HomeMy Public PortalAbout03-03-1986 • 305 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, MARCH 3, 1986 1 The Common Council of the City of Richmond, Indiana, met in regular session 2 March 3, 1986 at the hour of 7:30 P.M. in the Council Chambers in said City. 3 President Bodiker presided with the following Councilmembers present: 4 Elstro, Williams, Brookbank, Hankinson, Whitesell, Parker, Hutton and Morris. 5 Absent: None. The following business was had to-wit: 6 7 PLEDGE OF ALLEGIANCE 8 9 SILENT DEVOTIONG 10 11 APPROVAL OF MINUTES OF FEBRUARY 18, 1986 12 13 Councilmember Hankinson moved to approve the minutes of the previous meeting 14 as prepared, seconded by Councilmember Brookbank and on unanimous voice vote 15 the motion was carried. 16 17 COMMUNICATIONS FROM THE MAYOR 18 19 Mayor Frank H. Waltermann informed the Council that he had received the audit 20 reports from the State Board of Accounts for 1983 and 1984 and that they wer 21 excellent, showing no problems in the City of Richmond. 22 23 Councilmember Morris asked about utility work on City streets and the proble 24 with leaving the streets barricaded for a long period of time. She stated 25 it would be appreciated by the motorists if utility street work could be don: 26 in a more timely fashion. 27 28 City Attorney Barden stated he had spoken with the attorneys and other 29 personnel from the utilities regarding ways of streamlining permit 30 procedures and marking and barricading construction areas . He said he would 31 bring up advance warning of work ahead at the next meeting along with new 32 street excavation procedures. 33 34 PRESENTATION OF REMONSTRANCES 'PETITION` AND MEMORIALS 35 36 Councilmember Morris congratulated Councilmember Hutton on her birthday. 37 38 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY 39 40 Ms. Maness reported to the Council on the several Unsafe Building Hearings 41 being conducted by the Board along with the adoption of criteria for 42 wreckers used on a rotation basis by the City. 43 44 Councilmember Williams asked about a semi-truck that had been parked in the 45 400 Block of South 4th Street. He also questioned Mr. Barden about the 46 condition of Glazers Scrap. 47 48 Mr. Barden stated he would look into the truck and said he had talked with 49 Glazers and Dennis Bronston and had toured the yard on March 3, 1986. He 50 will report back to the Council at its next regular meeting. 51 52 REPORTS FROM STANDING COMMITTEES 53 54 Reid Hospital 55 56 Councilmember Brookbank reported they had received a long range planning 57 report, a report on purchasing techniques to save dollars and a computer 58 demonstration. 59 60 MISCELLANEOUS BUSINESS 61 62 President Bodiker welcomed the students from Centerville High School in the 63 audience. 64 65 306 Common Council Minutes Cont 'd March 3, 1986 Page 2 1 Presentation on AURORA Unit of Reid Hospital 2 3 David Woodward, Director of the AURORA Unit of Reid Memorial Hospital 4 showed the Council a filmed presentation on the Unit. He explained that the 5 unit is open seven (7) days a week, twenty-four (24) hours a day and 6 provides help for the chemically dependant person. 7 8 Dr. Woodward stated that the unit has had thirty-five (35) admissions to dat 9 and the length of time in the program is twenty-eight (28) days . He said th 10 program offers both primary rehabilitation and after care and their staff 11 consists of multi-disciplinary persons including nurses, counselors and 12 a chaplin. 13 14 One of the programs, Dr. Woodward pointed out was the free intervention 15 service for help with denial of the problem. He stated that the total charg 16 for the program was 150.00 per day and they are receiving referrals from many 17 areas of the community. 18 19 Councilmember Morris thanked Dr. Woodward for what they were doing. 20 21 RESOLUTIONS 22 23 Councilmember Morris moved to suspend the rules and read Resolutions No. 4 24 and 7-1986 by title only, seconded by Councilmember Whitesell and on 25 unanimous voice vote the motion was carried. 26 27 RESOLUTION NO. 4-1986 28 29 The Clerk read by title only Resolution No. 4-1986 - A RESOLUTION ESTABLISHI G 30 A COMMITTEE TO REVIEW AND UDATE THE CITY CODE, TO PREPARE RECORDS MANAGEMENT 31 POLICY AND PERSONNEL POLICY AND AUTHORIZING THE CITY ATTORNEY TO ACT AS 32 PARLIAMENTARIAN. 33 34 Councilmember Morris asked why these issues were being handled by 35 Resolution and Mr. Barden explained that he felt a Resolution would get the ball 36 moving to accomplish the code update and records management policy. He also 37 stated the reference to parliamentarian was required for certain board 38 guidelines. 39 40 Councilmember Whitesell stated that the rules Committee for the Council rule- 41 had met and made recommendations back to the City Attorney. 42 43 There being no further comment, Councilmember Hankinson moved for adoption o 44 Resolution No. 4-1986, seconded by Councilmember Brookbank and on unanimous oice 45 vote the motion was carried. 46 47 RESOLUTION NO. 7-1986 48 49 The Clerk read by title only Resolution No. 7-1986 - A RESOLUTION APPROVING 50 AND SUPPORTING THE PARTICIPATION OF THE CITY OF RICHMOND IN THE INDIANA MAIN 51 STREET PROGRAM. 52 53 Planning Supervisor, Dan Dooley, explained to the Council that the commissio 54 is a Statewide program to encourage new development or renovation of 55 downtown areas. He stated it provides technical services and materials 56 sharing and the City must file an application and show the community support 57 of the Common Council . 58 59 Councilmember Elstro asked if support of the program was all the Resolution 60 addressed and Mr. Dooley said the Resolution indicated the Council 's support 61 of the application for the Mainstreet Program through the Indiana Department of 62 Commerce. 63 64 Councilmember Hankinson asked what the program had to offer and Mr. Dooley 65 stated things can always be improved and we would see what other cities do. 30 Common Council Minutes Cont 'd March 3, 1986 Page 3 1 Also speaking for Resolution No. 7-1986 was Ms . Kathy Rees, Executive 2 Director of Downtown Merchants Association. Ms. Rees informed the Council 3 that the City has a Million Dollar plus facility in their downtown and 4 it is unique to the area. She said they support the Resolution and see the 5 need for outside information to keep the revitalization of the downtown 6 alive. 7 8 Councilmember Elstro moved for adoption of Resolution No. 7-1986, seconded 9 by Councilmember Williams and on a voice vote the motion was adopted. 10 11 ORDINANCES 12 13 ORDINANCES ON FIRST READING 14 15 Councilmember Hankinson moved to suspend the rules and read Ordinances No. 16 19, 20, 21 and 22-1986 on first reading by title only, seconded by 17 Councilmember Parker and on unanimous voice vote the motion was carried. 18 19 TRANSFER ORDINANCE NO. 19-1986 20 21 The Clerk read on first reading by title only Transfer Ordinance No. 19-198.- 22 AN ORDINANCE TO TRANSFER WITHIN THE FIRE DEPARTMENT. 23 24 Councilmember Elstro moved to suspend the rules and move Transfer Ordinance 25 No. 19-1986 to second reading, seconded by Councilmember Hankinson and on 26 unanimous voice vote the motion was carried. 27 28 The Clerk read on second reading Transfer Ordinance No. 19-1986 - AN 29 ORDINANCE TO TRANFER WITHIN THE FIRE DEPARTMENT. 30 31 Ms. Maness explained that the ordinance clears up a error made in a previou 32 transfer. 33 34 President Bodiker announced Ordinance No. 19-1986 was on public hearing. 35 36 There being no public comment, Councilmember Elstro moved for engrossment 37 of Ordinance No. 19-1986, seconded by Councilmember Whitesell and on 38 unanimous voice vote the motion was carried. 39 40 Councilmember Elstro moved to suspend the rules and move Transfer Ordinanc- 41 No. 19-1986 to third and final reading and read by title only, seconded by 42 Councilmember Hankinson and on unanimous voice vote the motion was 43 carried. 44 45 The Clerk read on third and final reading by title only Transfer Ordinance 46 No. 19-1986 - AN 57 ORDINANCE .AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 58 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, 59 INDIANA, PROVIDING FOR THE REZONING OF THE PROPERTY LOCATED ON THE NORTH 60 SIDE OF NORTH "F" STREET IN THE 1400 BLOCK, FROM R-3 ONE-TO-EIGHT FAMILY 61 RESIDENCE DISTRICT TO M-2 GENERAL INDUSTRIAL DISTRICT. 62 63 President Bodiker assigned Ordinance No. 20-1986 to the Plan Commission 64 for public hearing. 65 30.8 Common Council Minutes Cont'd March 3, 1986 • Page 4 1 Councilmember Williams asked about the specific location of the rezoning and 2 Mr. Dooley stated it was two (2) lots between 14th and 15th on North F 3 Street. 4 5 Mayor Waltermann stated it was being requested for a new plant, Woodruff 6 Plastics, and they were looking for parking for employees. 7 8 ORDINANCE NO. 21-1986 9 10 The Clerk read on first reading by title only Ordinance No. 21-1986 - AN ORDINANS1 2 ESTABLISHING AS A PART OF THE BUILDING CODE OF THE CITY OF RICHMOND, INDIAN, , 3 A UNIFORM STANDARD FOR THE SEALING OF VACANT BUILDINGS AND STRUCTURES AND 4 ALSO ESTABLISHING MINIMUM STANDARDS FOR THE CONDITION, REPAIR, MAINTENANCE 5 OF THE EXTERIOR OF PROPERTY. 6 7 President Bodiker announced Amended Ordinance No. 13-1985 was on public 8 hearing. 9 10 Councilmember Morris requested that the proposed amendments be acted upon 11 prior to the public hearing. She also shared photographs with the Council 12 showing exterior deterioration of homes that would be addressed by this 13 Ordinance. 14 15 Councilmember Morris moved to amend Section 2 by adding (b) reading: 16 Prior to the sealing and securing of any vacant building or structure, the 17 building or structureshall be cleared of all human inhabitants. The motion 18 was seconded by Councilmember Brookbank and adopted on unanimous voice vote. 19 20 Councilmember moved to amend Section 7 with the addition of the following 21 language for an appeals procedure: 22 23 That is any property owner violates the provisions of this ordinance, 24 said property owner shall be notified in writing of such violation. 25 26 The Director of the Department of Planning, Permits and Inspections 27 shall send a "Violation Notice" by certified mail or by delivery in 28 person to the property owner found to be in violation of this ordinanc: 29 and that said person shall have a maximum of 15 days to complete and 30 return a form letter indicating agreement to "Correct the Violation wi'hin 31 30 Days" of to "Appeal the Violation". 32 33 Upon receipt of a request for an appeal the director shall notify the 34 appellant in writing of the place and dates to schedule an appeal. Th: 35 property owner may appeal "The Violation", "The Compliance Requirement-", 36 or "The Completion Date". 37 38 Upon presentation of convincing evidence the Board of Public Works and 39 Safety may negotiate an adjusted "Compliance Schedule" commensurate wish 40 the evidence presented and in keeping with the ordinance. 41 42 Proof of Hardship: Upon proof of hardship a resident-owner may be 43 granted a continuance and be execpted from fines for those violations 44 requiring the expenditure of unavailable funds provided that said 45 violations do not adversely affect the public health or safety. 46 47 Failure to comply: In the event the owner failed to respond to any of 48 the above procedures the owner would be found in violation of the 49 ordinance and fined accordingly, pursuant to Section 10.99 of the City . 50 Code. 51 52 The motion to amend Section 7 was seconded by Councilmember Brookbank and 53 was adopted by a unanimous voice vote. 54 55 Councilmember Parker asked about Section 10.99 on the fines and Mr. Barden 56 explained it was general penalty and could be established by the Court 57 according to the severity of the offense from 50.00 to 1000.00. 58 59 Councilmember Whitesell stated he was in agreement with the amendment even 60 though it is in conflict with personal feelings about instituting given finrs 61 instead of using court action. He stated it watered down the effectiveness 62 of the ordinance, but felt it would facilitate passage. 63 64 Mr. Barden stated that the Attorney's Office and the Planning Department 65 intended to enforce the ordinance. 310 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 48 49 50 51 52 53 54 55 56 57 58 59 . 60 61 62 63 64 65 311 Common Council Minutes Cont'd March 3, 1986 Page 6 1 Councilmember Morris moved to amend Section 8 with the addition of paragraph 2 (b) as follows: 3 4 The Board of Public Works and Safety may develop standards and 5 6 procedures for the implementation and enforcement of these provisions. 7 Councilmember Whitesell seconded the motion to amend Section 8 and the motio 8 was adopted on a unanimous voice vote. 9 10 Councilmember Hutton moved to amend Section 5, paragraph 3, line 2 by adding 11 the following language: , when such peeling consists of at least 33 1/3% 12 of the surface area. 13 14 Councilmember Morris seconded the motion to amend Section 5 and the motion 15 was. adopted on a unanimous voice vote. 16 17 There being no further amendments the floor was opened for public discussion 18 19 Speaking for Amended Ordinance No. 13-1985 was Mr. Cliff Wagoner of 1706 20 Idelwild Drive and representing the Chamber of Commerce Local Government 21 Committee. Mr. Wagoner stated the Ordinance deals with the attitudes of 22 people and the desirability of our community. He indicated that the 23 ordinance has been somewhat watered down with the amendments, but the 24 Chamber does endorse the concept. 25 26 Speaking for Amended Ordinance No. 13-1985 was Mr. Steve McClain of 515 Sout 27 10th Street. Mr. McClain informed the Council that the property at 519 Sout 28 10th Street, that was the subject of a newspaper article, had been vacant 29 for a long time and he has personally witnessed breakins at the property and 30 was fearful of the safety of his own property. He stated that the condition 31 of this property lowered the property values of other houses in the area. 32 33 In response to Councilmember Morris regarding demolition of the property, 34 Mr. McClain stated that the persons in the area preferred it be fixed up and 35 maintained in order to have neighbors . 36 37 Mr. Jim Criz of 715 West Main Street stated there was much concern and broad 38 base support for this ordinance and that it will also create an avenue for 39 dialogue within the community. He indicated the ordinance has an 40 intelligent approach to the problems of exterior maintenance of properties 41 and does offer genuine relief. 42 43 Mr. Joe Pierce of 3001 Parkwood Drive asked about old commercial buildings 44 within the City such as the Gennett Building and hoped the ordinance would 45 address these types of structures since they were on main entrances into 46 our community. 47 48 Mr. Herb Comer of 3368 N.W. C Street stated that he supported the ordinance 49 and suggested that the Council consider the adding "and inspected by the 50 local police and fire departments prior to sealing", in Section 2 (b) . 51 52 Ms. Ruby Wilson of 2101i North 5th Street informed the Council about a 53 property next to hers being in bad shape and that she was not able to enjoy 54 her porch due to the filth. 55 56 Mr. William Wingate of 325 South 16th Street stated he was in favor of the 57 ordinance. 58 59 Mayor Frank H. Waltermann informed the Council that his office was in favor 60 of the ordinance and felt it would have a good psychological effect on the 61 City. Mayor Waltermann also reminded the Council of the aesthetic effects 62 and their impact on economic development of the City. He said the ordinance 63 will protect the citizens of Richmond and at the same time asist the less 64 fortunate. 65 E 312 Common Council Minutes Cont 'd March 3, 1986 Page 7 1 Mr. Robert Ridgeway asked the Council to pay special attention to protection 2 of the elderly citizens in enforcement of this ordinance. 3 4 President Bodiker asked about using the ordinance for commercial buildings ard 5 Mr. Dooley stated that they would address those under the issue of blight 6 or if they were a fire hazard the unsafe building process could be used. 7 Mr. Dooley stated that his office needs to get more publicity to the Council 8 regarding the work they have done. 9 10 Councilmember Elstro stated the Planning Department was doing a good job, 11 but there was not enough manpower. 12 13 Mr. Richard Knight asked the Council about the building at 16th and E. Main 14 Streets and was informed it was slated for an unsafe building hearing in the 15 near future. 16 17 There being no further discussion, Councilmember Whitesell moved for 18 engrossment of Amended Ordinance No. 13-1985, seconded by Councilmember 19 Hankinson and on unanimous voice vote the motion was carried. 20 21 Councilmember Hankinson moved to suspend the rules and move Amended Ordinance 22 No. 13-1985 to third and final reading and read by title only, seconded 23 by Councilmember Brookbank and on unanimous voice vote the motion was 24 carried. 25 26 The Clerk read on third and final reading by title only Amended Ordinance No. 27 13-1985 - AN ORDINANCE ESTABLISHING AS A PART OF THE BUILDING CODE OF THE CITY 28 OF RICHMOND, INDIANA, A UNIFORM STANDARD FOR THE SEALING OF VACANT BUILDINGS 29 AND STRUCTURES AND ALSO ESTABLISHING MINIMUM STANDARDS FOR THE CONDITION, 30 REPAIR AND MAINTENANCE OFTHE EXTERIOR OF PROPERTY, PREMISES, BUILDINGS AND 31 STRUCTURES. 32 33 Amended Ordinance No. 13-1985 was adopted on the following call of the roll: 34 35 Ayes: Elstro, Williams, Brookbank, Hankinson, Whitesell, Parker, Hutton, 36 Morris adn Bodiker (9) 37 Nays: None 38 39 ORDINANCE NO. 17-1986 40 41 The Clerk read on second reading Ordinance No. 17-1986 - AN ORDINANCE AMENDING 42 CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, COMMONLY KNOWN 43 AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA PROVIDING FOR THE REZONING 44 OF PROPERTY LOCATED AT 244 SOUTH 4TH STREET FROM R-3 ONE-TO-EIGHT FAMILY 45 RESIDENCE DISTRICT TO R-3 SPECIAL USE ONE-TO-EIGHT FAMILY RESIDENCE SPECIAL LSE 46 DISTRICT, AND AUTHORIZING THE SPECIAL USE OF SAID PROPERTY AS A BUSINESS AND 47 ADMINISTRATIVE OFFICE. 48 49 President Bodiker stated the Plan Commission had unanimously voted to 50 recommend adoption of the Ordinance.
