PROCEEDINGS OF THE COON COUNCIL OF THE
CITY OF RICK, INDIANA, OCTOBER 7, 1985
1 The Common Council of the City of Richmond, Indiana, met in regular session
2 Octoer 7, 1985 at the hour of 7:30 P.M. in the Council Chambers in said City.
3 President Williams presided with the following members present:
4 Councilmembers Elstro, Brookbank, Hankinson, Whitesell, Parker, Bodiker and
5 Morris. Absent: Lemoine. The following business was had to-wit:

11 APPROVAL OF MINUTES OF OCTOBER 7, 1985

13 Councilmember Whitesell moved to approve the minutes of the previous meeting
14 as prepared, seconded by Councilmember Brookbank and on unanimous voice vote
15 the motion was carried.

17 CUNICATIONS FROM THE MAYOR
18
19 Mayor Frank H. Waltennann congratulated the citizens of Richmond for all
20 their efforts on the Mitsubishi project. He also thanked the utilities,
21 government agencies and the State DepaiLiuent of Commerce for their
22 cooperation.

24 Mayor Waltermann cutumented on the public spirit in the community and such
25 events as Funderful Week now in progress. He said the Economic Development
26 Office are receiving so many inquiries on the information they have sent
27 out that they need part time help to assist in answering them.

29 Mayor Waltermann thanked Lt. Joe Pierce for his service as Acting Fire
30 Chief in the absence of a Fire Chief during July, August and September.
31 Mayor Waltermann commended Lt. Pierce for his dedication and excellent
32 service as Acting Fire Chief.

34 Councilmember Morris requested a letter be sent to Lt. Pierce thanking him
35 for his performance as Acting Fire Chief from the Council.

37 REPORTS FROM CITY DEPARTMENTS

39 Law DepaiLuient

41 Mr. Barden presented the false alarm statistics for the Council's consideration
42 at the scheduled committee of the whole on October 16, 1985.

44 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY

46 Ms. Maness informed the Council that the Board of Works awarded bids for
47 tree removal on city right-of-way and on park properties. Ms. Maness also
48 said the one-way signs had been erected in the first block of South 17th
49 Street. She told the 'Council that the Jaycees were assisting the Fire
50 DepaiLuient in the purchase of a new rescue unit and that the Board had
51 decided not to designate Harris Street north of L Street as one-way, but
52 to increase enforcement on a trial basis. Ms. Maness also informed the
53 Council that the holidays for city employees had been established and there
54 were a total of ten (10) paid holidays.

56 President Williams thanked Mayor Waltermann and Mr. Hillard for the good
57 job being done on streets within the Second District and Councilmember
58 Brookbank commented on the resurfacing of North 17th Street.

1 Councilmember Brookbank stated that the meeting in District 3 had been changed
2 from October 17, 1985 to October 24, 1985. The mooting will be at Valle
3 School at 7:30 P.M.

5 REPORTS FROM STANDING COMMITTEES

7 Reid Hospital

9 Councilmember Brookbank informed the Council that new emergency room
10 appointments had been made and that the Board was updated on medicare
11 reimbursements.

13 Arts Council

15 Councilmember Morris reminded the Council of the Arts Consortium Benefit on
16 October 10, 1985 with the Grand Opening of the Gennett Ballroom and
17 expressed hope that all would be in attendance.

19 Enterprise Zone

21 Councilmember Brookbank stated that the Urban Enterprise Zone Board was
22 following up on contributions to the zone and that seven (7) more contributions
23 had been received. She said the paint up, fix up program was underway and
24 that the reactions were very positive.

26 Education Committee

28 Councilmember Bodiker requested time in the future for a presentation by
29 Cheryl Amos on the ABA Program.

33 Councilmember Whitesell moved to suspend the rules and read Resolutions No. 12,

35 unanimous voice vote the motion was carried.

40 OF RICHMOND PROVIDING FOR THE ACQUISITION, CONSTRUCTION AND DEVELOPMENT OF A
41 MULTIFAMILY RENTAL PROJECT LOCATED WITHIN THE BOUNDARIES OF THE ISSUER AND
42 PROVIDING FOR THE FINANCING OF ALL OR A PORTION OF THE COST THEREOF BY THE
43 ISSUANCE OF THE ISSUER'S MULTIFAMILY REVENUE BONDS AT SUCH TIME OR TIMES
44 AS SHALL BE APPROPRIATE.

46 Speaking for Resolution No. 12-1985 was Mr. Andrew Cecere, Attorney at Law.
4 Mr. Cecere informed the Council that this was a different type of project for
48 Revenue Bonds. Mr. Cecere stated that the project was multi-family housing
49 development and that Mr. Hugh Gregan, President of Harcourt Development,
50 could better explain the specifics of the project.

52 Mr. Cecere told the Council that the Economic Development Commission, after
51 receiving further information on the project, had unanimously voted to adopt
54. a Resolution in support of the project and had decided that the project would
5' cause no adverse competitive affect in the area.

5 Mr. Cecere stated the Resolution before Council merely encourages the developer
5: to put the package together and proceed with locating a purchaser for the
56 bonds. The Council will need to pass an Ordinance to set out how the bonds '11
61 be sold and give final.approval.

6, Mr. Cecere reminded the Council that the bonds are not a general obligation
6 of the community and that the project will provide good housing for the
6P community and will be attractive for future industrial development within th
6' community along with expanding the tax base.

. Mr. Hugh Gregan of Tempe, Arizona, told the Council that by using Revenue
Bonds he will have a four percent (4%) savings on the mortgage rate allowing
himto invst more capital into the project. Mr. Gregan stated that the amount
. of the housing units will probably b reduced, but that the project will be
of the highest quality.
Councilmember Bodiker asked if the land to be used for the construciton of
the housing project was in the City and if so would the sub-division
• ordinance be applied to the project.

1 , Mr. Dan Dooley, Supervisor of City Planing, stated he thought the land was
1 in the City, but he would make certain. Mr. Dooley explained that the sub-
1 division ordinance was not applicable, but that the project would fall under
the special use zoning ordinance for regulation of streets, sidewalks, sewers,
1 curbs, etc.

1 Councilmember Parker asked if the developer would be willing to be annexed
1: into the City, if the property is not within the city limits and Mr. Gregan
1` stated he would expect to be annexed and that the Council might consider
26 placing that stipulation on the approval for the bond sale.

2 Councilmember Morris asked Mr. Gregan about a committment to use local labor
2 in the construction of the housing units and Mr. Gregan stated he would be
2. the construction manager and it was his practice to use local contractors
2'; and local trades.

2 Councilmember Parker asked about amending Resolution No. 12-1985 to reflect
2; the condition of annexation and City Attorney Ken Barden stated that he did
2• not want to change the technical language of the bond resolution prepared
36 by bond counsel.

3 . Councilmember Parker stated that since -the annexation issue was brought
3 forth publically and the Council would have final action on the project
3. that he would not propose an amendment to the Resolution at this time.

44, City Controller Cathy Maness explained to the Council that the resolution
4 was a formality and authorized the City to file an appeal for relief
4: on the limitations placed on property taxes.

56 Councilmember Hankinson asked if it would increase the tax rate and Ms.
5 Maness explained that it would only if relief was granted for increased
5; pension costs.

1 Road. Mr. Freeman informed the Council that the City had been invited to make
2 full application to the State DepaLLulent of Commerce for a grant for housing
3 rehabilitation and Home Equity Conversion-Reserve Mortgage Annuity. Mr.
4 Freeman stated the Home Equity Conversion-Reserve Mortgage Annuity program
5 allows hone equity to be used as collateral and establishes a recapture
6 system for funds loaned in order to make other funds available.

8 Councilmember Morris cumn ented on the fact that the elderly homeowners that
9 would participate in the Home Equity Conversion program would not be
10 obligated to payback of the funds and Mr. Freeman stated that they would
11 not be obligated for payback until such time as sale of property or
12 settlement of estate. Mr. Freeman stated the program would be administered
13 through the Community and Economic Development Loan Fund Board at a low
14 interest rate to be established by the Loan Fund Board.

16 Mr. Freeman stated the Department of Commerce was very enthusiastic and
17 encouraging about the application particularly the Home Equity Conversion
18 Program.

20 Councilmember Hankinson moved for adoption of Resolution No. 14-1985, seconded
21 by Councilmember Morris and on unanimous voice vote the motion was carried.

46 Speaking for Ordinance No. 87-1985 was Park Superintendent Nancy Mac Cartney.
47 Ms. Mac Cartney told the Council that these funds will allow the operation
48 of certain programs of the Park to be run like a business with funds generated
49 by programs to be returned to the programs for their operating
50 expenditures or capital expenditures. This will also allow the expansion of
51 the programs and the creation of other programs.

53 Councilmember Hankinson commented on the funds not being returned to the
54 Park General Fund and Councilmember Morris clarified that the budget should
55 reduce by the amount that is received into the non-reverting fund.

57 Ms. MacCartney also stated this will funds to be immediately put back into
58 programs and use without waiting for additional appropriations. Accounting
59 will be made to the Council regarding the funds.

Councilmember Morris thanked the Finance Committee for all their work in
the drafting of this Ordinance.

4 Board always takes action relating to funds prior to Council action.

21 Councilmember Bodiker informed the Council that the President of the Park
22 Board had been left out the original purchasing ordinance regarding
23 authority for approving expenditures and the ordinance would correct this
24 along with additions of other boards.

26 Mr. Barden explained that it also gives procedures for debarment or suspension
27 of vendors and sets procedures for protests to cut down the time on protests
28 to allow contracts to'be let sooner. The ordinance is also codified and will
29 increase the bid limitation to the maximum allowed by State Law.

31 Councilmember Whitesell asked if Section 9 required informal quotes
32 if the purchase if under the 25,000.00 bid limit and suggested the wording
33 might be changed to may. Ms. Stout explained that even though the new law
34 allows the 25,000.00 they would still use quotes under this amount.

• 36 In response to Councilmember Parker ragarding changing the bid limit to
37 25,000.00, Ms. Stout explained they prefer the higher-amount since the
38 public bidding procedure is so costly and confining on time.

40 Councilmember Parker stated he did not like to scc vendors excluded from
