HomeMy Public PortalAbout11-19-1984 23 • PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, NOVEMBER 19,1984 1 The Common Council of the City of Richmond, Indiana met in regular 2 session November 19, 1984 at the hour of 7:00 P.M. in the Council • 3 Chambers in said City. President Elstro presided with the following 4 members present: Councilpersons Williams, Brookbank, Hankinson, 5 Whitesell, Parker, Bodiker, and Morris. Absent: Lemoine. The 6 following business was had to-wit: 7 8 PLEDGE OF ALLEGIANCE 9 10 SILENT DEVOTIONS 11 12 APPROVAL OF MINUTES OF NOVEMBER 5, 1984 13 Councilperson Hankinson moved to approve the minutes of the previous 14 as prepared, seconded by Councilperson Whitesell and on unanimous 15 voice vote the motion was carried. 16 17 COMMUNICATIONS FROM THE MAYOR 18 19 Mayor Waltermann told the members of Council that two of the major 20 broadcasting networks had called his office regarding the Turn Off 21 TV Week sponsored through the Morrison Reeves Library under the 22 direction of Sue Weller. 23 24 Councilperson Morris asked the Mayor if he wouldrar_range; a. joint 25 meeting between the City and County regarding the 911 and the Central 26 Communication System. The Mayor indicated he would look into this 27 and felt that a final committment from the County regarding their 28 participation was necessary. 29 30 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY 31 32 Ms. Maness told the Council that the annual City Auction would be 33 Saturday, December 1, 1984 starting at the Polio Garage on Garden 34 Avenue and finishing at the Street Department Garage on Richmond 35 Avenue. Ms. Maness also stated that the Board had officially removed 36 parking on South L Street from 9th to 23rd and that at the November 37 14th meeting a representative of TCI had made an oral report to 38 the Board on the local cable TV and that the Board had offially 39 moved to request the report in writing within two (2) weeks. 40 41 Councilperson Bodiker commended the Board and the City Attorney 42 for the way they handled Mr.Morris 's attempted intimidation of the 43 Board during the cable report. 44 45 REPORTS FROM SPECIAL COMMITTEES 46 47 Parks and Recreation, Public Safety, Public Works and Safety 48 49 Mr. Bodiker reported that this committee had met regarding Ordinance 50 No. 142-1984 on hazards at intersections. Mr. Bodiker stated that 51 the Committee had taken the Ordinance under advisement for further 52 technical information and would have a final report on the Ordinance 53 by the end of 1984. 54 55 REPORT OF STANDING COMMITTEES 56 57 Reid Hospital • 58 59 Councilperson Brookbank reported on the closing of the Leeds 5 Nursing 60 Unit and the staff reduction of thirty-one (31) persons that would 61 mostly be accomplished by natural attrition such as early retirements . 62 63 Enterprise Zone 64 65 Councilperson Brookbank reported there are eight (8) new companies 66 located within the Enterprise Zone. 4 Common Council Minutes Cont'd November 19, 1984 Page 2 1 INTRODUCTION OF MISCELLANEOUS BUSINESS 2 3 Councilperson Morris told the Council that she had been appointed to 4 the Indiana Association of Cities and Towns Legislative Committee and 5 that there is a meeting on December 12, 1984 and she would appreciate 6 any input from the other members of Council about lobbying issues. 7 8 Appointment to Police Merit Commission 9 10 The Clerk read the following letter from Mr. Jack Gauker regarding serving 11 on the Police Merit Commission: 12 Dear Council Members: 13 14 In December, 1981, I was elected by the Richmond Police Officers 15 to serve as a member of the Police Merit Commission forthe calendar 16 years 1982 thru 1984. My term ends this next month. 17 18 I have enjoyed serving on the Commission and would welcome the 19 opportunity to continue as a member. Since I was elected by the 20 Officers, to serve again, I must be selected by the City Council. 21 22 Therefore, I wish to offer my services as a member of the Police 23 Merit Commission for a second term. 24 25 Thank you for your consideration. 26 77 /s/ Jack Gauker 28 29 30 Councilperson Parker moved to reappoint Jack Gauker to the Police Merit 31 Commission effective December 1, 1984, seconded by Councilperson Williams 32 and on unanimous voice vote the motion was carried. 33 34 35 ORDINANCES 36 37 38 ORDINANCES ON FIRST READING 39 40 Councilperson Bodiker moved to suspend the rules and read Ordinances 41 No. 143, 144 and 145-1984 on first reading by title only, seconded by 42 Councilperson Morris and on unanimous voice vote the motion was passed. 43 44 TRANSFER ORDINANCE NO. 143-1984 45 46 The Clerk read on first reading by title only Transfer Ordinance No. L7 143-1984 - AN ORDINANCE TO TRANSFER WITHIN THE PARK FUND. 48 49 Ms. Maness stated that this ordinance is to cover the cost of filing 50 cabinets purchased by the Park Department without being properly encumbered. 51 52 Councilperson Hankinson moved to suspend the rules and move Transfer 53 Ordinance No. 143-1984 to second reading, seconded by Councilperson Bodiker 54 and on unanimous voice vote the motion was carried. 55 56 The Clerk read on second reading Transfer Ordinance No. 143-1984 - AN 57 ORDINANCE TO TRANSFER WITHIN THE PARK DEPARTMENT. 58 59 Councilperson Morris asked Ms. Maness if the Park has been informed of 60 the proper procedures for purchases. Ms. Maness explained that they 61 have been informed and that these purchases were made prior to the new 62 policies. 63 64 President Elstro announced Ordinance No. 143-1984 was on public hearing. 65 • 25 Common Council Minutes Cont'd November 19, 1984 Page 3 1 Hearing no public comment, Councilperson Hankinson moved for engrossment 2 of Ordinance No. 143-1984, seconded by Councilperson Whitesell and 3 on unanimous voice vote the motion was carried. 4 5 Councilperson Morris moved to suspend the rules and moved Ordinance 6 No. 143-1984 to third and final reading and read by title only, seconded 7 by Councilperson Williams and on a voice vote with Councilperson 8 Hankinson voting no the motion was defeated. 9 10 ORDINANCE NO. 144-1984 11 12 The Clerk read on first reading by title only Ordinance No. 144-1984 - 13 AN ORDINANCE AUTHORIZING THE CITY OF RICHMOND, INDIANA TO ISSUE ITS 14 ECONOMIC DEVELOPMENT REVENUE BONDS, SERIES 1984, "(J.M. HUTTON AND 15 CO. INC. PROJECT)" AND APPROVING OTHER ACTIONS IN RESPECT THERETO. 16 17 Councilperson Bodiker moved to suspend the rules and.move Ordinance 18 No. 144-1984 to second reading, seconded by Councilperson Hankinson 19 and on unanimous voice vote the motion was carried. /0 11 The Clerk read on second reading Ordinance No. 144-1984 - AN ORDINANCE 22 AUTHORIZING THE CITY OF RICHMOND, INDIANA TO ISSUE ITS ECONOMIC DEVELOPMENT 23 REVENUE BONDS, SERIES 1984, "(J.M. HUTTON AND CO. INC. PROJECT)" 24 AND APPROVING OTHER ACTIONS IN RESPECT THERETO. 25 26 President Elstro announced Ordinance No. 144-1984 was on public hearing 27 28 Speaking for Ordinance No. 144-1984 was Attorney Kent Klinge. Mr. 29 Klinge knformed the Council that the Economic Development Commission 30 had met and unanimously approved a Resolution in support of thie 31 Bond Issue. The bond issue will be used for the acquisition of the 12 Wallace Metal Products Building in the amount of 1,000,000.00. This 313 building will be used for a stamping plant and assembly plant. Twenty- I4 five new jobs will be added by January 1, 1985 and forty (40) new 3I5 jobs will be added by December 31, 1985. The new employees will 16 be solicited within the community. 17 3I8 Mr. Klinge reminded the Council that Industrial Revenue Bonds are '39 no burden to the taxpayer and that they are issued on the consent 40 of the Council. Mr. Klinge also stated that this project has no 41 adverse economic impact on any competition within the community. 42 43 Hearing no other public comment, Councilperson Bodiker moved for 44 engrossment of Ordinance No. 144-1984, seconded by Councilperson 45 Whitesell and on unanimous voice vote the motion was carried. 46 47 Councilperson Williams moved to suspend the rules and move Ordinance 48 No. 144-1984 to third and final reading and' read by title only, seconded 49 by Councilperson Whitesell and on unanimous voice vote the motion 50 was carried. 51 52 The Clerk read on third and final reading by title only Ordinance 53 No. 144-1984 - AN ORDINANCE AUTHORIZING THE CITY OF RICHMOND, INDIANA 54 TO ISSUE ITS ECONOMIC DEVELOPMENT REVENUE BONDS, SERIES 1984 "(J.M. 55 HUTTON AND CO. INC. PROJECT)" AND APPROVING OTHER ACTIONS IN RESPECT 5. THERETO. 5 5: Ordinance NO. 144-1984 was adopted on the following vote: 51 61 Ayes: Williams, Brookbank, Hankinson, Whitesell, Parker, Bodiker, 61 Morris and Elstro (8) 69 Nays: None 61 Absent: Lemoine (1) 26 • Common Council Minutes Cont 'd November 19, 1984 Page 4 1 ORDINANCE NO. 145-1984 2 3 The Clerk read on first reading by title only Ordinance No. 145-1985 - 4 AN ORDINANCE REGULATING AND LICENSING THE KEEPING OF DOGS; PROVIDING FOR 5 THE TAKING UP AND IMPOUNDMENT OF DOGS AND OTHER ANIMALS; QUARANTINING 6� AND DESTRUCTION OF ANIMALS; PROHIBITING CERTAIN ANIMALS WITHIN THE CITY 1 OF RICHMOND, INDIANA; AND PENALTIES FOR THE VIOLATIONS THEREOF,', 99 Ordinance No. 145-1984 was assigned to the Committee of the Whole and 11 Councilperson Williams announced that the date for the meeting would be 1 set at the first meeting of the Council in December. 1 1 Councilperson Parker asked Mr. Barden why fowl had been included in this 1 ordinance and Mr. Barden indicated that question could better be handled 1'. at the meeting of the Committee of the Whole since there were so many l: different interest involved. 1 1: Councilperson Morris asked if the Animal Welfare Shelter had ever presented 1• their budget as requested and was informed that they had not. Mr. Barden 21 stated that the Council can insist their budget be presented if set out 2 in ordinance form. 2, 2 ORDINANCES ON SECOND READING 2 2' Councilperson Whitesell moved to suspend the rules and put Ordinance No. 2' 135-1984 on the agenda on second reading, seconded by Councilperson Brookbankc 2 and on unanimous voice vote the motion was carried. 2' 2' ORDINANCE NO. 134-1984 11/ 30 3 The Clerk read on second reading Amended Appropriation Ordinance No. 3 134-1984 - AN ORDINANCE TO APPROPRIATE WITHIN THE FEDERAL REVENUE SHARING 3 TRUST FUND. 34 3' Mr. Barden examined the Proof of Publication and found it to be in order. 3; Councilperson Morris moved to accept and file the Proof of Publication, 3 seconded by Councilperson Bodiker and on unanimous voice vote the notion 3: was carried. 3° 40 President Elstro announced Ordinance No. 134-1984 was on public hearing. 4 4 Hearing no public comment Councilperson Williams moved for engrossment 4 of Ordinance No. 134-1984, seconded by Councilperson Whitesell and on 4 unanimous voice vote the motion was carried. 4 4. Councilperson Whitesell moved to suspend the rules and move Ordinance 4 No. 134-1984 to third and final reading and read by title only, seconded 4' by Councilperson Brookbank and on unanimous voice vote the motion was 4° carried. 50 5 The Clerk read on third and final reading by title only, Amended Appropriation 5 Ordinance No. 134-1984 - AN ORDINANCE TO APPROPRIATE WITHIN THE FEDERAL 5' REVENUE SHARING TRUST FUND. 5 5 Ordinance No. 134-1984 was adopted on the following vote: 50 5 Ayes: Williams, Brookbank, Hankinson, Whitesell, Parker, Bodiker, Morris 5: and Elstro. Common Council Minutes Cont 'd November 19, 1984 Page 5 1 The Clerk read on second reading Transfer Ordinance No. 135-1984 - 2 AN ORDINANCE TO TRANSFER WITHIN THE MOTOR VEHICLE HIGHWAY FUND. 3 11/ 4 President Elstro announced Ordinance No. 135-1984 was on public hearing. 5 6 Councilperson Parker asked if this transfer would cover salt and Ms. 7 Maness replied that it would cover light bills and salt. Mr. Willis 8 indicated that the Street Department uses salt, sand and calcium chloride 9 mixed to treat streets for ice and snow. 10 11 There being no further comment, Councilperson Williams moved for 12 engrossment of Ordinance No. 135-1984, seconded by Councilperson Whitesell 13 and on unanimous voice vote the motion was carried. 14 15 Councilperson Whitesell moved to suspend the rules and move Ordinance 16 No. 135-1984 to third and final reading and read by title only, seconded 17 by Councilperson Brookbank and on unanimous voice vote the motion 18 was carried. 19 20 The Clerk read on third and final reading by title only Transfer Ordinance 21 No. 135-1984 - AN ORDINANCE TO TRANSFER WITHIN THE MOTOR VEHICLE HIGHWAY 22 FUND. 23 24 Ordinance No. 135-1984 was adopted on the following vote: 25 26 Ayes: Williams, Brookbank, Hankinson, Whitesell, Parker, Bodiker, 27 Morris and Elstro. (8) 28 Nays: None 29 Absent: Lemoine (1) 30 31 ORDINANCES ON THE TABLE 32 33 ORDINANCE NO. 44-1984 34 35 Councilperson Hankinson recommended that Ordinance No. 44-1984 regarding 36 transient vendors be acted on by the Council. He stated that he noted 37 five (5) instances of violations in one day. 38 39 Councilperson Hankinson moved to take Ordinance No. 44-1984 from the 40 table and refer it to the Committee of the Whole, seconded by Councilperson 41 Bodiker and on unanimous voice vote the motion was carried. 42 43 Councilperson Williams stated he will set the meeting date for this 44 Ordinance in December. 45 46 Councilperson Morris requested that the Alarm Ordinance also be allowed 47 on the agenda and referred to the Committee of the Whole. 48 49 President Elstro welcomed the Centerville Highschool students in the 50 audience. 51 52 ADJOURNMENT 53 54 There being no further business on a motion duly made, seconded and 55 passed the meeting was adjourned. 56 57 Howard J..
