PROCEEDINGS OF THE COMMON COUNCIL OF THE
CITY OF RICHMOND, INDIANA, JULY 2, 1984
1 The Common Council of the City of Richmond, Indiana, met in regular session
2 July 2, 1984, at the hour of 7:30 p.m. in the Council Chambers of the Munici-
3 pal Building in said City. President Elstro presided with the following mem-
bers present: Councilpersons Williams, Hankinson, Whitesell, Parker, Bodiker
5 Lemoine and Morris. Absent: Councilperson Brookbank. The following business
6 was had to-wit:

1 Councilperson Hankinson moved to approve the minutes of the previous meeting
15 as prepared, seconded by Councilperson Williams and on unanumous voice vote
16 the motion was carried.

18 COMMUNICATIONS FROM THE MAYOR

20 Mayor Frank H. Waltermann told the council that his office has sent 400 in-
21 vitations to Red Carpet Days to businesses in the surrounding areas for an
22 inspection of the City to create interest for their expansion into the City.
23 The Mayor stated he had met with a company looking at Richmond as a location
2 and that the company would be a major employer.

26 Mayor Waltermann announced that the Economic Growth and Development Board had
27 made an offer to Bill McDermott to become the Economic Development Director
28 for the City.

30 The Mayor commented on the Rose Festival Activities and the fact that he is
31 asking his departments involved to make an evaluation of their time spent on
32 Rose Festival Activities.

3 The Mayor also stated that the survey for the bus lines indicated there could
35 be some loss of UMPTA funding unless changes are made. The Mayor would like
36 to include the Transportation Committee from Council on any decisions made
37 on the operations of the bus line.

39 PRESENTATION OF PETITIONS, MEMORIALS AND REMONSTRANCES

41 Councilperson Hankinson presented a petition for one (1) street light from
42 residents of Cedar Cliff and Timberview Drive.

4 REPORTS FROM SPECIAL COMMITTEES

48 Councilperson Morris announced that the Plan Commission would be meeting
49 July 10, 1984 at 7:30 P.M. to consider matters not properly advertised for
50 the June public hearing.

52 President Elstro reminded the Council that the State of Indiana Department
53 of Highways had set August 2, 1984 at 7:30 P.M. for the public hearing on11/
5z the extension of East Main Street.

56 President Elstro also reminded the Council of the Committee of the Whole
57 Meeting on July 9, 1984 at 7:00 p.m. in the Board of Works Room to discuss
58 the residential parking permits and longevity pay and fees for the Police
59 Department.

8 Controller Cathy Maness explained that this Ordinance established the salaries
9 for the Economic Growth and Development Department. The Department was estab-
10 lished in the original salary ordinance, but the salaries were not set forth.
11 Funds have been appropriated for the salaries and in order for the Tax Commiss-
12 Toners to approve the additional appropriation the original salary ordinance
13 must be amended to include these additional salaries.

15 Councilperson Hankinson moved to suspend the rules and move Ordinance No. 78-
16 1984 to second reading, seconded by Councilperson Morris and on unanimous
17 voice vote the motion was carried.

24 President Elstro announced Ordinance No. 78-1984 was on public hearing.

26 Councilperson Morris asked since this is funding for six (6) months has the
27 person accepted the job as Economic Development Director and is there a
28 starting date for employment. Mayor Waltermann stated that the 25,000.00
29 is a maximum dollar amount for the six months and they are in negotiations
30 presently with Mr. McDermott and the total 25,000.00 does not have to be paid
31 for his job. The pay is negotiable and Mayor Waltermann stated he is looking
32 at the end of August before the job will start.

34 Gertrude Ward of PO Box 13, Centerville, Indiana spoke to the Council regard-
35 ing the Historic Development Funds that are to be placed in the Economic
36 Growth and Development Fund and hoped the Economic Development Director will
37 be sympathetic to using these funds for their original intent.

19 ED TO THE FUNDING OF LONGEVITY PAY OF SUCH POLICE OFFICERS OF THE CITY OF
20 RICHMOND, INDIANA: AND PROHIBITING THE USE OF CERTAIN TYPES OF ALARM EQUIP-
21 MENT.

23 Councilperson Morris stated that there are some items left out of the
24 original Ordinance that were arrived at by the negotiating team. Councilperson
25, Morris offered the following amendments to Ordiannce No. 81-1984:

27 Add the following paragraphs to Section 1. Section 1.3 - NON-EMERGENCY ENTR-
28 ANCE ASSISTANCE CALLS - Ten Dollars ($10.00) per call to assist in the openin:
29 of locked vehicles or residences. Hold harmless agreements shall be required
30 of the caller before assistance will be given. Section 1.4 - FUNERAL ESCORT
31i SERVICE- Twenty-five Dollars ($25.00) per escort. Escorts by City police
32 officers shall be limited to within a two-mile radius of the City corporate
33 boundaries. Section 1.5 - NON-LAW ENFORCEMENT FINGERPRINTING - Ten Dollars
3 ($10.00) per set of fingerprints, unless such service is already incorporat-
35 ed into a fee provision set by state statute or City Ordinance, and by amend-
36 ing the second sentence in Section 4 provide to read as follows: "The
37 Police Department shall bill such service charges and shall provide copies
38 of such bills to the Offices of the City Clerk and City Controller. The
39 Office of the City Clerk shall collect such service charges, post the pay-
40 ments to an open file of unpaid bills, and shall remit the collections to
41 the City Controller's Office."

43 Councilperson Lemoine seconded the motion to amend Ordinance No. 81-1984.
45 After discussion regarding acting on the amendments or holding them for fur •

46 ther discussion, it was decided that since they were inadvertently left out
47 of the original ordinance they need to be added to discuss the ordinance as
48 a whole.

50 Councilperson Bodiker noted that the portion on funeral escorts would be
51 costly to some people.

7 of the Whole.

22 A letter was presented from the Plan Commission requesting this Ordinance be

25 Dear Mr. Elstro, members of Common Council and Mrs. Merchanthouse:III ,

27 The Richmond City Plan Commission conducted a public hearing on Tuesday,
28 June 26, 1984, on the petition of Carolyn Faye Clay, Greenville,Ohio,
29 owners; Victor Bartlemay, Agent, requesting a rezoning from R-3 to R-3 SU
30 and also requesting Special Use Authorization to establish a manufacturer
31 representative office at 2826 East Main Street.

33 Mr. Bartlemay submitted a letter to the Plan Commission requesting that
34 the petition be withdrawn.
35
36 Therefore, the Plan Commission voted eight (8) to zero (0) to recommend
37 that Ordinance No. 5-1984 be striken.

53 President Elstro announced Ordinance No. 67-1984 was on public hearing.

55 Speaking for Ordinance No. 67-1984 was Mr. Roger Casey, owner of the property.
56 Mr. Casey has two (2) rentals in the building and would be using two (2) rooms
57 of the rental on the lower level to open a Consulting Firm. He stated there
58 would be no structural changes to the property and there would be parking fur-
59 nished in the rear of the lot with the alley used as the entrance and exit.
60 Mr. Casey told the Council that very few clients would be coming into the offi e
61 since he would be going to the clients and that he and a secretary would
62 probably be all the traffic involved.

64 Speaking against Ordinance No. 67-1984 was Ms. Georgana Beemer of 115 North
65 15th Street. Ms. Beemer expressed concern with drainage from the back of the

1 lot and also with the additional traffic and litter since the physician's
2 office located on North 15th already causes a great deal of traffic. Ms. Beemer
3 told the Council that she was not notified by the Planning department of the
4 Public Hearing as an adjacent property owner.

6 Mr. Dooley verified that Ms. Beemer has not been notified since her name was
7 left off the list of property owners to be notified. Mr. Dooley stated that
8 letters are mailed by first class mail to adjoining property owners and persons
9 affected in the immediate area. It was suggested to Mr. Dooley to avoid this
10 oversight in the future that he might send the letters by certified mail or
11 hand deliver these notices.

13 Also speaking against Ordinance No. 67-1984 was Mr. Clarence Dixon, Jr. of
14 116 North 16th Street. Mr. Dixon expressed his concern of the parking in the
15 rear of the facility and the effect this would have on an area where children
16 play.
17
18 A letter was also read from Mr. George Hunter at 203 North 15th Street in
19 opposition to Ordinance No. 67-1984.
20
21 Mr. Hunter's letter states:

23 I recently purchased a 6 unit apartment building (203 North 15th) where my
24 family and I live.
25
26 It has been my observation that with all the multi family residences on this
27 street, there is barely adeqate parking facilities to accomodate the needs
28 of the occupants.

30 If the new business that has been proposed for 119 North 15th Street will

28 business does not have noisy machinery or dangerous emissions. The location

30 adequate parking facilities. The company is hoping to expand up to 100 employers.
