President Elstro presided with the following members 41 present: Councilpersons: Williams, Brookbank, Hankinson, Whitesell, Parker, 1 Bodiker, Lemoine and-Morris. Absent: none. The following business was had to-wit: qPLEDGE OF ALLEGIANCE 9 10 SILENT DEVOTIONS 111 121 APPROVAL OF MINUTES OF JULY 16, 1984 13 11 Councilperson Hankinson moved to approve the minutes of the previous meeting 1 as prepared, seconded by Councilperson Brookbank and on usanimous voice vote 16 the motion was carried. 11 18 COMMUNICATIONS FROM THE MAYOR 191 20 Mayor Frank Waltermann told the Council that he had attended the midwest_ meet- 21 ing of the JAPTA in Chicago and had represented the State of Indiana at this 22 meeting. 23 21 The Mayor stated that the City is sweeping the streets ahead of the paving 25 crews:to ready the streets for paving and that the City had a contract with III 26 the State to sweep these streets. 27�28 REPORTS FROM SPECIAL COMMITTEES 21 30 Reid Hospital;. 31 32 Councilperson Brookbank reported that a Dr.. Campbell had been hired for the 33 Nettle Creek Clinic and that Reid Hospital has hired three full time emergency 34 room physicians. 35 36 Enterprise Zone 37I38 Councilperson Brookbank reminded the Council and public that the Enterprise 31 Zone meeting will be August 8, 1984 at 7:30 P.M. 40 41 MISCELLANEOUS BUSINESS 42 43 Appointment to Economic Development Coilaliission L 45 President Elstro announced that the Council needs to make an appointment to 46 the Economic Development Commission to replace Bruce Keith who has moved from 47 the City. Mayor Waltermann stated that Mr. George Bergeron of Alcoa has ex- 48 pressed an interested in serving on this Conaiiission. 49 50 Councilperson Hankinson moved to appoint Mr. George Bergeron as the Council 51 representative to the Economic Development Commission, seconded by Council- 52 person Whitesell and on unanimous voice vote the motion was carried. 53 5 Town Meeting - District 3 55 56 Councilperson Brookbank reminded the Council and the public that she will be 57 holding a Town Meeting for District 3 at the SWAC, 306 South 10th on August 58 8, 1984 at 7:00 P.M. All Citizens are invited. 59 60 RESOLUTIONS 61 62 Councilperson Morris moved to suspend the rules and add Resolution No. 22-1984 63 to the Agenda, seconded by Councilperson Lemoine and on unanimous voice vote 64 the motion was carried. 65 common Council Minutes Cont'd August 6, 1984 Page 2 1 Councilperson Bodiker moved to suspend the rules and read Resolution No. 21 2 and 22-1984 by title only, seconded by Councilperson Morris and on unanimous 3 voice vote the motion was carried. 4 5 RESOLUTION NO. 21-1984 6 7 The Clerk read by title only Resolution No. 21-1984 - A RESOLUTION AUTHORIZING 8 THE FILING OF AN OPERATING ASSISTANCE GRANT AND A CAPITAL ASSISTANCE GRANT 9 UNDER SECTION 18 OF THE URBAN MASS TRANSPORTATION ACT OF 1964, AS AMENDED. 10 11 Councilperson Whiteselil requested permission from the Council to abstain from 12 voting on this Resolution and reminded the Council that he has filed a Dis- 13 closure Statement regarding his employment with Wayne Division. 14 15 On a voice vote with Councilperson Hankinson voting no, Councilperson White- 16 sell was granted permission to abstain from voting on Resolution No. 21-1984. 17 18 Dan Dooley, Supervisor of the Planning & Economic Development Department ex- 19 plained that this Resolution authorizes the filing of two (2) grant applicat- 20 ions for operating assistance and capital equipment for the Rose View Transit 21 System. The Capital equipment grant will assist in purchasing new buses and 22 other equipment. The Resolution also authorizes execution of contracts dealing 23 with-- the grants. 24 25 Councilperson Hankinson moved for adoption of Resolution No. 21-1984, seconded 26 by Councilperson Williams and on a voice vote with Councilperson Whitesell 27 abstaining the motion was carried. 28 29 RESOLUTION NO. 22-1984 30 31 The Clerk read by title only Resolution No. 22-1984 - A RESOLUTION REQUESTING 32 THE STATE HIGHWAY COMMISSION TO RECONSIDER ITS PROPOSAL TO WIDEN EAST MAIN 33 STREET. 34 35 Councilperson Morris explained that this Resolution was requesting the State 36 Highway Commission to reconsider widening East Main Street from 16th Street 37 to Sycamore Drive and to begin the project at 30th Street and continue to 38 Sycamore Drvie to prevent a five (5) lane situation from 16th Street to 30th 39 Street. This Resolution also requests that the 16th Street intersection be 40 corrected and the 18th Street intersection be widened for better turning. 41 42 Councilperson Hankinson couuuented that this would save the trees along this 43 street and would also save money and if the street needs widened at a later 44 date from 16th to 30th this can be done. 45 46 Councilperson Bodiker stated that he feels there are many citizens in this 47 community with negatvie feelings about widening the street form 16th to 30th 48 Street. 49 50 Councilperson Hankinson moved for adoption of Resolution No. 22-1984, seconded 51 by Councilperson Brookbank and on unanimous voice vote the motion was carried . 52 53 ORDINANCES 54 55 ORDINANCES ON FIRST READING 56 57 Councilperson Hankinson moved to suspend the rules and read Ordinances No. 58 85, 86, 87, 88, 89 and 90-1984 by title only, seconded by Councilperson 59 Williams and on unanimous voice vote the motion was carried. 60 61 ORDINANCE NO. 85-1984 62 63 The Clerk read on first reading by title only Ordinance No. 85-1984-AN ORDI A CE 64 TO REDUCE WITHIN THE MOTOR VEHICLE HIGHWAY FUND. 65 - Common Council Minutes Cont'd August 6, 1984 Page 3 1 Councilperson Whitesell mvoed to suspend the rules and to move Ordinance NO. 2 85-1984 to second reading, seconded by Councilperson Hankinson and on unanimou 3 voice vote the motion was carried. 3 The Clerk read on second reading Ordinance No. 85-1984 - AN ORDINANCE TO.REDUC 0 WITHIN THE MOTOR VEHICLE HIGHWAY FUND. 8 President Elstro announced that Ordinance No. 85-1984 was on public hearing. 9 10 Speaking for Ordinance NO. 85-1984 was Cathy Maness. Ms. Maness explained this 11 Ordinance is to correct an error made at the State level on an overestimation 12 of revenue and the Motor Vehicle Highway Fund wiTh be 23,000.00 short and they 13 are not allowed to end the year in a deficit account. Ms. Maness stated that 48 Ordinances 86 and 87 were the same in theory and she would explain both 44. ordinances. Funds are provided to cover all persons eligible for retirement, 5d but not all eligible retire. Category of 18,000.00 and the Fire Department Personal Services Cat- 29 egory of 15,000.00. Mr. James stated that the does not oppose longev- 18 ity pay, but the method of fundign the pay through service charges and the 19 lack of thought given to the ordinance as a whole. Mr. James stated that this 20 ordinance effects hundreds of merchants having to own security systems to 21 protect their businesses and that there is only a small core of alarm owners 22 abusing these systems. The problem should be addressed by controlling the 23 abusers of the alarm systems not penalizing all alarm owners. 24 25 Councilperson Williams stated that the longevity pay should be on the tax 26 rolls and not funded by the collection of service charges. 27 28 This Ordinance will return on second reading on August 20, 1984. 29 30 ORDINANCE NO. 82-1984 31 32 The Clerk read on second reading by title only Ordinance No. 82-1984 - AN 33 ORDINANCE FOR APPROPRIATIONS AND TAX RATES. 34 35 In response to a question from Councilperson Lemoine Ms. Maness explained 36 that cuts suggested in 4000-Capital Outlay Accounts were items on which a 37 needs study could be done and the items prioitized for Revenue Sharing or 38 Cumulative Development funds, specifically the motor equipment. (9) 21 22 Fire Cheif Bosell told the Council that the Instructional Account includes 23 payment for travel and meals which has not been included this year. It will 24 also include National Fire Academy costs. The instructional fees will also 25 pay towards a degree in Fire Science at accredited universities. 26 27 Councilperson Brookbank moved to reduce account 3981 - Other Admin. Expenses 28 from 500.00 to 200.00, seconded by Councilperson Bodiker and on unanimous 29 voice vote the motion was carried. 30 31 Councilperson Brookbank moved to zero out account 4420 - Furniture & Fixtures 32 for 2,000.00, seconded by Councilperson Lemoine and on a voice vote with 33 Councilperson Bodiker and Williams voting no the motion was carried. 34 35 Ms. Maness stated that the Social Security Account will be reduced 385.00 and 36 the PERF will be redcued to 330.00 due to the cut in the Secretary category. 37 38 Street department 39 40 Councilperson bodiker moved to reduce account 1302 - Overtime from 50,000.00 41 to 40,000.00. The motion was seconded by Councilperson Parker. 42 43 Street Supervisor Bill Hillard told the Council that the Overtime account is 44 used for snow and leaf removal. The Street Department has only 27 emoloyees 45 and is open 24 hours a day, 7 days a week and they operate three (3) working 46 shifts. 47 48 On a roll call vote the motion was defeated. 49 50 Ayes: Whitesell, Parker, Bodiker and Morris (4) 51 Nays: Williams, Brookbank, Lemoine and Elstro (5) 52 53 Councilperson Bodiker moved to reduce account 1351 - Laundry from 9,000.00 54 to 8,000.00. The code is ambiguous regarding whether 4 the Fire Chief or the Fire Marshall is the head of the Fire Prevention Bureau. 5 This ordinance will clean up the language of the code, the Fire Marshall will 6 be under the dictates of the Fire Chief and the Board of Works and the Fire 7 Chief will have more latitude to run that department. 8 9 President Elstro announced that Ordinance No. 83-1984 was on public hearing. 10 11 Speaking for Ordinance No. 83-1984 was Fire Chief Bosell. He stated that this 12 ordinance will clear up the language regarding the Fire Marshall and current- 13 ly there is no classification as Fire Marshall, the Assistant Chief carries 14 the powers of Fire Marshall. 15 16 In response to a question from Councilperson Brookbank, Mr. Barden replied 17 that the top two policy making positions are subject to political removal. 18 19 Speaking against Ordinance No. 83-1984 was William Smith, 117 S.W. 10th 20 Street. Mr. Smith is the former Fire Marshall and stated the ordinance as it 21 now exists was to take politics out of public safety and make the head of the 22 Fire Prevention Bureau non-political. He stated that in the last 25 years 23 there have been nine (9) Fire Chiefs and only three (3) Fire Marshalls plus 24 himself. 25 26 Dave Harbin of 1407 Woodland Trail and a member of the Pension Coiiuuittee for 27 the Firefighters stated that I.C. 36-8-1-12 defines that the top two (2) 28 pay grades regardless of the title are political. 2911/ 30 Councilperson Hankinson requested that Ordinance No. 83-1984 be returned to 31 the agenda on third reading on August 20, 1984 and no further action be taken 32 on this Ordinance tonight.
