PROCEEDINGS OF THE COMMON COUNCIL OF THE
CITY OF RICHMOND, INDIANA, SEPTEMBER 2, 1986
1 The Common Council of the City of Richmond, Indiana, met in regular session
2 September 2, 1986 at the hour of 7:30 P.M. in the Council Chambers in
3 said City. President Bodiker presided with the following Councilmembers
4 present: Elstro, Williams, Brookbank, Hankinson, Whitesell, Parker,
5 Hutton and Morris. Absent : None. The following business was had to-wit:

11 APPROVAL OF MINUTES OF AUGUST 18, 1986 AND AUGUST 25, 1986

13 Councilmember Morris moved to approve the minutes of the meeting of August
14 18, 1986 as prepared, seconded by Councilmember Whitesell and on unanimous
15 voice vote the motion was carried.

17 Councilmember Hankinson moved to approve the minutes of the Special Meeting
18 on August 25, 1986 as prepared, seconded by Councilmember Hutton and
19 on unanimous voice vote the motion was carried.

21 COMMUNICATIONS FROM THE MAYOR

23 Mayor Frank H. Waltermann thanked the Common Council for their support
24 on the 1987 budget and congratulated the Department Heads and employees
25 on the good job they did on reducing the budgets and they are commited
26 to providing a better level of service.

28 Mayor Waltermann commented on the Reserve Officers and the liability
29 insurance problem. He stated the Reserves were not being disbanded, but
30 were being asked to perform duties inside the building rather than having
31 special police powers.

33 Councilmember Parker asked about the Reserve equipment and asked where
34 it would be stored. Mayor Waltermann stated it would be held at the Police
35 Department for the reserve officers.

37 REPORTS FROM OTHER CITY DEPARTMENTS

39 Energy Department

41 Ms. Lynn Johnstone of the Energy Department, explaned a program to the
42 Council using recycled newprint to assist in the insulation of houses
43 for low and moderate income families . Ms . Johnstone explained that volunteer
44 labor would be used through RSVP and paper would be sold to an Indiana
45 firm making insulation at 30.00 per ton. Insulation would then be
46 purchased from the same company at 3.10 per bag. Ms. Johnstone stated
47 that the project would also assist with landfill problems by removing
48 the newspaper from the landfill. Paper would be collected through an
49 incentive program by the Sanitary District.

51 President Bodiker asked what was expected of the Common Council and Ms .
52 Johnstone stated she wanted to make the Council aware of the project
53 and that there would also be a need for seed money of approximately 15,000.

55 Councilmember Hankinson stated the Council needs further information
56 on the mechanics of the project including storage of papers and separation
57 of the papers during recycling.

59 Ms . Johnstone stated she would do some checking and clear up matters
60 for another report to the Council.

62 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY

64 Ms . Silberstein reported that the Board had dismissed nine (9) inoperable
65 vehicle complaints that had been cleaned up and ordered four (4) others

1 to be removed. She reported that a date had been set for three (3) unsafe
2 building hearings and the contract with the Transit Union had been signed.

4 Ms. Silberstein reported that the Board had awarded the bid for the leaf
5 loaders and several paving projects and had ordered the disconnected fire
6 alarm boxes removed.

12 Councilmember Brookbank stated they had approved the purchase of a fire alarm
13 system, a blood PH unit and the trauma room is being replaced. She said
14 there was discussion on the Cancer center and how fortunate they were to
15 have a cancer-hemotologist. specialist.

21 Councilmember Morris moved to suspend the rules and read Ordinances No.
22 69 and 70-1986 on first reading by title only, seconded by Councilmember
23 Whitesell and on unanimous voice vote the motion was carried.

30 Councilmember Morris moved to suspend the rules and move Ordinance No. 69-
31 1986 to second reading, seconded by Councilmember Brookbank and on unanimous
32 voice vote the motion was carried.

34 Councilmember Elstro asked why the funds were in the Mayor's budget for the
35 testing of the Fire equipment and Mayor Waltermann explained that it was
36 part of the capital equipment funds that had been approved to be used forthe
37 testing and in order for the funds to be spent they needed to be transfered
38 to a 3000 account. He added that the transfer also would assist with the
39 installation of donated lights at the Airport.

41 There being no further discussion, Councilmember Hankinson moved for
42 engrossment of Ordinance No. 69-1986, seconded by Councilmember Williams
43 and on unanimous voice vote, the motion was carried.

45 Councilmember Williams moved to suspend the rules and move Ordinance No.
46 69-1986 to third and final reading and read by title only, seconded by
47 Councilmember Brookbank and on unanimous voice vote the motion was carried.

34 Mr. Barden examined the Proof of Publication and found it to be in order.
35 Councilmember Morris moved to accept and file the Proof of Publication,
36 seconded by Councilmember Brookbank and on unanimous voice vote the
37 motion was carried.

39 President Bodiker announced Ordinance No: 63-1986 was on public hearing.

42 It was noted that the Plan Commission had proposed an amendment to Section'
43 1, first paragraph regarding it being dedicated as a public right-of-way.

45 Councilmember Brookbank moved to amend Ordinance No. 63-1986 as requested
46 by the Plan Commission, seconded by Councilmember Whitesell and on unanimous
47 voice vote the motion was carried.

49 Councilmember Morris reported there were no remonstrators .

51 Ron Cross, Attorney at Law, representing the Humphrey Corporation as
52 petitioner, stated that they are in agreement with the dedication as
53 a public right-of-way and that it will be improved and paved with the
54 completion of the sub-division.

56 There being no further comment, Councilmember Whitesell moved for engrossment,
57 seconded by Councilmember Hutton and on unanimous voice vote the motion
58 was carried.

60 Councilmember Elstro moved to suspend the rules and move Amended Ordinance
61 No. 63-1986 to third and final reading and read by title only, seconded
62 by Councilmember Parker and on unanimous voice vote the motion was carried.

10 CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, COMMONLY
11 KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, PROVIDING
12 FOR THE REZONING OF PROPERTY LOCATED IN THE 1200 BLOCK OF SOUTH 21ST STREET
13 FROM R-2 DISTRICT TO R-2 SU SPECIAL USE DISTRICT AND AUTHORIZING THE SPECIAL
14 USE OF SAID PROPERTY FOR INSTALLATION OF A MANUFACTURED HOME.

16 President Bodiker announced Ordinance No. 65-1986 was on public hearing.

18 Councilmember Elstro asked if the construction would be completed within
19 the next two (2) months and Mr. Dooley stated that construction would begin
20 as soon as the ordinance is passed.

22 Councilmember Morris reported the Plan Commission unanimously approved the
23 request and it will add to the block.

25 There being no further discussion, Councilmember Hankinson moved for engrossment,
26 seconded by Councilmember Elstro and on unanimous voice vote the motion was
27 carried.

45 TO APPROPRIATE WITHIN THE FEDERAL REVENUE SHARING TRUST FUND.

47 Mr. Barden examined the Proof of Publication for the appropriation and for
48 the Revenue Sharing Budget and found them to be in order. Councilmember
49 Parker moved to accept and file the Proofs of Publication, seconded by
50 Councilmember Whitesell and on unanimous voice vote the motion was carried.

52 President Bodiker announced Ordinance No. 67-1986 was on public hearing.

54 Speaking for Ordinance No. 67-1986 was Rose View Manager, Janet Sams .
55 Ms. Sams reported that the 44,150. for Rose View was the 16% local match
56 for 1986. Ms.Sweet stated the balance of the appropriation was for Board
57 of Works to pay for street lights.

59 Councilmember Elstro complimented Ms . Sams on the packet of information of
60 Rose View Transit.

63 seconded by Councilmember Williams and on unanimous voice vote the motion

15 UNFINISHED BUSINESS

17 Councilmember Elstro asked that Ordinance 29-1986 be placed on the agenda
18 for action and recommended it be striken and the boxes be removed from
19 the South end of town that the Palladium had placed there.

21 Mr. Barden stated there was a Court decision stating cities cannot remove
22 delivery boxes .

24 President Bodiker stated there would be several Councilmember missing
25 the next meeting do to Indiana Cities and Towns and stated he would rather
26 keep it off the next agenda.

28 President Bodiker announced that Ordinances No. 45, 51, and 59-1986 would
29 be advertised and return to the agenda on October 6, 1986 for second
30 reading, public hearing.
