HomeMy Public PortalAbout03-17-1986 315 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, MARCH 17 , 1986 1 The Common Council of the City of Richmond, Indiana, met in regular session 2 March 17, 1986 at the hour of 7:30 P.M. in the Council Chambers in said 3 City. President Bodiker presided with the following Councilmember present: 4 Elstro, Williams, Hankinson, Whitesell, Parker, Hutton, and Morris. 5 Absent: Brookbank. The following business was had to-wit: 6 7 PLEDGE OF ALLEGIANCE 8 9 SILENT DEVOTIONS 10 11 APPROVAL OF MINUTES OF MARCH 3, 1986 12 13 Councilmember Hankinson moved to approve the minutes of the previous meetin: 14 as prepared, seconded by Councilmember Whitesell and on unanimous voice 15 vote the motion was carried. 16 17 COMMUNICATIONS FROM THE MAYOR 18 19 Mayor Frank H. Waltermann asked the Council to look over the information 20 included in the Council packets received from the National League of Cities 21 He said the information it contained information on revenue sharing, tax 22 reform, transportation and other issued that would have an impact on the 23 City of Richmond. Mayor Waltermann stated that he believed in the 24 reduction of the federal deficit, but felt that it should be accomplished 25 by fair and equal treatment of all and that there were already exemptions 26 being given to special interests groups from the automatic cuts in Gramm 27 Rudman, but no favoritism was being shown to cities . The Mayor indicated 28 that this was not fair and equal treatment. 29 30 BOARD OF PUBLIC WORKS AND SAFETY 31 32 Councilmember Elstro commented on semi-trucks still being parked on City 33 streets and that the Police Department had indicated to him that they 34 had no way to measure the width of the vehicles to see if they were in 35 violation of the City's ordinance. Councilmember Elstro stated that the 36 Council might consider an ordinance addressing only semi's parked on City 37 streets . 38 39 Councilmember Elstro also expressed concern over the stumps still remaining 40 around the City from trees being removed and that since the stump remover 41 owned by the City was inoperable, it might be wise for the City to purchase 42 one or get that one repaired. 43 44 Councilmember Elstro also commented on the boxes being installed in public 45 right-of-way for Palladium Item newspapers. He stated these boxes were 46 still being installed on South 4th Street and he was under the impression 47 that no more were to be put up until the City Attorney met with Palladium 48 Officials . Councilmember Elstro stated he would like to see tickets given 49 for each box just as the City had ticketed persons with garage sale signs 50 in the right-of-way last year or refund the money received from the 51 garage sale signs . 52 53 Councilmember Morris stated that additional boxes had been placed on South 54 3rd Street since last week and that she was aware the City Attorney had 55 received assurances that no more would go up until the issue had been 56 resolved, yet they are still being placed in the right-of-way. 57 58 President Bodiker stated he had also received complaints and asked the Cler 59 to direct the Council 's comments to the Board of Works and City Attorney 60 on that issue and other brought up by Councilmember Elstro. 61 62 REPORTS FROM SPECIAL COMMITTEES 63 64 Community Development and Community Services 65 316 Common Council Minutes Cont 'd March 17, 1986 Page 2 1 Councilmember Whitesell reported the Community Development-Community Services 2 Committee had met regarding Ordinance No. 21-1986 and that some technical 3 questions regarding the ordinance were being investigated by Mr. Dooley. 4 Councilmember Whitesell requested Ordinance No. 21-1986 be continued on 5 second reading until the regular meeting of the Common Council. on April 6 7, 1986. 7 8 Alarm Ordinance Committee 9 10 Councilmember Whitesell stated that the committee established to re-write the 11 Alarm Ordinance had completed their work and were working with the 12 City Attorney to finish the ordinance. Councilmember Whitesell requested 13 that the Alarm Ordinance bey-placed on the Cbuficil agenda dnnApril(,21, 1986. 14 15 Finance Committee 16 17 President Bodiker announced the Finance Committee (all members of Common Cou cil) 18 would meet on April 3, 1986 at 7:00 P.M. in the Council Chambers for 19 discussion of finances for the budget preparation for the upcoming year. 20 21 REPORTS FROM STANDING COMMITTEES 22 23 Plan Commission 24 25 Councilmember Morris stated that the Plan Commission would be viewing a vide. 26 on survival games in connection with Ordinance No. 18-1986 on March 25, 1986 27 at 6:30 P.M. in the Council Chambers . She indicated it might be helpful 28 for the Council to participate since they will be making a decision on this 29 request. 30 31 ORDINANCES 32 33 ORDINANCES ON FIRST READING 34 35 ORDINANCE NO. 23-1986 36 37 Councilmember Morris moved to suspend the rules and read Ordinance No. 23-19:6 38 on first reading by title only, seconded by Councilmember Williams and on 39 unanimous voice vote the motion was carried. 40 41 The Clerk read on first reading by title only Ordinance No. 23-1986 - AN 42 ORDINANCE AMENDING ORDINANCE NO. 61-1985, RATIFYING THE SALARIES, WAGES AND 43 POSITIONS FOR APPOINTED OFFICERS AND EMPLOYEES OF THE RICHMOND SANITARY 44 DISTRICT FOR THE FISCAL YEAR BEGINNING JANUARY 1, 1986 AND ENDING 45 DECEMBER 31, 1986, AS ADOPTED BY THE BOARD OF SANITARY COMMISSIONERS. 46 47 Councilmember Morris moved to suspend the rules and move Ordinance No. 23-19:6 48 to second reading, seconded by Councilmember Williams and on unanimous voice 49 vote the motion was carried. 50 51 The Clerk on second reading Ordinance No. 23-1986 - AN ORDINANCE AMENDING 52 ORDINANCE NO. 61-1985, RATIFYING THE SALARIES, WAGES AND POSITIONS FOR APPOI TED 53 OFFICERS AND EMPLOYEES OF THE RICHMOND SANITARY DISTRICT FOR THE FISCAL YEAR 54 BEGINNING JANUARY 1, 1986 AND ENDING DECEMBER 31, 1986, AS ADOPTED BY THE BO RD 55 OF SANITARY COMMISSIONERS. 56 57 President Bodiker announced Ordinance No. 23-1986 was on public hearing. 58 59 There being no public comment, Councilmember Elstro moved for engrossment of 60 Ordinance No. 23-1986, seconded by Councilmember Williams and on unanimous v ice 61 vote the motion was carried. 62 63 Councilmember Elstro moved to suspend the rules and move Ordinance No. 23-1916 64 to third and final reading and read by title only, seconded by Councilmember 65 Williams and on unanimous voice vote the motion was carried. 317 Common ouncil Minutes Contc1 March 17, 1986 Page 3 1 The Clerk read on third and final reading by title only Ordinance NO. 23-1986- 2 AN ORDINANCE AMENDING ORDINANCE NO. 61-1985, RATIFYING THE SALARIES, WAGES 3 AND POSITIONS FOR APPOINTEDI) OFFICERS AND EMPLOYEES OF THE RICHMOND SANITARY 4 DISTRICT FOR THE FISCAL YEAR BEGINNING JANUARY 1, 1986 AND ENDING DECEMBER 5 31, 1986, AS ADOPTED BY THE BOARD OF SANITARY COMMISSIONERS. 6 7 Ordinance No. 23-1986 was adopted on the following call of the roll: 8 9 Ayes: Elstro, Williams , Hankinson, Whitesell, Parker, Hutton, Morris and 10 Bodiker (8) 11 Nays: None 12 Absent: Brookbank (1) 13 14 ORDINANCE ON SECOND READING 15 1 ORDINANCE NO. 21-1986 1 18 President Bodiker stated Ordinance No. 21-1986 would be held for public 19 hearing, second reading on April 7, 1986, but that he would receive public 20 comment tonight since the Ordinance was on second reading. 21 22 Councilmember Parker asked if the Indiana Code citation in Section 2 23 allowed the City to request the information regarding tax sales from the 2 i County Auditor and Councilmember Whitesell stated the ordinance follows the 25 format of the state law and does alloq the city to enact a request to the 20 County Auditor regarding properties deliquent in taxes. 27 11/ 28 Councilmember Hankinson stated that after the fourth (4th) installment of 291 taxes are missed, according to state law, the property is put up for tax sale. 3 3 UNFINISHED BUSINESS 3 3 Councilmember Bodiker stated that a Committee of the Whole hearing would 3 be scheduled soon on Ordinance No. 129-1985. 3 3 Appointments for Street Tree Commission 3 3� Councilmember Whitesell moved to confirm the appointments by Mayor Waltermann 39 of Lorrie Foust, Don Weaver and Robert Delaney and to appoint as the 4 Council representatives Gerry Raderstorf, David Stevens and Carl Reynolds . 4 The motion was seconded by Councilmember Parker and was passed on the 4 following call of the roll: 4 4 Ayes: Elstro, Williams, Hankinson, Whitesell, Parker, Hutton, Morris , and 4 Bodiker (8) 4 Nays: None 4 Absent: Brookbank (1) 481, 4Y President Bodiker stated he was appointed Councilmember Elstro as the 5C Council Liason to the Street Tree Commission. 51 5 ADJOURNMENT 5 5 There being no further business, on a motion duly made, seconded and passed. 5 the meeting was adjourned. 5 5 5E Richard Bodiker, President 55 61 6 ATTEST: 6 • Mary Merchanthouse, City Clerk 6 6 6 ' Fes' CC 01 CA CA C a, a, Ui Ui Ui In In In Ui In Ui Ui 1> .P W W W W W W W W W W N N N) N NJ NJ N N N NJ I✓ r-' I--' F-' I--' 1--' I-` F-' I--' F--' In W N }-' O k.0 CO In W N F-' O l0 CO -I 0.'
