HomeMy Public PortalAbout07-21-1986 36 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, JULY 21, 1986 1 The Common Council of the City of Richmond, Indiana, met in regular session 2 July 21, 1986 at the hour of 7:30 P.M. in the Council Chambers in said 3 City. President Bodiker presided with the following Councilmembers in 11/ 4 attendance: Elstro, Williams, Brookbank, Hankinson, Whitesell, Parker, 5 Hutton and Morris. Absent: None. The following business was had to-wit: 6 7 PLEDGE OF ALLEGIANCE 8 9 SILENT DEVOTIONS 10 11 ADDITION OF AGENDA ITEM 12 13 Councilmember Hutton moved to suspend the rules and add Ordinance No. 14 61-1986 to the agenda, seconded by Councilmember Brookbank and on 15 unanimous voice vote the motion was carried. 16 17 APPROVAL OF MINUTES OF JULY 21, 1986 18 19 Councilmember Hankinson moved to approve the minutes of the previous meeting 20 as prepared, seconded by Councilmember Whitesell and on unanimous voice 21 vote the motion was carried. 22 23 COMMUNICATIONS FROM THE MAYOR 24 25 Mayor Frank H. Waltermann updated the Council on what the City was doing 26 regarding the problem of hazardous waste and possible spills . He reported 27 that City Attorney Ken Barden and Public Works Director Ralph Willis had 28 attended a meeting in Cincinnati, Ohio on Hazardous Waste. - -He added' that 29 the City then requested a model ordinance on hazardous waste from a 30 contact made at the conference in Louisville, Kentucky. 31 32 Mayor Waltermann stated that on July 1, 1986 there was a meeting of the 33 Civil Defense Advisory Committee discussing hazardous waste and the 34 addition of funds in the County budget for training on handling hazardous 35 waste. 36 37 Mayor Waltermann informed the Council that on July 21, 1986 the Civil 38 Defense Advisory Committee met again with State representatives to state 39 their concerns on hazardous waste and the protection of public safety. 40 The Mayor indicated that a centralized Emergency Response Authority would 41 be formed regarding hazardous waste. He said that with OSHA mandates 42 all industries must now maintain list of hazardous materials in their 43 facilities and these could be forwarded to the Richmond Fire Department 44 for information on potential hazards . 45 46 Mayor Waltermann stated that the Council would shortly be receiving an 47 ordinance on the transportation and storage of hazardous waste. 48 49 REPORTS FROM OTHER CITY DEPARTMENTS 50 51 Law Office 52 53 Mr. Barden stated that Mayor Waltermann had covered what he needed to 54 discuss with the Council and that he would have the ordinance ready within 55 the next two (2) council meetings. He requested the Council to set a 56 Committee of the Whole for discussion of the ordinance before it was placed 57 on the Council Agenda in order that the Council be involved with each 58 step of the ordinance since it would require cooperation of businesses 59 and industry in the community. Mr. Barden said the Committee of the Whole 60 could also serve as a public awareness meeting. 61 62 Councilmember Brookbank stated she would set a Committee of the Whole 63 for the discussion of the proposed hazardous waste ordinance for August 64 28, 1986. 65 380 Common Council Minutes Cont'd July 21, 1986 Page 2 1 President Bodiker asked Mr. Barden about three (3) ordinances still on the 2 agenda that had not been acted upon and Mr. Barden stated that Ordinance No. 3 16 was still awaiting a report from the Sanitary District and they would be 4 meeting to discuss it in the near future. Mr. Barden added that he had not 5 received any clear direction from the Council on the Cat Ordinance and that 6 the ordinance on collective bargaining could be acted upon at the pleasure 7 of the Council. 8 9 Councilmember Morris asked about the status of Ordinance No. 29-1986 regarding 10 news racks . Councilmember Elstro stated he felt it could be striken and tell 11 the Palladium Item to pull out the boxes . 12 13 Mr. Barden stated that without an ordinance it would be selective enforcement 14 and that the Council could simplify the proposed ordinance. 15 16 Councilmember Morris asked if the Council Committee that it had been 17 assigne'd to had reviewed the news rack ordinance. 18 19 Mr. Barden stated they had met with the Palladium Item several times and the) 20 were supposed to be developing guidelines which he has not yet received. 21 22 REPORTS FROM SPECIAL COMMITTEES 23 24 Committee of the Whole 25 26 Councilmember Brookbank reminded the Council of the Committee of the Whole 27 meetings set for August 6, 7, 13 and 14th for the 1987 budget and that the 28 Council would have to call a special meeting on August 25, 1986 for passage 29 of the annual budget. Councilmember Brookbank also stated the Committee of 30 the Whole would meet on August 28, 1986 for Ordinance No. 59-1986 and the 31 proposed hazardous waste ordinance. 32 33 REPORTS FROM STANDING COMMITTEES 34 35 Plan Commission 36 37 Councilmember Morris reported that the Plan Commission had no regular business 38 for their meeting of July 22, 1986, but would be meeting for the Master Plan 39 and the hiring of consultants and to make her appointment to the Street Tree 40 Commission. 41 42 MISCELLANEOUS BUSINESS 43 44 Councilmember Williams commented that he felt the public should be informed 45 of the condition of the Sanitary District compared to the prior administraticn. 46 47 Street Tree Commission Appointments 48 49 The following names were submitted for the Street Tree Commission: 50 51 Council Appointments : Mr. Carl Reynolds for a 3 year term and Mr. David 52 Stevens for a 2 year term. 53 54 Mayor's Appointments : Mr. Don Weaver for a 1 year term and Mr. Robert 55 Delaney for a 3 year term. . 56 57 The appointments for a 1 year term from Council and a 2 year term from the 58 Mayor will be filled at a later date. 59 60 Councilmember Hutton moved to approve the names submitted for the Street 61 Tree Commission, seconded by Councilmember Morris and on unanimous voice vote 62 the motion was carried. 63 64 Police Merit Commission Appointment 65 *.Common Council ._Minutes:COnt'd July 21, 196 Page 3 ' 1 President Bodiker announced that Councilmember Hutton was still in the 2 process of contacting a member of the Clergy to serve on the Merit Commission 3 and this would be acted upon at the next meeting of the Common Council. 4 5 ORDINANCES 6 7 ORDINANCES ON FIRST READING 8 9 Councilmember Morris moved to suspend the rules and read Ordinances No. 10 59, 60 and 61-1986 on first reading by title only, seconded by Councilmember 11 Elstro and on unanimous voice vote the motion was carried. 12 13 ORDINANCE NO. 59-1986 14 15 The Clerk read on first reading by title only Ordinance No. 59-1986 - 16 AN ORDINANCE REGULATING THE CONSTRUCTION, ALTERATION, REPAIR, LOCATION 17 AND USE OF BUILDINGS AND STRUCTURES IN THE CITY OF RICHMOND, INDIANA; 18 PROVIDING FORTHE ISSUANCE OF PERMITS THEREFORE; PROVIDING PENALTIES FOR 19 THE VIOLATION THEREOF; AND REPEALING ALL ORDINANCES AND PARTS OF 20 ORDINANCES IN CONFLICT THEREWITH. 21 22 President Bodiker announced that he would allow Mr. Dan Dooley to explain 23 the ordinance to the Council. 24 25 Mr. Dooley told the Council that the ordinance is subject by State Law 26 to approval by the Department of Fire Prevention and Building Safety prior 27 to the Council taking any final action. He indicated their next meeting 28 would be on August 6, 1986 and hopefully comment would be received prior 29 to the Committee of the Whole set for August 28, 1986. He said it had 30 been developed from a model ordinance and made to fit local needs. 31 32 President Bodiker referred Ordinance No. 59-1986 to the Committee of the 33 Whole for further study. 34 35 ORDINANCE NO. 60-1986 36 37 The Clerk read on first reading by title only Ordinance No. 60-1986 - 38 AN ORDINANCE CLARIFYING SECTION 74.27 AND 74.99 OF THE RICHMOND CITY CODE. 39 40 President Bodiker announced Ordinance No. 60-1986 had to be advertised. 41 42 ORDINANCE NO. 61-1986 43 44 The Clerk read on first reading by title only Ordinance No. 61-1986 - 45 AN ORDINANCE RATIFYING THE SALARIES, WAGES AND POSITIONS FOR APPOINTED 46 OFFICERS AND EMPLOYEES OF THE RICHMOND SANITARY DISTRICT FOR THE FISCAL 47 YEAR BEGINNING JANUARY 1, 1987, AND ENDING DECEMBER 31, 1987, AS ADOPTED 48 BY THE BOARD OF SANITARY COMMISSIONERS. 49 50 President Bodiker stated that the Ordinance could be passed onto second 51 reading tonight and would be held for third and final reading on August 52 4, 1986. 53 54 Councilmember Elstro moved to suspend the rules and move Ordinance No. 55 61-1986 to second reading, seconded by Councilmember Whitesell and on 56 unanimous voice vote the motion was carried. 57 58 The Clerk read Ordinance No. 61-1986 on second reading. 59 60 President Bodiker announced Ordinance No. 61-1986 was on public hearing. 61 62 Speaking for Ordinance No. 61-1986 was Mr. Jerald Judge, Sanitary District 63 Administrator. Mr. Judge apologized to the Council for the Ordinance 64 not being on the agenda. He stated that the ordinance represents a total 65 3.9% increase and funds 90 positions .
