HomeMy Public PortalAbout11-03-1986 7_ PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND', INDIANA, NOVEMBER 3, 1986 • The Common Council of the City of Richmond, Indiana, met in regular session 2 Novemeber 3, 1986 at the hour of 7:30 P.M. in the Council Chambers in • 3 said City. President Bodiker presided with the following Councilmembers 4 in attendance: Elstro, Willliams , Brookbank, Hankinson, Parker, Hutton 5 and. Morris. Absent : Whitesell. The following business was held to-wit: 6 7 PLEDGE OF ALLEGIANCE 8 9 SILENT DEVOTIONS . 10 11 APPROVAL OF MINUTES OF OCTOBER 2O,_ 1986 12 13 Councilmember Hankinson moved to approve the minutes of the previous meeting 14 as prepared, .seconded by Councilmember Hutton and on unanimous voice vote 15 the motion was carried. 16 17 COMMUNICATIONS FROM THE MAYOR 18 19 Mayor Waltermann told the Council there would be a celebration for the 20 All American City competition on November 5, 1986 at 6:00 P.M. on' the 21 Promenade. The Mayor said the whole community has had an active part 22 and with the quality of life in our community we are one of the top sixteen 23 finalists out of 800 applications . 24 • 25 Councilmember Morris asked Mayor Waltermann to extend her appreciation 26 for the sidewalk at the Recycling Center. 27 28 REPORTS FROM OTHER CITY DEPARTMENTS 29 111 30 Councilmember Parker asked Mr. Willis about sewer user fees and summer 31 useage. Councilmember Parker stated that in the past summer billing 32 reflected sprinkling clause and adjustment and the bills are not 33 reflecting that currently. 34 35 Mr. Willis explained that with the Sanitary District doing their own billint 36 it is an in house problem on the bills. He said the public needs to 37 demonstrate the adjustment to the Sanitary District . He indicated the 38 public with concerns about the sprinkling adjustment should contact Mr. .39 Judge and the District will make the comparisons on billings and 40 forward requests to the Sanitary Commissioners for action'. 41 • 42 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY 43 44 Ms. Silberstein reported on unsafe building orders at 517 North 20th, 45 1302 East Main Street and 325 North 10th. She also said the Board 46 approved a fifteen minute 'parking zone on West Main Street adjacent to 47 Beerman's Drug Store 'and awarded the bid for the re-roofing of Fire House 48 No. 1. 49 50 Councilmember Hutton asked about the unsafe building at 1302 East Main 51 and Ms. Silberstein stated the order had been stayed temporarily for 52 the posting of a performance bond by the new owner. 53 54 Councilmember Parker asked about the drainage problem in Hidden Valley 55 and Ms. Silberstein indicated that Mr. Barden had forwarded the complaint 56 to the County Drainage Board and she would follow up to see who's 57 responsibility it is. 58 . 59 REPORTS FROM SPECIAL COMMITTEES 60 • 61 Committee of the Whole 62 63 Councilmember Brookbank reminded the Council of the Committee 'of the Whole 64 on the Human Relations Ordinance. The meeting will be held in the Board 65 of Works Room on November 13, 1986 at 7:00 P.M. • Common Council Minutes Cont 'd November 3, 1986 Page 2 1 REPORTS FROM STANDING COMMITTEES 2 3 Reid Hospital 4 5 Councilmember Brookbank reported on the changes in Reller 7 with the new 6 respite care available. She also reported on the Priority One. 7 8 Plan Commission -9 • 10 Councilmember Morris reported on a Master Plan Steering Committee meeting 11 on November 6, 1986 at 12:00 noon with the Greater Richmond Progress 12 Committee Task Force. 13 14 MISCELLANEOUS BUSINESS 15 16 Councilmember Williams expressed his concerns with persons trespassing on 17 the railroad overpass near Commons Lumber Company. He said the public 18 needs to be warned of the dangers . 19 20 ORDINANCES 21 22 ORDINANCES ON FIRST READING 23 24 Councilmember Morris moved to suspend the rules and read Ordinances No. 83 25 and 84-1986 on first reading by title only, seconded by Councilmember Elstrc 26 and unanimous voice vote the motion was carried. 27 • 28 TRANSFER ORDINANCE NO. 83-1986 29 30 The Clerk read on first reading by title only Transfer Ordinance No. 83-198.- 31 AN ORDINANCE TO TRANSFER WITHIN THE MOTOR VEHICLE HIGHWAY FUND. 32 33 Councilmember Morris moved to suspend the rules and read Ordinance No. 83- 34 1986 on second reading, seconded by Councilmember Brookbank and on 35 unanimous voice vote the motion was carried. 36 37 The Clerk read Ordinance No. 83-1986 on second reading. 38 39 President Bodiker announced Ordinance No. 83-1986 was on public hearing. 40 41 Speaking for Ordinance No. 83-1986 was Ms. Janet Sams, Rose View Manager. 42 Ms. Sams explained that the transfers in the Motor Vehicle Highway Fund and 43 the Public Transit Fund were for a lubrication system to address a problem 44 identified as dangerous by OSHA. 45 46 Being no further comment, Councilmember Elstro moved for engrossment of 47 Ordinance No. 83-1986, seconded by Councilmember Hankinson and on unanimous 48 voice vote the motion was carried. 49 50 Councilmember Elstro moved to suspend the rules and move Ordinance No. 83- 51 1986 to third and final reading and read by title only, seconded by 52 Councilmember Hankinson and on unanimous voice vote the motion was carried. 53 54 The Clerk read Ordinance No. 83-1986 on third and final reading by title on y. 55 ' 56 Transfer Ordinance No. 83-1986 was adopted on the following call of the rol : 57 58 Ayes: Elstro, Williams, Brookbank, Hankinson, Parker, Hutton, Morris and 59 Bodiker (8) . 60 Nays: None 61 Absent: Whitesell 62 6 TRANSFER ORDINANCE NO. 84-1986 64 • • 65 The Clerk read on first reading by title only Transfer Ordinance No. 84-198:- 429. Bodiker ' (8) 27 Nays: None 28 Absent: Whitesell • • 29 30 ORDINANCES ON SECOND READING 31 . 32 ORDINANCE NO. 72-1986 . 33 • 34 The Clerk read on second reading Ordinance No. 72-1986 - AN ORDINANCE AMENDING 35 CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, COMMONLY 36 KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, .INDIANA, PROVIDING 37 FOR THE .REZONING OF THE PROPERTY LOCATED IN THE 1200 BLOCK OF NORTH "F" 38 STREET FROM R-3 ONE-TO-EIGHT FAMILY RESIDENCE DISTRICT TO M-2 GENERAL 39 INDUSTRIAL DISTRICT. 40 41 President Bodiker announced Ordinance No. 72-1986 was •on public hearing. 42 43 Councilmember Morris stated there were no remonstrators against the rezoning 44 and the request suits the character of zoning in the neighborhood. 45 46 Being no further comment, Councilmember Elstro moved for engrossment, 47 seconded by Councilmember Hankinson and on unanimous voice vote the motion 48 was carried. 49 50 Councilmember Elstro moved to suspend the rules and move Ordinance No. • 51 72-1986 to third and final reading and read by title only, seconded by • 52 Councilmember Hankinson .and on unanimous voice vote the motion was carried. 53 54 The Clerk read Ordinance No.. 72-1986 on third and final reading by title 55 only. • 56 57 Ordinance No. 72-1986 was adopted on the following call of the roll: 58 59 Ayes : Elstro, Williams, Brookbank, Hankinson, Parker, Hutton, Morris and 60 Bodiker (8) 61 Nays: None 62 Absent: Whitesell 53 64 ORDINANCE NO. 74-1986 65 ' 430 Common Council Minutes Cont 'd November 3, 1986 Page 4 1 The Clerk read on second reading Ordinance No. 74-1986 - AN ORDINANCE 2 VACATING A CERTAIN 20 FOOT WIDE ALLEY RUNNING OFF OF COLLEGE AVENUE. 3 4 The Proof of Publication was found to be in order and Councilmember Morris 5 moved to accept and file the Proof of Publication, seconded by 111 6 Councilmember Parker and on unanimous voice vote the motion was carried. 7 8 Councilmember Morris moved to amend Section 1 to grant a perpetual ingress/ 9 egress easement for Lots 4 and 5, seconded by Councilmember Hankinson and 10 on unanimous voice vote the motion was carried. 11 12 President Bodiker announced Ordinance No. 74-1986 was on public hearing. 13 14 Councilmember Morris reported that only one (1) property owner spoke at the 15 Plan Commission hearing and spoke in favor. She added that there was one 16 persons speaking in opposition to the expansion of Earlhan College. 17 18 There being no further comment, Councilmember Hankinson moved for engrossment 19 of Amended Ordinance No. 74-1986, seconded by Councilmember Williams and on 20 unanimous voice vote the motion was carried. 21 22 Councilmember Brookbank moved to suspend the rules and move Amended Ordinance 23 No. 74-1986 to third and final reading and read by title only, seconded by 24 Councilmember Hankinson and on unanimous voice vote the motion was carried. 25 26 The Clerk read Amended Ordinance No. 74-1986 on third and final reading by. 27 title only. 28 29 Amended Ordinance No. 74-1986 was adopted on the following call of the roll: 30 31 Ayes: Elstro, Williams , Brookbank, Hankinson, Parker, Hutton, Morris and 32 Bodiker (8) 33 Nays : None 34 Absent: Whitesell 35 36 ORDINANCE NO. 77-1986 37 38 The Clerk read on second reading Ordinance No. 77-1986 - AN ORDINANCE AMENDIIG 39 CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, COMMONLY 40 KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, PROVIDING 41 FOR THE REZONING OF THE PROPERTY LOCATED AT 2500-2800 NATIONAL ROAD WEST FROM 42 C-2 AND R-2 TO C-4. 43 44 President Bodiker announced Ordinance No. 77-1986 was on public hearing. 45 46 Councilmember Morris stated there were no remonstrators at the hearing and 47 the change in zoning is a logical progression and was unanimously adopted. 48 49 Councilmember Morris stated there were concerns expressed with a drainage 50 problem and the petitioner is working with the County Drainage Board. 51 52 Speaking for Ordinance No. 77-1986 was Robert G. Burton, attorney for the 53 petitioner. He informed the Council that the area to be rezoned is currently 54 a weed infested lot and a John Deere Franshise will be located on the 55 property. Mr. Burton introduced Mr. Phil Richert and Mr. Tom 56 Arthur with John Deere. . 57 58 Mr. Tom Arthur of Marion, Indiana informed the Council that a John Deere 59 franshise had been approved for this location to attract farmers and also 60 persons residing in town. 61 62 Mr. Burton stated that they will comply with all drainage requirements of 63 the City. 64 65 Being no further comment, Councilmember Hankinson moved for engrossment of 431 Common Council Minutes Cont'd November 3, 1986 Page 5 1 Ordinance No. 77-1986, seconded by Councilmember Williams and on unanimous 2 voice vote the motion was carried. 3 II/ 4 Councilmember Williams moved to suspend the rules and move Ordinance No. 5 77-1986 to third and final reading and read by title only, seconded by 6 Councilmember Hankinson and on unanimous voice vote the motion was 7 carried. 8 9 The Clerk read Ordinance No. 77-1986 on third and final reading by title 10 only. 11 12 Ordinance No. 77-1986 was adopted on the following call of the roll: 13 14 Ayes: Elstro, Williams, Brookbank, Hankinson, Parker, Hutton, Morris 15 and Bodiker (8) 16 Nays: None 17 Absent: Whitesell 18 19 APPROPRIATION ORDINANCE NO. 79-1986 20 21 The Clerk read on second reading Appropriation Ordinance No. 79-1986 - 22 AN ORDINANCE TO APPROPRIATE WITHIN THE LOCAL ROAD AND STREET FUND. 23 24 The Proof of Publication was found to be in order and Councilmember Hankinson 25 moved to accept and file the Proof of Publication, seconded by Councilmember 26 Brookbank and on unanimous voice vote the motion was carried. 27 28 President Bodiker announced Ordinance No. 79-1986 was on public hearing. 29 30 Speaking for Ordinance No. 79-1986 was Mr. Ralph Willis . Mr. Willis 31 explained the funds were for signalization of Eastern Indiana Industrial 32 Parkway .
