HomeMy Public PortalAbout11-17-1986 433 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, NOVEMBER 17, 1986 1 The Common Council of the City of Richmond, Indiana, met in regular session 2 November 17, 1986 at the hour of 7:30 P.M. in the Council Chambers in said 3 City. President Brookbank presided with the following Councilmembers III 4 in attendance: Elstro, Williams , Hankinson, Whitesell, Parker, Hutton 5 and Morris. Absent: Bodiker. The following business was held to-wit: 6 . 7 PLEDGE OF ALLEGIANCE 8 9 SILENT DEVOTIONS 10 11 APPROVAL OF MINUTES OF NOVEMBER 3, 1986 12 13 Councilmember Hankinson moved to approve the minutes of the previous meeting 14 as prepared, seconded by Councilmember Hutton and on unanimous voice vote 15 the motion was carried. 16 17 REPORT FROM CITY DEPARTMENTS 18 19 City Attorney Ken Barden reported on the ticketing on Fire Lane violations 20 and that many of the vehicles in violation are from out of state or city. 21 Mr. Barden stated the ordinance was working and that he has had stores 22 thanking for the City's assistance in solving a problem and that the stores 23 are getting compliments from their customers on the clear fire lanes. 24 25 BOARD OF PUBLIC WORKS AND SAFETY 26 27 Councilmember Morris commented on the numerous calls she has received 28 regarding the channel changes to be made by Clearview Cable and the 29 dissatisfaction of the subscribers with the changes. Councilmember Morris 3 suggested a public forum might be the best approach to take and that the 3 Telecommunications Council would be a good place for public discussion. 3 Councilmember Morris suggested petitions regarding the channel changes 33 without any local input should be made available to the public. 34 35 Councilmember Hankinson stated that he had also received numerous calls 30 on the channel changes and feels it is the height of irresponsibility on 31 the part of TCI. 38 31 President Brookbank stated she had also received calls and the public is 40 concerned and upset. 41 421 Mr. Barden informed the Council that the contract between TCI and the County 4 is up for renewal and that possibly this would be a place for comment. 4 Mr. Barden stated that with deregulation of the cable industry, public 4 persuasion would have to be used. 46 47 Councilmember Parker commented on the intersection of S.W. 16th and 48 National Road West and the concerns of the residents of the area with the 4 suggestion of the State that the signal be downgraded to flasher except 5 during times school children would be using the crossing. Councilmember 5 Parker stated the residents of the area would be circulating another petition_ 51 to present to the State in support of the intersection remaining signalized. 5 5 REPORTS FROM STANDING COMMITTEES 5 5 Park Board 5 5: Councilmember Hutton informed the Council that the Park Board has had 5• several meetings interviewing architects for the proposed bond issue projects 61 and that an engineering firm had been hired to work up specifications on 6 the projects and the costs . 6, 6 Councilmember Parker asked Councilmember Hutton to inquire about the 6 possibility of leaving the fence at Clear Creek down until next spring 6' to allow sledding for the children. 04 Common Council Minutes Cont'd November 17, 1986 Page 2 1 MISCELLANEOUS BUSINESS 2 3 President Brookbank welcomed the students in attendance from Richmond and 4 Centerville government classes. 5 6 ORDINANCES. 7 8 ORDINANCES ON FIRST READING 9 10 Councilmember Morris moved to suspend the rules and read Ordinances No. 85, 11 86, 87, 88 and 89-1986 on first reading by title only, seconded by 12 Councilmember Parker and on unanimous voice vote the motion was carried. 13 14 ORDINANCE NO. 85-1986 15 16 The Clerk read on first reading by title only Ordinance No. 85-1986 - AN 17 ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 18 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, 19 INDIANA, PROVIDING FOR THE REZONING OF PROPERTY LOCATED AT 401 SOUTH "Q" 20 • STREET FROM M-1 LIGHT INDUSTRIAL DISTRICT AND R-3 ONE-TO-EIGHT FAMILY 21 RESIDENCE DISTRICT TO M-1 SU AND R-3 SU AND PROVIDING FOR THE SPECIAL USE 22 OF SAID PROPERTY AS AN AUTOMOBILE ACCESSORY STORE AND ALSO AS AN ACCESS DRIVE 23 SERVING AS AN ACCESSORY OFF-STREET PARKING FACILITY. 24 25 President Brookbank assigned Ordinance No. 85-1986 to the Plan Commission 26 for public hearing and recommendation. 27 28 Councilmember Elstro stated that he is receiving calls against the 29 proposed zoning and hoped the Council would take a close look at the 30 request. 31 32 Councilmember Morris reminded the Council and public that the Plan 33 Commission will be having their public hearing on the request on November 34 25, 1986. 35 36 ORDINANCE NO. 86-1986 37 38 The Clerk read on first reading by title only Ordinance No. 86-1986 - AN 39 ORDINANCE VACATING A CERTAIN PUBLIC WAY WITHIN THE CITY OF RICHMOND, 40 INDIANA. 41 42 President Brookbank assigned Ordinance No. 86-1986 to the Plan Commission 43 for public hearing and recommendation. 44 45 ORDINANCE NO. 87-1986 46 47 The Clerk read on first reading by title only Ordinance No. 87-1986 - AN 48 ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 49 2325-1986, COMMONLY KNOWN AS THE ZONIG ORDINANCE OF THE CITY OF RICHMOND, 50 INDIANA, PROVIDING FOR THE REZONING OF PROPERTY LOCATED AT 317 SOUTH 5TH 51 STREET FROM R-3 ONE-TO-EIGHT FAMILY RESIDENCE DISTRICT TO R-3 ONE-TO-EIGHT 52 FAMILY RESIDENCE SPECIAL USE DISTRICT, AND AUTORIZING THE SPECIAL USE OF SAID 53 PROPERTY AS AN ANTIQUE SHOP. 54 55 President Brookbank assigned Ordinance No. 87-1986 to the Plan Commission 56 for public hearing and recommendation. 57 58 TRANSFER ORDINANCE NO. 88-1986 59 60 The Clerk read on first reading by title only Transfer Ordinance No. 88-1986- 61 AN ORDINANCE TO TRANSFER WITHIN THE GENERAL FUND. 62 63 Councilmember Morris moved to suspend the rules and move Ordinance No. 88- 64 1986 to second reading, seconded by Councilmember Whitesell and on unanimous 65 voice vote the motion was carried. 435' Common Council Minutes Cont'd November 17, 1986 Page 3 1 The Clerk read Ordinance No. 88-1986 on second reading. 2 3 President Brookbank announced Ordinance No. 88-1986 was on public hearing. 4 5 City Controller Marge Sweet explained that the transfers of funds was in 6 the Mayor's Office from capital outlay to contractual services to defray 7 the costs of the All American City competition costs , to pay for an 8 energy conference for Energy Director Lynn Johnstone and for costs for 9 the Mid-West Japan Conference. 10 11 There being no further discussion, Councilmember Williams moved for 12 engrossment of Ordinance No. 88-1986, seconded by Councilmember Whitesell 13 and on unanimous voice vote the motion was carried. 14 15 Councilmember Morris moved to suspend the rules and move Transfer Ordinance 16 No. 88-1986 to third and final reading and read by title only, seconded 17 by Councilmember Hutton and on unanimous voice vote the motion was carried. 18 19 The Clerk read Transfer Ordinance No. 88-1986 on third and final reading 20 by title only. 21 22 Transfer Ordinance No. 88-1986 was adopted on the following call of the 23 roll: 24 25 Ayes: Elstro, Williams, Hankinson, Whitesell, Parker, Hutton, Morris and 26 Brookbank (8) 27 Nays: None 28 Absent: Bodiker (1) 29 30 TRANSFER ORDINANCE NO. 89-1986 31 32 The Clerk read on first reading by title only Transfer Ordinance No. 89-1986 33 AN ORDINANCE TO TRANSFER WITHIN THE PURCHASING FUND. 34 35 Councilmember Morris moved to suspend the rules and move Ordinance No. 36 89-1986 to second reading, seconded by Councilmember Whitesell and on 37 unanimous voice vote the motion was carried. - 38 39 The Clerk read Ordinance No. 88-1986 on second reading. 40 41 President Brookbank announced Ordinance No. 88-1986 was on public hearing. 42 43 City Controller Marge Sweet explained that the transfer from from the 44 payroll account to contractual services to contract for assistance in writin•_ 45 specifications and bidding bulk materials, capital equipment and central 46 store items. Ms . Sweet informed the Council that with the resignation 47 of the Purchasing Director these items needed to be completed before the 48 end of the year. Ms . Sweet added that former Purchasing Director, Rita 49 Stout, would assist on a contract basis to be paid by the hour not to 50 exceed 1,500.00. 51 52 There being no further comment, Councilmember Hankinson moved for 53 engrossment of Ordinance No. 89-1986, seconded by Councilmember Parker 54 and on unanimous voice vote the motion was carried. 55 56 Councilmember Morris moved to suspend the rules and move Transfer Ordinance 57 No. 89-1986 to third and final reading and read by title only, seconded 58 by Councilmember Hutton and on unanimous voice vote the motion was carried. 59 60 The Clerk read Transfer Ordinance No. 89-1986 on third and final reading 61 by title only. 62 63 Transfer Ordinance No. 89-1986 was adopted on the following call of the 64 roll: 65 4$ Common Council Minutes Cont'd November 17, 1986 Page 4 1 Ayes: Elstro, Williams, Hankinson, Whitesell, Parker, Hutton, Morris and 2 Brookbank (8) 3 Nays: None 4 Absent: Bodiker (1) 5 6 UNFINISHED BUSINESS 7 8 Mr. Barden asked the Council about Ordinances remaining in Committee and 9 about acting on them prior to the end of the year. Mr. Barden indicated he 10 would find out about Ordinances No. 16-1986 and 46-1986 from the 11 Sanitary District to see what action they would recommend. 12 13 Mr. Barden stated that Ordinance No. 129-1985 could be returned to the agenda 14 and striken if the Council would chose to do so. 15 16 ORDINANCE NO. 129-1985 17 18 Councilmember Hankinson moved to return Ordinance No. 129-1985 to second 19 reading on the Council Agenda and to strike the ordinance from the agenda, 20 seconded by Councilmember Whitesell and on unanimous voice vote the motion 21 was carried. 22 23 ALL AMERICAN CITY COMPETITION 24 25 Councilmember Elstro reported on the trip to Kansas City for the All Americar, 26 City Competition. He said it was a very good trip and that the group . 27 representing Richmond was very enthusiastic. Councilmember Elstro stated 28 he feels good about Richmond becomming all All American City and that the 29 presentation by Richmond was the best presentation and the questions asked 30 of the representatives were well answered. 31 32 President Brookbank stated that she was very proud of the Richmond 33 presentation. 34 35 ADJOURNMENT 36 37 There being no further business, on a motion duly made, seconded and passed 38 the meeting was adjourned. 39 40 41 Jane R.
