HomeMy Public PortalAbout03-18-1985 PROCEEDINGS OF THE COON COUNCIL OF THE CITY OF RICHMOND, INDIANA, MARCH 18, 1985 l The Common Council of the City of Richmond, Indiana met in regular 2 session March 18, 1985 at the hour of 7:30 P.M. in the Council Chambers 3 in said City. President Williams presided with the following members 4 present: Elstro, Brookbank, Hankinson, Whitesell, Parker, Bodiker, 5 Lemoine and Morris. Absent: None. The following business was had 6 to-wit: 7 8 PLEDGE OF ALLEGIANCE 9 10 SILENT DEVOTIONS 11 12 APPROVAL OF MINUTES OF MARCH 18,-. 1985 13 14 Councilmember Hankinson moved to approve the minutes of the previous 15 meeting as prepared, seconded by Councilmember Whitesell and on unanimous 16 voice vote the motion was carried. 17 18 COMMUNICATIONS FROM THE MAYOR 19 20 Mayor Waltermann told the Council that there will be an effort made 21 for a city wide clean up effort. Street crews are working on cleaning 22 and repairing streets and the Sanitary Department is currently issuing 23 litter ordinance violation tickets. 24 25 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY 26 27 Ms. Maness reported that the Board of Works had set March 28, 1985 28 as the date to hold an unsafe building hearing on the property at 29 16th and East Main Streets. She also told the Council that the 30 Telecommunications Council had set the second Tuesday of each month 31 at 7:30 P.M. in the Board of Works Room as their regular meeting time 32 and they would be having a study session on March 19, 1985 at 7:30 33 P.M. in the Board of Works Room. 34 35 Councilmember Parker asked if specific curbs and sidewalks had been 36 decided upon for repair. Mayor Waltennann explained that the Street 37 Department would be hiring temporary help this summer in order to 38 have more concrete crews available. This would enable the Street 39 Department to make a large effort to repair and replace more curbs 40 and sidewalks. Depending on the budget they will work on a priority 41 list continuing from last year. Mayor Waltermann told the Council 42 to make any recommendations to Mr. Hillard on curbs or sidewalks they 43 would like to see repaired. 44 45 REPORTS FROM CITY DEPARTMENTS 46 47 Richmond Municipal Airport 48 49 Mr. Paul Hedges, Airport Manager, updated the Council on the Instrument 50 Landing System. Mr. Hedges told the Council that the project should 51 be completed within ten (10) months. The environmental impact has 52 been advertised and they will be able to start drawing funds within 53 thirty (30) days. 54 55 REPORTS FROM SPECIAL COMMITTEES 56 57 Parks & Recreation, Public Safety, Public Works and Safety 58 59 Councilmember Bodiker reported that this committee had met regarding 60 Ordinance No. 142-1984 and were requesting the Ordinance return to 61 the Agenda on second reading. 62 63 Committee of the Whole 64 65 Councilmember Lemoine announced a meeting of the Committee of the 86 Common Council Minutes Cont'd March 18, 1985 Page 2 1 Whole on April 25, 1985 at 7:00 P.M. in the Board of Works Roan on 2 Ordinance No. 15-1985. 3 4 REPORTS FROM STANDING COMMITTEES 5 6 Plan Commission 7 8 Councilmember Morris announced the Plan Commission will be meeting on 9 March 26, 1985 at 7:30 P.M. 10 11 Councilmember Morris commented to the Council on the fact that the Planning 12 Department is in her estimation understaffed and unable to enforce the 13 Zoning Ordinance and deal with infractions appropriately. She asked the 14 Council that during the upcoming budget hearing they consider expanding 15 the staff of the Planning Department. 16 17 Enterprise Zone 18 19 Councilmember Brookbank announced that the Board had received their tax 20 exempt status through the federal government and were still awaiting this 21 status fran the State. She also told the Council that new brochures are 22 now available on the Enterprise Zone. 23 24 Education 25 26 Councilmember Bodiker announced that the I.U. Singers would be at Indiana 27 University East on March 27, 1985 for Founder's Day. 28 29 RESOLUTIONS 30 31 Councilmember Parker moved to suspend the rules and place Resolution No. 32 4-1985 at its proper place on the Agenda, seconded by Councilmember Morris 33 and on unanimous voice vote the motion was carried. 34 35 RESOLUTION NO. 3-1985 36 37 The Clerk read in its entirety Resolution No. 3-1985. 38 39 A RESOLUTION AWARDING THE CITY OF RICHMOND MEDAL OF VALOR TO RICHMOND 40 CITY POLICE OFFICER NARK CONNER2 Y AND RICHMOND RESERVE OFFICER RICK KOLENTUS 41 42 WHEREAS, on October 13, 1984, while enroute to an emergency call, Officer 43 Robert Hobson and Diablo, the Police Dog were involved in a 44 collision; and, 45 46 WHEREAS, said collision seriously endangered the lives of Officer Hobson 47 and Diablo; and, 48 49 WHEREAS, but for the courageous acts of Officers Mark Connery and Reserve 50 Officer Rick Kolentus in rescuing Officer Robert Hobson and 51 Diablo fran the wreckage, serious injury and/or death may have 52 occurred. 53 54 NOW THEREFORE BE IT RESOLVED by the Richmond City Council and Mayor Frank 55 H. Waltermann, that the City of Richmond Medal of Valor be 56 awarded to Officer Mark Connery and Reserve Officer Rick 57 Kolentus for their heroic deeds. 58 59 Councilmember Parker moved for adoption of Resolution No. 3-1985, seconded 60 by Councilmember Whitesell and on unanimous voice vote the motion was 6 carried. 6 63 Chief Joseph Nimitz told the Council that as a result of the collision 64. Officer Hobson and Diablo were engulfed in flames and that Officer Mark 6 Cannery and Reserve Officer Rick Kolentus went to their aid without concern 87 Common Council Minutes Cont'd March 18, 1985 Page 3 l for their own well being and pulled Officer Hobson and Diablo fran 2 the burning vehicle. 111 3 4 Chief Nimitz presented the Medal of Valor to Officer Mark Connery 5 and Reserve Officer Rick Kolentus and the congratulations and gratitude 6 of the City were offered to the Officers by the Mayor and the members 7 of the Council. 8 9 RESOLUTION NO. 4-1985 10 11 Mayor Frank H. Waltermann read Resolution No. 4-1985 in its entirety. 12 13 A RESOLUTION DESIGNATING RED AND WHITE WEEK TO CELEBRATE.THE 1985 14 SEMI-STATE CHAMPIONS 15 16 WHEREAS, The Richmond High School Boys Basketball team has won the 17 1985 Indianapolis Semi-State Championship; and 18 19 WHEREAS, This team along with coaches, school administrators, parents, 20 students, and fans represent the winning spirit of our 21 community; and, 22 23 WHEREAS, We ask that all citizens participate in the spirit and 24 demonstrate their support by wearing, decorating, and 25 celebrating this victory with red and white colors for the 26 week of March 18 through March 23, 1985; and, 27 28 WHEREAS, We ask that all participate in the pep assembly on Friday, 29 March 22, 1985; and, 30 31 WHEREAS, We ask that everyone welcome our team back to our fine city 32 after the tournament, 33 34 NOW THEREFORE, I FRANK H. The Clerk read Ordinance No. 25-1985 on third and final 27 reading by title only. 28 Ordinance No. 25-1985 was adopted on the following vote: 29 30 Ayes: Elstro, Brookbank, Hankinson, Whitesell, Parker, Bodiker, Lemoine, 31 Morris and Williams (9) 32 Nays: None 33 _ 34 ORDINANCE NO. 26-1985 35 36 The Clerk read on first reading by title only Ordinance No. 26-1985 - 37 AN ORDINANCE RATIFYING STATE LAW AS THE LEGAL RESIDENCE REQUIREMENTS 38 FOR MEMBERS OF THE POLICEAND FIRE DEPARTMENTS AND STRIKING ORDINANCE 39 NO. 66-1984 AS UNCONSTITUTIONAL. 40 41 Councilmember Hankinson moved to suspend the rules and move Ordinance 42 No. 26-1985 to second reading, seconded by Councilmember Whitesell 43 and on unanimous voice vote the motion was carried. 44 45 The Clerk read on second reading Ordinance No. 26-1985 - AN ORDINANCE 46 RATIFYING STATE LAW AS THE LEGAL RESIDENCE REQUIREMENTS FOR MEMBERS 47 OF THE POLICE AND FIRE DEPARTMENTS AND STRIKING ORDINANCE NO. 66-1984 ' 48 AS UNCONSTITUTIONAL. 49 50 President Williams announced Ordinance No. 26-1985 was on public hearing. 51 52 Councilmember Parker asked Mr. Barden if this ordinance excluded anyone. 53 Mr. Barden explained that this was a housekeeping ordinance since 54 he realized that Ordinance No. 66-1984 was unconstitutional based 55 on a decision by the Indiana Appellate Court. This Ordinance will 56 only clean up the books. 57 58 In response to Councilmember Parker, Mr. Barden stated that they are 59 allowed to live within fifteen (15) miles of the city within Wayne 60 County and that would eliminate persons from Ohio. 61 62 Councilmember Lemoine asked if this applies before or after the hiring. 63 Mr. Barden stated that it applies to hirees and not applicants. 64 65 Councilmember Whitesell stated that he realizes State Law cannot be 90 Common Council Minutes C3FEra March 18, 1985 Page 6 1 changed, but that he believes they should reside within the boundaries 2 of the City. 3 4 Mr. Barden stated that persons applying for jobs cannot be discriminated 5 against because of where they live. He said that this Ordinance is just 6 to correct an unconstitutional ordinance and residency requirements start 7 at the time of hiring. 8 9 Hearing no more comment, Councilmember Hankinson moved for engrossment 10 of Ordinance No. 26-1985, seconded by Councilmember Whitesell and on 11 unanimous voice vote the motion was carried. 12 13 Councilmember Bodiker moved to suspend the rules and move Ordinance No. 14 26-1985 to third and final reading and read by title only, seconded by 15 Councilmember Whitesell and on unanimous voice vote the motion was carried. 16 17 The Clerk read on third and final reading by title only Ordinance No. 18 26-1985 - AN ORDINANCE RATIFYING STATE LAW AS THE LEGAL RESIDENCE 19 REQURIEMENTS FOR MEMBERS OF THE POLICE AND FIRE DEPARTMENTS AND STRIKING 20 ORDINANCE NO. 66-1984 AS UNCONSTITUTIONAL. 21 22 Ordinance No. 26-1985 was adopted on the following vote: 23 24 Ayes: Elstro, Brookbank, Hankinson, Whitesell, Parker, Bodiker, Lemoine, 25 and Morris. (8) 26 Nays: Williams (1) 27 28 ORDINANCES ON SECOND READING 29 30 Councilmember Bodiker moved to suspend the rules and place Ordinance No. 31 142-1984 on the Agenda on second reading, seconded by Councilmember Whitesell 32 and on a voice vote with Councilmember Hankinson voting no the motion was 33 carried. 34 • 35 Mt. Barden explained to the Council that he feels the substance in this 36 ordinance is adequately covered in the zoning ordinance and the incidents 37 that this ordinance would specifically deal with can be handled by proper 38 enforcement of the present zoning ordinance. Mr. Barden requested the 39 Council strike Ordinance No. 142-1984 fran the Agenda. 40 41 Councilmember Brookbank stated that she felt the public should be educated 42 and remain aware of obstructions at intersections such as shrubs and trees 43 and keep them properly trimmed. 44 45 Councilmember Hankinson moved to strike Ordinance No. 142-1984 from the 46 Agenda, seconded by Councilmember Elstro and on unanimous voice vote the 47 motion was carried. 48 49 ORDINANCE NO. 9-1985 50 51 The Clerk read on second reading Ordinance No. 9-1985 - AN ORDINANCE 52 REQUIRING ALL BOARDS, COMMITTEES, COMMISSIONS, AND AUTHORITIES OF THE CITY 53 OF RICHMOND FOR WHICH CITY FUNDS ARE EXPENDED OR WHICH .HAVE CITY OFFICERS 54 OR EMPLOYEES AS MEMBERS IN THEIR OFFICIAL CAPACITIES, TO FURNISH TO THE 55 CITY CLERK FOR THE CITY OF RICHMOND COPIFS OF ALL MEETING AGENDAS, MINUTES, 56 MEMORANDA, AND NOTICES. 57 58 President Williams announced Ordinance No. 9-1985 was still on public 59 hearing. 60 61 Councilmember Lemoine asked Mr. Barden about the legalities of the Ordinance. 62 Mr. Barden stated that the Council has the authority to require minutes, 63 etc. Mr. Barden said that this Ordinance creates a central repository 64 for the records of the City and that something new is not being created. 65 He commented that other bodies such as the State Board of Accounts, Board 91 Common Council Minutes Cont'd March 18, 1985 Page 7 1 of Public Works and Safety and the Council all need minutes of other 2 Boards and committees. 3 4 Councilmember Parker asked if this would take additional personnel 5 or payroll and was informed that no additional personnel or payroll 6 would be necessary: 7 8 Councilmember Lemoine moved to Amend Amended Ordinance No. 9-1985 9 as follows: Title to read - An Ordinance Requiring All Boards, Committees, 10 Carmissions, and Authorities of the City Of Richmond Supported in whole 11 or Part by City Funds or Which Have City Officers or Employees or Appointees 12 as Members in Their Official Capacities, to Furnish To The City Clerk . 13 For The City of Richmond Copies of All Meeting Agendas, Minutes, Memoranda, 14 and Notices. The second whereas to read - official action by many 15 boards, commissions, Committees and offices of the City of Richmond are 16 dependent' on the action of other boa rds;. cOi unissions and coiuinittees.. 17 'Paragr-aph (a) to read - all boards, commissions, committees., or'authorities, 18 created either by City_ resolution, ordinance, agreement or. State law, 19 including, but not limited to the Richmond Sanitary District, Richmond 20 Park Board, Richmond Airport Board, the Boar' of Zoning Appeals,• the 21 Richmond Planning Commission, the Economic Growth and Development Board; 22 Police Merit'Curuuission, Police Pension Board, Fire Pension Board, 23 Urban Enterprise Zone, Revolving Loan FUnd, Telecommunications Council 24 or which are supported in whole or in part by City funds, etc. 25 26 Councilmember Morris seconded the motion to amend Amended Ordinance 27 No. 9-1985 and on unanimous voice vote the motion was carried. 28 29 In response to Councilmember Elstro, Mr. Barden explained that if the 30 Boards, etc do not comply with the Ordinance the Council would require 31 their attendance at a meeting for an explanation of why they are not 32 complying. The Council has powers of investigation. 33 34 Councilmember Elstro asked who was not complying with the previous 35 requests to forward the records and was informed the Fireman's Pension 36 Fund Board. Mr. Barden was asked about the opinion fran Attorney John 37 Rucklehaus stating that the Pension Board was created by State Law 38 and the City had no control over the Board. Mr. Barden stated that 39 he does not agree with this opinion and that the Pension Board falls 40 under the Open Door Laws. 41 42 Ms. Maness stated that all financial aspects of the Pension Board fall 43 under the jurisdiction of the City and through the Controller's Office 44 thereby making the Pension Board a part of the City of Richmond. She 45 also stated that all hiring and retirements are approved by the Board 46 of Public Works and Safety and the records of the proceedings of the 47 Pension Board are necessary for the Board of Works to take action. 48 49 Mr. Barden told the Council that any session of the Pension Board dealing 50 with personnel should be held in a duly called executive session and 51 not discussed in a public meeting. 52 • 53 Councilmember Hankinson moved for engrossment of Amended Ordinance 54 No. 9-1985, seconded by Councilmember Brookbank and on unanimous voice 55 vote the motion was carried. 56 57 Councilmember Whitesell stated that he would time allowed for all 58 affected to become aware of the Ordinance. 59 60 Councilmember Hankinson asked why the Council should hold a hearing 61 and why the discipline was placed on the Council. Mr. Barden explained 62 that the Council has final control through budgetary restraints. 63 64 Amended Ordinance No. 9-1985 will return on third and final reading 65 on April 1, 1985. 91 Common Council Minutes Cont'd March 18, 1985 � rINAANCE NO. 11-1985 1 The Clerk read on second reading Ordinance No. 11-1985 - AN ORDINANCE 2 REPEALING ORDINANCE NO. 10-1982 AND ADOPTING BY REFERENCE, AS A PART( IMMIHE 3 BUILDING CODE OF THE CITY OF RICHMOND, INDIANA, RULES AND REGULATIONS 4 GOVERNING THE CONSTRUCTION AND ALTERATION OF BUILDINGS AND STRUCTURES. 5 6 Mr. Barden examined the Proof of Publication and found it to be in order. 7 Councilmember Parker moved to accept and file the Proof of Publications, 8 seconded by Councilmember Bodiker and on unanimous voice vote the motion 9 was carried. 10 11 President Williams announced Ordinance No. 11-1985 was on public hearing. 12 13 Mr. Tom Hill of 3451 Dorothy Lane, asked the Council what the Ordinance 14 was for and what the affect would be on businesses. 15 16 Councilmember Morris explained that the Ordinance adopts the State Code 17 as it already exists. 18 19 Due to the complexity of the Ordinance, Councilmember Hankinson moved to 20 assign Ordinance No. 11-1985 to the Committee of the Whole, seconded by 21 Councilmember Parker and on unanimous voice vote the motion was carried. 22 23 ORDINANCE NO. 12-1985 24 25 The Clerk read on second reading Ordinance No. 12-1985 - AN ORDINANCE 26 REPEALING ORDINANCE NO. 100-1979 AND ALL AMENDMENTS THERETO ANDADOPTING 27 A NEW ORDINANCE FOR THE ENFORCEMENT OF BUILDING STANDARDS PROVIDING FOR 28 THE INSPECTION, REPAIR OR REMOVAL OF UNSAFE BUILDINGS WITHIN THE CITY OF 29 RICHMOND, INDIANA. 30 31 Mr. Barden examined the Proof of Publication and found it to be in order. 32 Councilmember Bodiker moved to accept and file the Proof of Publication, 33 seconded by Councilmember Parker and on unanimous voice vote the motion 34 was carried. 35 . 36 President Williams stated the ordinance was on public hearing. Mr. Barden explained that the $10.00 7 additional cost is an incentive to pay in a timely fashion. Also 8 the added revenue will make it more feasible for the City to take 9 parking violators to Court especially for repeat offenders. 10 11 In response to Councilmember Hankinson asking if the $10.00 was enough, 12 City Clerk, Mary Merchanthouse explained that it will help pay the 13 expenses to locate and collect parking tickets. (9) 38 Nays: None 39 40 ORDINANCE NO. 19-1985 41 42 The Clerk read on second readin Ordinance No. 19-1985 - AN ORDINANCE 43 AUTHORIZING THE BOARD OF PUBLIC WORKS AND SAFETY AND THE MAYOR UPON 44 THE RECOMMENDATION OF THE CITY ATTORNEY TO SETTLE CERTAIN CLAIMS AND 45 LIABILITIES OF THE CITY OF RICHMOND. 46 47 President Williams announced Ordinance No. 19-1985 was on public hearing. 48 49 Mr. Barden explained that this is a housekeeping ordinance suggested 50 by the State Board of Accounts. There is a conflict in the State 51 Law regarding the settling of claims and this ordinance will establish 52 procedure for the City. 53 54 In response to Councilmember Parker, Mr. Barden stated that larger 55 claims will be brought to the Council for settlement.
