HomeMy Public PortalAbout07-15-1985 169 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICTh&1JD, INDIANA, JULY 15, 1985 1 The Common Council of the City of Richmond, Indiana, met in regular session 2 July 15, 1985 at the hour of 7:30 P.M. in the Council Chambers in said City. 3 President Williams presided with the following members present: 4 Councilmembers Elstro, Brookbank, Hankinson, Parker, Bodiker, Lemoine and 5 Morris. Absent: Whitesell. The following business was had to-wit: 6 7 PT.F,I Y'F. OF ALLEGIANCE 8 9 SILENT DEVOTIONS 10 11 APPROVAL OF MINUTES OF JULY 1, 1985 12. 13 Councilmember Hankinson moved to approve the minutes of the previous 14 meeting as prepared, seconded by Councilmember Brookbank and on unanimous 15 voice vote the motion was carried. 16 17 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY 18 19 Board President Cathy Maness informed the Council that an agreement had 20 been reached between the City and Local 1474, representing the Bus Drivers. 21 The agreement is the wage addendum to the Contract for 1986. Ms. Maness 22 also stated the Board had notified the Railroad companies of the 23 disrepair of the North 8th and E Street Crossing and set a Public Review 24 Hearing for the condition of this crossing for September 5, 1985 at 9:00 25 A.M. 26 27 Ms. Maness invited the Council to attend the joint mooting of the Board of 28 Public Works and Safety and the Telecommunications Council for discussion 29 of the proposed rate increase by Clearview Cable. The meeting will be July 30 30, 1985 at 7:30 P.M. in the Board of Works Roan. 31 32 President Williams asked if the Board of Works could actually do anything 33 about the proposed increase and Ms. Maness stated they must determine if 34 the rate of return is excessive and after the proper hearings the Board 35 would then establish the rate. 36 37 President Williams asked if all television sets would be able to receive the 38 new channels proposed by Clearview Cable and Ms. Maness stated they 39 would need a converter and that the converter is included in the base 40 package with no additional charge. 41 42 REPORT FROM SPECIAL COMMITTEES 43 44 Transportation, Community Development and Cammunity Services 45 46 Councilmember Lemoine announced a second mooting of the Community Services 47 sub-committee on July 18, 1985 at 12:00 noon. The mooting would be with 48 David Fulton and Ann Withers of the Community Services Council for the 49 purpose of continuing discussion regarding the report on the Human and 50 Environmental Information and Referral Office. 51 52 REPORT FROM STANDING COMMITTEES 53 54 Enterprise Zone 55 56 Councilmember Brookbank reported the Urban Enterprise Zone Board had met 57 on July 9, 1985 and that she and John Brown were to choose a block to 58 participate in a fix up campaign with the allocated funds. 59 60 MISCELLANEOUS BUSINESS 61 62 Mrs. Pat Stewart of 1727 South 9th Street complained to the Council about 63 Robert Spencer of 1725 South 9th Strcct selling cars from his property oh 64 9th Street. Mrs. Stewart stated that Mr. Spencer always has cars for sale 65 and that she has been fighting this problem for the past three (3) years. 17() Common Council Minutes Cont'd July 15, 1985 Page 2 1 Councilmember Elstro gave City Attorney Barden advertisements that had been 2 taken fran the Graphic newspaper attesting to the fact that Mr. Spencer was 3 advertising cars for sale at 1725 South 9th Street. 4 5 Councilmember Brookbank commented that this is a problem all over town and 6 is very difficult to prove. 7 8 Mr. Robert Spencer of 1725 South 9th Street told the Council that he has one 9 (1) or two (2) cars at a time and one belongs to his son and he is working 10 on it. 11 12 President Williams asked Mr. Spencer if he was zoned to sell cars and Mr. 13 Spencer stated he had talked with City Hall if they were parked in his 14 driveway and no more than two (2) or three (3) a year were sold it was OK. 15 16 Mr. Barden informed Mr. Spencer that he currently had at least five (5) 17 listed for sale at that address and that if he did not cease sale of the 18 automobiles immediately he would report this activity to the Attorney 19 General's Office for prosecution. 20 21 Congratulations to Mr. Stanley Vigran 22 23 Councilmember Bodiker congratulated Mr.' Stanley Vigran for the recent honor 24 bestowed upon him for his efforts to obtain jobs for the citizens of Richmond. 25 26 Councilmember Bodiker moved to have the Clerk send a letter to Mr. Vigran 27 fran the Council thanking him for his efforts and offering their 28 congratulations, seconded by Councilmember Parker and on unanimous voice vote 29 the motion was carried. 30 31 ORDINANCES 32 33 ORDINANCES ON FIRST READING 34 35 Councilmember Hankinson moved to suspend the rules and read Ordinances No. 36 61, 62, 63, 64, 65, 66 and 67-1985 on first reading by title only, 37 seconded by Councilmember Brookbank and on unanimous voice vote the motion 38 was carried. 39 40 ORDINANCE NO. 61-1985 41 42 The Clerk read on first reading by title only Ordinance No. 61-1985 - AN 43 ORDINANCE RATIFYING THE SALARIES, WAGES AND POSITIONS FOR APPOINTED OFFICERS 44 AND EMPLOYEES OF THE RICHMOND SANITARY DISTRICT FOR THE FISCAL YEAR BEGINNING 45 JANUARY 1, 1986 AND ENDING DECEMBER 31, 1986, AS ADOPTED BY THE BOARD OF 46 SANITARY COMMISSIONERS. 47 48 Councilmember Hankinson moved to suspend the rules and move Ordinance No. 61- 49 1985 to second reading, seconded by Councilmamber Brookbank and on unanimous 50 voice vote the motion was carried. 51 52 The Clerk read on second reading Ordinance No. 61-1985 - AN ORDINANCE 53 RATIFYING THE SALARIES, WAGES AND POSITIONS FOR THE APPOINTED OFFICERS AND 54 EMPLOYEES OF THE RICHMOND SANITARY DISTRICT FOR THE FISCAL YEAR BEGINNING 55 JANUARY 1, 1986, AND ENDING DECEMBER 31, 1986, AS ADOPTED BY THE BOARD OF 56 SANITARY COMMISSIONERS. 57 58 President Williams announced Ordinance No. 61-1985 was on public hearing. 59 60 There being no further discussion, Councilmember Hankinson moved for 61 engrossment of Ordinance No. 61-1985, seconded by Councilmember Parker and on 62 unanimous voice vote the motion was carried. 63 64 Councilmember Hankinson moved to suspend the rules and move Ordinance No. 61- 65 1985 to third and final reading and read by title only, seconded by 171 Common Council Minutes Cont'd July 15, 1985 Page 3 1 Councilmember Parker and on unanimous voice vote the motion was carried. 2 3 The Clerk read on third and final reading by title only Ordinance No. 61- 4 1985 - AN ORDINANCE RATIFYING THE SALARIES, WAGES AND POSITIONS FOR APPOINTED 5 OFFICERS AND EMPLOYEES OF THE RICHMOND SANITARY DISTRICT FOR THE FISCAL YEAR 6 BEGINNING JANUARY 1, 1986, AND ENDING DECEMBER 31, 1986, AS ADOPTED BY THE 7 BOARD OF SANITARY COMMISSIONERS. 8 9 Ordinance No. 61-1985 was adopted on the following call of the roll: 10 11 Ayes: Elstro, Brookbank, Hankinson, Parker, Bodiker, Lemoine, Morris and 12 Williams (8) 13 Nays: None 14 Absent: Whitesell (1) 15 16 ORDINANCE NO. 62-1985 17 18 The. Clerk read on first reading by title only Ordinance No. 62-1985 - AN 19 ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 20 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, 21 INDIANA, PROVIDING FOR THE REZONING OF THE PROPERTY LOCATED AT 3413 EAST 22 MAIN STREET FROM R-2 SINGLE FAMILY RESIDENCE DISTRICT TO C-2 COMMUNITY 23 BUSINESS DISTRICT. 24 25 President Williams announced Ordinance No. 62-1985 will be assigned to the 26 Plan Commission. 27 28 APPROPRIATION ORDINANCE NO. 63-1985 11/ 29 30 The Clerk read on first reading by title only Appropriation Ordinance No. 31 63-1985 - AN ORDINANCE TO APPROPRIATE WITHIN THE GENERAL FUND. 32 33 President Williams announced Appropriation Ordinance No. 63-1985 has to be 34 advertised. 35 36 ORDINANCE NO. 64-1985 37 38 The Clerk read on first reading by title only Ordinance No. 64-1985 - AN 39 ORDINANCE ADDING SECTION 31.55 TO THE RICHMOND CITY CODE ESTABLISHING A 40 STANDARD TO BE USED IN CALCULATING BENEFITS ADN ASSESSMENTS FOR RETIRED POLIO 41 PENSIONERS UNDER THE 1925 POLICE PENSION FUND. 42 43 Mr. Barden requested Ordinance No. 64-1985 be held on first reading for the 44 input of the Police Pension Board. 45. 46 ORDINANCE NO. 65-1985 47 48 The Clerk read on first reading by title only Ordinance No. 65-1985 - AN 49 ORDINANCE PROVIDING FOR DEATH BENEFITS FOR MEMBERS OF THE POLICE AND FIRE 50 DEPARTMENTS. 51 52 Mr. Barden requested Council amend Ordinance No. 65-1985 by striking all 53 reference to Fire Department since death benefits for members of the Fire 54 Department are set by State Statute and that the Council also hold this 55 ordinance on first reading for input of the Police Deparluuent. 56 57 Councilmember Lemoine moved to amend Ordinance No. 65-1985 as proposed by 58 Mr. Barden, seconded by Councilmember Hankinson and on unanimous voice vote 59 the motion was carried. 60 61 Amended Ordinance No. 65-1985 will remain on first reading. 62 63 ORDINANCE NO. 66-1985 64 65 The Clerk read on first reading by title only Ordinance No. 66-1985 - AN 172 Common Council Minutes Cont'd July 15, 1985 Page 4 1 ORDINANCE DESIGNATING SOUTH 6TH STREET BETWEEN SOUTH A AND SOUTH B STREETS 2 AS A RESIDENTIAL PARKING PERMIT AREA AND AUTHORIZING THE CONDITIONAL ISSUANCE 3 OF PARKING PERMITS TO RESIDENTS OF SUCH AREA. 4 5 President Williams announced Ordinance No.66-1985 has to be advertised. 6 7 ORDINANCE NO. 67-1985 8 9 The Clerk read on first reading by title only Ordinance No. 67-1985 - AN 10 ORDINANCE AMENDING SECTION 94.03 OF THE RICHMOND CITY CODE AS IT APPLIES 11 TO STHE REMOVAL OF WEEDS AND RANK VEGETATION AND PROVIDING FOR A PENALTY IN 12 , ADDITION TO COSTS OF REMOVAL. 13 14 President Williams assigned Ordinance No. 67-1985 to the Committee of the 15 Whole for further study. 16 17 Board of Works President, Cathy Maness, told the Council that the Board of 18 Works plans to take final action by way of a Resolution encouraging the 19 Council to set a stiff penalty for repeat offenders of the City's Weed 20 Control Ordinance. .. Ms. Maness stated the City should not be in the busines of. 21 mowing privately owned lots for persons and that there are land owners now 22 depending on the City to mow their lots and bill them for the weed 23 removal. Ms. Maness stated that 50% of the persons having lots mowed by 24 the City pay immediately and the other 50% must be attached as a lien and will 25 not be received until 1987 for work done in 1985. She stated the Board 26 supports this ordinance and feels it is directed toward the repeat 27 offenders and not people who simply forget to mow their lawns. Ms. 28 Maness said Mr. Bronston will furnish the Council with a list of repeat 29 offenders for 1984 and 1985 to show the Council the problem created by 30' these persons. 31 32 President Williams stated he asked the City Attorney to update the present 33 ordinance and feels something needs to be done since he for one has many 34, calls on weeds. 35 36 Councilmember Hankinson why the effective date of the Ordinance was set for 37 January 1, 1986 and Mr. Barden stated that would give the public plenty of 38 notice since the fine is $250.00.
