PROCEEDINGS OF THE COMMON COUNCIL OF THE
CITY OF RICHMOND, INDIANA, JUNE 4, 1984
1 The Common Council of the City of Richmond,Indiana, met in regular session
2 June 4, 1984 at the hour of 7:30 p.m. in the Council Chambers in the Municipal
3 Building in said City. President Elstro presided with the following members
4 in attendance: Councilpersons Brookbank, Hankinson, Whitesell, Parker, Bodiker,
5 LEmoine and Morris. Absent: Councilperson Williams. The following business

14 Councilperson Morris moved to approve the minutes of the previous meeting as
15 propared, seconded by Councilperson Parker and on unanimous voice vote the
16 motion was carried.

18 COMMUNICATIONS FROM THE MAYOR
19
20 Mayor Frank Waltermann told the Council he had traveled to Chicago to meet
21 with a group called JETRO ( Japan Trade Center ) and visited several Japanese
22 Banks on May 31, 1984. This was in cooperation of Mr. Todd Wynn of the Indian.
23 Department of Commerce. On June 6, 1984, Mayor Waltermann will be attending
24 a meeting in Indianapolis with Japanese Bankers. He hopes they will look
25 favorable upon Richmond in the future.

27 Mayor Waltermann stated that the Economic Growth and Development Board had
28 met and elected Stanley Vigran as President and James Beier as Secretary and
29 they have formed a group to interview applicants for the job of Economic
30 Development. Director.

32 REPORT bROM BOARD OF PUBLIC WORKS AND SAFETY

34 Councilperson Brookbank reported on the decision made by the Board of Works
35 regarding the traffic hazard at the intersection of South 21 and A Streets.
36 The Board has recommended the trimming of hedges at this intersection, the
37 removal of a tree if necessary and the yellow stripping of an additional 20'
38 if necessary to improve this intersection. She also reported that parking
39 had been limited to the east of South 20th Street from Main to A by the
40 Board of Works.

46 Councilperson Brookbank reminded the Council that the meeting of the Enter-
47 prise Zone is on June 5, 1984 at 7:30 p.m.

49 REMINDER OF PUBLIC HEARING

51 The Clerk reminded the Councilpersons of the Public Hearing on the Cumualtive
52 Capital Development Fund on June 6, 1984 at 7:00 p.m. in the Council Chambers.

54 MISCELLANEOUS BUSINESS

56 Councilperson Bodiker made a motion to have the Indiana State Highway Comm-
57 ission hold a public hearing on the widening of East Main Street from 16th
58 Street eastward, seconed by Councilperson Lemoine and on unanimous voice vote
59 the motion was carried.

61 President Elstro requested the Mayor to contact the State Highway.Commission
62 to request a public hearing.

9 COMMISSIONERS AND COUNTY COUNCIL OF WAYNE COUNTY, INDIANA TO CONTRACT OR
10 FRANCHISE ON THE CITY'S BEHALF FOR EMERGENCY MEDICAL SERVICES.

12 Councilperson Parker asked if this Resolution would take away the City's
13 power in this decision and give it to the County.

15 Councilperson Whitesell couuuented on the April 3, 1984 memo from the City
16 Attorney regarding Ambulance Services and new legislation giving the Council
17 control over the Ambulance Service. Councilperson Whitesell stated he feels
18 Mr. Barden's intent with this Resolution is to continue the same format
19 with the County contracting for these services.

21 Councilperson Morris questioned the fact that there was no time. limitation
22 on this Resolution.

24 It was decided to hold this Resolution until the next meeting of the Common
25 Council in order to have the City Attorney answer questions on: it.

29 President Elstro announced that Ordinance No. 41-1984 had been inadvertantly
30 left off the Agenda on first reading and that it will take a motion and
31 unanimous approval of the Council to place it on the agenda.

34 place on the agenda, seconded by Councilperson Morris and on a call of the
35 roll the motion was passed.-

65 Councilperson Bodiker reminded the Council that there was a proposed amendmen

1 to Ordinance No. 38-1984 on the floor that still needed action. The amend-
2 ment includes the addition of a Section H readign, "The Corporate authorities
3 shall within five days after the receipt of the formal report of the Fact-
4 Finding Panel, establish final negotiation meetings with the bargaining agent
5 for a final effort to resolve the issues. Facts,, evidence, and recommendations
6 of the Fact-Finding Panel shall then be binding upon the parties .in dispute
7 and shall form a part of the ordinance passed.by Common Council, unless so
8 modified or rejected by at least 2/3 vote of the entire membership of the
9- Common Council."

11 Councilperson Whitesell requested that the Council allow the public hearing
12 on :the total Ordinance since this amendment is a basic part of the Ordinance.
13 This was allowed by general consensus.
14
15 Councilperson Bodiker stated that having served on fact finding panels he
16 feels that fact finding is useless without some teeth in it. This amendment
17 will assure that fact finding. panels serve with some purpose.
18
19 Speaking in favor of Ordinance No. 38-1984 and the amendment was Marc Smith,
20 President of the Fraternal Order of Police. Mr. Smith stated that once the
21 City and a bargaining unit have negotiated to a point they cannot resolve,
22 these bargaining units have no recourse at this point, it becomes a take it
23 or leave it situation. In the past the City has ignored the recommendations
24 of the fact finding panels. This amendment means both the City,and the FOP
25 or any other bargaining unit has to live with the findings even if it would
26 mean a pay freeze. The Council does have an out with a 2/3 vote
27
28 Councilperson Morris ocnunented on the fact that the amendment is clouding
29 the issue of the open fact finding hearings. Mr. Smith stated that he does
30 not agree with the fact that the hearing must be open to the public, but if
31 these negotiations are done open to the public and the decision is public
32 then let the decision be binding. Councilperson Morris asked Mr. Smith if
33 they were asking for future protection in negotiations and Mr. Smith answered
34 yes.

36 In response to a question from Councilperson Parker, Mr. Smith coi:mented
37 that if the findings of the panel were binding it would be easier to accept
38 the fact that funding is not available for the percentage of raise requested.

40 Also speaking for the amended version of Ordinance No. 38-1984 was Dale
41 Sharrits, 1000 N.W. D Street. Mr. Sharrits stated Ordinance No. 38-1984 with
42 the amendment gives public recourse in negotiations with the Council being
43 the final decision maker.

8 Company owned all the property contiguous to the alleys they are requesting
9 to be vacated. The Plan Couuuission recommended approval of this request by
10 a vote of 8 to O.

17 Councilperson Lemoine stated that this covers the sales tax on gasoline at
18 the Airport. This is a bookkeeping problem and corrects a failure to include
19 the sales taxes as revenue and to include this budget category in the operati g
20 budget.

5 Councilperson Whitesell commented that he had held the Ordinance on third
6 reading regarding the status of the animal shelter. Mr. Barden has presented
7 the following amendments and they can be adopted with a unanimous vote of

8 the Council. The amendments are as follows: Section 6. Exemptions - Hospital. ,
9 common clinics, and other premises operated by license veterinarians for
10 the care and treatment of animals and charitable not-for-profit organizations
11 are exempt from the provisions of this except those provisions in Section 3,
12 paragraphs (a), (b), (c), (d), (e), (g), (h), (i), (j), (1), (m), (n) and
13 (o) and Section 4 - Records. C. Sales of fish under $5.00 are exempt from
14 the record keeping provision of this Section.

40 Councilperson Parker questioned President Elstro regarding a letter received
41 from Mr. Aaron Scharlach of 409 N.W. 8th Street which had been shown to all
42 the members of Council. The letter was requested to be entered into the
43 minutes in full as follows:

47 I spent my working years in Ft. Wayne, Indiana, as an employee of a Public.
48 Utility, not an Electric Utility, and moved to_ Richmond in 1973.

50 While a resident of Ft. Wayne I was a patrol of Ft. Wayne City Light, a
51 Municipal Utility, operating a coal fired steam plant. We enjoyed dependable
52 service, at a very reasonable rate.

54 In later years the Common Council of the City of Ft. Wayne saw fit to dip
55 into the Surplus Funds of City Light in order to provide funds for other
561 City Departments, such as Recreation and Park Department activities, to the
57 detriment of the Cash Surplus and Depreciation Accounts of City Light.

59 After a number of years the Common Council found that the City Light was
60 being pinched for funds to maintain a competative utility, and for some
61 time was unable to decide what to do about a serious problem, to the detri-
62 ment of what had been a healthy utility. The fianl result was to lease the
63 coal fired plant to the competition and watch the last Alternator in Ft.
64 Wayne come to halt.

1 Today, there are many people in Ft. Wayne who think of Mayor William Hosey and
2 City Light when they read their Monthly Electric Bills.

4 Will Richmond's younger generation of today'be reading their Electric Bills
5 in the year 2010 and suffer the agony experienced by Ft. Wayne Citizens in
6 recent years?

8 I moved to Richmond in 1973 and have enjoyed being a customer of Richmond
9 Power & Light, at the above address. I feel that the People of Richmond are
10 very fortunate in having a person of the capability, qualifications and years
11 of experience in Electrical Generating Equipment of Mr. Irving Huffman as
12 Manager of the Richmond Power & Light Plant.

14 As a user of Eelctric Power, as a Taxpayer and as a holder of Bonds in the
15 Indiana Municipal Power Agency I urge every Member of the Governing Board of
16 Richmond Power & Light to think seriously before casting a vote in favor of
17 using Surplus Funds for other purposes that the operation of Richmond Power
18 & Light.
