HomeMy Public PortalAbout08-20-1984 PROCEEDINGS OF THE COMMON .COUNCIL OF THE CITY OF RICHMOND, INDIANA, AUGUST 20, 1984 1 The Common Council of the .City of Richmond, Indiana, met in regular session 2 August 20, 1984, at the hour of 7:30 p.m.. in the Council Chambers in the 3 Municipal Building in said City. President Elstro presided with:: the 4 following members present: Councilpersons Williams, Brookbank, Hankinson, 5 Whitesell, Bodiker, Lemoine.and Morris. Absent: Parker. The following 6 b isiness was had to-wit: 7 ' 8 PLEDGE OF ALLEGIANCE 9 10 SILENT DEVOTIONS 11 12 APPROVAL OF MINUTES OF AUGUST 6, 1984 13 14 Councilperson Morris moved to correct the minutes with the following 15 additions:.. Page 8, line 51 - add the name of Hankinson to the voting 16 record and Page 8, line 63 - add the name of Morris to the voting record, 17 seconded by Councilperson Hankinson and on unanimous voice vote the motion 18 was carried. 19 20 Councilperson Hankinson moved to approve the minutes of the previous meeting 21 as corrected, seconded by Councilperson Brookbank and on unanimous voice 22 vote the motion was carried. 23 24 COMMUNICATIONS FROM THE MAYOR 25 26 Mayor Frank Waltermann read a response from Farmhand to a letter he had sent 27 them regarding their closing their local plant. The letter stated that the 28 decisionsto close the Richmond plant were business decisions such as 29 proximity to main market, physical capabilities of the factory to produce the 30 entire product line and proximity to the home office and financial 31 institutions that serve them. . 32 33 Mayor Waltermann told the members of Council about an electronic gas pump 34 to dispense gas and that the Leland project is 95 to 99% assured that the 35 project will go ahead. - 36 37 The Mayor also commented on interviews for the Purchasing Director and a 38 trip to Camp Grayling, Michigan to see our local National Guard in action. 39 L0 PRESENTATION OF REMONSTRANCES, PETITIONS AND MEMORIALS 41 42 South J Street Residents. . 43 44 Councilperson Morris presented a petition from the residents of South J Street 45 from 15th to 16th Street regarding limiting parking to the South side of 46 the street in this area due to a visibility problem. 47 48 Police Officer Dale Sharits stated that on his walking patrol he found this 49 area to be very dangerous and there are a .lot of school children. involved. 50 51 President Elstro requested the Board of Works to consider this request from 52 the residents of J Street. 53 . • . 54 Residents and Businesses of South 9th Street 55 56 Mrs. Robert Sizemore presented a petition to the Council from the residents 57 and business owners. on South 9th Street regarding the railroad bridge that 58 is closed for repairs. .This has caused a hardship on the residents and 59 businesses of the area trying to get to and from their locations. 60 . .. 61 Mr. Barden explained•'that the Railroad is responsible for the cost of 62 maintenance and repair on this bridge and they have indicated that the bridge 63 needs replaced and the cost would be in the hundreds of thousands of dollars. 64 With US 27 running parallel this is low priority and will probably be next 65 . nl 58 Common Council Minutes Cont'd August 20, 1984 Page 2 1 spring before anything will be done on the bridge. Mr. Barden and Mr. Willis 2 will follow up on the problem with this bridge. 3 4 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY 5 6 Ms•. Maness stated that the Board of Works held a special meeting to approve 7 the amendments to the Firefighters Contract with Local 1408. These 8 are subject to approval by the Council and there will be an ordinance offered 9 in September for Council consideration. 10 11 Ms. Maness also noted that the Board of Works had set a date to receive bids 12 for the construction of N.W. 7th Street, established fares for the Rose • 13 View Transit System and set a bid date for removal of street trees for 14 salvage rights. 15 16 ' MISCELLANEOUS BUSINESS 17 _ 18 President Elstro suggested that a meeting be set up with the Prime 19 Contractor on the South L Street Project to see were the project stands. 20 21 Ms. Maness suggested a representative from the State also be invited. 22 23 Mayor Waltermann stated that the contractor has so many working days to 24 finish the project and the completion date was November, 1984. Weather 25 effects the working days if the contractor is unable to perform work on 26 a bad day. 11/ 27 28 _ Councilperson Brookbank told the. Council that the residents of the 29 Reeveston area were having a meeting regarding Cable TV service being 30 installed in their area. 31 32 Councilperson Williams commented on the condition of the Main Street 33 Bridge and asked if the State could be notified about the condition of the 34 Bridge. 35 36 Councilperson Bodiker stated that the State had checked the condition of 37 the bridge earlier this year and decided it was structurally sound and 38 the resurfacing is. the responsibility of the State. 39 _ 40 RESOLUTIONS 41 42 Councilperson Morris moved to suspend the rules and read Resolutions No. L3 23 and 24-1984 by title only, seconded by Councilperson Williams and on 44 unanimous voice vote the motion was carried. 45 46 RESOLUTION NO. 23-1984 ... . . . 47 48 The Clerk read by title only Resolution No. 23-1984 - A RESOLUTION OF THE CITY 49 OF RICHMOND TO INDUCE J.M. HUTTON & COMPANY, INC. , AN INDIANA CORPORATION, 50 TO ACQUIRE, CONSTRUCT AND EQUIP AN ECONOMIC DEVELOPMENT FACILITY AND TO 51 UNDERTAKE TO SELL REVENUE BONDS TO PAY THE COSTS THEREOF, AND OTHER MATTERS 52 RELATING THERETO. . 53 54 President Elstro announced that Resolution No. 23-1984 was on public hearing. 55 56 Speaking for Resolution No. 23-1984. was Kent Klinge, Attorney at Law, 57 representing J.M. Hutton & Company, Ind. Mr. Klinge stated that J.M. 58 Hutton Company was undertaking to sell 1,000,000.00 in Industrial Revenue 59 Bonds for the acquisition, remodeling and equipping of the Wallace Metal 60 Products Building at 1501 South 8th .Street. This facility will be an 61 expansion of their existing business with an addition of 25 immediate jobs • 62 and 65 jobs within the first year. Mr. Klinge reminded the Council that 63 Revenue Bonds are not a burden to the taxpayers and that the Economic 64 Development Commission had ruled that this bond issue has no adverse 65 competitive effect on sithilar facilities already operating. • 561 Common Council Minutes Cont'd • • August 20, 1984 Page 3 • • 1 Also speaking for Resolution No.. 23-1984 was Mr. Richard Jeffers of 217 . 2 North West 10th Street. Mr. Jeffers is the President of J.M. Hutton 3 . Company and.stated that this facility will be used immediately to bolpSe'.. the • 4 stamping business and that the 25 jobs will be created within thirty (3.0) - 5 days of occupying the facility. . 6 . 7 There being no further public comment, Councilperson Williams moved for 8 adoption of Resolution No. 23-1984, seconded by.• Councilperson Brookbank and • 9 on unanimous voice vote the motion was .carried. . 10 . . . 11 RESOLUTION NO. 24-1984 12 • 13 The Clerk read by title only Resolution' No. 24-1984 -. A RESOLUTION • 14 AUTHORIZING AN APPEAL TO THE STATE BOARD OF TAX COMMISSIONERS FOR RELIEF. 15 FROM PROPERTY TAX .LEVY LIMITATIONS. 16 . 17 Speaking for Resolution No. 24-1984, Cathy Maness stated that she must have 18 this document on file for her to appeal for relief on the tax levy 19 :limitations. There was 18,000.00 lost due to decline in assessed valuations 20 and the relief provisions will allow the City to make this up in 1985. 21 22 Councilperson Morris moved for adoption of Resolution No.• 24-1984, seconded 23 by Councilperson•Brookbank and. on unanimous voice vote the motion was carried • 24 . 25 ORDINANCES • 26 . . . . • 27 ORDINANCES ON FIRST READING 28 . 29 Councilperson Morris moved to suspend 'the rules and read Ordinances No. 30 92, 93, 94, 95, 96,97, and 98-1984 on first reading by title only, seconded 31 by Councilperson Bodiker and on unanimous voice vote the motion was carried. 32 . 33 ORDINANCE NO. 92-1984 34 35 The Clerk read on first reading by. .title only Ordinance No. 92-1984 - AN 36 ORDINANCE TO TRANSFER WITHIN THE PARK FUND. 37 - 38 Ms. Maness explained that 'this Ordinance transfers 10,500.00 from 39 Personal Services to Other Services and Charges' in order for Don McBride 40 and Dominic, Mitrione to get ` consultants fees since they are no longer 41 salaried employees. 42 43 Councilperson Whitesell moved to. suspend the rules and move Ordinance No. . OF ALARM EQUIPMENT. 60 , • • 61 President Elstro announced Ordinance No. 81-1984 was on public hearing. 62 . 63 Speaking for Ordinance No. 81-1984 was Dale Sharits a member of the Richmond 64 Police Department. Mr. Sharits stated that the 'money issue in this 65 Ordinance has clouded the issue and- the major problem needing to be addressed 6 Common Council Minutes Cont'd August 20, 1984 Page 6 • 1 is the abuse of the alarms. There were 118 alarms in December of 1983 2 and only five (5) were real alarms with reports being made. To respond to 3 an alarm takes 2.6 officers and a time of 26 minutes per alarm. 4 5 Councilperson Hankinson asked if there was a reason for the alarm such as 6 carelessness or malfunction. 7 8 Mr. Sharits commented that several were employee error and the police has no 9 means to take action other than notifying the company that a false alarm 10 was turned in. Something needs to done to give the police the ability and 11 power to control these false alarms. 12 13 Councilperson Morris stated that the longevity pay issue included in 14 Ordinance No. 81-1984 is confusing the issue and she presented the Council 15 a copy of an Ordinance from the City of Columbus regarding the control of 16 alarms and asked for their review and comment before the next Council . 17 meeting. 18 • 19 Councilperson Morris moved to strike Ordinance No. 81-1984, seconded by 20 Councilperson Lemoine and on unanimous voice vote the motion to strike 21 was carried. 22 23 ORDINANCE NO. 89-1984 24 25 The Clerk read on .second reading Ordinance No. 89-1984 - AN ORDINANCE TO 26 APPROPRIATE FROM THE FEDERAL REVENUE SHARING TRUST FUND. 27 28 Mr. Barden examined the Proof of Publication and found it to be in order. 29 Councilperson Whitesell moved to accept and file the Proof of Publication, 30 seconded by Councilperson Hankinson and on unanimous voice vote the motion 31 was carried. 32 33 President Elstro announced Ordinance No. 89-1984 was on public hearing. 34 35 In response to a question from Councilperson Hankinson it was explained 36 this was to purchase a street sweeper. 37 - 38 Councilperson Hankinson moved for engrossment of Ordinance No. 89-1984, 39 seconded by Councilperson Whitesell and on unanimous voice vote the motion 40 was carried. 41 42 Councilperson Whitesell moved to suspend the rules and to moved Ordinance No. 43 89-1984 to third and final reading and to read by title only, seconded by 44 Councilperson Williams and on unanimous voice vote the motion was carried. 45 The Clerk read Ordinance No. 89-1984 on third and final reading by title only. 46 Ordinance No. 89-1984 was adopted with the following vote: 47 48 Ayes: Williams, Brookbank, Hankinson, Whitesell, Bodiker, Lemoine, Morris 49 and Elstro (8) 50 Nays: (0) 51 Absent: (1) . 52 53 ORDINANCES ON THIRD READING 54 55 Councilperson Whitesell moved to suspend the rules and read Ordinances No. 56 82 and 83-1984 on third by title only; seconded by Councilperson Morris and 57 on unanimous voice vote the motion was carried. 58 59 ORDINANCE NO. 82-1984 60 61 The Clerk read on third and final reading by title only Ordinance No. 82-1984 - 62 AN ORDINANCE FOR APPROPRIATIONS AND TAX RATES. 63 64 65 6 Common Council Minutes Cont'd August 20, 1984 Page 7 1 Ms. Maness told the Council that a total of 494,000.00 had been cut by the 2 Council .from the budget at their August 6, 1984 meeting for a total of 3 .27 from the tax rate. The 1985 budget is still 591,000.00 over the levy. 4 Ms. Maness stated that they anticipate another 100,000.00 being cut from 5 this through the savings in 1984 from the police and fire pension.budgets. . 6 Ms. Maness suggested that the remaining 491,000.00 could be cut from the 7 Street Light Budget and this could be taken from the Revenue Sharing Fund. 8 9 In response to a question from Councilperson Morris regarding the County 10 participation in the Weights and Measures budget, Ms: Maness explained the 11• County is only funding one third (1/3) of the salary for this Department. 12 13 Ordinance No. 82-1984 was adopted with the following vote: 14 15 Ayes: Williams, Brookbank, Whitesell, Bodiker, Lemoine and Morris (6) 16 Nays: Hankinson and Elstro (2) 17 Absent: (1) 18 19 ORDINANCE NO. 83-1984 20 21 The Clerk read on third and final reading by title only Ordinance No. 83-1984- 22 AN ORDINANCE AMENDING SECTION 92.03 OF THE RICHMOND CITY CODE. 23 24 Ordinance No. 83-1984 was adopted with the following vote: 25 • 26 Ayes: Williams, Brookbank, Hankinson, Whitesell,.
