Inc., Hilton Head Island, SC, The tree in question is located on the north property line of the above address. The purpose of this inspection is to determine any effect or interference by the proposed pool and fence construction. The main considerations were the present tree health, possible damage to the tree during construction, long -term health effects and any hazardous situations caused by the proposed construction. The following are my findings, Tree Observation; This tree is a 31 -inch caliper DSH live Oak (quercus virginiana) located a few feet outside of the north property line. It currently appears in overall good health. The lower trunk has a slight lean to the north but the upper crown is an overall balanced structure. The new fence and pool construction is planned to cover the majority of the southern half root plate. While carefully excavating in this area it will be critical not to sever any large transport/structural roots (any roots over 3 inches in diameter) that are required to maintain tree stability. Although many feeder roots will be severed in this area, this can be overcome with a regularly scheduled root fertilization injection program in the remaining undisturbed root plate. ec nen Yio This 31 -inch Live Oak has character and is estimated to be over 100 years old. Every effort should be made to make accommodations regarding the proposed construction. If large transport/structural roots are encountered during careful excavation the position of the pool should be laterally adjusted in order to not cut these roots. The contractor has agreed to this possibility. Pervious paving should be used for decking surrounding the pool. Arboriculture industry best management practices recommend a root fertilization injection prior to construction and then every six months thereafter in order to overcome the loss of the smaller feeder roots, Follow -up inspections by a certified arborist should also be scheduled at this time in order to monitor and advise if any changes in the overall health and stability occurs. With proper care and precautions taken during construction and proper follow -up, I believe this tree can remain healthy and stable. If further information or clarification regarding this report is needed, I can be contacted anytime via mobile phone (843) 338 -7337, Sincerely, j / Woody ISA certified Arborist # SO -1949A Message Dee Anderson From: Bubba Hughes [bhughes @cbrhlaw.com] Sent: Friday, July 28, 2006 2:57 PM To: Dee Anderson Subject: tree ordinance Page 1 of 1 Dee, I understand that a question has arisen about the barricading requirement for trees during development. As we discussed 7 -070 would literally require any permitted work near a tree to result in a barricade at the drip line & that the area within the barricade shall remain free of development activities. I also understand that a fence is being constructed along a property line which contains or abuts a tree & that a permit for the work was granted. Putting aside questions on whether the section applies to all construction activities, as you know we have permitted houses, fences & other structures to be placed within the drip line where appropriate protections have been made for trees & in light of that, I do not think we can revoke a permit already granted, if the section would have been applicable to this activity to start with in light of our prior actions. 07/28/2006 LLn 8 3 3 -1 ► S `I I c- e- SoP W orK r D (o -D33CA W,tl 6, 5 o- So, x CITY OF TYBEE ISLAND BUILDING PERMIT DATE ISSUED: 06 -6 -2006 WORK DESCRIPTION: RENOVATION RESIDENTIAL BLDG WORK LOCATION: 40 OFFICERS ROW OWNER NAME JOHN MELLENCAMP ADDRESS 5087 W LOWER SCHOONER RD CITY, ST, ZIP NASHVILLE IN 47448 CONTRACTOR NAME END 7 13 CITY STATE ZIP FLOOD ZONE BUILDING VALUATION SQUARE FOOTAGE OCCUPANCY TYPE TOTAL FEE'S CHARGED PROPERTY IDENTIFICATION # PROJECT VALUATION GRAVES CONSTRUCTION CO INC PO BOX 7108 HILTON HEAD SC 29938 P $ 415.00 $50,000.00 TOTAL BALANCE DUE: PERMIT #: 060336 $ 415.00 It is understood that if this permit is granted the builder will at all times comply with the zoning, subdivision, flood control, building, fire, soil and sedimentation, wetlands, marshlands protection and shore protection ordinances and codes whether local, state or federal, including all environmental laws and regulations when applicable, subsequent owners should be informed that any alterations to the property must be approved by the issuance of another building permit.
