HomeMy Public PortalAbout11-05-1984 13 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, NOVEMBER 5, 1984 1 The Common Council of the City of Richmond, Indiana met in regular session 2 November 5, 1984 at the hour of 7:30 P.M. in the Council Chambers in the 3 Municipal Building in said City. President Elstro presided with the following 4 members present: Councilpersons Williams, Brookbank, Hankinson, Parker, 5 Bodiker, Lemo.ine _and Morris. Absent: Whitesell. The following business 6 was had to-wit: 7 8 PLEDGE OF ALLEGIANCE 9 10 SILENT DEVOTIONS 11 12 APPROVAL OF MINUTES OF OCTOBER 15, 1984 13 14 Councilperson Hankinson moved to approve the minutes of the previous 15 meeting as prepared, seconded by Councilperson Parker and on unanimous 16 voice vote the motion was carried. 17 18 COMMUNICATIONS FROM THE MAYOR 19 20 Mayor Waltermann told the Council that the paving of state highways through 21 the City had started November 5, 1984 and that the clean up by the Street 22 Department and Sanitary District had been going well. 23 24 Mayor Waltermann reported that William McDermott, Economic Development 25 Director was working with the Indiana Department of Commerce and that 26 Rita Stout, Purchasing Director was already saving dollars for the City and 27 was investigating past purchasing practices. 28 29 The Mayor also reported on the updating of job discriptions for all 30 city employees and welcomed the students in the audience from the 31 Centerville Government classes. 32 33 REPJORT FROM BOARD OF PUBLIC WORKS AND SAFETY 34 35 Ms. Maness reported the Board had approved the hiring of a new fire fighter 36 bringing the manpower to eighty-three (83) . She also stated that the 37 report due from Cable TV on October 25, 1985 had been extended to the 38 November 14, 1984 meeting. The Board has adopted a policy for not for 39 profit agencies to place advertising on city buses and a policy regarding 40 out of County travel in City owned vehicles. The Board also approved 41 the transfer of property with SPUR for a Richmond Power & Light substation 42 at North 17 and J Streets. Ms. Maness told the Council that the residents 43 of the 300 block of S.W. 1st Street had petitioned to become a residential 44 parking district and the Board had set the public hearing for November 21, 45 1984. 46 47 Councilperson Williams asked Ms. Maness about the number of blacks on the 48 Fire Department and if the City was hiring firefighters according to 49 qualifications regardless of race. Ms. Maness stated the City was hiring 50 by qualifications and she would get the information regarding the number 51 of blacks on the Fire Department for Councilperson Williams. 52 53 Councilperson Parker asked regarding the extension of N.W. 7th Street and 54 if it was primarily for Johns Manville truck traffic. Public Works 55 Director Ralph Willis explained that the extension of N.W. 7th Street north 56 of Richmond Avenue will accomodate the new dock area of Johns, Manville and 57 will alleviate the truck traffic on Richmond Avenue. This will also 58 correct a drainage problem in the area. 59 60 Councilperson Parker also requested Mr. Willis to invesitgate damage to 61 N.W. 9th Street to determine if it was the City or utilities. . 62 63 Councilperson Lemoine asked Ms. Maness about the status on-a stop light at 64 5th and Main Streets and Ms. Maness explained that that request had been 65 tabled for drawings of the area and to look at some long range plans, 14 Common Council Minutes Cont'_d November 5, 1984 Page 2 1 Ms. Maness also explained that currently funding prohibits any further 2 action on a stop light. 3 4 President Elstro commented on the utility cuts in the streets and if 5 something could be done to make certain that they meet the city's standards. 6 Mr. Barden stated that there was an ordinance on the agenda regarding 7 excavations in city streets and that he has sent notice to all utility 8 companies and has referred all damages to the utilities and as far as he 9 knew they were paying for damages caused by their cuts. 10 11 REPORTS FROM SPECIAL COMMITTEES 12 13 Councilperson Williams stated that he would not be calling a Committee of 14 the Whole for the Garage Sale Ordinance since he understood that this 15 ordinance would be rewritten. 16 17 REPORTS FROM STANDING COMMITTEES 18 19 Reid Hospital 20 21 Councilperson Brookbank reported that the increase in wages to hospital 22 personnel was three (3) percent and that the length of stay for patients 23 was decreasing. Councilperson Brookbank commented that the physician 24 scheduled for the Nettlecreek area would not be moving to that area now. 25 26 Enterprise Zone 27 28 Councilperson Brookbank reported that the meeting will be November 7, 1984 29 at 7:30 P.M. and that Mayor Waltermann has made two (2) new appointments 30 to the Board. Mayor Waltermann announced that he has appointed Mr. Karl 31 Kinder as the residential representative to the Board and Mr. Charles 32 Robinson as the industrial representative to the Board. 33 34 Plan Commission 35 36 Councilperson Morris told the Council that the Plan Commission would be 37 holding a work study session November 8, 1984 at 5:00 P.M. on the new 38 Ordinance defining landfills. 39 40 MISCELLANEOUS BUSINESS 41 42 President Elstro introduced Rebecca Peacemaker to make a presentation to the 43 Council on the TTY System for the hearing impaired. Ms. Peacemaker teaches 44 sign language and is currently working with the Richmond Police Department 45 instructing signing. Ms. Peacemaker told the Council that for approximately 46 300.00 the City could install a telephone system in the Police Department 47 for the deaf that will provide a paper printout. 48 49 Councilperson Bodiker asked how many people have these units in their homes 50 and are there agencies available to assist in purchasing these units for 51 deaf individuals. Ms. Peacemaker stated ther.e are charities that will assist 52 in these purchases and currently she is aware of at least three (3) couples 53 having this equipment along with the library and IUE. 54 55 Ms. Maness stated that Ms. Roberson, Compliance Officer for 504 Regulations, 56 is aware of the systems and that the City will be purchasing one to be 57 in compliance with 504 Regulations. 58 59 ORDINANCES 60 61 ORDINANCES ON FIRST READING 62 63 Councilperson Parker moved to suspend the rules and read Ordinances No. 64 133, 134, 135, 136, 137, 138, 139, 140, 141 and 142-1984 on first reading 65 15 • Common Council Minutes Cont'd November 5, 1984 Page 3 1 by title -only, seconded by Councilperson Williams and on unanimous voice 2 vote the motion was carried. 3 4 TRANSFER ORDINANCE NO. 133-1984 5 6 The Clerk read on first reading by title only Transfer Ordinance No. 133= 7 1984 - AN ORDINACE TO TRANSFER WITHIN THE OFF STREET PARKING FUND. This 8 Ordinance was sponsored by President Elstro and authored by Cathy Maness. 9 10 Councilperson Morris moved to suspend the rules and move Transfer Ordinance 11 No. 133-1984 to second reading, seconded by Councilperson Williams and. on 12 unanimous voice vote the motion was carried. 13 14 The Clerk read-on second reading by title only Transfer Ordinance No. 133- 15 1984 - AN ORDINANCE TO TRANSFER WITHIN THE OFF STREET PARKING FUND. 16 17 Councilperson Morris asked if the 'repair fundsbeing transfered into 18 payroll will cause problems and Mary Merchanthouse explained that it 19 was more important to keep personnel in the lots and that the repairs 20 would wait until 1985. 21 22 President Elstro announced that Transfer Ordinance No. 133-1984 was 23 on public hearing. 24 25 There being no public comment, Councilperson Hankinson moved for engross- 26 ment of Ordinance No. 133-1984, seconded by Councilperson Morris and 27 on unanimous voice vote the motion was carried. 28 29 Councilperson Lemoine moved to suspend the rules and move Transfer Ordinance 30 No. 133-1984 to third and final reading and read by title only, seconded 31 by Councilperson Brookbank and on unanimous voice vote the motion was 32 carried. 33 The Clerk read Transfer Ordinance No. 133-1984 on third reading. 34 Transfer Ordinance No. 133-1984 was adopted with the following vote: 35 36 Ayes : Williams, Brookbank, Hankinson, Parker, Bodiker, Lemoine, Morris 37 and Elstro (8) 38 Nays: None 39 Absent: Whitesell (1) 40 41 APPROPRIATION ORDINANCE NO. 134-1984 42 43 The Clerk read on first reading by title only Appropriation- Ordinance • 44 No. 134-1984 - AN ORDINANCE TO APPROPRIATE WITHIN THE FEDERAL REVENUE 45 SHARING TRUST FUND. This Ordinace was sponsored by President Elstro 46 and authored by Cathy Maness. 47 48 Councilperson Parker questioned this ordinance regarding setting up 49 central store for purchasing. Ms. Maness explained that this is the 50 appropriation to assist setting up central store and the reimbursements 51 from departments will be used to purchase supplies after the initial 52 purchases. Supplies will be ready to be dispensed January 1,1985 and 53 all departments will be doing their own purchasing through the end of 54 1984. • 55 56 Councilperson Bodiker asked Purchasing Director Rita Stout what supplies 57 she will be purchasing. Ms. Stout informed the Council that all 58 departments are furnishing her with lists of supplies used to assist 59 her with setting up central store and she will be stocking such items 60 as janitorial supplies, office supplies, some office equipment; etc. 61 62 Councilperson Parker stated that he hoped local merchants will be contacted 63 for quotes and that a value judgement can be made and local purchasing 64 done whenever possible. 65 - - • 16 • • Common Council Minutes Cont 'd • November 5,1984 Page 4 1 Ms. Stout stated that. she will make all possible efforts to buy locally 2 and do the job professionally. 3 4 Ms. Maness noted that a clerical error needed to be amended in Ordinance 5 No. 134-1984. The 3000-Supplies needs to read 2000-Supplies . 6 Councilperson Hankinson so moved to correct Ordinance No. 134-1984, 7 seconded by Councilperson Parker and on unanimous voice vote the motion 8 was carried. 9 10 President Elstro announced that Appropriation Ordinance no. 134-1984 needs 11 to be advertised for public hearing. 12 • 13 TRANSFER ORDINANCE NO. 135-1984 14 15 The Clerk read on first reading by title only Transfer Ordinance No. 135- 16 1984 - AN ORDINANCE TO TRANSFER WITHIN THE MOTOR VEHICLE HIGHWAY FUND. 17 18 Councilperson Morris moved to suspend the rules and move Ordinance No. 19 135-1984 to second reading, seconded by Councilperson Brookbank and on 20 a voice vote the Councilperson Hankinson voting no the motion was defeated. 21 22 TRANSFER ORDINANCE NO. 136-1984 23 24 The Clerk read on first reading by title only Transfer Ordinance No. 136- 25 1984 - AN ORDINANCE TO TRANSFER WITHIN THE GENERAL FUND. This Ordinance 26 was sponsored by President Elstro and authored by Cathy Maness . 27 28 Councilperson Williams moved to suspend the rules and move Ordinance No. . 29 136-1984 to second reading, seconded by Councilperson Brookbank and on . 30 unanimous voice vote the motion was carried. 31 32 The Clerk read on second reading by title only Transfer Ordinance No. 33 136-1984 - AN ORDINANCE TO TRANSFER WITHIN THE GENERAL FUND. 35 President Elstro announced Ordinance No. 136-1984 was on public hearing. 36 37 Mr. Barden stated that he is currently filing claims with insurance 38 companies to recover these damages to traffic lights and in the past no 39 claims had been filed. 40 41 Ms. Maness stated that she has already paid Richmond Power & Light 10,000.00 42 in back repair bills for seven years (7) of damages and that this transfer 43 within the Police Department for 500.00 should cover the remainder of 44 the year. 45 46 Councilperson Hankinson moved for engrossment of Ordinance no. 136-1984, 47 seconded by Councilperson Williams and on unanimous voice vote the motion 48 was carried. 49 50 Councilperson Williams moved to suspend the rules and move Ordiannce No. 51 136-1984, to third and final reading and read by title only, seconded by 52 Councilperson Hankinson and on unanimous voice vote the motion was carried. 53 54 The Clerk read on third and final reading by title only Ordinance No. 55 136-1984 - AN ORDINANCE TO TRANSFER WITHIN THE GENERAL FUND. 56 57 Transfer Ordinance No. 136-1984 was adopted on the following vote: 58 59 Ayes: Williams, Brookbank, Hankinson, Parker, Bodiker, Lemoine, Morris 60 and Elstro (9) 61 Nays: None 62 Absent: Whitesell (9) 63 64 65 17 • Common Council Minutes Cont'd November 5, 1984 Page 5 • 1 TRANSFER ORDINANCE NO. 137-1984 2 3 The Clerk read on first reading by title only Ordinance No. 137-1984- [{ AN ORDINANCE TO TRANSFER WITHIN THE PARK 'FUND. - 5 6 Councilperson Morris moved to suspend the rules and move Ordinance 7 No. 137-1984 to second reading; seconded by Councilperson Parker and 8 on unanimous voice vote the motion was carried. 9 10 The Clerk read on second reading by title only Transfer Ordinance No. 11 137-1984 - AN ORDINANCE TO TRANSFER WITHIN THE PARK FUND. 12 13 Ms. Maness noted a clerical error that needed to be amended. Under 14 Amount Requested 3000-Other Services and Charges the amount should . 15 be 6,500.00. Common Council Minutes Cont 'd November 5, 1984 Page 7 1 ORDINANCE NO. 142-1984 2 3 The Clerk read on first reading by title only Ordinance No. 142-1984- 4 AN ORDINANCE PROHIBITING THE OBSTRUCTION OF VIEW ALONG STREETS AND 5 HIGHWAYS WITHIN THE CITY OF RICHMOND, PROVIDING FORTHE MAINTENANCE 6 AND TRIMMING OF HEDGES AND LIVE FENCES AND PROVIDING A MEANS FOR RECOVERY 7 OF EXPENSES OF CUTTING OR TRIMMING. 8 9 Ordiance No. 142-1984 will have to be advertised for a public hearing. 10 11 Councilperson Bodiker moved to assign Ordinance No. 142-1984 to the 12 Parks & Recreation, Public Safety and Public Works and Safety of the 13 Common Council for consideration and recommendation, seconded by 14 Councilperson Hankinson and on unanimous Voice vote the motion was 15 carried. 16 17 That committee consists of Councilpersons Bodiker, Williams, Brookbank 18 and Parker. • 19 20 ORDINANCES ON SECOND READING 21 22 ORDINANCE NO. 124-1984 23 24 The Clerk read on second reading Ordinance No. 124-1984 - AN ORDINANCE 25 TO APPROPRIATE WITHIN THE AIRPORT FUND. 26 27 Mr. Barden examined the Proof of Publication and found it to be in 28 order. Councilperson Parker moved to accept and file the proof of 29 publication, seconded by Councilperson Hankinson and on unanimous voice 30 vote the motion was carried. 31 32 President Elstro announced-Ordinance No. 124-1984 was on public -hearing. 33 34 Hearing no comment Councilperson Hankinson moved for engrossment of 35 Ordinance No. 124-1984, seconded by Councilperson Lemoine and on 36 unanimous voice vote the motion was carried. 37 38 Councilperson Williams moved to suspend the rides and moved Ordinance 39 No. 124-1984 to third and final reading and read by title only, seconded 40 by Councilperson Hankinson and on unanimous voice vote the motion was 41 carried. 42 43 The Clerk read on third and final reading by title only Ordinance No. 44 124-1984 - AN ORDINANCE TO APPROPRIATE WITHIN THE AIRPORT FUND. 45 • 46 Ordinance No. 124-1984 was adopted by the following vote: 47 - 48 Ayes: Williams, Brookbank, Hankinson, Parker, Bodiker, Lemoine, Morris 49 and Elstro (8) 50 Nays: None 51 Absent: Whitesell 52 53 ORDINANCE NO. 126-1984 54 55. Mr.' Barden asked the assistance of the press to inform 20 citizens that he will need specific information on offenders and will 21 need this information verified before he can act on complaints. 22 Mr. Barden also stated that the litter ordinance can be used to assist 23 in the posting of signs, etc. 24 25 UNFINISHED BUSINESS 26 27 Councilperson Bodiker stated that a committee meeting would be held 28 on Ordinance No. 142-1984 in the Council Office on November 12,1984 29 at 7:00 P.M. 30 - 31 President Elstro presented the Disclosure Statement of Councilperson 32 Brookbank regarding a vehicle leased from Tom Brookbank Chevrolet for 33 the Economic Development Director. 34 35 Esther Kellner told the Council that Garage Sales were a value to the 36 community. 37 38 ADJOURNMENT 39 40 There being no further business on a motion duly made, seconded and 41 passed the meeting was adjourned. 42 43 Howard J.
