PROCEEDINGS OF THE COMMON COUNCIL OF THE
CITY OF RICHMOND, INDIANA, DECEMBER 2, 1985
1 The Common Council of the City of Richmond, Indiana, met in regular session
2 December 2, 1985 at the hour of 7:30 P.M. in the Council Chembers in said
3 City. President Williams presided with the following member present:
4 Councilmembers Elstro, Brookbank, Hankinson, Parker, Bodiker, Lemoine,
5 and Morris. Absent: Whitesell. The following business was had to-wit:

13 Councilmember Hankinson moved to approve the minutess of the previous meeting
14 as prepared, seconded by Councilmember Parker and on unanimous voice vote
15 the motion was carried.

17 COMMUNICATIONS FROM THE MAYOR

19 Mayor Frank H. Waltermann informed the Council that he had received a letter
20 fran the City of Smolinsk in the Soviet Union. Smolinsk is the City
21 being considered for the Sister City Program and members of the Richmond
22 Community are nor visiting the City.

24 Mayor Waltermann invited the Council to read a Newsletter being published
25 by City employees and contains news fran the City Departments. The
26 Newsletter is designed to acquaint persons with the operations of the
27 various City Departments.

29 REPORT FROM CITY DEPARTMENTS

33 Mr. Barden informed the Council that his office and the Clerk's Office
34 were now following up on delinquent tickets. All tickets that are over
35 fourteen (14) days old will be invoiced to the persons being issued the
36 ticket along the the late fee. Parking violations are also being filed
37 in Court after the time has expired to pay. Mr. Barden explained that
38 with an accumulation of three (3) of more unpaid parking tickets, the
39 State Bureau of Motor Vehicles can be petitioned to suspend the persons
40 car registration.

42 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY

44 Ms. Maness, City Controller, stated that the Board had awarded the final
45 bid for five (5) Rose View Transit Buses to Merchanthouse Transportation
46 Service. •
47 Ms. Maness also invited the Council to participate in the Public Meeting
48 to receive information on the tier structure proposal by Clearview Cable
49 TV. The meeting is scheduled for December 5, 1985 at 7:00 P.M. in the
50 Council Chambers.

52 Councilmember Elstro requested the Board to investigate a problem with
53 semi-trucks parking on City streets, particularly at South 7th and E and
54 South 16th and H Streets. Mr. Barden will follow up on this problem.

60 Councilmember Brookbank reported that the Reid Hospital Board had met on
61 November 25, 1985 and had reported on the Cancer Unit, a joint venture
62 for sports injuries, an increase in roan rates and the Chemical Dependency
63 Unit.

18 Councilmember Parker moved to suspend the rules and read Resolution No. 17-1 85

26 President Williams commented that the settlement involved a case against the
27 City that had been tied up in Court the past ten (10) years regarding the
28 dismissal of city employees.

30 Mr. Barden stated this resolution commits the City to the settlement and tha.
31 he will bring an appropriation ordinance to the Council in the future for
32 the funding.
33 Councilmember Elstro moved for engrossment of Resolution No. 17-1985,
34 seconded by Councilmember Hankinson and on unanimous voice vote the motion
35 was carried.

43 A RESOLUTION IN MEMORY OF MAJOR EDWARD DUANE BRATTON

45 WHEREAS, Major Edward Duane Bratton was a Richmond native and a seventeen
46 (17) year member of the Richmond Police Deparliuent; and,
47
48 WHEREAS, Major Bratton was a valued employee of the City of Richmond, India a,
49 since June 17, 1968; and,
50
51 WHEREAS, Major Bratton epitomized professionalism in the Police Service
52 through his conscientious, dedicated and loyal service to the City
53 of Richmond and its citizens; and,
54
55 WHEREAS, Mayor Bratton served as an example to all of his colleagues throug
56 his ideals of fairness and his desires to achieve; and,
57
58 WHEREAS, Major Bratton held the following positions with the Richmond Polic:
59 Deparhuent: Patrol Officer, Juvenile Officer, Detective, Sergeant,
60 Lieutenant, Captain and Major; and,

62 WHEREAS, Major Bratton was well known and equally well respected by all who

1 NOW THEREFORE BE IT RESOLVED by the Common Council of the City of Richmond,

28 Councilmember Parker asked why this ordinance was being presented when the C'ty
29 had a resolution addressing the issue and Mr. Barden explained that more
30 stringent guidelines need to be established and it is his opinion that the C'ty
31 needs an ordinance to designate the guidelines. Mr. Barden stated the other
32, alternatives would only be used in cases of necessity.

52 Councilmember Parker asked about the fine and Mr. Barden explained it falls
53 under the general fine provisions of the City. Mr. Barden also commented
54 that with the new State Laws the law is pretty effective handled through
55 the Public Service Coinuuission regarding repair of hazardous crossings.

13 TO REGULATE BURGLARY AND ROBBERY ALARM SYSTEMS.

17 Councilmember Morris asked if some proposed amendments could made after the
18 public hearing in order to gain additional input. Councilmember Elstro
19 stated he felt the amendments should be addressed prior to the public heari g
20 in order that the public could make comments on them also.

22 President requested Mr. Barden to stated the amendments prior to the public
23 hearing.

25 Mr. Barden proposed the following Sections be amended:

27 Section 1 - add sane examples of false alarm activity.
28 Section 3 - request additional information on the alarm user, alarm c. .any
29 and the type of alarm.
30 Section 4 - Change fee to 10.00 for two year permit.
31 Section 5 - Allow testing procedure and two week trial period.
32 Section 7 - Placement of permit in praninent location.
33 Section 8 - new section on keeping of log of activities
34 Section 9 - Information on alarm system.
35 Section 14 - Notice of violation filed in quadruplicate
36 Section 16 - Change in penalties.
37 Section 19 - Revocation and reinstatement with Board of Works Hearing.
38 Section 20 - Features on automatic dialers
39 Section 22 - Effective Date changed.

41 Councilmember Morris read fran Police Chief Nimitz regarding his support of
42 the Alarm Ordinance the problems it addresses.

44 Speaking in favor was Mr. Cliff Waggoner of 1706 Idlewild Drive. Mr.
45 Waggoner stated that some cities will not respond to alarms without proof o:
46 suspect behavior. He stated that it costs Richmond 328.00 to respond to ea.h
47 alarm. He said that most false alarms are human error and unreliable
48 detection systems. He added that if we don't eventually control the abuses
49 we will lose the right to have alarm systems.

51 Speaking in favor was also Mark Smith of 225 Crestwood Lane. Mr. Smith staged
52 that he helped foster the alarm ordinance and that it needs penalties for
53 abuses. He also stated that a registration is needed for alarm users. and
54 that the ordinance is only directed at abusers.

56 Also speaking was Mr. Dave Dolan of 806 North H Street. Mr. Dolan stated at
57 the false alarm statistics support control, but the control should not get
58 too complicated. He also stated that alarm users need sane headway and that.
59 one (1) false alarm was not a chronic abuser.

61 Speaking against was Mr. Ray James of Sonitrol. Mr. James stated he was nog
62 totally against control of false alarms, but against the way this ordinance
63 was written. He said that 5% of the users cause 95% of the problems and tho
64 ordinance should be fair to the other 95%. He suggested the Council start
65 over with the ordinance since it is so full of inconsistencies.

Mr. James suggested a committee of Police, City Attorney, Council and the
2 Alarm businesses to reconsider an ordinance.

4 Councilmember Morris reminded Mr. James that such input had been received
5 in the conception of the present ordinance.

7 Also speaking against was Mr. Jim Knight of 809 South 17th Street. Mr.
8 Knight suggested that he objected to no recourse and a flat fine. Mr. Barde
9 explained that recourse is addressed in the proposed amendments.

11 Also speaking was Mr. Robert Doyle of 3300 Geraldine Lane. Mr. Dolye
12 stated the problem is a few people with many false alarms and he felt they
13 should be charged for the false alarms if you have over a certain amount
14 in a time period.

16 Mr. Jerry Foreman, Security Officer for the Second National Bank, told the
17 Council that 95% of the false alarms are negligence of employees. He also
18 presented the Council question regarding a business with satellite locations
19 and the charges per location.

21 Speaking was Mr. Robert Burdette, owner of a business in Richmond. He
22 stated that his alarm problems are also employees and he complimented the
23 Police Department on their responses. His major concern was businesses or
24 persons on a small budget and would they be forced to do without.
25
26 Ms. Suzanne Meyer of 800 South 9th stated she was not against just had many
27 questions especially about revocation and where does that put the alarm user.
III28 Mr. Barden explained the reinstatement procedure proposed.

30 Marian Dolan of 806 North H Street stated she was concerned with acts of
31 God and felt there should be some false alarms allowed.

33 Councilmember Lemoine suggested the Council act on the proposed amendments.

35 Mr. Don Miller of 1100 South 24th requested to speak and told the Council
36 that he felt it was a lenient ordinance and that it should be voted on since
37 it is impossible to please everybody. He stated the ordinance will make
38 people more aware of their responsibilities.

40 Councilmember Lemoine moved to amend Section 1 (a) as proposed by Mr. Barden,
41 seconded by Councilmember Morris and on unanimous voice vote the motion was
42 carried.

44 Councilmember Lemoine moved to amend Section 1 (d) ii as proposed, seconded
45 by Councilmember Morris and on unanimous voice vote the motion was carried.

47 Councilmember Lemoine moved to amend Section 3 (a) by replacing 72 with 48,
48 seconded by Councilmember Hankinson and on unanimous voice vote the motion
49 was carried.

51 Councilmember Lemoine moved to amend Section 3 (g) as proposed, seconded
52 by Councilmember Morris and on unanimous voice vote the motion was carried.

55 by Councilmember Morris and on unaimous voice vote the motion was carried.

14 Councilmember Parker moved to amend Section 9 to read 25.00 fee instead of
15 100.00, seconded by Councilmember Hankinson and on a voice vote with
16 Councilmembers Bodiker and Morris voting no the motion was carried.

18 Councilmember Parker moved to amend Section 10 (b) to 10.00 fee, seconded
19 by Councilmember Hankinson and with Councilmanbers Morris and Bodiker voting
20 no the motion was carried.

22 Councilmember Lemoine moved to amend Section 14 (b) as proposed, seconded
23 by Councilmember Morris and on unanimous voice vote the motion was carried. .

25 Councilmember Lemoine moved to amend Section 17 as proposed, seconded by
26 Councilmember Brookbank and on unanimous voice vote the motion was carried.

28 Councilmember Lemoine moved to amend Section 18 as proposed, seconded by
29 Councilmember Morris and on unanimous voice vote the motion was carried.

39 motion was carried.

41 Councilmember Elstro moved to strike Ordinance No. 47-1985 and start over.
42 The motion died for the lack of a second.

44 There being no further comment, Councilmember Lemoine moved for engrossment
45 of Amended Ordinance No. 47-1985, seconded by Councilmember Brookbank and
46 on unanimous voice vote the motion was carried.

48 President Williams commented that he is in sympathy with the police answer' g
49 the false alarm calls and feels abusers should be penalized and they should
50 be controlled.

52 Councilmember Bodiker moved to suspend the rules and move Amended Ordinance
53 No. 47-1985 to third and final reading and read by title only, seconded by
54 Councilmember Morris and with Councilmember Elstro voting no the motion was
55 defeated.
