PROCEEDINGS OF THE COMMON COUNCIL OF THE
CITY OF RICHMOND, INDIANA, MARCH 17 , 1986
1 The Common Council of the City of Richmond, Indiana, met in regular session
2 March 17, 1986 at the hour of 7:30 P.M. in the Council Chambers in said
3 City. President Bodiker presided with the following Councilmember present:
4 Elstro, Williams, Hankinson, Whitesell, Parker, Hutton, and Morris.
5 Absent: Brookbank. The following business was had to-wit:

11 APPROVAL OF MINUTES OF MARCH 3, 1986

13 Councilmember Hankinson moved to approve the minutes of the previous meetin:
14 as prepared, seconded by Councilmember Whitesell and on unanimous voice
15 vote the motion was carried.

17 COMMUNICATIONS FROM THE MAYOR

19 Mayor Frank H. Waltermann asked the Council to look over the information
20 included in the Council packets received from the National League of Cities
21 He said the information it contained information on revenue sharing, tax
22 reform, transportation and other issued that would have an impact on the
23 City of Richmond. Mayor Waltermann stated that he believed in the
24 reduction of the federal deficit, but felt that it should be accomplished
25 by fair and equal treatment of all and that there were already exemptions
26 being given to special interests groups from the automatic cuts in Gramm
27 Rudman, but no favoritism was being shown to cities . The Mayor indicated
28 that this was not fair and equal treatment.

30 BOARD OF PUBLIC WORKS AND SAFETY

32 Councilmember Elstro commented on semi-trucks still being parked on City
33 streets and that the Police Department had indicated to him that they
34 had no way to measure the width of the vehicles to see if they were in
35 violation of the City's ordinance. Councilmember Elstro stated that the
36 Council might consider an ordinance addressing only semi's parked on City
37 streets .

39 Councilmember Elstro also expressed concern over the stumps still remaining
40 around the City from trees being removed and that since the stump remover
41 owned by the City was inoperable, it might be wise for the City to purchase
42 one or get that one repaired.

44 Councilmember Elstro also commented on the boxes being installed in public
45 right-of-way for Palladium Item newspapers. He stated these boxes were
46 still being installed on South 4th Street and he was under the impression
47 that no more were to be put up until the City Attorney met with Palladium
48 Officials . Councilmember Elstro stated he would like to see tickets given
49 for each box just as the City had ticketed persons with garage sale signs
50 in the right-of-way last year or refund the money received from the
51 garage sale signs .

53 Councilmember Morris stated that additional boxes had been placed on South
54 3rd Street since last week and that she was aware the City Attorney had
55 received assurances that no more would go up until the issue had been
56 resolved, yet they are still being placed in the right-of-way.

58 President Bodiker stated he had also received complaints and asked the Cler
59 to direct the Council 's comments to the Board of Works and City Attorney
60 on that issue and other brought up by Councilmember Elstro.

1 Councilmember Whitesell reported the Community Development-Community Services
2 Committee had met regarding Ordinance No. 21-1986 and that some technical
3 questions regarding the ordinance were being investigated by Mr. Dooley.
4 Councilmember Whitesell requested Ordinance No. 21-1986 be continued on
5 second reading until the regular meeting of the Common Council. on April
6 7, 1986.

8 Alarm Ordinance Committee

10 Councilmember Whitesell stated that the committee established to re-write the
11 Alarm Ordinance had completed their work and were working with the
12 City Attorney to finish the ordinance. Councilmember Whitesell requested
13 that the Alarm Ordinance bey-placed on the Cbuficil agenda dnnApril(,21, 1986.

15 Finance Committee

17 President Bodiker announced the Finance Committee (all members of Common Cou cil)
18 would meet on April 3, 1986 at 7:00 P.M. in the Council Chambers for
19 discussion of finances for the budget preparation for the upcoming year.

23 Plan Commission

25 Councilmember Morris stated that the Plan Commission would be viewing a vide.
26 on survival games in connection with Ordinance No. 18-1986 on March 25, 1986
27 at 6:30 P.M. in the Council Chambers . She indicated it might be helpful
28 for the Council to participate since they will be making a decision on this
29 request.

37 Councilmember Morris moved to suspend the rules and read Ordinance No. 23-19:6
38 on first reading by title only, seconded by Councilmember Williams and on
39 unanimous voice vote the motion was carried.

45 DECEMBER 31, 1986, AS ADOPTED BY THE BOARD OF SANITARY COMMISSIONERS.

47 Councilmember Morris moved to suspend the rules and move Ordinance No. 23-19:6
48 to second reading, seconded by Councilmember Williams and on unanimous voice
49 vote the motion was carried.

59 There being no public comment, Councilmember Elstro moved for engrossment of
60 Ordinance No. 23-1986, seconded by Councilmember Williams and on unanimous v ice
61 vote the motion was carried.

63 Councilmember Elstro moved to suspend the rules and move Ordinance No. 23-1916
64 to third and final reading and read by title only, seconded by Councilmember
65 Williams and on unanimous voice vote the motion was carried.

14 ORDINANCE ON SECOND READING

1 ORDINANCE NO. 21-1986

18 President Bodiker stated Ordinance No. 21-1986 would be held for public
19 hearing, second reading on April 7, 1986, but that he would receive public
20 comment tonight since the Ordinance was on second reading.

22 Councilmember Parker asked if the Indiana Code citation in Section 2
23 allowed the City to request the information regarding tax sales from the
2 i County Auditor and Councilmember Whitesell stated the ordinance follows the
25 format of the state law and does alloq the city to enact a request to the
20 County Auditor regarding properties deliquent in taxes.

11/ 28 Councilmember Hankinson stated that after the fourth (4th) installment of
291 taxes are missed, according to state law, the property is put up for tax sale.

3 UNFINISHED BUSINESS

3 Councilmember Bodiker stated that a Committee of the Whole hearing would
3 be scheduled soon on Ordinance No. 129-1985.

3 Appointments for Street Tree Commission

3� Councilmember Whitesell moved to confirm the appointments by Mayor Waltermann
39 of Lorrie Foust, Don Weaver and Robert Delaney and to appoint as the
4 Council representatives Gerry Raderstorf, David Stevens and Carl Reynolds .
4 The motion was seconded by Councilmember Parker and was passed on the
4 following call of the roll:
