assessed evaluation. 37 38 Mr. Knight asked if the ditch would not create more flooding problems and Councilmember Morris said it will 39 relieve the storm sewer system. 40 41 There being no further discussion, Councilmember Elstro moved for engrossment of Ordinance No. 11-1987, 42 seconded by Councilmember Parker and on unanimous voice vote the motion was carried. 43 44 Councilmember Whitesell moved to suspend the rules and move Ordinance No. 11-1987 to third and final 45 reading and read by title only, seconded by Councilmember Elstro and on unanimous voice vote the motion 46 was carried. 47 48 The Clerk read Ordinance No. 11-1987 on third and final reading by title only. 49 50 Ordinance No. 11-1987 was adopted on the following call of the roll: 51 52 Ayes: Elstro,Williams,Whitesell, Parker, Hutton, Morris,Theobald and Brookbank(8) 53 Nays: Hankinson (1) 54 55 ORDINANCE NO.12-1987 56 57 The Clerk read on second reading Ordinance No. 12-1987-AN ORDINANCE AMENDING SECTION 92.99 OF 58 THE RICHMOND CITY CODE AS IT CONCERNS THE PENALTY FOR NON-COMPLIANCE OF THE 59 RICHMOND SMOKE ALARM ORDINANCE. 60 61 President Brookbank announced Ordinance No. 12-1987 was on public hearing. 62 63 Mr. Barden examined the Proof of Publication and found it to be in order. 64 65 y9 Common Council Minutes Cont'd April 6, 1987 Page 6 1 Councilmember Parker moved to accept and file the Proof of Publication, seconded by Councilmember 2 Morris and on unanimous voice vote the motion was carried. 3 4 President Brookbank announced Ordinance No. 12-1987 was on public hearing. 5 6 There being no public comment, Councilmember Morris moved for engrossment of Ordinance No. 12-1987, 7 seconded by Councilmember Elstro and on unanimous voice vote the motion was carried. 8 9 Councilmember Whitesell moved to suspend the rules and move Ordinance No. 12-1987 to third and final 10 reading and read by title only,seconded by Councilmember Hutton and on unanimous voice vote the motion 11 was carried. 12 13 The Clerk read Ordinance No. 12-1987 on third and final reading by title only. 14 15 Ordinance No. 12-1987 was adopted on the following call of the roll: 16 17 Ayes: Elstro,Williams, Hankinson,Whitesell, Parker, Hutton, Morris,Theobald and Brookbank (9) 18 Nays: None. 19 20 APPROPRIATION ORDINANCE NO.14-1987 21 22 The Clerk read on second reading Appropriation Ordinance No. 14-1987 - AN ORDINANCE TO 23 APPROPRIATE WITHIN THE GENERAL FUND. 24 25 Mr. Barden examined the Proof of Publication and found it to be in order. Councilmember Morris moved to 26 accept and file the Proof of Publication, seconded by Councilmember Parker and on unanimous voice vote 27 the motion was carried. 28 29 President Brookbank announced Appropriation Ordinance No. 14-1987 was on public hearing. 30 31 Speaking for Ordinance No. 14-1987 was Purchasing Director, Rita Stout. Ms. Stout explained to the 32 Council about the 10,000.00 appropriation for trees. She stated 5,000 of the trees would be used in the East 33 Main Street project and 5,000 trees were slated for planting in the rest of the City particularly for entrances 34 to the City. She added they would also be used to replace trees being cut down by the City. 35 36 Councilmember Elstro commented he would rather see trees planted in the neighborhoods than on entrances 37 to the City. 38 39 Ms. Stout stated it was the intention of the Street Tree Commission to replace one out of every three trees 40 cut. She said they have also received saplings through Senator Paul and Representative Bodiker and are 41 planting them in the landfill for future use. 42 43 Also speaking for Ordinance No. 14-1987 was Police Chief Nimitz. Chief Nimitz informed the Council that a 44 portion of the appropriation was to fund additional dispatchers for the E 9-1-1 and to put appropriate funds 45 into the job classification for the additional responsibilities. 46 47 There being no further comment, Councilmember Morris moved for engrossment of Ordinance No. 14-1987, 48 seconded by Councilmember Hutton and on unanimous voice vote the motion was carried. 49 50 Councilmember Whitesell moved to suspend the rules and move Ordinance No. 14-1987 to third and final 51 reading and read by title only, seconded by Councilmember Morris and on unanimous voice vote the motion 52 was carried. 53 54 The Clerk read Appropriation Ordinance No. 14-1987 on third and final reading by title only. 55 56 Appropriation Ordinance No. 14-1987 was adopted on the following call of the roll: 57 58 Ayes: Elstro,Williams, Hankinson,Whitesell, Parker, Hutton, Morris,Theobald and Brookbank (9) 59 Nays: None. 60 61 ADJOURNMENT 62 63 There being no further business,on a motion duly made,seconded and passed,the meeting was adjourned. 64 65 Jane R.
