HomeMy Public PortalAbout02-04-1985 63 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, FEBRUARY 4, 1985 1 The Common Council of the City of Richmond, Indiana metin regular session 2 February 4, 1985 at the hour of 7:30 P.M. in the Council Chambers in 3 said City. President Williams presided, with the following members 4 present: Councilmembers Elstro, Brookbank, Hankinson, Whitesell, Parker, 5 Bodiker, Lemoine and Morris. Absent : None. The following business 6 was had to-wit: 7 8 PLEDGE OF ALLEGIANCE 9 10 SILENT DEVOTIONS 11 12 APPROVAL OF MINUTES OF JANUARY 21, 1985 13 14 Councilmember Hankinson moved to approve the minutes of the previous 15 meeting as prepared, seconded by Councilmember Whitesell and on unanimous 16 voice vote the motion was carried. 17 18 COMMUNICATIONS FROM THE MAYOR 19 20 Mayor Frank Waltermann told the Council that he had visited the State 21 Legislature with Councilmember Bodiker on January 30, 1985 regarding 22 Senate Bill 75 (Unitary Tax) . This bill has a great impact on Japanese 23 Industry locating in the State. 24 25 Mayor Waltermann stated that he and Mary Merchanthouse had attended 26 a meeting with HUD on February 1, 1985 to discuss a program for the 27 elderly for home rehabiliation. 28 29 The Mayor called attention to the Legislative Bulletins sent to the 30 Council by the Indiana Association of Cities and Towns and said that 31 he would keep the Council apprised of bills coming up to assist cities 32 in order that they may contact their legislators in support of the 33 bills. 34 35 Mayor Waltermann commented on the proposed budget cuts by the Federal 36 Government. He stated that the proposed cut in Federal Revenue Sharing 37 will mean an 850,000.00 loss to the City. Other program cuts affecting 38 Richmond also include UDAG, Economic Development Administration funds, 39 Small Business Administration funds, Community Development Block Grant 40 funds, public transit funds, and Housing and Urban Development funds. 41 The Mayor stated that cities are at bare bones now. He said that he 42 does advocate deficit spending, but cities live within their budgets 43 and now will be penalized for being good managers. He encouraged the 44 Council to write their Senators and Representative regarding the proposed 45 cuts . 46 47 Councilmember Whitesell presented the Mayor the plaque he accepted for 48 the Mayor for the donation made to the Music Boosters for band uniforms. 49 50 REPORTS FROM CITY DEPARTMENTS 51 52 Finance Department 53 54 City Controller Cathy Maness gave the Council copies of a survey conducted 55 by the Indiana Controller's Association showing that Richmond has the 56 lowest 1985 City 'tax rate of all of the 2nd Class cities in Indiana. 57 The tax rate is 2.41/$100 Assessed Valuation. This rate includes the 58 .05/$100 for the cummulative capital development fund. Richmond's total 59 corporate rate of 10.61/$100 is the 7th lowest of the 2nd Class Cities 60 and Indianapolis . 61 62 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY 63 64 Ms . Maness told the Council that the Board of Works had approve all 65 proposed Rose Festival activities for 1985 and also approved the request 64 Common Council Minutes Cont 'd February 4, 1985 Page 2 1 of the Jaycees to hold their Grand Prix Cart races. 2 3 Councilmember Elstro asked Ms. Maness regarding a letter sent to the Animal 4 Welfare Shelter regarding their compliance with 504 Handicapped Regulations. 5 He stated that the Animal Welfare Shelter does not receive revenue sharing 6 funds. 7 8 Ms. Maness stated that through the fungibility concept they indirectly 9 receive revenue sharing funds. Ms. Maness and Ms. Roberson will be 10 contacting the Federal Revenue Sharing Office to try and resolve this 11 problem. 12 13 REPORTS FROM SPECIAL COMMITTEES 14 15 Committee of the Whole 16 17 Councilmember Lemoine reminded the Council of the Committee of the Whole 18 meeting, set for February 7, 1985 for discussion of position descriptions 19 of city employees and the meeting set for March 11, 1985 for the proposed 20 Alarm Ordinance. She also told the Council that an off site meeting has 21 been set for District 6 at the National Guard Armory on February 21, 1985 22 at 7:30 P.M. 23 24 REPORT OF STANDING COMMITTEES 25 26 Reid Hospital 27 28 Councilmember Brookbank reported that she had attended a presentation on 29 marketing. She also reported that Dr. Ron Brown has been appointed ChiefIII 30 of Medicine and that the 3% rate increase requested had been denied on the 31 basis of excessive operating cash. 32 33 Enterprise Zone 34 35 Councilmember Brookbank told the Council that the Urban Enterprise Zone . 36 Association would be meeting on February 5, 1985 at 7:30 P.M. 37 38 MISCELLANEOUS BUSINESS 39 40 Request to Support Nuclear Freeze 41 42 Father Joseph Dooley, Pastor of St. Mary's Church suggested the Council 43 support a resolution in favor of Nuclear Freeze. Father Dooley stated 44j that even without nuclear arms we are in a good position to carry on a first 45 class war. Father Dooley told the Council that the idea of nuclear freeze 4 I is not a political effort and would not bring peace, but that it was a good 4 psychological effort to take steps in favor of world peace. 4I 499 Committee Named to represent City on Central Dispatch 5 5 President Williams named Mayor Frank Waltermann and Councilmembers Whitesell 5 and Parker to serve on a joint committee with the County to resolve the issue 5 of central dispatch and 911. 511/ 5 ORDINANCES 5 5 ORDINANCES ON FIRST READING 5 59 Councilmember Bodiker moved to suspend the rules and read Ordinances No. 6 6, 7, and 8-1985 on first reading by title only, seconded by Councilmember 6 Morris and on unanimous voice vote the motion was carried. 6 6 ORDINANCE NO. 6-1985 6 6 The Clerk read on first reading by title only Ordinance No. 6-1985 - AN 65 Common Council Minutes Cont'd February 4, 1985 Page 3 ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, PROVIDING FOR THE REZONING OF THE PROPERTY LOCATED IN THE 600 BLOCK OF SOUTH "L" STREET FROM M-1 LIGHT INDUSTRIAL DISTRICT TO M-2 GENERAL INDUSTRIAL DISTRICT. President Williams assigned Ordinance No. 6-1985 to the Plan Commission ° for a public hearing. 10 ORDINANCE NO. 7-1985 1 1 The Clerk read on first reading by title only Ordinance No. 7-1985 - 1 , AN ORDINANCE VACATING A CERTAIN UTILITY EASEMENT LOCATED BETWEEN LOTS 1 17 AND 18 IN THE GLEN HILLS ADDITION TO THE CITY OF RICHMOND, INDIANA. 1 1° President Williams assigned Ordinance No. 7-1985 to the Plan Commission 1 for a public hearing. 1� 1° ORDINANCE NO. 8-1985 20 2 The, Clerk read on first reading by title only. Ordi,nance(No. .8-1985 - 2' AN ORDINANCE ESTABLISHING A TELECOMMUNICATIONS COUNCIL. 2 ; 2, Councilmember Morris moved to amend Ordinance No. 8-1985 by changing 2 , Section 2 to read as follows : 2° 2 ' (2) APPOINTMENTS: The council shall consist of five voting members, 2a two of whom shall be appointed by the Mayor and three by the Common 2s Council. In addition each cable television franchiseemay provide 30 a reference person in advisory capacity only as requested by the 3 telecommunications commission. Members shall be appointed for 3 two-year terms. 3 , 34 Councilmember Lemoine seconded the motion to amend Ordinance No. 8-1985 3 and on unanimous voice vote the motion was carried. 3° 3 Councilmember Elstro asked where funding for the Commission would come 3: from and Mr. Barden explained that the Ordinance was kept simple and 3'; allows the Board of Works to alter the duties of the commission. He 40 stated that the Board of Works would have to make any funding proposals 4 to the Council for approval. 4 4 , Councilmember Whitesell stated that the Ordinance sets up a method of 4 funding by stating that it will be supported from cable television 4 franchise fee subject to approval of the Mayor and Common Council. 46 4 ' Mr. Barden explained that the commission will work similar to the Plan 4: Commisison with 'no provisions for salaries and using volunteer effort. 4° 5o Councilmember Morris moved to suspend the rules and move Ordinance No. 5 8-1985 to second reading, seconded by Councilmember Bodiker and on 5, unanimous voice vote the motion was carried. 5 The Clerk read Amended Ordinance No. 8-1985 on second reading. 5' President Williams announced Ordinance No. 8-1985 was on public hearing. 5' 5° Speaking for Ordinance No. 8-1985 was Cathy Maness, President of the 5 ' Board of Public Works and Safety. Ms. Maness stated that the public 5„ hearing the Board of Works held demonstrated the need for the tele- 5° communications council and the Board supports the ordinance and the 60 amendment to the ordinance. 6 6 Councilmember Hankinson moved for engrossment of Ordinance No. 8-1985, 6 seconded by Councilmember Whitesell and on unanimous voice vote the 6, motion was carried. 6 Common Council Minutes Con't February 4, 1985 Page 4 1 Councilmember Lemoine moved to suspend the rules and move Amended Ordinance 2 No. 8-1985 to third and final reading and read by title only, seconded by 3 Councilmember Morris and on unanimous voice vote the motion was carried. IAmended Ordinance No. 8-1985 was adopted with the following vote: 11 Ayes: Elstro, Brookbank, Hankinson, Whitesell, Parker, Bodiker, Lemoine, 1 Morris and Williams . 1. 1 Nays : None 1 1' ORDINANCES ON SECOND READING 1: ORDINANCE NO. 114-1984 1 The Clerk read on second reading Ordinance No. 114-1984 - AN ORDINANCE 1: AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, 1° COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, 2C PROVIDING FOR THE REZONING OF THE PROPERTY LOCATED IN THE 3500 BLOCK OF 21 NEW PARIS PIKE FROM A-1 AGRICULTURAL DISTRICT TO M-2 GENERAL INDUSTRIAL 2 DISTRICT AND TO M-2 SU GENERAL INDUSTRIAL SPECIAL USE DISTRICT, AND 2 AUTHORIZING THE SPECIAL USE OF SAID PROPERTY AS A LANDFILL. 2 2' The Clerk presented a letter to the Council from the City Plan Commission 2 requesting that Ordinance No. 114-1984 be striken, the vote to recommend 2 striking being eight (8) to zero (0) . 2: 2' Councilmember Hankinson moved to strike Ordinance No. 114-1984 from the 31 Agenda, seconded by Councilmember Morris and on unanimous voice vote the 3 motion was carried. 3 3 ORDINANCE NO. 4-1985 3 3' The Clerk read on second reading Ordinance No. 4-1985 - AN ORDINANCE AMENDING 3: CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, COMMONLY 3 KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, PROVIDING 3E FOR THE REZONING OF PROPERTY LOCATED IN THE 600 BLOCK OF NORTH 12TH STREET 35 FROM R-3 ONE-TO-EIGHT FAMILY RESIDENCE DISTRICT TO C-2 COMMERCIAL DISTRICT. 4 4 The Clerk informed the Council that the Plan Commission had voted eight 4 (8) to zero (0) to recommend that Ordinance No. 4-1985 be adopted. 4 4 President Williams announced Ordinance No. 4-1985 was on public hearing. 4 4 Hearing no public comment on Ordinance No. 4-1985, Councilmember 4 Hankinson moved for engrossment, seconded by Councilmember Whitesell and 4: on unanimous voice vote the motion was carried. 4• 51 Councilmember Whitesell moved to suspend the rules and move Ordinance No. 5 4-1985 to third and final reading and read by title only, seconded by 5. Councilmember Parker and on unanimous voice vote the motion was carried. 5 5 The Clerk read on third and final reading by title only Ordinance No. 4- 5' 1985 - AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING 5: ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE - 5 CITY OF RICHMOND, INDIANA, PROVIDING FOR THE REZONING OF PROPERTY LOCATED 5: IN THE 600 BLOCK OF NORTH 12TH STREET FROM R-3 ONE-TO-EIGHT FAMILY 5' RESIDENCE DISTRICT TO C-2 COMMERCIAL DISTRICT. 61 6 Ordinance No. 4-1985 was adopted on the following vote: 6• 6 Ayes: Elstro, Brookbank, Hankinson, Whitesell, Parker, Bodiker, Lemoine, 6 Morris and Williams 6' Nays: None 6' Common Council Minutes Cont'd February 4, 1985 Page 5 1 APPROPRIATION ORDINANCE NO. 5-1985 2 3 The Clerk read on second reading Appropriation Ordinance No. 5-1985 - 4 AN ORDINANCE TO APPROPRIATE WITHIN THE GENERAL FUND. 5 6 Mr. Barden examined the Proof of Publication and found it to be in order. 7 Councilmember Morris moved to accept and file the Proof of Publication, 8 seconded by Councilmember Bodiker and on unanimous voice vote the motion 9 was carried. 10 11 President Williams announced Appropriation Ordinance No. 5-1985 was 12 on public hearing. 13 14 Speaking for Ordinance No. 5-1985 was City Attorney Ken Barden. Mr. 15 Barden explained this appropriation would be used in settlement of a 16 possible suit against the City for the burning of a property in the 17 Gorge Area. The settlement includes the purchase of the property. 18 Mr. Barden stated that in comparison with prices paid for other properties 19 in the Gorge Area this is a very reasonable settlement. 20 21 Councilmember Elstro asked about heirs to the estate and Mr. Barden 22 stated that he did not know the ultimate heirs and this was settlement 23 of a Tort Claim as part of the estate. 24 2 In response to a question regarding the use of Redevelopment Funds instead 26 of a fund balance appropriation to settle, Mr. Barden said that it is 27 not clear if Redevelopment Funds can be used to settle a law suit. 28 29 There being no further comment, Councilmember Hankinson moved for 30 engrossment of Ordinance No. 5-1985, seconded by Councilmember Parker 31 and on unanimous voice vote the motion was carried. 32 33 Councilmember Bodiker moved to suspend the rules and move Appropriation 34 Ordinance No. 5-1985 to third and final reading and read by title only, 35 seconded by Councilmember Whitesell and on a voice vote with Council- 36 member Elstro voting no the motion was defeated. 37 38 ADJOURNMENT 39 40 There being no further business on a motion duly made, seconded and 41 passed the meeting was adjourned. . 42 43 44I Marion Williams, President 4 46 4 ATTEST: cif 4 Mary Me chan house 491 City Clerk 50 51 52 53 54 55.1 5 58 591 60 61 62 63 • 64 65 ON Cr, Cr.
