PROCEEDINGS OF THE COMMON COUNCIL OF THE
CITY OF RIB, INDIANA, NOVEMBER 18, 1985
1 The Common Council of the City of Richmond, Indiana, met in regular
2 session, November 18, 1985 at the hour of 7:30 P.M. in the Council Chambers
3 in said City. President Williams presided with the following members
4 present: Councilmembers Elstro, Brookbank, Hankinson, Whitesell, Parker,
5 Bodiker, Lemoine and Morris. .Absent: None. The following business
6 was had to-wit:

14 Councilmember Hankinson moved to approve the minutes of the previous mccting
15 as prepared, seconded by Councilmember Whitesell and on unanimous voice
16 vote the motion was carried.

18 CUNICATIONS FROM THE MAYOR
19
20 Mayor Frank H. Waltermann told the Council that he had met with the
21 DepaLllnent of Commerce last week. He also stated they had met with a
22 small firm out of Michigan about locating in Richmond and that it was
23 too early to tell about any decisions.

25 Mayor Waltermann said he had attended a meeting with the Richmond Tourism
26 Bureau and that they had successfully bid for the 1986 Festival Association
27 Convention. The Mayor thanked Vickie Wogoman and Mary Walker and the
28 other volunteers involved in the presentation to locate the convention
29 in Richmond.

31 Mayor Waltermann congratulated the High School Football team and the Girl's
32 Volleyball team on successful seasons and offered best wishes to
33 the Hagerstown Football team as they attempt to win a championship.

35 The Mayor also informed the Council that students fran Mr. Zinken's
36 government classes were in attendance. He also said that he and the
37 Purchasing Director Rita Stout had just completed Rick Beer's program
38 on WKBV and had discussed the purchasing department on the show.

40 PRESENTATIONS OF PETITIONS, REMONSTRANCES AND MEMORIALS

42 Councilmember Lynn Morris paid tribute to Judge James Ronald. President
43 Williams stated that he regretted Judge Ronald's death and that he had
44 been a good loyal citizen and friend.

46 REPORTS FROM CITY DEPAR°r MEETS

48 Purchasing Deparlruent

50 Rita Stout, Purchasing Director, updated the Council on activities in
51 the Purchasing Department. Ms. Stout informed the Council that final
52 bid award will be made to Merchanthouse Transportation Sales for five
53 (5) buses for Rose View Transit and they are scheduled for a mid-February
54 delivery.

56 Ms. Stout also stated that the bids for bulk gasoline purchases will be
57 received in December, the weather prevented the tennis court painting
58 and lighting at Glen Miller Park and they are working on specifications
59 for a water slide for the municipal pool. Ms. Stout also informed the
60 Council that a Lilly Fellow has been assigned to the City to assist in
61 plans for a centralized garage.

65 Councilmember Elstro asked Mr. Hillard about leaf removal ending and the

1 fact that a lot of leaves remain on the streets.

3 Mr. Hillard explained that they would bereadyingH all but two (2) vehicles
4 for snow removal and these vehicles would be used to make one (1) more pick
5 up in each zone.

7 Councilmember Elstro asked the press if they might assist the City by noting
8 that leaves can be bagged for pick up after removal has ended and not to put
9 leaves in the gutters.

11 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY

13 Ms. Maness informed the Council that the Board had taken the tier structure
14 rate proposal from Clearview Cable TV under advisement and would be setting
15 a public hearing for the first week in December on the proposed rate
16 increase.

18 Councilmember Morris asked that the Board of Works issue a warning to bicycle
19 riders and express the rider's responsibility for their safety.

21 REPORT FROM STANDING COMMITTEES

23 Enterprise Zone

25 Councilmember Brookbank reported the resignation of John Hitch from the
26 Urban Enterprise Zone Board due to his business closing. She asked for
27 thoughts on his replacement from the Councilmembers since it is a Council
28 appointment and it must be from the business sector..

30 President Williams commended Mr. Hitch for his service to the City.

32 MISCELLANEOUS BUSINESS

34 Presentation on Adult Basic Education Program - Cheryl Amos
35
36 Ms. Cherly Amos, Coordinator of the Adult Basic Education program informed
37 the Council that the program through State and Federal dollars provides
38 an education for those sixteen (16) and over not having completed high
39 school and has been in existance in Richmond since 1979. Ms. Amos said there
40 were 753 participants in 1984-85 and that there are already over 400
41 participants in 1985. Ms. Amos explained that classes are held four (4)
42 days a week and that this problem is just not local, but nationwide.

35 Speaking for Ordinance No. 124-1985 was Ms. Cathy Maness. Ms. Maness
36 explained that according to Indiana Code §36-1-11.3 the fiscal body of
37 the municipality must approve the sale if the appraised value is over
38 $10,000.00. Ms. Maness said the Revolving Loan Fund Board is requesting
39 Common Council to approve any-future sale of the Depot and delegate the
40 authority to the Loan Fund Board. Ms. Maness said they would sell the
41 depot to the highest and best bidder and would use a stringent set of
42 guidelines for the future use of the property. She stated that they are
43 currently trying to place the structure on the Historic Register.

45 In response to Councilmember Morris, Ms. Maness stated that the City naa
46 owns the depot.

48 Councilmember Elstro commented that although the Council would lose
49 jurisdiction over the sale, Councilmember Parker represents the Council
50 on the Loan Fund Board.

52 Mr. Dave Dolan of 806 North H Street asked why the Council would be left
53 out of the sale and why contingencies would be put on the sale of the
54 property.

56 Ms. Maness explained that the Loan Fund Board has more time for such
57 activities and that the City will set guidelines on the sale and covenants
58 in the deed to insure the historic preservation of the structure.

32 with new state legislation calling for a two-thirds (2/3) vote to pass an
33 ordinance in the same meeting it was introduced.

19 No. 15-1985 - AN ORDINANCE DIRECTING THE RICHMOND ECONOMIC DEVELOPMENT
20 COMMISSION TO REQUIRE CONTRACTORS FOR APPROVED ECONOMIC DEVELOPMENT AND
21 INVESTMENT INCENTIVE PROJECTS TO SET AS A GOAL THE EMPLOYMENT OF WAYNE COUNTY
22 RESIDENTS AND TO PAY PREVAILING WAGES TO ALL WORKERS EMPLOYED ON APPROVED
23 PROJECTS.

25 Councilmember Bodiker informed the Council that they had amended Section 6.01
26 to reflect the addition of the Community and Economic Development Loan Fund
27 Board and now the balanc of the ordinance needed to be amended to reflect
28 that change. Councilmember Bodiker moved to amend Ordinance No. 15 to
29 reflect the Community and Economic Development Loan Fund Board throughout
30 the Ordinance and to amend the Title by replacing the word "require" with
31 the words "recommend that" and also make the same amendment in Section 6.01,
32 seconded by Councilmember Parker and on unanimous voice vote the motion was
33 carried.

35 Councilmember Bodiker urged adoption of Amended Ordinance No. 15-1985 and
36 informed the Council that they have passed protection ordinances in the past
37 and if businesses need to ask for government help, the government should be
38 able to demand their help in return to solve unemployment.

40 Councilmember Whitesell stated that based on the changes made tonight he would
41 support the ordinance, but that he was still disturbed with the initial intent
42 and felt government had no right to place stipulations on the private sector.
43 He stated he would still like to see the ordinance structured around funds
44 the Common Council has control over, not other boards and commissions.

46 President Williams stated he would support the ordinance since it is a safe-
47 guard for workers in this community.

49 Councilmember Brookbank stated she has had several calls regarding this
50 ordinance in the past several months and only two (2) calls were from labor
51 in support of the ordinance. She stated that based on contacts she cannot
52 support the ordinance.
