PROCEEDINGS OF THE COMMON COUNCIL OF THE
CITY OF RICFIlID, INDIANA, AUGUST 5, 1985
1 The Common Council of the City of Richmond, Indiana met in regular session
2 August 5, 1985 at the hour of 7:30 P.M. in the Council Chambers in said
3 City, President Williams presided with the following members present:

5 Lemoine and Morris. Absent: None. THe following business was had to-wit:

11 APPROVAL OF MINUTES OF JULY 15, 1985

13 Councilmember Parker moved to approve the minutes of the previous meeting
14 as prepared, seconded by Councilmember Parker and on unanimous voice vote
15 the motion was carried.

17 COMMUNICATIONS FROM THE MAYOR

19 Mayor Frank H. Waltermann briefly commented on his recent trip to Japan
20 and informed the Council that he would issue a written report to them
21 regarding the trip. •

23 REPORT FROM BOARD OF PUBLIC WORM AND SAFETY

25 Ms. Maness informed the Council that the Board had approved the posting
26 of signs at entrances to the City regarding the Transient Vendor Ordinance.
27 She also reported that a survey of all railroad crossings had been forwarded
11/ 28 to the Public Service Commission and that currently the crossing on Gravel
29 Pit Road was under repair and more repairs are anticipated.

31 Ms. Maness stated that on August 1, 1985 the Board accepted bids for the
32 resurfacing of Whitewater Boulevard and S.W. 2nd Street and approved an
33 agility evaluation for candidates for the Fire Department. She said a
34 proposal was requested by the Board for a similar evaluation for existing
35 members of the Fire Department and would be presented at a later date.

37 Councilmember Morris asked if the departments were scheduled for the
38 Committee of the Whole budget hearings and Ms. Maness stated the schedule
39 was included in the budget packet with depaLLuents and time.

41 REPORTS FROM SPECIAL COMMITTEES

43 Councilmember Lemoine announced the Community Services Committee would
44 be meeting on August 27, 1985 at 12:00 noon in the Community Roan.

46 Committee of the Whole

48 Councilmember Lemoine reminded the Council of the dates set for budget
49 hearings and stated they would accept amendments at the Committee of the
50 Whole for vote and present them at the public hearing for action.
51
52 Councilmember Lemoine also set a Committee of the Whole for September 26,
53 1985 at 7:00 P.M. for discussion of recodification of the City Code.

55 Mr. Barden requested an executive session of the Council on September 26,
56 1985 at 6:30 for discussion of pending litigation.

58 REPORTS FROM STANDING COMMITTEES

60 Reid Hospital

62 Councilmember Brookbank stated the Reid Hospital Board met on July 22,
63 1985 and received information on a refinancing of a bond issue, an update
64 on the Chemical Dependency Program and toured the outpatient surgery unit.

3 Councilmember Brookbank informed the Council that the Urban Enterprise Zone
. 4 Board would be meeting on August 6,1985.

6 MISCELLANEOUS INFORMATION

8 Mr. David Stevens of 425 Porterfield Road requested the Council to investigat-
9 the possiblity of Rose View Transit Drivers being trained in life saving
10 techniques since many of the passengers are elderly.
11
12 Councilmember Hankinson thanked Mr. Stevens and commented that it was a good
13 idea.

15 Mr. Tom Dickman of 3101 Porterfield Road requested the Council to investigate
16 the problems of pigeons at 39 South 15th Street. Mr. Dickman stated this
17 property has many pigeons residing there year round and causing health probl .
18 He asked the Council to consider adding control of these problems in
19 Ordinance No. 13-1985.

21 Councilmember Brookbank stated she was unaware of the problem and would look
22 into it and President Williams said he feels the responsibility should be put
23 on the property owner.

29 Councilmember Elstro moved to suspend the rules and read Resolution No. 10-

34 THE FILING OF AN OPERATIONS ASSISTANCE GRANT UNDER SECTION 18 OF THE URBAN

37 Speaking for Resolution No. 10-1985 was Ms. Janet Sams, Manager of Rose View
38 Transit System. Ms. Sams stated this will allow the City to file for operati g
39 assistance for 1986 and the grant is due to the State of Indiana on
40 September 3, 1985.

42 Councilmember Hankinson moved to adopt Resolution No. 10-1985, seconded by
43 Councilmember Brookbank and on unanimous voice vote the motion was carried.

10 State Law, but the State Law regarding Police Departments gives a range
11 and it must be set specifically by ordinance.

• 27 Speaking for Ordinance No. 62-1985 was Mr. George Reller, 202 Peoples
II 28 Building, representing the petitioner. Mr. Reller stated the current
29 zoning of C-2 runs 140' through the center of the property and the petitioner
30 asks that zoning be extended to include the total trak owned by the property
31 owner. There will still be land remaining zoned R-2 to serve as a buffer
32 between.the business and the residents.

34 The Plan Commission voted 7 to 1 in favor of the request.

1 Mr. Barden examined the Proof of Publication and found it to be in order.
2 Councilmember Hankinson moved to accept and file the Proof of Publication,
3 seconded by Councilmember Whitesell and on uanimous voice vote the motion was
4 carried.

. 6 Speaking for Ordinance No. 63-1985 was Dan Dooley. Mr. Dooley told the Counc 1
7 the reason for the appropriation was to update the master plan that was
8 adopted in 1966. He said with the current active economic development policy
9 of the City it was now necessary to update the master plan in anticipation
10 of growth. Mr. Dooley said they would be tapping the resources of the
11 community in preparation of the master plan, but would have to have a
12 . professional planning consultant for different perspective and expertise.

14 Councilmember Whitesell asked if the 1966 master plan was totally prepared
15 by professionals at a cost of 80,000.00 to 100,000.00 and this was a
16 minimal cost by using local expertise..

18 In response to Councilmember Lemoine, Mr. Dooley stated it would take 12 to
19 18 months to complete.

21 Speaking against Ordinance No. 63-1985 was Gertrude Ward. Ms.
22 Ward stated that 20 years was not that a long of time period and the
23 population increase will not justify this expenditure.

25 Councilmember Bodiker stated that after talking with the Mayor the master pl.
26 was a priority and is definitely outdated after 20 years and the City needs
27 to update planning and use of resources.

29 Councilmember Bodiker moved for engrossment of Ordinance No. 63-1985, seconder.
30 by Councilmember Morris and on unanimous voice vote the motion was carried.

32 Councilmember Whitesell moved to suspend the rules and move Ordinance
33 No. 63-1985 to third and final reading and read by title only, seconded by
34 Councilmember Bodiker and on unanimous voice vote the motion was carried.

5 Speaking for Ordinance No. 66-1985 was Bob Ridgeway, 121 South 6th Street.
6 Mr. Ridgeway told the Council that all but one of the residents had
6 signed the petition in support of the residential district and the problem
6 is employees of downtown parking on the street. He stated that when there
6 is publicity on this matter the problem decreases for a short period of time,
6 but the residents of the street have a difficult time parking on the street.
6 He said there is no off street parking available in the backs of the properties.

1 Mr. Ridgeway stated that on an average day there are five to six non-
2 resident cars parked there all day and on a heavy day seven to ten non-
• 3 - resident cars park there all day..

5 Ms. Maness stated the Board of Works based its decision to not support
6 the request on the traffic surveys taken.
7
8 Mr. Barden stated the Council can override the recommendation of the Board
. 9 of Works, but out of the seven surveys taken two showed over a 75% useage
10 of the parking available.

12 President Williams stated the area is always congested when he is on .the
13 street. •

15 Councilmember Whitesell stated that with the consideration that the Council
16 might override the Board of Works, he would like to have more time
17 to explore and structure of the Ordinance and the effect on the area and
18 would like to see it held on third reading.

20 Councilmember Elstro stated it worked well for the area around the High
21 School, and this is a nuisance and problem.

.23 Also speaking was Reverend Albert Tyson of the Bethel AME Church. Rev.
24 Tyson stated the Church uses all available parking and was not certain
25 how the ordinance would affect the Church.

27 Mr. Barden explained that the two hour limitation was only effective Monday
28 thru Saturday, 8:30 A.M. to 5:00 P.M.

30 Rev. Tyson stated the Church has functions during weekdays and they would
31 possibly have to curtail sane activities.

33 Councilmonber Elstro moved for engrossment of Ordinance No. 66-1985,
34 seconded by Councilmember Brookbank and on unanimous voice vote the motion
35 was carried.

37 Ordinance No. 66-1985 will return on third reading at the August 19, 1985
38 meeting of the Council.
