HomeMy Public PortalAbout04-02-1984 059 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, APRIL 2, 1984 1 The Common Council of the City of Richmond, Indiana, met in regular session 2 April 2, 1984, at the hour of 7:30 p.m. in the Council Chambers in the Mun- 3 icipal Building in said City.President Elstro presided with the following 4 members present: Williams, Brookbank, Hankinson, Whitesell, Parker, Bodiker, 5 Lemoine and Morris. Absent: none. The following business was had to-wit: 6 7 PLEDGE OF ALLEGIANCE 8 9 SILENT DEVOTIONS 10 11 APPROVAL OF MINUTES OF MARCH 19, 1984 12 13 Councilperson Hankinson moved to approve the minutes of the previous meeting 14 as received, seconded by Councilperson Morris and on unanimous voice vote 15 the motion was carried. 16 17 COMMUNICATIONS FROM THE MAYOR 18 19 Mayor Frank Waltermann reported he had met with Dianne Lupke regarding the 20 Enterprise Zone and had attended Labor Management Conferences on April 2nd 21 and 3rd and found these especially helpful with ideas on remaining neutral 22 but helping both labor and management. 23 24 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY 25 26 Joseph Nimitz, Chief of Police, reported to the members of Common Council 27 regarding the decision to stop the Foot Patrol program and return the Offic- 28 ers to the cars. The Chief explained the manpower shortage existing in the 29 department. They are currently seven (7) men short from the seventy-seven 30 (77) allocated men. They currently have four (4) eligible for retirement. 31 Chief Nimitz stated the hiring procedures through the Merit Commission is 32 a very time consuming process and is also costly for the department. In the 33 future the department will probably start a list of qualified applicants and 34 will initiate the hiring process as quickly as possible to keep the depart- 35 ment to full staff. 36 37 Councilperson Bodiker asked Chief Nimitz why the Foot Patrol Program was 38 suspended entirely. He asked if it would be possible to limit the program to 39 certain areas that could be alternated and to also limit the hours and days 40 of operation of the program. 41 42 Chief Nimitz stated that the walking concept has always been with the depart- 43 ment and even though the Foot Patrol Program has been stopped. Shift Captains 44 can assign officers to walk when they deem it necessary. They have always 45 had officers walking problem areas. The Chief stated they looked at using 46 Reserve Officers, but that this would probably not work since their hours 47 are not mandatory. Currently the department is looking for federal and pri- 48 vate funding to reinstate the program. 49 50 Councilperson Morris stated that the Foot Patrol Program was valuable and 51 worth saving. She has been collecting signatures of persons in the affected 52 areas and over 700 signatures have been collected supporting the program. 53 She stated the residents of the areas felt that juvenile problems have been 54 reduced and the program is restorign pride in the neighborhoods. She offered 55 the assistance of Common Council to save the program. 56 57 Councilperson Hankinson stated he supports the decision of the Chief to 58 eliminate the Foot Patrol until the personnel is up to strength. 59 60 REPORT FROM CITY DEPARTMENTS 61 — 62 City Attorney Kenneth Barden told the Common Council that a new State Statute 63 regarding ambulance service for municipalities mandates that the Common 64 Council set up the program for ambulance service. 65 60460 Common Council Minutes Con't April 2, 1984 Page 2 . . 1 Councilperson Williams announced a Couuuittee of the Whole Meeting for April 2 25, 1984 at 7:00 p.m. in the Board of Works Room to discuss ambulance service, 3 complaints on wrecker service and the placement of the police communications 4 equipment. 5 6 REPORTS FROM SPECIAL COMMITTEES 7 8 Councilperson Brookbank reported on the Reid Hospital Board meeting. She 9 stated that the construction has been completed and that the trailers were 10 to have been removed as of April 1, 1984. Councilperson Brookbank also 11 reported on the rural designation received by Reid Hospital and the loss of 12 revenue this will cause the hospital in Medicare reimbursments. 13 14 Councilperson Lemoine reported on the meeting at the Airport with the City 15 Council and the County Council. The meeting outlined the cost estimates for 16 the Instrument Landing System. Councilperson Lemoine stated it was her im- 17 pression that the Mayor's Office was working on an Ordinance to set aside 18 some money for the Instrument Landing System. 19 20 Councilperson Brookbank announced: the Enterprise Zone meeting on April 3, 21 1984 at 7:30 p.m. in the Board of Works Room and invited other members of the 22 Council to attend. 23 24 INTRODUCTION OF MISCELLANEOUS BUSINESS 25 26 Councilperson Williams asked the City Attorney if there is a State Statute 27 that gives the State Board of Accounts jurisdiction over City Councils. Mr. 28 Barden stated the State Board of Accounts enforce State Statutes and point 29 out what they suspect could be violations. They also point areas they consider, 30 to be poor or bad judgement. They, are not a law enforcement agency, but they 31 report either to the prosecuting attorney or the State Attorney General. 32 33 President Elstro announced that he will take the appointment of a represent- 34 ative from Council to the City Negotiating Committee under advisement. Ms. 35 Maness stated there is a possibility they will need more than one represent- 36 ative. 37 38 RESOLUTIONS 39 40 RESOLUTION NO. 9-1984 41 42 Councilperson Whitesell moved to suspend the rules and read Resolution No. 43 9-1984 by title only, seconded by Councilperson Hankinson and on unanimous 44 voice vote the motion was carried. 45 46 The Clerk read by title only Resolution No. 9-1984 - A RESOLUTION ADOPTING 47 THE GENERAL STANDARDS AND REQUIREMENTS TO BE USED IN FINDING AN AREA TO BE AN 48 ECONOMIC REVITALIZATION AREA. 49 50 Councilperson Whitesell asked for Resolution No. 9-1984 to be explained. 51 52 Mr. Daniel Dooley, Supervisor of the Planing and Economic Development Dep- 53 artment, explained this Resolution sets forth criteria and guidelines for an 11/ 54 Ordinance to establish an Economic Revitalization Area. Property owners in 55 this area will be able to seek Tax Abatement which is a part of the total 56 package of the City of Richmond for Economic Development. Mr. Dooley stated 57 that the 1981 Ordinance for Tax Abatement-is now obsolete. 58 59 Mr. Dooley commented that a second Resolution can be presented to Council to 60 propose and designate actual areas. 61 62 Councilperson Hankinson asked Mr. Dooley who sets standards of revitalization 63 for residences. This resolution does not state exactly what has to be done 64 for this to be consisered revitalization. Mr. Dooley stated the Council would 65 have the broad discretionary powers to look at the project and decide if it 61 Common Council Minutes Cont'_d April 2, 1984 Page 3 1 meets the intent of the program. III 2 3 Councilperson Bodiker asked Mr. Dooley if this Resolution addressed places of 4 business or places of residences. Mr. Dooley commented it can be either busi- 5 ness or residence. 6 7 Councilperson Lemoine asked Mr. Dooley if the current Resolution is intended 8 to update the prior designations. Mr. Dooley stated that was correct. Prior 9 all areas zoned industrial or downtown business were eligbile. Mr. Dooley 10 couu«ented the Council must now set the standards and then they can actually 11 designate certain areas for revitalization. 12 13 Councilperson moved to adopt Resolution No. 9-1984, seconded by Councilperson 14 Whitesell and on the following vote the Resolution was adopted. 15 16 Ayes: Williams, Brookbank, Whitesell, Parker, Lemoine, Morris and Elstro (7) 17 Nays: Hankinson and Bodiker (2) 18 19 ORDINANCES ON FIRST READING 20 21 Councilperson Whitesell moved to suspend the rules and read Ordinances 19,20, 22 21,22,23,24,25,26,27,28,29 and 30-1984 by title only, seconded by Councilperso 23 Brookbank and on unanimous voice vote the motion was carried. 24 25 The Cleric read on first reading by ttile only Ordinance no. 19-1984- AN ORDI- 26 NANCE REQUIRING THE LICENSING OF KENNELS AND PET SHOPS, REQUIRING SUCH KENNELS 27 AND PET SHOPS TO BE KEPT IN A CLEAN AND SANITARY CONDITION, PROVIDING FOR THE 28 INSPECTION OF SAME AND PENALTIES FOR VIOLATION THEREOF. . 29 30 President Elstro announced Ordinance No. 19-1984 will be advertised for public 31 hearing. 32 33 The Clerk read on first reading by title only Ordinance No. 20-1984 - AN 34 ORDINANCE AMENDING THE DESIGANTION OF HANDICAPPED PARKING SPACES TO PERMIT 35 ONLY VEHICLES IDENTIFIED BY THE INDIANA STATE BUREAU OF MOTOR VEHICLES AS 36 BEING USED TO TRANSPORT HANDICAPPED PERSONS, AND TO CLARIFY THAT SUCH DESIG- 37 NATION AS A HANDICAPPED PARKING AREA DOES NOT EXEMPT SUCH SPACE FROM OTHER 38 APPLICABLE PARKING OR TRAFFIC RESTRICTIONS. 39 40 Councilperson Morris moved to suspend the rules and move Ordinance No. 20-1984 41 to second reading, seconded by Councilperson Hankinson and on unanimous voice 42 vote the motion was carried. 43 44 The Clerk read on second reading by title only Ordinance No. 20-1984 - AN 45 ORDINANCE AMENDING THE DESIGNATION OF HANDICAPPED PARKING SPACES TO PERMIT 46 ONLY VEHICLES IDENTIFIED BY INDIANA STATE BUREAU OF MOTOR VEHICLES AS BEING 47 USED TO TRANSPORT HANDICAPPED PERSONS, AND TO CLARIFY THAT SUCH DESIGNATIONS 48 AS A HANDICAPPED PARKING AREA DOES NOT EXEMPT SUCH SPACE r'ROM OTHER APPLIC- 49 ABLE PARKING OR TRAFFIC RESTRICTIONS. 50 51 The City Attorney stated this amendment is needed to avoid conflict with 52 purchases of stickers available locally in commercial establishments and not 53 issued by the Bureau of Motor Vehicles. It also clarifies the fact that this 54 does not exempt the person from other violations such as the two (2) hour 55 limit. 56 57 Councilperson Parker questioned Mr. Barden regarding enforcement of Handicapp-d 58 parking in the Post Office Lot. Mr. Barden expalined they could contract with 59 the City for enforcement, but other wise the City had no authority for en- 60 forcement. (9) 19� 20 Nays: None 21 22 ORDINANCE NO. 21-1984 23 2 The Clerk read on first reading by title only Ordinance No. 21-1984- AN 2 ORDINANCE AMENDING THE SALARIES AND POSITIONS OF THE BOARD OF WORKS AND 26 THE PUBLIC TRANSIT FUND OF THE CITY OF RICHMOND, INDIANA, FOR THE FISCAL 27 YEAR BEGINNING JANUARY 1, 1984 AND ENDING DECEMBER 31, 1984. 28 29 Councilperson Morris asked Ms. Maness regarding the refunding of the position 30 of the Coi:uuunciation Technicain. Ms. Maness stated that this is needed for 31I radio repair .and the fire alarm system. Mayor Waltermann told the Council 32211 that the position was eliminated because it was not understood exactly what 33 the job entailed. 34 35 Councilperson Whitesell asked Ms. Maness what the percent of raise was on 30 the CORTA drivers. The Chief stated 23 the department had received donations from businesses and individuals to 24 purchase a dog. The transfers will be used to purchase equipment for the 25 K-9 use, new shotguns, repainting one cruiser, lab supplies and shirts and 26 jackets. The surplus funds are from personnel since they are six officers 27 short. 28 29 President Esltro announced Ordinance No. 26-1984 was on public hearing. 30 31 There was no public comment on Ordinance no. 26-1984. 32 33 Councilperson Hankinson moved to engross Ordinance No. 26-1984, seconded 34 by Councilperson Perker and on unanimous voice vote the motion was carried. 35 36 Councilperson Williams moved to suspend the rules and to move Ordinance No. 37 26-1984 to third and final reading and read by title only, seconded by 38 Councilperson Whitesell and on unanimous voice vote the motion was carried. 39 40 The Clerk read on third and final reading OrdinancecNo. 26-1984:.- AN ORDINANCE 41 TO TRANSFER WITHIN THE GENERAL FUND - POLICE DEPARTMENT. 42 43, Ordinance No. 26-1984 was adopted with the following vote: 44 45 Ayes: Williams, Brookbank, Hankinson, Whitesell, Parker, Bodiker, Lemoine, 46 Morris and Elstro (9)Y: 47 48 Nays: None 49 50 ORDINANCE NO. 27-1984 51 52 The Clerk read on first reading by title only Ordinance No. 27-1984 - AN 53 ORDINANCE TO APPROPRIATE FROM THE LOCAL ROAD AND STREET FUND. 54 55 President Elstro announced Ordinance No. 27-1984 will be advertised for 56 public hearing. 57 58 ORDINANCE NO. 28-1984 59 60 The Clerk read on first reading by title only Ordinance NO. 28-1984 - AN 61 ORDINANCE TO TRANSFER WITHIN THE LOCAL ROAD AND STREET FUND. 62 63 Ralph Willis, Public Works Director, explained to the Council that this 64 transfer-of $40,000.00 is for right of way purchase and appraisers for the 65 extension of South L Street from 23rd Street to Henley Road which is Phase II 466 Common Council Minutes Cont'd April 2, 1984 Page 7 1 of the extension. IIIMr. Willis. stated that Phase I of the South L Street extension from 9th Street to 23rd Street should be completed by November of 1984. d Councilperson Whitesell asked Mr. Willis what the status of Phase II of this 1 project was. Mr. Willis stated that the FA-2's had been submitted to the stat for funding of the building portion of the project, but that right of way " l9 9 purchase must be done with lcoal funds. 11i Councilperson Hankinson asked if the City was committed to a time period on 12 this phase of the project. Mr. Willis explained the rights of way must be 13 purchased by August 2, 1984 or the State will not allocate funds for the buil • 1 � ing of the route.:This means that the City will finish the portion of the route 1 stated and stop. 1 11 Councilperson Whitesell commented that he did not support this project and 14 feels this request should be delayed. 19 2 Mr. Willis stated that the penalty involved in delaying the project would be 2 the repaying of the engineers fees after a five (5) year time limit. Mr. 2 Willis also stated that if we don't finish with this project the funding re- 23 quest for 1985 with the State will automatically by killed. 2 2 There was no other action on Ordinance No. 28-1984. 2 27 ORDINANCE NO. 29-1984 2 2 The Clerk read on first reading by title only Ordinance No. 29-1984 - AN 30 ORDINANCE TO TRANSFER WITHIN THE PARK AND RECREATION FUND. 31 371 Councilperson Bodiker moved to suspend the rules and move Ordinance No. 29-1984 33 to second reading, seconded by Councilperson Brookbank and on unanimous voice 3i vote the motion was carried. 3 36 The Clerk read on second reading Ordinance No. 29-1984 - AN ORDINANCE TO 3ATRANSFER WITHIN THE PARK AND RECREATION FUND. 39, President Elstro announced Ordinance No. 29-1984 was on public hearing. 4C 41 Ms. Maness explained the $10,000.00 would be taken from payroll as part of th- 42 savings of the retirement of Don McBride as Superintendent and used to repair 41 the roof at the Municipal Stadium. 41 4 Councilperson Bodiker told .the Council that the roof was in bad need of repai 4 and the Park Board had supported this project. 41 4.
