HomeMy Public PortalAbout12-03-1984 29 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, DECEMBER 3, 1984 1 The Common Council of the City of Richmond, Indiana, met in regular session 2 December 3, 1984 at the hour of 7:30 P.M. in the Council Chambers in 3 said City. President Elstro presided with the following members present: 4 Councilpersons Williams, Brookbank, Whitesell, Parker, Bodiker, Lemoine 5 and Morris. Absent: Hankinson. The following business was had to-wit: 6 7 PLEDGE OF ALLEGIANCE 8 9 SILENT DEVOTIONS 10 11 APPROVAL OF MINUTES OF NOVEMBER 19, 1984 12 13 Councilperson Williams moved to approve the minutes of the previous meeting 14 as prepared, seconded by Councilperson Brookbank and on unanimous voice 15 vote the motion was carried. 16 17 COMMUNI_CATIONS FROM THE MAYOR 18 19 Mayor Waltermann reported on the 61st annual meeting of the Congress 20 of Cities. He told the Council that Cathy Maness, Mary Merchanthouse, 21 Ken Barden and himself had attended and that the delegates had spread 22 out to attend as many of the workshops as possible. He stated that there 23 were 125 various exhibits on display and that it was a good conference 24 and .much valuable information had been brought back to be applied locally. 25 26 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY 27 11/ 28 Ms. Maness stated that TCI had responded to the Board in writing and 29 that the response had been very brief and only addressed the questions 30 that had been formally posed. 31 32 Councilperson Brookbank asked Ms. Maness if the Board could look into 33 funeral processions going in front of the High School when school was 34 letting out. 35 • 36 Councilperson Parker stated that he was receiving many cable complaint 37 calls on the outage currently happening on the west side of town. Ms. 38 Maness stated that persons calling are encouraged to call cable, but 39 all complaints are looked into. 40 41 Councilperson Morris asked the Board to look into the striping on North 42 8th Street. After the repaving the lanes have been marked in error 43 on the two (2) blocks north of North A Street causing the cars traveling 44 in the east problems getting around parked cars . Ms. Maness stated that 45 she would refer this to Mr. Willis for action by the State. 46 47 Councilperson Elstro commented on the Water Works replacing fireplugs 48 and creating quite a mess . He was enquiring as to when the mess would 49 be cleaned up. He also enquired about a water leak at South llth and 50 J Street that has been there for about four (4) weeks. • 51 52 Councilperson Williams questioned about abandoned filing station and 53 if the underground tanks had been removed. Councilperson Elstro commented 54 that these tanks can also be filled with sand and not removed. 55 56 COMMITTEE OF THE WHOLE 57 58 Councilperson Williams stated that they will be establishing a meeting 59 in January to consider the two (2) ordinances assisgned to the Committee 60 of the Whole. President Elstro suggested that this date be set at the 61 December 17th Council meeting. 62 63 64 65 Common Council Minutes Cont'd • December 3, 1984 Page 2 1 REPORT OF STANDING COMMITTEES 2 3 Reid Hospital 4 5 Councilperson Brookbank reported on the layoffs due to the closing of Leeds 6 5 and that the layoffs were completed December 1, 1985 and that all have 7 recall rights. She also reported that the laundry service was busy and that 8 they were going, to have to make a 19,000.00 investment in a new solid waste 9 truck. 10 11 Councilperson Bodiker asked if there was a porportionate cutback in managerial 12 positions. Councilperson Brookbank commented that the cuts were made on 13 a seniority basis and she was not aware of any managerial cutbacks. 14 15 Councilperson Williams commented on the fact that council members serve on 16 boards and have no voting rights on many of these boards and that he did 17 not care to serve on boards where he had no voting right. President Elstro 18 explained that the Council members on these boards act as liasons back to 19 the Council to keep the Council informed of actions taken by the boards . 20 21 Arts Council 22 23 Councilperson Lemoine stated that they would be meeting on December 5, 1984 24 at 4:00 P.M. at Morrison Reeves. 25 26 Plan Commission 27 28 Councilperson Morris stated that the regular meeting of the Plan Commission 29 for December would be held on December 18, 1984 at 7:30 P.M. and that a work 30 session would be held on the landfill issue on December 11, 1984 at 7:00 31 P.M. in the Board of Works Room. She invited all the Council to attend this 32 session. 33 34 Enterprise Zone 35 36 Councilperson Brookbank announced they would be meeting on December 4, 1984 37 .and they are working on updating the inventory manual. 38 39 ORDINANCES 40 41 ORDINANCES ON FIRST READING 42 43 Councilperson Morris moved to suspend the rules and read ordinances 146, 44 147, 148, 149, 150 and 151 on first reading by title only, seconded by 45 Councilperson Williams and on unanimous voice vote the motion was carried. 46 47 ORDINANCE NO. 14-6-1984 48 49 The Clerk read on first reading by title only Transfer Ordinance No. 146-1984- 50 AN ORDINANCE TO TRANSFER WITHIN THE GENERAL FUND - PLANNING AND ECONOMIC 51 DEVELOPMENT. 52 53 Councilperson Williams moved to suspend the rules and move Transfer Ordinance 54 No. 146-1984 to second reading, seconded by Councilperson Parker and on 55 unanimous voice vote the motion was carried. 56 57 The Clerk read on second reading Transfer Ordinance No. 14s6.-1984 - AN 58 ORDINANCE TO TRANSFER WITHIN THE GENERAL FUND - PLANNING AND ECONOMIC 59 DEVELOPMENT. ' 60 61 President Elstro announced Transfer Ordinance No. 146-1984 was on public 62 hearing. 63 64 Councilperson Bodiker asked how they were able to request a specific name 65 of computer and Ms. Maness stated that if was below the required amount to -• 31 Common Council Minutes Cont'd December 3, 1984 Page 3 1 bid. Ms. Maness also told the Council that this computer would be compatible 2 with other computers in the building. 3 4 There being no further comment, Councilperson Williams moved for engrossment 5 of Transfer Ordinance No. 146-1984, seconded by Councilperson Whitesell 6 and on unanimous voice vote the motion was carried. 7 8 Councilperson Williams moved to suspend the rules and move Transfer Ordinance 9 No. 144-1984 to third and final reading and read by title only, seconded 10 by Councilperson Whitesell and on unanimous voice vote the motion was 11 carried. 12 13 The Clerk read on third and final reading by title only Transfer Ordinance 14 No. 146-1984 - AN ORDINANCE TO TRANSFER WITHIN THE GENERAL FUND - PLANNING 15 AND ECONOMIC DEVELOPMENT 16 17 Transfer Ordinance No. 146-1984 was adopted on the following vote: 18 19 Ayes: Williams, Brookbank, Whitesell, Parker, Bodiker, Lemoine, Morris 20 and Elstro (8) 21 Nays: None 22 Absent-: Hankinson (1) 23 24 ORDINANCE NO. 147-1984 25 26 The Clerk read on first reading by title only Transfer Ordinance No. 27 147-1984 - AN ORDINANCE TO TRANSFER WITHIN THE GENERAL FUND - ECONOMIC 28 DEVELOPMENT 29 30 Councilperson Williams moved to suspend the rules and move Transfer Ordinance 31 to second reading, seconded by Councilperson Brookbank and on uanimous 32 'voice vote the motion was carried. 33 34 The Clerk read on second reading Transfer Ordinance No. 147-1984 - AN 35 ORDINANCE TO TRANSFER WITHIN THE GENERAL FUND - ECONOMIC DEVELOPMENT 36 Councilperson Parker asked how many computers werer in the City Building. 37 Ms. Maness stated that the mainframe and four (4) PC were in the building 38 along with the equiment in the Police records. The Clerk and Attorney 39 have word processing equipment and a computer was included in the UMPTA 40 Grant for public transit and the Engineer will be acquiring equipment 41 with map drawing capabilities. 42 43 Councilperson Parker asked when the UMPTA Grant would come before Council 44 and Mr. Dooley explained that the computer was a part of the total capital 45 assistance grant and was approved by the Council. Ms. Maness stated that 46 the match request for the grant would come before Council and that the 47 computer would be used for fleet maintenance control and scheduling. 48 49 President Elstro announced Transfer Ordinance NO. 147-1984 was on public 50 hearing. 51 Hearing no futher comment, Councilperson Williams moved for engrossment, 52 seconded by Councilperson Brookbank and on unanimous voice vote the motion 53 was carried. • 54 55 Councilperson Whitesell moved to suspend the. rules and move Transfer Ordinance 56 No. 147-1984 to third and final reading and read by title only, seconded 57 by Councilperson Williams and on unanimous voice vote the motion was carried. 58 59 Bill McDermott, Economic Development Director told the Council that the 60 computer to be placed in his office would assist with the volume of data 61 in the Chamber of Commerce and all data generated by his office would 62 also be added. This will allow the data to be managed and recalled more 63 quickly in the needed form. • 64 - 65 2 Common Council Minutes Cont'd December 3, 1984 Page 4 1 The Clerk read. on ,third .and final reading by*,title only Transfer, Ordinance 2 No. 147-1984 - AN ORDINANCE TO TRANSFER WITHIN THE GENERAL FUND - ECONOMIC 3 DEVELOPMENT. 4 5 Ordinance No. 147-1984 was adopted on the following vote: 6 7 Ayes: Williams, Brookbank, Whitesell, Parker, Bodiker, Lemoine, Morris 8 and Elstro (8) 9 Nays: None 10 Absent: Hankinson (1) 11 12 ORDINANCE NO. 148-1984 13 14 The Clerk read on first reading by title only Ordinance No. 148-1984 - AN 15 ORDINANCE AMENDING CHAPTER 150 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 16 1700-1958, COMMONLY KNOWN AS THE BUILDING CODE OF THE CITY OF RICHMOND, INDIANA 17 PROVIDING FOR THE REGISTRATION OF PLUMBING CONTRACTORS AND REQUIRING THE 18 OBTAINING OF A PERMIT PRIOR TO PERFORMING PLUMBING SERVICES. 19 20 Councilperson Whitesell moved to amend Ordinance No. 148-1984 by deleting 21 paragraph 321 1 (e) and replacing paragraph 322 with the following language, 22 seconded by Councilperson Brookbank and on unanimous voice vote the motion 23 was carried. 24 25 322 Registration of Pumbing Contractors 26 All persons performing plumbing services in the City of Richmond, 27 Indiana shall be licensed by the State of Indiana as a Plumbing 28 Contractor and shall be registered with the Planning Department 29 of said City, provided, however, that the owner-occupant of a 30 dwelling of eight (8) or fewer residential units shall not be 31 required to be licensed by the State and shall not be required 32 to register when the owner-occupant is installing, altering or 33 repairing the plumbing of said residential units. Registration 34 shall be on forms psrovided by the Planning Department and shall 35 be accompanied by a registration fee of ten dollars ($10.00) . 36 Registration is on a per annum calendar year basis. Anual regis- 37 tration renewal shall be accompanied by a registration renewal 38 fee of ten dollare ($10:00) whereupon payment the registration 39 shall be renewed. 40 41 President Elstro announced Ordinance No. 148-1984 has to be advertised for 42 public hearing. 43 44 ORDINANCE NO. 149-1984 45 46 The Clerk read on first reading by title only Ordinance No. 149-1984 - AN 47 ORDINANCE RATIFYING THE AMENDMENT BETWEEN THE AMALGAMATED TRANSIT UNION LOCAL 48 NO. 1474 AND THE CITY OF RICHMOND. 49 50 Ms. Maness explained that the delay in bringing this Ordinance to Council 51 was an oversight and that the Board of Works has approved the agreement on 52 June 21, 1984. The wage rate reflected is 3.5%. 53 54 Councilperson Lemoine asked who was on the bargaining team and Ms. Maness 55 explained that Mr. Willis, herself, and Janet Sams the Manager of the bus 56 lines served on the bargaining team. Ms. Maness stated that the funds to 57 cover this agreement were included in the 1985 budget. 58 59 Councilperson Williams requested a report on revenue from the bus system 60 for 1984. 61 62 Councilperson Williams moved to suspend the rules and move Ordinance no. 63 149-1984 to second reading, seconded by Councilperson Whitesell and on 64 unanimous voice vote the motion was carried. 65 33 • Common Council Minutes Cont'd December 3, 1984 Page 5 1 The Clerk read on second reading Ordinance No. 149-1984 - AN ORDINANCE 2 RATIFYING THE AMENDMENT BETWEEN THE AMALGAMATED TRANSIT UNION LOCAL NO. 3 1474 AND THE CITY OF RICHMOND. 4 5 President Elstro announced Ordinance No. 149-1984 was on public hearing. 6 7 Hearing no comment, Councilperson Morris moved for engrossment of Ordinance 8 No. 149-1984, seconded by Councilperson Williams and on unanimous voice 9 vote the motion was carried. 10 11 Councilperson Williams moved to suspend the rules and move Ordinance 12 No. 149-1984 to third and final reading and read by title only, seconded 13 by Councilperson Whitesell and on unanimous voice vote the motion was 14 carried. 15 16 The Clerk read on third and final reading by title only Ordinance No. 17 149-1984 - AN ORDINANCE RATIFYING THE AMENDMENT BETWEEN THE AMALGAMATED 18 ' TRANSIT UNION LOCAL NO. 1474 AND THE CITY OF RICHMOND. 19 20 Ordinance No. 149-1984 was adopted on the following vote: 21 22 Ayes: Williams, Brookbank, Whitesell, Parker, Bodiker, Lemoine, Morris 23 and Elstro (8) 24 Nays: None 25 Absent: Hankinson (1) 26 • 27 ORDINANCE NO. 150-1984 28 11/ 29 The Clerk read on first reading by title only Ordinance No. 150-1984 - 30 AN ORDINANCE RATIFYING THE 1985 BUDGET OF THE RICHMOND SANITAY DISTRICT, 31 AS ADOPTED BY THE BOARD OF SANITARY COMMISISONERS FOR THE SEWER UTILITY, 32 THE SOLID WASTE FUND AND THE BOND SINKING FUND. 33 34 Councilperson Williams stated that the Council has no powers except to 35 ratify this budget and had no jurisdiction to cut or no voice in these 36 actions. He said the Sanitary Commissioners made the budget decisions 37 and he is not in support of the Ordinance if he has no power in making 38 the decisions. 39 40 Councilperson Morris requested that action on this Ordinance be delayed 41 until the next meeting of the Council since they have not had the budgets 42 long enough to look over them very well. Ms. Maness stated that it must 43 be passed by the end of the year. 44 45 In response to Councilperson Parker, Mr. Barden explained that this is 46 a formality and the Council's ultimate control over the Sanitary District 47 is rate control. The Council has no authority to cut this budget, but 48 it gives another public forum to have questions answered regarding the 49 budget. 50 51 Councilperson Parker questioned what happens if. the Council does not 52 ratify the budget and Mr. Barden explained that it would be written up 53 in the State Board of Accounts Audits. 54 55 Councilperson Whitesell commented that this gives the Council a change 56 to share thoughts on the budget and be a part of the overall review process. 57 58 President Elstro announced that Ordinance No. 150-1984 will be allowed 59 to return to the agenda on second reading at the next council meeting. 60 61: '.ORDINANCE NO.' 151-1984 62 • 63 •The Clerk read on first reading by title only Transfer Ordinance No. 64 151-1984 - AN ORDINANCE TO TRANSFER WITHIN THE GENERAL FUND- ATTORNEY'S 65 OFFICE Common Council Minutes Cont'd December 3, 1984 Page 6 1 Councilperson Williams moved. to suspend the rules and move Transfer Ordinance 2 No. 151-1984 to second reading, seconded by Councilperson Whitesell and on 3 unanimous voice vote the motion was carried: . 4 The Clerk read Ordinance No. 151-1984 on second reading. 5 President Elstro announced Transfer Ordinance No. 151-1984 was on public hearing. 6 7 Mr. Barden explained that this transfer will cover the cose of storage boxes 8 and files for his office. 9 10 '1 There being no further comment, Councilperson Whitesell moved for engrossment 11 of Transfer Ordinance No. 151-1984, seconded by Councilperson Brookbank and 12 on unanimous voice vote the motion was carried. 13 14 Councilperson Williams moved to suspend the rules and move Transfer Ordinance 15 No. 151-1984 to third and final reading and read by title only, seconded by 16 Councilperson Parker and on unanimous voice vote the motion was carried. 17 18 The Clerk read on third and final reading by title only Transfer Ordinance, 19 NO. 151-1984 - AN ORDINANCE TO TRANSFER WITHIN THE GENERAL FUND - ATTORNEY'S 20 , OFFICE. 21 22 Ordinance No. 151-1984 was adopted on the following vote: 23 24 Ayes: Williams, Brookbank, Whitesell, Parker, Bodiker, Lemoine, Morris and 25 Elstro. (8) 26 Nays: None 27 Absent: Hankinson (1) 28 29 ORDINANCES ON SECOND READING 30 31 ORDINANCE NO. 115-1984 32 . 33 The Clerk read on second reading Ordinance No. 115-1984 - AN ORDINANCE VACATING 34 A CERTAIN FIFTEEN (15) FOOT UTILITY EASEMENT WITHIN THE HENLEY HILLS 35 SUBDIVISION, SECTION TWO, IN THE CITY OF RICHMOND, INDIANA, LOCATED BETWEEN 36 LOTS 26, 27 and 28. 37 38 Mr. Barden stated that due to Holiday deadlines at the Palladium-Item the 39 legal ad was not published on time, but the Palladium-Item notified the Clerks 40 Office and they were able to post Notices of Hearing for Ordinance No. 115-1984 41 as prescribed by Ordinance. Mr. Barden examined the Proof of Posting and 42 found them to be in order. Councilperson Parker moved to accept and file 43 the Proof of Posting, seconded by Councilperson Whitesell and on unanimous 44 voice vote the motion was carried. 45 ' 46 ' President Elstro announced Ordinance No. 115-1984 was on public hearing. 47 48 Speaking for Ordinance No. 115-1984 was Gordon Moore, representing the 49 petitioners, Frank and Theresa Lavallo. Mr. Moore stated that the two (2) 50 lots are not used by the utility companies and that there are no objections 51 by the utility companies on the petition for the vacation. Mr. Moore also 52 stated that the Lavallos own all the lots. 53 54 In response to Councilperson Williams, Mr. Moore told the Council that the 55' Lavallos plan to redefine their property lines around an existing swimming 56 pool and tennis court that extend into the utility easement. Mr. Moore also 57 ' informed Councilperson Brookbank that the lots remaining after the vacation 58 of the utility easement and the redefination of the property lines will be 59 over the minimum lot size required by the City. 60 61' Speaking against Ordinance No. 115-1984 was Tom Humphrey, agent for Humphrey 62 Builders. Mr. Humphrey presented the Council a petition signed by the residents 63 of Lantern Trail and Waverly Drive in opposition to the vacation. Mr. 64 Humphrey stated that the three (3) lots belonging to the Lavallos were considered 65 one entity. If the vacation is granted there would be a possibility that 66 the two (2) lots left after the vacation and the redefining of the property 35 Common Council Minutes Cont 'd December 3,1984 Page 7 1 would be sold and they would be much smaller than the existing lots in 2 the division. 3 4 Councilperson Whitesell asked Mr. Humphrey if the restrictive covenants 11/ 5 of the development did not give control over the lots . 6 7 Also speaking against Ordinance No. 115-1984 was Peggy Merkin. Mrs . 8 Merkin stated that there would not be sufficient room to build on the 9 remaining portion of the lots if the tennis courts are kept in tact. 10 She stated that lots 26 and 27 should be kept together and not separated. 11 12 President Elstro stated that the Council has no control over some of the 13 problems involved only the vacation of the utility easement. 14 15 Councilperson Morris stated that she voted against the vacation in Plan 16 Commission because she felt the question was called for before all the 17 presentation was made. 18 19 Mr. Barden explained that the Council has no powers to enforce the restrictive 20 covenants and that an injunctive suit would have to be filed to prevent 21 any violation of the covenants. 22 23 Councilperson Williams reminded the council that it will take six (6) 24 votes to override the decision of the Plan Commission. 25 26 Mrs. Merkin told the Council that the residents of the area were also 27 concerned about the reduction in size of an easement and no drainage system. 28 111 29 In response to President Elstro, Mr. Barden stated that the Council could 30 refer this issue back to the Plan Commission with a suspension of the 31 rules. 32 33 Mr. Dooley stated that the Plan Commission felt the problems fell under 34 the jurisdiciton of the restrictive covenants of the development and not 35 the zoning ordinance of the City. They acted on the request to vacate 36 a utility easement and all utility companies have indicated they do not 37 need this easement and the owners deserve to use it. 38 39 Councilperson Whitesell stated he viewed this request as more of a special 40 use request and the impact on the neighborhood rather than the city as 41 a whole. 42 43 Mr. Dooley responded to Councilperson Bodiker's question regarding 44 redefining the property lines by stating that the owners do not need the 45 permission of the City as long as the lots meet the square footage 46 requirements. 47 48 Councilperson Morris requested this Ordinance remain on second reading 49 and that the members of the Council visually survey the property in question. 50 51 President Elstro announced Ordinance No. 115-1984 will return on second 52 reading at the next meeting of the Council. 53 54 ORDINANCE NO. 138-1984 55 56 The Clerk read on second reading Ordinance No. 138-1984 - AN ORDINANCE 57 VACATING A CERTAIN PUBLIC WAY WITHIN THE CITY OF RICHMOND, INDIANA, BEING 58 THAT PORTION OF A TEN (10) FOOT ALLEY RUNNING WEST OFF OF SOUTH 5TH STREET 59 BETWEEN SOUTH "A" AND SOUTH "B" STREETS. 60 61 Mr. Barden examined the Proof of Posting and found it to be in order. 62 Councilperson Parker moved to accept and file the Proof of Posting, seconded 63 by Councilperson Whitesell and on unanimous voice vote the motion was 64 carried. 65 315 Common Council Minutes Cont'd December 3,1984 Page 8 1 President Elstro announced Ordinance NO. 138-1984 was on public hearing. 2 3 Speaking for Ordinance No. 138-1984 was James Ronald, Attorney at Law.
