PROCEEDINGS OF THE COMMON COUNCIL OF THE
CITY OF RICHMOND, INDIANA, DECEMBER 1, 1986
1 The Common Council of the City of Richmond, Indiana, met in regular session
2 December 1, 1986 at the hour of 7:30 P.M. in the Council Chambers in said
3 City. President Brookbank presided with the following Councilmembers
4 present: Elstro, Williams, Hankinson, Whitesell, Parker, Hutton and Morris.
5 Absent: None. The following business was had to-wit:

1 APPROVAL OF MINUTES OF NOVEMBER 17, 1986

13 Councilmember Hankinson moved to approve the minutes of the previous meeting
14 as prepared, seconded by Councilmember Hutton and on unanimous voice vote
15 the motion was carried.

17 COMMUNICATIONS FROM THE MAYOR

19 Mayor Frank H. Waltermann reported to the Council that the City had
2 received approximately twenty-five (25) calls in regards to flooding of
2 basements from the most recent rains . Mayor Waltermann stated the same
2 procedures are in effect as before, with inspections and clean-ups being
2 provided upon reporting the problems . He stated they hope to have alleviates
24 some of the problems with the insertion of a new pipe in the south end.

20+ The Mayor informed the Council that he was glad to be back home after
27i his recent trip to Japan with the Mid-American Japanese Association.
ili 25 He said there were 130 persons participating from a five (5) state area
III 29 and Governor Orr was the only governor in attendance. Mayor Waltermann
3d stated the group from Richmond had made over 100 contacts in Japan and
31 hoped the trip would be fruitfull.

3 Mayor Waltermann indicated that the highlight of the trip was the visit
3 with Sanyo and their research labs . He stated he would make a more formal
3 report in the future.

3 BOARD OF PUBLIC WORKS AND SAFETY

3 Councilmember Morris reminded the Council and the public of the meeting
41 of the Telecommunications Council to be held on December 2, 1986 at 7:30
4 P.M. She added that she has petitions regarding Clearview Cable and has
44 been approached by citizens wanting to speak.

4 Councilmember Hankinson asked the Press to remind the public that the
4- Telecommunications Council meeting was open to the public and of the place
4 and time.

5, President Brookbank reported that the Reid Hospital Board had been lined
III 5 up with members for another year.

5 MISCELLANEOUS BUSINESS

5 President Brookbank welcomed the government students from Centerville
5: in attendance.

61 GTE Equal Access Presentation

6, President Brookbank introduced Mr. Tom Docherty and Ms . Rhonda Walton
6 with GTE. Mr. Docherty explained that many changes have taken place in
6 the telephone service and by exchanging information there is a better
6' understanding. Mr. Docherty introduced Ms . Walton to present more information

1 regarding equal access .

3 Ms . Walton stated that equal access would allow customers to use more than
4 one (1) long distance company and the purpose is to give the right to use
5 other than your preferred company if all circuits were busy. She stated
6 that changes were made regarding long distance companies when ATT was
7 divested of the Bell Companies. Ms. Walton indicated that equal access would
8 be available to all consumers with the possible exception of persons in small
9 communities. She said the long distance companies available in this area
10 are AT&T, One Call Communications and SPRINT would be available after the
11 December 13, 1986 deadline date.

13 Ms . Walton said preferred long distance companies could be chosen by sending
14 in the ballot received, calling the local business office or calling the long
15 distance company direct. She said if you want to change your preferred
16 company, you should do it prior to the December 13th deadline or there would
17 be a charge added if you change after the conversion date.

19 Ms . Walton explained that if the customer did not choose a preferred long
20 distance company by December 13, 1986 one be allocated on a percentage basis .

22 Ms . Walton stated that billing would be done by the long distance company
23 and that GTE does bill for AT&T. She added that trouble should be reported
24 to the long distance company or if it was in the geographic area handled by
25 GTE they could address the problems.

27 Ms. Walton gave a sample of comparative rates for the long distance companies
28 available locally and encouraged consumers to be aware of rates and to feel
29 free to call the local business office with questions. Ms . Walton stated
30 that she feels the equal access will improve long distance calling needs .

32 Councilmember Whitesell thanked Ms .Walton for the information and stated that
33 he was unaware you could access any company other than your preferred company
34
35 Councilmember Hankinson asked if the access numbers to call through other
36 companies would be made available and Ms . Walton stated customers would have
37 to call the long distance companies to get the access numbers and to
38 indicate an interest in that company so that you may be allowed to utilize
39 their services and not blocked when trying to access .

41 Councilmember Elsto asked if this would improve the billing from GTE and Ms.
42 Walton stated there would be some changes in the billing starting January
43 7, 1987.

45 Councilmember Morris asked about One Call Communications and Ms. Walton
46 stated they were organized as TMC in 1982 and started providing long distance
47 service in 1985.

49 Councilmember Williams addressed Mr. Docherty with a complaint regarding a
50 lack of help in the business office causing persons to wait in lines to pay
51 telephone bills.

53 Mr. Docherty stated he agreed and would look at the problem to see if it
54 could be eliminated.

56 Mr. Docherty stated the equal access was a confusing situation and he felt
57 the Palladium-Item had covered it well. He said GTE wants to continue to
58 be the telephone company and to help make the transition as easy as possible.
59 He added that he appreciated the opportunity to talk about equal access and
60 encouraged customers to call if they have any doubts .

62 Storm Flooding Problems

64 Public Works Director, Ralph Willis addressed the Council regarding the recent
65 flooding in basements and reported that the City has widened pipes between

1 South 6th and 7th Streets which should make some minor improvements in
2 the area. Mr. Willis stated that they had also tapped the storm sewer
3 on llth Street.

5 Mr. Willis indicated they are doing an investigation with field cameras
6 and are 70% complete. He said the City is trying to do something about
7 the problems with flooding, but they will not give any false hopes since
8 the existing system is beat up and it is too costly to replace completely.

10 Councilmember Elstro asked about not enough storm sewers on South L and
11 South 9th Streets and Mr. Willis stated there is a big storm sewer at
12 9th and L and enough inlets would handle the problem. He said. there
13 is a 66" sewer for all the south end and surface water:; is going. into:
14 the sanitary-sewer . ; n

16 Mr. Willis stated that the regulatory agencies could make up plug up
17 the taps. Mr. Willis informed the Council that no one had to be relocated,
18 but that provisions had been made at the Kuhlman Center for emergencies
19 and there had also been offers of donations of food if needed.

25 Councilmember Elstro moved to suspend the rules and read Ordinance No.
26 90-1986 on first reading by title only, seconded by Councilmember Morris
27 and on unanimous voice vote the motion was carried.

32 AN ORDINANCE CREATING A REPLACEMENT FUND TO CONSTRUCT, REPAIR, IMPROVE
33 OR REPLACE. BUILDINGS, STRUCTURES, GROUNDS AND EQUIPMENT FOR OFF STREET
34 PARKING FACILITIES FOR THE CITY OF RICHMOND, INDIANA.

36 Councilmember Hankinson moved to suspend the rules and move Ordinance
37 No. 90-1986 to second reading, seconded by Councilmember Morris and on
38 unanimous voice vote the motion was carried.

42 President Brookbank announced Ordinance No. 90-1986 was on public hearing.

44 Speaking for Ordinance No. 90-1986 was Off Street Parking Manager Mary
45 Merchanthouse. Ms. Merchanthouse explained to the Council that the Off
46 Street Parking Fund would have a fund balance and all past debt paid
47 at the end of 1986. Ms . Merchanthouse stated that with federal funds
48 unavailable for such structures as the parking garage, plans needed to
49 be made for any replacement or large repairs and this ordinance would
50 set aside a percentage of any cash balance in excess of 1,000.00 at the
51 end of the fiscal year to be dedicated for replacement and repairs of
52 structures, etc. and not allow the funds to spent for other less important
53 reasons .

55 Councilmember Morris asked about the amount of funds available and Ms.
56 Merchanthouse stated that as of November 27, 1986 there was a 22,000.00
57 plus cash operating balance and that after December expenses had been
58 met and all past debt paid, there should be 10,000.00 to be put into
59 the replacement fund. .

61 There being no further comment, Councilmember Elstro moved for engrossment
62 of Ordinance No. 90-1986, seconded by Councilmember Hankinson and on
63 unanimous voice vote the motion was carried.

17 The Clerk read on second reading Ordinance No. 86-1986 - AN ORDINANCE VACATING
18 A CERTAIN PUBLIC WAY WITHIN THE CITY OF RICHMOND, INDIANA.

20 Mr. Barden examined the Proof of Publication and found it to be in order.
21 Coucilmember Morris moved to accept and file the Proof of Publication,
22 seconded by Councilmember Whitesell and on unanimous voice vote the motion
23 was carried.

25 President Brookbank announced Ordinance No. 86-1986 was on public hearing.

27 Speaking for Ordinance No. 86-1986 was Mr. Donald Simkin, Attorney at Law,
28 25 North 7th Street. Mr. Simkin addressed the Council resprenting Holland
29 Colors, Inc. Mr. Simkin stated that Holland Colors was petitioning to vacate
30 part of a twenty (20) foot alley contiguous to lots 615, 616, 623 and 624
31 in Elizabeth Starr's Addition. Mr. Simkin indicated that each utility
32 company had given consent for the vacation and that Mr. Mosey, adjacent
33 property owner, had spoken in favor of the petition at the public hearing
34 held by the Richmond Plan Commission.

36 Mr. Simkin stated that the only concern expressed at the Plan Commission
37 hearing was trash pick-up and Mr. Willis said there would be no effect.
38 Mr. Simkin added that Mr. Mosey was willing to dedicate an easement for
39 turn around of the trash trucks.

41 Mr. Simkin stated the vacated alley would be used for parking for employees
42 of Holland Colors in order that they would not have to use city streets
43 for parking.

45 The Plan Commission voted unanimously to recomment adoption of Ordinance
46 No. 86-1986 and Councilmember Morris reminded the Council that the issue
47 of a turn around area for trash trucks has no bearing on the petition for
48 the vacation of the alley.

50 There being no further comment, Councilmember Elstro moved for engrossment
51 of Ordinance No. 86-1986, seconded by Councilmember Hankinson and on unanimous
52 voice vote the motion was carried.

54 Councilmember Morris moved to suspend the rules and move Ordinance No.
55 . 86-1986 to third and final and read by title only, seconded by Councilmember
56 Parker and on unanimous voice vote the motion was carried.

1 Councilmember Whitesell commented on the positive references he is hearing
2 about ICC Primex and he would like to add his appreciation and compliments.

16 Speaking for Ordinance No. 87-1986 was Mr. Wil.l,iardDeBruler or 112 West
17 Main Street, Centerville, Indiana. Mr. DeBruler stated that he had been
18 in business in Wayne County for twenty-six (26) years and he has completed
19 a lot of renovation on the property at 317 South 5th Street.

21 Mr. DeBruler informed the Council that on a petition of the neighborhood,
22 95% of the neighbors approved the placement of an antique shop as requested
23
24 Councilmember Morris asked Mr. DeBruler if he intended to reside at his
25 place of business also and Mr. DeBruler stated that was their eventual
26 plans .

49 City Attorney Barden suggested that the Council strike Ordinances No.
50 16-1986 and 46-1986 dealing with construction waste at the landfill and
51 to leave the opportunity for them to be reintroduced at a later date
52 without having to wait the one (1) year for reintroduction.

54 Councilmember Hankinson moved to strike Ordinances No. 16-1986 and 46-
55 1986 from the agenda and allow their reintroduction when needed, seconded
56 by Councilmember Whitesell and on unanimous voice vote the motion was
57 carried.
