CITY OF RICIID, INDIANA, OCTOBER 21, 1985 1 The Common Council of the City of Richmond, Indiana, met in regular session • 2 October 21, 1985 at the hour of 7:30 P.M. in the Council Chambers in said 3 City. President Williams presided with the following members present: 4 Councilmembers Elstro, Brookbank, Hankinson, Whitesell, Parker, Bodiker, 5 Lemoine and Morris. Absent: None. The following business was had to wit: 6 7 PLEDGE OF ALLEGIANCE 8 9 SILENT DEVOTIONS 10 11 APPROVAL OF MINUTES OF OCTOBER 7, 1985 12 13 Councilmember Hankinson moved to approve the minutes of the previous meeting 14 as prepared, seconded by Councilmember Whitesell and on unanimous voice vote , 15 the motion was carried. 16 17 COMMUNICATIONS FROM THE MAYOR 18 19 Mayor Frank H. Waltermann informed the Council that a meeting had been held 20 regarding liability insurance for the City. Mayor Waltennann stated that 21 liability insurance costs for the City was 234,000.00 in 1984 and will be 22 475,000.00 for 1986. He indicated that cities will be in a financial bind 23 without General Revenue Sharing and the federal government needs to be 24 aware of cities problems. Mayor Waltermann stated the committee meeting 25 for the liability insurance was trying to assist in solving the problem and 26 making suggestions to help control the problem. 27 28 CouncilmeMber Morris suggested that Representatives Hibner and Brown and 29 Senator Nicholson be invited to a meeting of the Common Council to allow 30 the City to express their concerns and ask for their assistance on the 31 State level. 32 33 Mayor Waltermann agreed that the State Legislators could be of help in 34 offsetting these insurance costs. 35 .36 President Williams asked Mayor Waltennann to set the date and time for an 37 appearance by the State Legislators and get it on the Council Agenda. 38 39 Mayor Waltermann suggested a date in November would be appropriate. 40 41 Councilmanber Whitesell asked if cost tracking was done on insurance by 42 depaLLuent and Mayor Waltennann explained that the costs are broken down 43 and paid from each department's budget. He said the Wayne County Insurance 44 Service can tell where the losses in each area are. 45 46 REPORTS FROM CITY DEPARTMENTS • 47 48 Purchasing Department 49 50 The Purchasing Director, Rita Stout, presented the camera to the Council 51 that had been purchased for their use. Ms. Stout suggested that the camera 52 be stored in the Clerk's Office with a sign out sheet available to keep 53 track of the camera. 54 • 55 Law DepaL tuuent 56 57 Mr. Barden informed the Council that the term of Orville Allen to the Board 58 of Zoning Appeals had p and it is the Council's turn to make the 59 selection. 60 61 The Council requested that the appointment be made at the next meeting in 62 order that Mr. Allen can be contacted about remaining on the BZA. 63 64 65 2 9. Cuiunon Council Minutes Cont'd October 21, 1985 Page 2 1 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY 2 3 Ms. Maness informed the Council that the Board of Public Works and Safety 4 had approved a contract with General Telephone for a seven (7) year lease 5 purchase package for new communications equipment except the Sanitary 6 District. This will reduce the overall cost to the city for telephone 7 communications by $3.00+ a month and will allow a better system for cost 8 tracking of long distance charges. 9 10 Ms. Maness also directed the Council's attention to the leaf pick up • 11 schedule for Saturday pick ups. 12 13 REPORTS FROM SPECIAL COMMITTEES 14 15 Transportation, Community Development and Cututunity Services 16 17 Councilmember Lemoine stated the committee would be meeting on October 18 23, 1985 at 12:00 noon. 19 20 Committee of the Whole 21 22 Councilmember Lemoine reported on the presentation by Lorrie Foust on the 23 Street Tree project. Councilmember Lemoine complimented Mr. Foust on 24 his presentation and recommended that the Council appoint Mr. Elstro to 25 head up this project with the assistance of Mr. Barden in the 26 establishing of a Street Tree Commission. 27 28 Councilmember Lemoine stated that Committee of the Whole was scheduled for 29 October 23, 1985 for discussion of Ordinance No.84-1985 and that the 30 District Mooting for District 3 was scheduled for October 24, 1985. 31 Councilmember Lemoine suggested that since discussion of Ordinance No. 84- 32 1985 was scheduled for both meetings that Council merge the two (2) 33 meetings on October 24, 1985. 34 35 Councilmember Brookbank commented that 1000 flyers had boon passed out 36 regarding the District Meeting and that it is at 7:30 P.M. at Vaile School. 37 38 Ordinances No. 47-1985 and 67-1985 will be removed from the Committee of the 39 Whole and placed on the Council Agenda for November 4, 1985 on second 40 reading, public hearing. 41 42 REPORTS FROM STANDING COMMITTEES 43 44 Reid Hospital 45 46 Councilmember Brookbank asked the members of Council to pay particular 47 attention to the article in the Palladium Item about the hospital's position . 48 on competition. 49 50 ORDINANCES 51 52 ORDINANCES ON FIRST READING 53 54 Councilmember Hankinson moved to suspend the rules and read Ordinances No. 55 105, 106, 107 and 108-1985 on first reading by title only, seconded by 56 Councilmember Morris and on unanimous voice vote the motion was carried. 57 58 TRANSFER ORDINANCE NO. 105-1985 59 60 The Clerk read on first reading by title only Transfer Ordinance No. 105-198'+ - AN 36 ORDINANCE TO TRANSFER WITHIN THE GENERAL FUND - FIRE DEPARTMENT. 37 38 President Williams announced Ordinance No. 106-1985 was on public hearing. 39 40 Councilmenber Lemoine asked if the 3,170.00 was sufficient to purchase the 41 automobile for the Fire DepaiLutent and Purchasing Director Rita Stout 42 stated that it was sufficient. 43 44 Councilmember Parker asked if the old vehicle would be traded in or sold 45 at the City Auction and Ms. Maness stated it would be sold at the City 46 Auction. 47 48 There being no further comment, Councilmember Hankinson moved for 49 engrossment of Ordinance No. 106-1985,- seconded by Councilmember Parker 50 and on unanimous voice vote the motion was carried. 51 52 Councilmenber Elstro moved to suspend the rules and move Transfer Ordinance III 53 No. 106-1985 to third and final reading and read by title only, seconded 54 by Councilmember Hankinson and on unanimous voice vote the motion was 55 carried. 56 57 The Clerk read on third and final reading by title only Transfer Ordinance 58 No. 106-1985 - AN 4 ORDINANCE AMENDING ORDINANCE NO. 75-1984 FIXING SALARIES AND POSITIONS FOR 5 APPOINTED OFFICES AND EMPLOYEES OF THE CITY OF RICHMOND, INDIANA FOR 1985. 11/ 6 7 Councilmember Morris moved to suspend the rules and move Ordinance No. 107-19:5 8 to second reading, seconded by Councilmember Elstro and on unanimous voice 9 vote the motion was carried. 10 11 The Clerk read on second reading Ordinance No. 107-1985 - AN ORDINANCE 12 AMENDING ORDINANCE NO. 75-1984 FIXING SALARIES AND POSITIONS FOR APPOINTED 13 OFFICES AND EMPLOYEES OF THE CITY OF RICHMOND, INDIANA FOR 1985. 14 15 President Williams announced Ordinance No. 107-1985 was on public hearing. 16 17 Councilmember Morris asked for an explanation of the need of a full time 18 secretary within the Fire Deparmment. 19 20 Mayor Waltermann explained that the request was made on the suggestion of 21 Acting Fire Chief Don Atkins, Acting Fire Chief Joe Pierce and Fire Chief 22 Dave Harbin. 23 24 Fire Chief Harbin explained to the Council that the Fire Department was in 25 need of a full time secretary to expand and update record keeping within 26 the Fire Department. Chief Harbin stated that the job description for that 27 position had been revised and the duties would include such items as payroll, 28 filing for Fire Prevention, pre-fire plan date sheets, records for training, 29 equipment testing records, medical and physical fitness records, FLSA 30 records, update Book of Rules, Pension Fund typing, daily reports and 31 records for agility testing of candidates. 32 33 Councilmember Hankinson asked if the person employed part time would be 34 pranoted to the full time position and Mayor Waltermann stated that the 35 individual would have first opportunity to apply for the new position. 36 37 In response to Councilmember Morris, Mayor Waltermann stated that nobody was 38 on payroll for that position. 39 40 Councilmember Bodiker asked where the excess in the budget was to allow for 41 the full time position and Mayor Waltennann explained it was from funds 42 remaining in salary line items and the insurance budget due to positions 43 not being immediately filled in the Fire Department. 44 45 Mayor Waltermann also explained that a request would be made to the Council 46 to amend the 1986 salary ordinance and fund the position for full time. 47 48 Councilmember Brookbank asked if fire suppression personnel could not 49 assist a part time secretary and Chief Harbin stated that universally 50 firefighters are nuts and bolts type people and not trained for 51 administrative type work. 52 53 Speaking against Ordinance No. 107-1985 was Carol Brady, Deputy Clerk and 54 EEO Officer for the City of Richmond. Ms. Brady explained to the Council 55 that in communication with Fire Department personnel and the person holding 56 the secretarial position, she felt that a full time secretarial position 57 was not needed if the Depar ment was fully staffed in the Chief and 58 Assistant Chief positions. 59 60 In response to President Williams, Chief Harbin explained that the part time 61 person was layed off for the purpose of redefining the job position and has 62 been encouraged to reapply for the position. Chief Harbin further responded 63 by saying the part time person was layed off due to no salary ordinance for 64 the position and he did not want to compound department problems with the 65 State Board of Accounts. 225 • Common Council Minutes Cont'd October 21, 1985 Page 5 • 1 Councilmember Elstro stated that he felt the Council should allow the Fire 2 Chief some discretion in running the department. 3 4 Councilmember Morris commented that her only regard was that the • 5 ordinance needed to be amended prior to the position being filled and 6 reminded Chief Harbin that was the proper way to handle the situation. • 7 • 8 Chief Harbin stated that the positions of Chief and Assistant Chief - 9 and Fire Prevention are administrative and the request for a full time 10 secretary is totally justified. 11 12 There being no further discussion, Councilmember Hankinson moved for 13 engrossment of Ordinance No. 107-1985, seconded by Councilmember Elstro and . 14 on unanimous voice vote the motion was carried. 15 16 Councilmember Elstro moved to suspend the rules and move Ordinance No. 107- 17 1985 to third and final reading and read by title only, seconded by 18 Councilmember Hankinson and with Councilmember Bodiker voting no the 19 motion was defeated. 20 21 Ordinance No. 107-1985 will return on third and final reading on November 22 4, 1985, 23 24 ORDINANCE NO. 108-1985 25 26 The Clerk read on first reading by title only Ordinance No. 108-1985 - AN 27 ORDINANCE ANNEXING CERTAIN TERRITORY, LEGALLY DESCRIBING THE AREA TO BE 28 ANNEXED, PROVIDING FOR THE PUBLICATION THEREOF, AND FIXING THE TIME WHEN 29 THE ANNEXATION SHALL TAKE EFFECT. 30 31 Councilmember Morris moved to suspend the rules and move Ordinance No. 108- 32 1985 to second reading, seconded by Councilmember Hankinson and on 33 unanimous voice vote the motion was carried. 34 35 The Clerk read on second reading Ordinance No. 108-1985 - AN ORDINANCE 36 ANNEXING CERTAIN TERRITORY, LEGALLY DESCRIBING THE AREA TO BE ANNEXED, 37 PROVIDING FOR THE PUBLICATION THEREOF, AND FIXING THE TIME WHEN THE 38 ANNEXATION SHALL TAKE EFFECT. 39 40 President Williams announced Ordinance No. 108-1985 was on public hearing. 41 42 Mr. Barden explained that pursuant to the suggest of the Common Council 43 concerning an economic development project on the east side, the owners 44 of the property are requesting voluntary annexation into the City. Mr. 45 Barden explained that since it was a request for voluntary annexation 46 there was no need for Plan Commission to conduct a hearing and that upon 47 paassage of the ordinance by the Common Council the annexation would take 48 affect sixty (60) days following legal publication in the absence of any 49 filed remonstrances during that time period. 50 51 Councilmember Bodiker questioned if the City could afford to provide the 52 needed services and if this would be cost effective in terms of service 53 cost versus tax dollars. 54 55 Mr. Barden stated that the area would be developed as a planned unit 56 development and would increase the tax base. He stated that since it is 57 currently vacant land there was no need to develop a plan for services and 58 the developers would be responsible for making certain that City services 59 were provided for. 60 61 There being no further discussion, Councilmember Parker moved for • 62 engrossment of Ordinance No. 108-1985, seconded by Councilmember Brookbank 63 and on unanimous voice vote the motion was carried. 64 65 Councilmember Hankinson moved to suspend the rules and move Ordinance No. 226 Common Council Minutes Cont'd October 21, 1985 Page 6 1 108-1985 to third and final reading and read by title only, seconded by 2 Councilmember Brookbank and on unanimous voice vote the motion was carried. 3 4 The Clerk read on third and final reading by title only Ordinance No. 108- 5 1985 - AN ORDINANCE ANNEXING CERTAIN TERRITORY, LEGALLY DESCRIBING THE AREA 6 TO BE ANNEXED, PROVIDING FOR THE PUBLICATION THEREOF, AND FIXING THE TIME 7 WHEN THE ANNEXATION SHALL TAKE EFFECT. 8 9 Ordinance No. 108-1985 was adopted on the following call of the roll: 10 11 Ayes: Elstro, Brookbank, Hankinson, Whitesell, Parker, Bodiker, Lemoine, 12 Morris and Williams (9) 13 Nays: None 14 15 ORDINANCES ON SECOND READING 16 17 APPROPRIATION ORDINANCE NO. 102-1985 18 19 The Clerk read on second reading Appropriation Ordinance No. 102-1985 - AN 20 ORDINANCE TO APPROPRIATE WITHIN THE PARK FUND. 21 22 Mr. Barden examined the Proof of Publication and found it to be in order. 23 Councilmember Hankinson moved to accept and file the Proof of Publication, 24 seconded by Councilmember Morris and on unanimous voice vote the motion was 25 carried. 26 27 President Williams announced Ordinance No. 102-1985 was on public hearing. 28 • 29 Speaking for Ordinance No. 102-1985 was Park Superintendent, Nancy 30 MacCartney. Ms. MacCartney told the Council that the additional 31 appropriation is being requested from additional revenues and would be used 32 for capital needs within the Park DepaLLment. 33 34 Councilmember Elstro asked about the 21,650.00 budgeted for a computer and 35 Ms. MacCartney explained the computer would be canpatable with the mainframe 36 in the Controller's Office and would give the Park access to information 37 and the ability to compile data.
