HomeMy Public PortalAbout12-15-1986 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, DECEMBER 15, 1986 1 The Common Council of the City of Richmond, Indiana met in regular session December 15, 1986 2 at the hour of 7:3:0 P.M. in the Council Chambers in said City. President Brookbank presided with 3 the following Councilmembers present: Williams, Hankinson, Whitesell, Parker, Hutton, Morris 4 and Theobald. Absent: Elstro. The following.business was had to-wit: 5 6 APPROVAL OF MINUTES OF DECEMBER 1, 1987 7 8 Councilmember Hankinson moved to approve the minutes of the previous meeting as prepared, 9 seconded by Councilmember Parker and on unanimous voice vote the motion was carried. 10 11 COMMUNICATIONS FROM THE MAYOR 12 13 Mayor Frank H. Waltermann welcomed Chester Theobald as a member of the Common Council and 14 wished him well. 15 16 PRESENTATIONS OF REMONSTRANCES, PETITIONS AND MEMORIALS 17 18 Councilmember Morris commented on the adoption of the contract between the City and the F.O.P. 19 and complimented Officers Fitzgerald, Shaw and Hurst on their acts of bravery at rescuing a child 20 from a fire today. The Council asked that the Clerk draft a resolution to the officers. 21 22 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY 23 24 Board President Silberstein reported that the performance bond requirement had been dropped on 25 the unsafe building at 1302 East Main Street after a new owner had purchased the property and 26 repairs had started. Ms. Silberstein stated that the property at 326 North 10th Street was to be 27 repaired by June 1, 1987 and a bond was required to be posted. 28 29 Ms. Silberstein informed the Council that the residents of the 300 block of South 5th Street had 30 petitioned the Board for residential parking privileges, but the constraints of the residential 31 parking ordinance would not have alleviated their situation with evening parking. 32 33 Ms. Silberstein stated the Board had approved an agreement with the State for the signalization 34 of the intersection of U.S. 40 and Eastern Indiana Industrial Parkway and approved addendums to 35 the Police and Fire contracts. 36 37 REPORTS FROM SPECIAL COMMITTEES 38 39 Human Relations Ordinance Committee 40 41 President Brookbank appointed a special committee of Councilmember Whitesell as Chairman, 42 Councilmember Morris, Councilmember Hutton, Councilmember Elstro and Councilmember 43 Williams for the purpose of considering Ordinance No. 45-1986 on a Human Relations Commission. 44 The committee is to report on the ordinance at the second meeting of January, 1987. 45 46 REPORTS FROM STANDING COMMITTEES 47 48 AIRPORT BOARD 49 50 Councilmember Parker reported that the Airport showed a $65,000.00 profit in November of 51 1986 and had discussed the cost of liability insurance. Councilmember Parker stated that the 521 interior and exterior painting had been completed and looked very good. 53 54 PLAN COMMISSION 55 56 Councilmember Morris reported that the re-zoning of the property on South Q Street would be 57 back on public hearing on December 23, 1986. 58 59 MISCELLANEOUS BUSINESS 60 61 Clearview Cable - TCI Presentation 62 63 President Brookbank stated that even though the Common Council has no control over cable, they 64 still receive complaints. She added that one of the major problems is the inability to reach the 65 cable office by telephone to report problems, since the lines always seem busy. 4.4' Common Council Minutes Cont'd December 15, 1986 Page 2 1 President Brookbank introduced Mr. Rich Cody, Manager of Clearview Cable TV. Mr. Cody 2 introduced Mr. Lee Endicott, Indiana State Manager. 3 4 Mr. Endicott informed the Council that he and Mr. Cody had talked over the proposed channel 5 restructure and had decided that the plans as presented were not as good as originally believed. 6 Mr. Endicott stated they had decided to do a survey of subscribers to determine what they would 7 like and they were asking the Richmond Telecommunications Council to help design the survey. 8 Mr. Endicott stated that no channels would be rearranged until after the completion of the survey, 9 but they will be adding channels in open spaces. 10 11 Mr. Endicott added that they would be carrying Channel 45 as a must carry and there had been 12 quite a bit of confusion on the must carry rules that become effective January 1, 1987. Mr. 13 Endicott stated that it now appears that all of the Dayton Market in qualified to be carried under 14 the must carry ruling. He said that Channel 22 will not meet the significantly viewed status and 15 Clearview would have to pay a copyright fee to carry Channel 22, therefore it will not be 16 carried. 17 18 Councilmember Hutton asked if the problem with the phone lines would be rectified and Mr. 19 Endicott stated they were doing a phone survey now to see if problems exist. 20 21 Councilmember Whitesell asked about stereo broadcasts and if it can or cannot be received locally 22 and Mr. Endicott stated they would have to contact the networks to see if it is available and then 23 check their processors. 24 25 In response to Councilmember Whitesell about converters, Mr. Endicott stated there was no 26 additional monthly charge for additional outlets, but the converters would be needed if the sets 27 were not cable ready. 28 29 Councilmember Hankinson asked if plans were still to keep Channel 14/16 and Mr. Endicott stated 30 they would be kept. 31 32 Councilmember Morris asked about the status of the PEG channel and Mr. Endicott stated he spoke 33 with TCI and the agreement regarding the PEG channel was to be signed and routed back locally. 34 35 Councilmember Williams asked about rate increases and how many could be planned on throughout 36 the year and Mr. Endicott stated that he could not answer that, but that rates will be deregulated 37 January 1, 1987. 38 39 President Brookbank asked if they were planning to expand the cable into Reeveston and Mr. 40 Endicott stated they were having problems obtaining easements and they were unable to build 41 without easements. 42 43 DELAY OF ALL AMERICAN CITY PRESENTATION 44 45 In order to accomodate a live broadcast of the All American City Presentation, President 46 Brookbank continued with the Agenda and announced the Agenda would be interrupted at the 47 appropriate time for the presentation. 48 49 ORDINANCES 50 51 ORDINANCES ON FIRST READING 52 53 Councilmember Morris moved to suspend the rules and read Ordinances No. 91, 92, 93, 94 and 54 95-1986 on first reading by title only, seconded by Councilmember Hankinson and on unanimous 55 voice vote the motion was carried. 56 57 _ORDINANCE NO. 91-1986 58 59 The Clerk read on first reading by title only Ordinance No. 91-1986 - AN ORDINANCE OF THE 60 CITY OF RICHMOND, INDIANA AUTHORIZING THE CONSENT OF THE CITY TO THE CONVEYANCE OF 61 REAL ESTATE AND THE ASSIGNMENT OF THE LOAN AGREEMENT, A PART OF THE FINANCING 62 AGREEMENT UNDER WHICH CITY OF RICHMOND ECONOMIC DEVELOPMENT REVENUE BONDS,SERIES 63 1985(IMPERIAL PROJECT), WERE ISSUED AND SOLD. 64 65 Councilmember Hankinson moved to suspend the rules and move Ordinance No. 91-1986 to second 447 Common Council Minutes Cont'd December 15, 1986 Page 3 1 reading, seconded by Councilmember Williams and on unanimous voice vote the motion was 2 carried. 3 4 The Clerk read on second reading Ordinance No. 91-1986. 5 6 President Brookbank announced Ordinance No. 91-1986 was on public hearing. 7 8 Speaking for Ordinance No. 91-1986 was Mr. Andrew Cecere, Attorney at Law, 101 South A 9 Street. 10 11 Mr. Cecere stated he was representing Mr. Ray Imperial and that the bonds had been sold for the 12 construction of a facility in Eastern Indiana Industrial Park and that now Mr. Imperial is entering 13 into a sale of the facility. Mr. Cecere stated that in order to effectuate the sale of the business 14 and real estate, the bonds would need to be transferred to the new company (Imperial Products, 15 Inc.) Mr. Cecere explained that the Second National Bank would also have to approve the sale as 16 the purchaser of the bonds and that the Ordinance empowers the Mayor and the Clerk to execute 17 documents if the sale goes through and is approved by the bank. 18 19 Mr. Cecere stated that Mr. Imperial will remain as General Manager and the prospective new 20 owner has three (3) plants and is interested in the area and in growing within the area, which 21 could mean expansion in Richmond. 22 23 Councilmember Morris asked if Mr. Cecere was familiar with any plans for expansion by the new 24 owner and Mr. Cecere said he was not, only certain of the desire to grow. 25 26 Councilmember Hutton asked who the purchaser was and Mr. Cecere stated it was Dunn Barth 27 Company of Alabama. 28 29 Councilmember Parker asked if the City Attorney had approved the Ordinance and Mr. Barden 30 stated he had approved the document. 31 32 There being no further comment, Councilmember Hankinson moved for engrossment, seconded by 33 Councilmember Williams and on unanimous voice vote the motion was carried. 34 35 Councilmember Morris moved to suspend the rules and move Ordinance No. 91-1986 to third and 36 final reading and read by title only, seconded by Councilmember Parker and on unanimous voice 37 vote the motion was carried. 38 39 The Clerk read Ordinance No. 91-1986 on third and final reading by title only. 40 41 Ordinance No. 91-1986 was adopted on the following call of the roll: 42 43 Ayes: Williams, Hankinson, Whitesell, Parker, Hutton, Morris, Theobald and Brookbank. (8) 44 Nays: None 45 Absent: Elstro 46 , 47 ALL AMERICAN CITY PRESENTATION 48 49 The team consisting of Nan Halsey, Mayor Frank H. Waltermann and Henry Merrill shared with 50 the Council and the citizens of the City the presentation made in Kansas City during the 51 competition for the All American City Competition. The presentors were assisted by John Ford 52 and the other members of the committee were in attendance. 53 54 The All American City Presentation consisted of a ten (10) minutes verbal presentation 55 accompanied by a slide. show and spoke of the attritubes of the City including Economic 56 Development, Gorge Park, Displaced Worker Assistance Programs and others. 57 58 CONTINUATION OF REGULAR BUSINESS 59 60 ORDINANCE NO. 92-1986 61 62 The Clerk read on first reading by title only Ordinance No. 92-1986 - AN ORDINANCE RATIFYING 63 CERTAIN BENEFIT PAYMENTS TO THE RICHMOND POLICE DEPARTMENT AND FIRE DEPARTMENT 64 EMPLOYEES. 448 Common Council Minutes Cont'd December 15, 1986 Page 4 1', Councilmember Morris moved to suspend the rules and move Ordinance No. 92-1986 to second 2 reading, seconded by Councilmember Whitesell and on unanimous voice vote the motion was 3 carried. 4 5 The Clerk read Ordinance No. 92-1986 on second reading. 6 7 President Brookbank announced Ordinance No. 92-1986 was on public hearing. 8 There being no comment, Councilmember Hankinson moved for engrossment, seconded by 10 Councilmember Williams and on unanimous voice vote the motion was carried. 11 12 Councilmember Hankinson moved to suspend the rules and move Ordinance No. 91-1986 to third 13 and final reading and read by title only, seconded by Councilmember Hutton and on unanimous 14 voice vote the motion was carried. 15 16 The Clerk read Ordinance No. 91-1986 on third and final reading by title only. 17 18 Ordinance No. 92-1986 was adopted on the following call of the roll: 19 20 Ayes: Williams, Hankinson, Whitesell, Parker, Hutton, Morris, Theobald, and Brookbank (8) 21 Nays: None 22 Absent: Elstro 23 24 ORDINANCE NO. 93-1986 25 26 The Clerk read on first reading by title only Ordinance No. 93-1986 - AN ORDINANCE RATIFYING 27 THE PROFESSIONAL NEGOTIATION AGREEMENT BETWEEN THE RICHMOND PROFESSIONAL 28 FIREFIGHTERS INC., LOCAL 1408 AND THE CITY OF RICHMOND; PROVIDING FOR LONGEVITY PAY 29 FOR THE FIREFIGHTERS;AND AMENDING ORDINANCE NO.53-1986 TO SET SALARIES FOR CERTAIN 30 APPOINTED OFFICERS AND EMPLOYEES. 31 32 Councilmember Morris moved to suspend the rules and read Ordinance No. 93-1986 on second 33 reading, seconded by Councilmember Hankinson and on unanimous voice vote the motion was 34 carried. 35 36 The Clerk read Ordinance No. 93-1986 on second reading. 37 38 President Brookbank announced Ordinance No. 93-1986 was on public hearing. 39 40 Speaking for Ordinance No. 93-1986 was Susan Silberstein. Ms. Silberstein informed the Council 41 that negotiations for both Police and Fire contracts for 1987 had been enjoyable and she felt they 42 were a friutful experience and good contracts had been negotiated. 43 44 There being no further comment, Councilmember Williams moved for engrossment of Ordinance 45 No. 93-1986, seconded by Councilmember Whitesell and on unanimous voice vote the motion was 46 carried. 47 48 Councilmember Williams moved to suspend the rules and move Ordinance No. 93-1986 to third 49 and final reading and read by title only, seconded by Councilmember Hankinson and on unanimous 50 voice vote the motion was carried. 51 52 The Clerk read Ordinance No. 93-1986 on third and final reading by title only. 53 54 Ordinance No. 93-1986 was adopted on the following call of the roll: 55 56 Ayes: Williams, Hankinson, Whitesell, Parker, Hutton, Morris, Theobald and Brookbank (8) 57 Nays: None 58 Absent: Elstro 59 60 ORDINANCE NO. 94-1986 61 62 The Clerk read on first reading by title only Ordinance No. 94-1986 - AN ORDINANCE RATIFYING 63 THE PROFESSIONAL NEGOTIATION AGREEMENT BETWEEN THE F.O.P. Ms. Silberstein stated that there 9 were very few changes and the Board of Works had just adopted the contract at a special meeting 10 this morning. She said she was pleased they were able to reach a mutually acceptable level prior 11 to the end of the year. 12 13 There being no further comment, Councilmember Hankinson moved for engrossment of Ordinance 14 No. 94-1986, seconded by Councilmember Williams and on unanimous voice vote the motion was 15 carried. 16 17i Councilmember Williams moved to suspend the rules and move Ordinance No. 94-1986 to third 18 and final reading and read by title only, seconded by Councilmember Hankinson and on unanimous 19 voice vote the motion was carried. 20 21 The Clerk read Ordinance No. 94-1986 on third and final reading by title only. 22 23 Ordinance No. 94-1986 was adopted on the following call of the roll: 24 25 Ayes: Williams, Hankinson, Whitesell, Parker, Hutton, Morris, Theobald and Brookbank (8) 26 Nays: None 27 Absent: Elstro 28 29 ORDINANCE NO. 95-1986 30 31 The Clerk read on first reading by title only Ordinance No. 95-1986 - AN ORDINANCE AMENDING 32 ORDINANCE NO. 53-1986 (1987 SALARY ORDINANCE FOR THE CITY OF RICHMOND, INDIANA FOR 33 THE FISCAL YEAR BEGINNING JANUARY 1, 1987 AND ENDING DECEMBER 31, 1987) 34 35 Councilmember Morris moved to suspend the rules and move Ordinance No. 95-1986 to third and 36 final reading and read by title only, seconded by Councilmember Whitesell and on unanimous voice 37 vote the motion was carried. 38 39 The Clerk read Ordinance No. 95-1986 on second reading. 40 41 President Brookbank announced Ordinance No. 95-1986 was on public hearing. 4 43 Councilmember Morris asked Mayor Waltermann if he could give some specifics on the need to 44 increase the salary of the Chief of Fire Prevention. 45 46 Mayor Waltermann stated that he had asked Planning Director, Dan Dooley, to speak to the 47 Council about the importance of this position in connection with the new fire and building codes. 48 49 Mr. Dooley informed the Council that the new codes were effective July 1, 1986 and there were 50 now significant new responsibilities. He said the Fire Department would now have to inspect all 51 public buildings and all but one and two family dwellings. Mr. Dooley stated the law requires 52 annual inspections and the Building Inspectors are responsible for new structure and the Fire 53 Department for all existing structures. 54 5 Mayor Waltermann stated that the magnitude of the job is enormous and the enforcement of. the 56 codes will change the structure of the Fire Prevention Bureau, making the Chief of Fire 571 Prevention a supervisor. The Mayor said that Fire Chief Trotter had requested the pay for this 58 position be placed just below that of the Assistant Fire Chief. Mayor Waltermann stated the 59 increase will not cause additional funds to be needed. 60 61 Councilmember Morris stated that she felt there were startling violations within the community. 62 63 There being no further comment, Councilmember Williams moved for engrossment, seconded by Councilmember Whitesell and on unanimous voice vote the motion was carried. r 50 Common Council Minutes Cont'd December 15, 1986 Page 6 1 Councilmember Williams moved to suspend the rules and move Ordinance No. 95-1986 to third 2 and final reading and read by title only, seconded by Councilmember Morris and on unanimous 3 voce vote the motion was carried. 4 5 The Clerk read Ordinance No. 95-1986 on third and final reading by title only. 6 7 Ordinance No. 95-1986 was adopted on the following call of the roll: 8 9 Ayes: Williams, Hankinson, Whitesell, Parker, Hutton, Morris, Theobald and Brookbank (8) 10 Nays: None 11 Absent: Elstro 12 13 1987 BUDGET 14 15 City Clerk, Mary Merchanthouse, commented that she would like to congratulate the Mayor, the 16 City Controller and the Council on the 1987 Budget She commented that the budget had been 17 approved by the State Tax Commission and the only cuts made in the entire budget was the 18 20,000.00 Council had cut at their hearings. 19 20 ADJOURNMENT 21 22 There being no further business, on a motion duly made, seconded and passed, the meeting was 23 adjourned. 24 25 26 27 Jane R. President Brookbank presided with 3 the following Councilmembers present: Elstro, Williams, Hankinson, Parker, Hutton, Morris and 4 Theobald. Absent: Whitesell. The following business was had to-wit: 5 6 ELECTION OF OFFICERS FOR 1987 7 8 President Brookbank requested nominations be received for the Office of President of the 9 Common Council. 10 11 Councilmember Hutton placed the name of Councilmember Brookbank in nomination for President 12 of the Common Council for 1987. The motion was seconded by Councilmember Williams. 13 14 Councilmember Morris moved to close the nominations, seconded by Councilmember Williams and 15 on unanimous voice vote the motion was carried. 16 17 There being no further nominations, Councilmember Brookbank was elected President of the 18 Common Council for 1987. 19 20 President Brookbank requested nominations be received for the Office of President Pro-tern of 21 the Common Council. 22 23 Councilmember Morris placed the name of Councilmember Whitesell in nomination for the Office 24 of President Pro-tern. The motion was seconded by Councilmember Hutton. 25 26 Councilmember Williams moved to close the nominations for the Office of President Pro-tern, 27 seconded by Councilmember Morris and on unanimous voice vote the motion was carried. 28 29 Councilmember Whitesell will serve as President Pro-tern of the Common Council for 1987. 30 31 President Brookbank thanked the members of Common Council for their continued support. 32 33 ADJOURNMENT 34 35 There being no further business, on a motion duly made, seconded and passed the meeting was 36 adjourned. 37 38 39 40 41 Jane R.
