PROCEEDINGS OF THE COMMON COUNCIL OF THE
CITY OF RICHMOND, INDIANA, MAY 5, 1986
1 The Common Council of the City of Richmond, Indiana, met in regular session
2 May 5, 1986 at the hour of 7:30 P.M. in the Council Chambers in said City.
3 President Bodiker presided with the following Councilmembers present: Elstr. ,
4 Williams, Brookbank, Hankinson, Whitesell, Parker, Hutton and Morris.
5 Absent: None. The following business was had to-wit:

11 APPROVAL OF MINUTES OF APRIL 21, 1986

13 Councilmember Hankinson moved to approve the minutes of the previous meeting
14 as prepared, seconded by Councilmember Parker and on unanimous voice vote th-
15 motion was carried.

17 COMMUNICATIONS FROM THE MAYOR
18
19 Mayor Frank H. Waltermann informed the Council that the Executive Board of
20 the Greater Richmond Progress Committee met on April 30, 1986 with Margo Lyo
21 of the Greater Indianapolis Progress Committee. Mayor Waltermann stated the
22 Progress Committee would be set up with three (3) tiers consisting of the
23 Executive Board, Board of Directors and Progress Committee. The Mayor also
24 stated that the taskforces would also be established from the membership
25 and other persons within the community.

27 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY

29 Board President, Susan Silberstein, reported to the Council that the unsafe
30 building at 511 North 19th was being repaired. She also stated that bids
31 had been awarded for the Fire Department breathing apparatus and bids had
32 been received for mowing equipment for the Park and other various city
33 vehicles.

35 Ms. Silberstein added that the weight limit on the G Street Bridge had been
36 lowered to three (3) ton and that the speed limit on Hodgin Road had been
37 reduced from 40 MPH to 30 MPH, a weight limit of ten (10) ton had been
38 posted and Caution-Children Playing signs were being erected.

40 Ms. Silberstein also informed the Council that the Board had approved a requ-st
41 for Mr. Omer Thomas to place a rose garden on public right-of-way at the
42 end of 3800 South A Street.

44 Councilmember Williams asked who would be receiving the vehicles that were b-ing
45 bid and Ms. Silberstein stated they were approved by the Capital Equipment
46 Committee and were for the motor pool and other uses and she would find out
47 specifically where they would be assigned.

49 REPORTS FROM STANDING COMMITTEES

51 Reid Hospital

53 Councilmember Brookbank informed the Council that the Auxillary hosted the
54 Eastern Indiana Association at the Radisson. She also stated that the
55 consultants had been interviewing the Board members and she had been
56 interviewed.

58 Plan Commission

60 Councilmember Morris stated that the Plan Commission had met on the rezoninx
61 for the residential group home and the issued was governed by State Law and
62 not local zoning control and that the ordinance should be striken. She also
63 stated that the Plan Commission would be meeting on May 13, 1986 in the Board
64 of Works Room for an update on the landfill situation.

1 Street Tree Commission

3 Councilmember Elstro reported that the Street Tree Commission would be
4 meeting on May 15, 1986 to take final action on an ordinance to be on the
5 May 19, 1986 agenda.

9 Councilmember Hutton reported that the Park Master Plan public hearing would
10 be on May 14, 1986.

12 MISCELLANEOUS BUSINESS

14 • President Bodiker welcomed Mr. Fish's government class to the Council
15 meeting.

17 RESOLUTION NO. 10-1986

19 Councilmember Hankinson moved to suspend the rules and place Resolution No.
20 10-1986 on the agenda and read it by title only, seconded by Councilmember
21 Whitesell and on unanimous voice vote the motion was carried.

23 The Clerk read by title only Resolution No. 10-1986 - A RESOLUTION APPROVING
24 THE SETTLEMENT OF A CLAIM FILED BY JERDEAN HEMPHILL.

26 City Attorney Ken Barden explained that the claim was filed against the City
27 for fees charged at the J Street Auto for impound charges . Mr. Barden
28 stated that he, as City Attorney, would deny the claim since it did not
29 comply with the Tort Claim Act. He said that he has been approached by
30 members of the City Council regarding paying the claim and the Resolution is
31 being presented for the decision to be made by Council on the payment of the
32 claim.

34 Councilmember Williams commented that the claim was only for the money paid for
35 the impound charges to the City.

37 Mr. Barden clarified that the money was not paid to the City, but rather to
38 J Street Auto where the vehicle had been impounded and now city dollars would
39 be used to refund the money paid to J Street Auto. Mr. Barden explained that
40 the City was not liable under the Tort Claim Act. He stated that the vehicle
41 was seized and impounded pursuant to State law as a vehicle involved in a
42 criminal act and the negligence lies with Mrs . Hemphill and he recommends the
43 claim not be settled.

45 President Bodiker asked if this would set a precedent and Mr. Barden explained
46 that the legislative body can settle in unusual or special circumstances and
47 legislative acts were not considered precedents .

49 Councilmember Parker asked if the claim was settled if it would eliminate
50 any liabilty and Mr. Barden stated that the City would have no liability
51 even if there was a court suit.

53 Councilmember Parker asked what it would cost to defend a law suit and Mr.
54 Barden stated that his salary is already paid by the City.

56 Councilmember Williams moved for adoption of Resolution No. 10-1986 and the
57 motion was seconded by Councilmember Morris .

59 Councilmember Morris stated that even though there was no legal liability, s`le
60 resented the fact that Mrs. Hemphill contact city employees daily to get
61 help on the impounded vehicle and she did not get the information she needed.
62 Councilmember Morris added that the City needs to make the system clearer
63 regarding the impoundment of vehicles used in criminal acts belonging to
64 innocent parties.

1 Councilmember Williams commented that Mrs. Hemphill had tried to obtain
2 information from the City and was not directed on how to get the car release. .

4 Mr. Barden added that Mrs. Hemphill was also represented by two (2) attorney-
5 who misdirected her requests and did not follow the proper way to present
6 the claim in court.

27 The Clerk read on second reading Ordinance No. 21-1986 - AN ORDINANCE
28 ESTABLISHING, PURSUANT TO I.C. 36-7-17, AN URBAN HOMESTEAD PROGRAM AND
29 DESIGNATING THE DEPARTMENT OF PLANNING, PERMITS AND INSPECTION AS THE
30 AGENCY AUTHORIZED TO ADMINISTER SAID PROGRAM.

32 Councilmember Whitesell reported that amendments are ready as proposed
33 by Mr. Dooley and the Community Services Committee. Councilmember Whitesell
34 moved to amend Section 5 C with the ;additdon ofc"Immed'iate family shall
35 be defined as any person living in the same household and related to the
36 applicant including but not limited to a wife, son, daughter, mother,
37 father, brother or sister, seconded by Councilmember Morris and on
38 unanimous voice vote the motion was carried.

40 Councilmember Whitesell moved to add to Section 5 D "is not an elected
41 official of the City of Richmond, Indiana or an employee of the Department
42 of Planning, Permits and Inspections", seconded by Councilmember Hankinson
43 and on unanimous voice vote the motion was carried.

45 Councilmember Whitesell moved to amend Section 6, first paragraph by adding,
46 "which includes the total amount of city funds expended to acquire the
47 property, to secure and stabilize the property and the total amount of
48 payments in lieu of taxes during the time the applicant resides in the
49 dwelling and the property is held in the City's name", seconded by
50 Councilmember Hankinson and on unanimous voice vote the motion was carried.

52 President Bodiker announced Amended Ordinance No. 21-1986 was on public
53 hearing.

55 Mr. Dan Dooley informed the Council that he may anticipates one (1) or
56 two (2) properties a year and this ordinance will serve as a way to preserve
57 housing stock that might be demolished and it will add one more tool to
58 deal with the housing in Richmond.

60 There being no further discussion, Councilmember Hankinson moved for
61 engrossment of Ordinance No. 21-1986, seconded by Councilmember Elstro
62 and on unanimous voice vote the motion was carried. .

16 Councilmember Morris stated that this was controlled by the State
17 and was not a local zoning issue and so moved to strike Ordinance
18 No. 28-1986 from the agenda, seconded by Councilmember Hankinson and
19 on unanimous voice the motion was carried.

23 Mr. Barden examined the Proof of Publication and found it to be in
24 order. COuncilmember Morris moved to accept and file the Proof of

42 The Clerk read on second reading Ordinance No. 31-1986 - AN ORDINANCE
43 TO VACATE THAT PORTION OF NORTHWEST "K" STREET RUNNING EAST BETWEEN
44 LOT 21 IN THE GRISWOLD ADDITION AND THE PENNSYLVANIA RAILROAD RIGHT -
45 OF-WAY; AND ALSO VACATING A PORTION OF A FOURTEEN (14) FOOT ALLEY
46 RUNNING NORTH OFF OF NORTHWEST "K" STREET.

48 Mr. Barden examined the Proof of Publication and found it to be in
49 order. Councilmember Morris moved to accept and file the Proof of
50 Publication, seconded by Councilmember Brookbank and on unanimous
51 voice vote the motion was carried.

53 Councilmember Morris reported that the Plan Commission had voted six
54 (6) to two (2) in favor of Ordinance No. 31-1986 and that since the
55 Plan Commission meeting issues had been cleared up on access that
56 was impeded by a tree line.

58 President Bodiker announced Ordinance No. 31-1986 was on public hearing.

60 Speaking for Ordinance No. 31-1986 was Mr. Andrew Cecere, Attorney
61 at Law, 101 South 10th Street. Mr. Cecere stated that Productivity
62 Corporation on N.W. K Street which dead ends at the railroad with
63 no access along the railroad tracks . He said that Productivity
64 Corporation uses tractors and trailers that require a turning radius
65 and are requesting the vacation of that portion of N.W. K Street and

1 a portion of the alley adjoining the property. Mr. Cecere stated they
2 would fence in the area in question for purposes of moving trucks and
3 for storage.

5 The utility easements will be maintained.

7 There being no further discussion, Councilmember Elstro moved for engross-
8 ment of Ordinance No. 31-1986, seconded by Councilmember Hankinson and
9 on unanimous voice vote the motion was carried.

26 The Clerk read on second reading Appropriation Ordinance No. 32-1986 -
27 AN ORDINANCE TO APPROPRIATE WITHIN THE LOCAL ROAD AND STREET FUND.

29 Mr. Barden examined the Proof of Publication and found it to be in order.
30 Councilmember Morris moved to accept and file the Proof of Publication,
31 seconded by Councilmember Brookbank and on unanimous voice vote the motion
32 was carried.

34 President Bodiker announced Ordinance No. 32-1986 was on public hearing.

36 Speaking for was Public Works Director, Ralph Willis. Mr. Willis presented
37 the Council maps showing population spread in 1963 and in 1970's regarding
38 the growth on the S.E. side of the City. Mr. Willis assured the Council
39 funds for the purchase of right-of-way will not hamper repair work within
40 the City, but will come from excess funds generated by the gasoline tax.

42 Mr. Willis stated that he will take into consideration upgrading the area
43 along the project with sidewalks, curbs and medians .

45 Councilmember Brookbank asked about the speed on Hodgin Road and Board
46 of Works President, Susan Silberstein stated that the Board reduced the
47 speed from 40 MPH to 30 MPH.

49 Councilmember Hankinson asked if the Board had heard from the County
50 Commissioners regarding reducing the speed on the portion of Hodgin in
51 the County and Ms. Silberstein stated they had not received comment to
52 date.

54 Councilmember Williams stated that he decided to support the project since
55 it would now be a two (2) lane project and no longer a four (4) lane
56 project.

58 Mr. Willis stated that the ordinance only appropriated funds for the
59 purchase of right-of-way and that they would request federal funds for
60 75% of the funding of the project in the fiscal year 1987 and the project
61 would have to meet federal standards.

63 Councilmember Morris asked what the project would do to the Public Works
64 budget in 1987 and Mr. Willis stated the match would be 150,000.00 in
65 new funds generated.

1 Councilmember Morris commented that the City has not addressed the
2 hazards on Hodgin Road in the past and that the concern on South L
3 Street is not only increased traffic, but the speed of the traffic.

5 Speaking for Ordinance No. 32-1986 wass Mr. Dan Ritter of 1038 South
6 8th Street. Mr. Ritter commented that the extension would alleviate
7 traffic on South A, South E and Main Streets and was for the common
8 good of the community.

10 Also speaking for was Planning Director, Dan Dooley. Mr. Dooley stated
11 that the 1966 Master Plan identified this area as a major traffic problem
12 and the need for an east-west thoroughfare. He said South E is narrow
13 and is a high accident area. He stated that South L was the way to
14 address the traffic problems and even with a loss of population, traffic
15 related problems still rise. He indicated that 43% of the City's
16 population growth has been in the S.E. area and it is expected to
. 17 continue making the South L extension important to the community.

19 Councilmember Morris asked if improvements to South L had been scheduled
20 further west of 8th Street and Mr. Dooley indicated the extension was
21 designed to feed into South 8th and 9th Streets.

23 Also speaking for was Mr. Paul Anderson of 625 Sheridan Street . Mr.
24 Anderson stated it was a city-wide issue and is needed to relieve u
25 pressure in other areas.

27 Also speaking for was Mr. Ted McKillip of 3004 S.W. Parkway. Mr.
28 McKillip explained that S.E. Parkway was now a dangerous roadway from
29 traffic and that South L could alleviate that situation.

31 Mr. Thomas Burke of 2723 Willow Drive stated that if the extension
32 was not completed it would be an injustice for the west side of the
33 city faced to use Main Street with the congested traffic .

35 Mr. Kevin Jennings of 700 West Main indicated that if the extension
36 was not completed it could be a deterent to new businesses on the east
37 side.

39 Tom Burke of 2723 Willow Drive stated that the issue was the project
40 being good for a few or a lot of people and he believed it would help
41 more than it would hurt.

43 Mr. Glen Hawkins of 340 South 33rd stated the project was good for
44 the city as a whole.

46 Street Commissioner, Bill Hillard stated that he favored the right-of
47 way purchase and that the City was looking down the road to such problems
48 as the replacement of G Street Bridge and if L Street then could be
49 connected across the river.

51 Speaking in opposition to Ordinance No. 32-1986 was Roy Hunteman of
52 3040 Hodgin Road. Mr. Hunteman stated the project was being designed
11/ 53 on statistics that were 18 to 20 years old and it is appalling that
54 the city was still operating on a plan that old. He also commented
55 on the fact that the Plan Commission working under the Master Plan
56 did not make contractors set houses further from the roadway with this
57 plan in mind and felt they had fallen down on their duty.

59 Mr. Henry Doersam stated that the development in the S.E. area was
60 not there when the plan was developed and that the City has not done
61 a complete job of planning.

63 Mr. Charles Robinson of 3145 Lantern Trail commented about trucks and
64 access to the Eastern Industrial Parkway. He stated trucks do not
65 belong in the area. Mr. Robinson stated that the Common Council voted

1 against the project in 1984 and the people in the area believed the issue
2 was dead and it is a great injustice to the people in the Hodgin Road area
3 who bought property believing the issue was dead.

5 Mr. George Burgeron asked why the City would run an arterial highway
6 through a residential area. Mr. Bergeron also stated that there are 507
7 cars fewer in Wayne County that in 1970. He said the city needs to look
8 at another whole plan rather than create a white elephant like L Street
9 is now.

11 Mr. Carl Sharp of 981 Breckinridge stated there are build in chuck holes
12 now existing on city streets and that L Street going west from 8th needs
13 immediate attention. He asked the Council to vote against the ordinance
14 until other problems are addressed first .

16 ' Mr. Frank Kotechek of 1317 Quail Ridge stated that we were unable to properly
17 maintain our infrastructure and the City should first commit to repairs
18 first and that a new Master Plan should be developed with facts and not
19 conjectures.

21 Mr. Christopher Wise of 3211 Backmeyer Road stated that he felt the funds
22 should be dedicated to East Main and not South L Street.

24 Mr. Jim McWilliams of 1321 Hunters Pointe stated the Council should
25 consider the quality of life for all their citizens.

27 There being no further discussion, Councilmember Hankinson moved for
28 engrossment of Appropriation Ordinance No. 32-1986, seconded by Council-
29 member Elstro and on unanimous voice vote the motion was carried.

32 32-1986 to third and final reading and read by title only, seconded by
33 Councilmember Hankinson and on unanimous voice vote the motion was carried.

38 President Bodiker thanked all for their participation and making the
39 democratic process work.

41 Councilmember Hankinson stated that he appreciated the letters, calls and
42 comments and input from his district. He stated he felt this was a city-
43 wide issue and beyond the 4th District, therefore he would support the
44 Ordinance.

46 Councilmember Williams stated that he has not supported the project in
47 the past, but now that it has been changed and will only be a two (2) lane
48 access, he will support the Ordinance.

50 Councilmember Brookbank stated she was against the street in the beginning,
51 but after checking with other persons in her district, she will now support
52 the ordinance.

54 President Bodiker stated that he is against freeways in residential districts
55 with left turns being involved, but this is not the -case in this project.
56 He challenged the City to look into a way to create an access connecting
57 the industrial areas of the City with the airport.

59 Councilmember Elstro asked that the Council be updated on the project at
60 the first meeting of each month.
