HomeMy Public PortalAbout02-06-1984 427 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INAIANA, FEBRUARY 6, 1984 1 The Common Council of the City of Richmond, Indiana, met in regular session 2 February 6, 1984, at the hour of 7:30 p.m. in the Council Chambers in the 3 Municipal Building in said City. President Elstro presided with the follow- 4 ing members present: Councilpersons: Williams, Brookbank, Hankinson, 5 Whitesell, Parker, Bodiker, Lemoine and Morris. Absent: None. The follow- 6 ing business was had, to-wit: 7 8 PLEDGE OF ALLEGIANCE 9 10 DEVOTIONS 11 12 APPROVAL OF MINUTES OF JANUARY 16, 1984 13 14 Councilperson Hankinson moved the minutes of the previous meeting be approved 15 as received, seconded by Councilperson Parker and on unanimous voice vote 16 the motion was carried. 17 18 PRESENTATION OF PETITIONS, MEMORIALS OR REMONSTRANCES 19 20 Councilperson Brookbank stated she has a problem on East Main Street with 21 a person having a Used Car Lot in the rear of a residence at 22nd and East 22 Main Streets. She stated that Ordinance 56-1983 addresses this issue and 23 she would like attention given to this matter. The City Attorney has 24 already responded with a letter to the owner of the property and that Mr. 25 Dennis Bronston, the Zoning Administrator, is also looking into the matter. 26 27 COMMUNICATIONS FROM THE MAYOR 28 29 Mayor. Frank Waltermann stated that the sound system in the Council Chambers 30 has been repaired. Mayor. Waltermann commented that since the last Council 31 Meeting he has been involved with the Insurance Advisory Panel, the Urban 32 Enterprise Zone Association and has participated in two (2) Grand Openings. 33 34 Mayor Waltermann stated he had met with one (1) local business regarding 35 expansion d'that business. He has also met with Dr. Tim Jackson and Don 36 Petro of the Richmond Community Schools ragarding ridership on City buses 37 when they go to the four (4) year High School and Middle School. 38 39 On January 27th Mayor Waltermann met with Lt. Governa'Mutz and was assured 40 by the Lt. Governor that Richmond's Economic Development will not be 41 affected by the change in administration. Mayor Waltermann also attended 42 a meeting regarding the Job Training Partnership Act. 43 44 The Mayor announced that the Holiday schedule for trash pick-up is being 45 studied and that the missed route will be made up the following working 46 day and not held over for two (2) weeks. 47 48 BOARD OF PUBLIC WORKS AND SAFETY 111 49 50 Councilperson Parker requested thatthe Board of Public Works and Safety 51 look into the condition of the traffic at the corner of S.W. 1st and Main 52 Street. The traffic is becoming confused as to what lane to travel in since 53 the lane marker originally designed for buses is not well marked and had 54 deteriorated. Cathy Maness, Controller and President of the Board of Public 55 Works, stated the Board will take this under advisement. 56 57 Councilperson Bodiker asked the Board to investigate the timing of the 58 traffic lights on North and South A Streets in the downtown area. The 59 lights are no longer timed properly causing problems in the traffic flow. 60 61 Councilperson Morris asked the Board to investigate the traffic at the 62 intersection of North 16th and East Main Streets. The northbound traffic 63 on 16th Street is often confused due to Right Turn onRed for the Westbound 64 traffic on U.S. 40. 65 42 . Common Council Minutes Cont'd February 6, 1984 Page 2 1 The Board will take all these inquiries under advisement and report back 2 at the next Council Meeting. 3 4 REPORT FROM CITY DEPARTMENTS 5 6 None 7 8 REPORT FROM OTHER OFFICES 9 10 None 11 12 REPORT FROM STANDING COMMITTEES • 13 14 None 15 16 REPORT FROM SPECIAL COMMITTEES 17 18 Coucilperson Brookbank, liaison to Reid Hospital Board reported she had 19 attended two (2) orientation meetings for new Board Members and one Board 20 Meeting. She also reported on the Enterprise Zone. The meetings of the 21 Enterprise Zone are the first Tuesday of each month at 7:30 p.m. in the 22 Board of Works Room. They will be compiling a list of businesses and 23 industries within the Enterprise Zone and the Board will-_be touring the 24 Zone. Councilperson Brookbank also reported on the Chemical People project. 25 She asked support against HB 1229 since this bill would cause the lose 26 of funding for Alcohol and Drug Rehabilitation Programs. 27 28 Councilperson Lemoine invited the members of Common Council to attend 29 a meeting at the Airport on February 28, 1984 at 7:00 p.m. This meeting 30 will be to give a tour of the airport facilities and talk about the ILS. 31 32 Councilperson Morris reported on the meeting of the Plan Commission on 33 February 24,1984. At that meeting they gave approval for the request 34 of Victor Bartlemay for his project on US 27 North. Councilperson Morris 35 has asked Dan Dooley to meet with the members of Council and a meeting 36 has been arranged for February 16,1984 at 7:00 p.m. in the Planning Office. 37 38 Councilperson Whitesell stated that he, Mary Merchanthouse and Mayor Frank 39 Waltermann attended the meeting of the Community Services Council on January 40 20, 1984. Councilperson Whitesell commented that the Community Services 41 Council is currently working on such problems as handling of transients 42 and utility deposits for persons unable to pay. He commented that the 43 Mayor spoke to the group regarding the willingness of the City to assist 44 in funding for a Needs Survey. He has invited the Community Services 45 Council to attend the March 5, 1984 meeting of Common Council to give 46 a short presentation stating their functions and activities. The next 47 meeting of the group will be on February 17, 1984. 48 49 MISCELLANEOUS BUSINESS 50 51 President Elstro announced that there is new stationary available for 52 the members of the Common Council in the City Clerk's Office. 53 54 President Elstro asked that from now on all Ordinances that originate 55 from the Planning Department be referred to the Common Council on first 56 reading and them to the Plan Commission for Public Hearing and recommendation. 57 58 Councilperson Lemoine complimented the Police Department on their attendance 59 at a Deaf Awareness Workshop. 60 61 62 63 64 65 6 `d R_) Common Council Minutes Cont'd February 6, 1984 Page 3 1 ORDINANCES ON FIRST READING 2 3 Councilperson Whitesell moved to suspend th=.rules and read by title only 4. Ordinance No. 5-1984, seconded by Councilperson Brookbank and on unanimous 5 voice vote the motion was carried. 6 7 The Clerk read by title only on first reading Ordinance No. 5-1984 - AN 8 ORDINANCE VACATING A CERTAIN PUBLIC ALLEY LYING IN THE TERRITORY GENERALLY 9 BOUNDED BY NORTH "B" STREET, NORTH 8TH STREET, NORTH "A" STREET AND NORTH 10 7TH STREET. 11 12 President Elstro announced that Ordinance No. 5-1984 will be referred to 13 the Plan Commission. 14 15 Councilperson Morris moved to suspend the rules and read by title only 16 Ordinance No. 6-1984, seconded by Councilperson Whitesell and on unanimous 17 voice vote the motion was carried. 18 19 The Clerk read by title only on first reading Ordinance No. 6-1984 - AN 20 ORDINANCE TO APPROPRIATE WITHIN THE GENERAL FUND. 21 22 Councilperson Williams moved to suspend the rules and move Ordinance No. 23 6-1984 to second reading and read by title only, seconded by Councilperson 24 Brookbank and on unanimous voice vote the motion was carried. 25 26 The Clerk read by title only on second reading Ordinance No. 6-1984 - AN 27 ORDINANCE TO APPROPRIATE WITHIN THE GENERAL FUND. 28 29 President Elstro announced that Ordinance No. 6-1984 is on public hearing. 30 31 Controller, Cathy Maness, speaking for Ordinance No. 6-1984 explained 32 that this Ordinance involves a transfer of $6,200.00 from the Personal 33 Services account of the..Police Department into the categories of Other 34 Services and Charges and Capital Outlays. 35 36 Councilperson Parker asked regarding what the category Services and Charges 37 is made up of. Ms. Maness commented that this was made up of a variety of 38 supply categories. Councilperson Parker commented that it was very difficult 39 for Council to decide on these appropriations without proper explanation 40 and that the Council would appreciate it if the Department Heads would be 41 present at the meeting to assist the Council in these matters. 42 43 Ms. Maness explained she has a letter from Chief Nimitz and will locate it 44 to read to the Council. 45 46 Councilperson Morris asked regarding the budget of Personal Services and 47 the Controller explained this is the payroll account. 48 49 There was no public comment for or against Ordinance No 6-1984. 50 51 Councilperson Williams moved to engross Ordinance No. 6-1984, seconded by 52 Councilperson Brookbank and on unanimous voice vote the motion was carried. 53 54 Councilperson Williams moved to suspend the rules and to move Ordinance No. 55 6-1984 to third and final reading and to read by title only, seconded by 56 Councilperson Brookbank and on unanimous voice vote the motion was carried. 57 58 The Clerk read on third and final reading by title only Ordinance No. 6-1984- 59 AN ORDINANCE TO APPROPRIATE WITHIN THE GENERAL FUND. 60 61 Ordinance No. 6-1984 was carried with the following vote: 62 63 Ayes: Williams, Brookbank, Hankinson, Whitesell, Parker, Bodiker, Lemoine, 64 Morris and Elstro (9) 65 Nays: None 432 Common Council Minutes Cont'd February 6,1984 Page 4 1 ORDINANCES ON SECOND READING 2 3 The Clerk read by title only on second reading Ordinance No. 4-1984 - 4 AN ORDINANCE TO APPROPRIATE WITHIN THE MOTOR VEHICLE HIGHWAY FUND. 5 6 President Elstro announced Ordinance No. 4-1984 is on Public Hearing. 7 8 Speaking for Ordinance No. 4-1984 was City Controller, Cathy Maness. 9 Ms. Maness explained this was a transfer of funds from the Personal 10 Services account of the Motor Vehicle Highway Fund into the Supply account 11 in the amount of $16,213.00. This is being done due to monies saved 12 form the reorganization of the personnel and will be used to help compensate 13 for the cut in this account made by the State Tax Commissioners. The 14 funds will be used: to purchase salt for the City streets. 15 16 There was no public comment for or against Ordinance No. 4-1984. 17 18 Councilperson Williams moved to engross Ordinance No. 4-1984, seconded 19 by Councilperson Parker and on unanimous voice vote the motion was carried. 20 21 Councilperson Williams moved to suspend the rules and to move Ordinance 22 No. 4-1984 to third and final reading and to read by title only, seconded 23 by Councilperson Morris and on unanimous voice vote the motion was carried. 24 25 The Clerk read on third and final reading by title only Ordinance No. 26 4-1984 - AN ORDINANCE TO APPROPRIATE WITHIN THE MOTOR VEHICLE HIGHWAY 27 FUND. 28 29 Ordinance No. 4-1984 was carried with the following vote: 30 31 Ayes: Williams, Brookbank, Hankinson, Whitesell, Parker, Bodiker, Lemoine, 32 Morris and Elstro (9) 33 Nays: None 34 35 ORDINANCES ON THIRD READING 36 37 Councilperson Whitesell moved to suspend the rules and read Amended 38 Ordinance No. 1-1984 on third and final reading by title only, seconded 39 by Councilperson Williams and on unanimous voice vote the motion was 40 carried. 41 42 The Clerk read on third and final reading by title only Amended Ordinance 43 No 1-1984 - AN ORDINANCE AMENDING ORDINANCE NO. 28-1983, AS AMENDED, 44 (AN ORDINANCE AMENDING TITLE III, ADMINISTRATION OF THE MUNICIPAL CODE 45 OF THE CITY OF RICHMOND, INDIANA) , ESTABLISHING EXECUTIVE DEPARTMENTS 46 AND ADMINISTRATIVE PROVISIONS. 47 48 Councilperson Whitesell asked for clarification concerning legalities 49 of the language of within the Ordinance. City Attorney, Ken Barden, 50 commented that the section of the Ordinance dealing with the Sanitary 51 Board and the Board of Public Works and Safety is worded properly. 52 State Statutes show both Boards have concurrent powers over the administra- 53 tion and operation of the sewers, etc. Under the language in this 54 Ordinance , the Board of Sanitary Commissioners will retain their power 55 to levy taxes and set fees. 56 57 Councilperson Parker asked the City Attorney if it were correct that 58 the City Engineer may ormay not serve on the Board of Sanitary Commissioners 59 and that neither an Engineer or third member to the Board of Sanitary 60 Commissioners have been appointed. Mr. Barden stated that this is correct. 61 62 63 64 65 433 Common Council Minutes Cont'd February 6, 1984 Page 5 1 Amended Ordinance No. 1-1984 was carried with the following vote: 2 3 Ayes: Williams, Brookbank, Whitesell, Bodiker, Lemoine, Morris and Elstro 4 (7) 5 Nays: Hankinson and Parker (2) 6 7 Councilperson Whitesell moved to suspend the rules and read Amended 8 Ordinance No. 2-1984 on third and final reading by title only, seconded 9 by Councilperson Williams and on unanimous voice vote the motion was carried. 10 11 The Clerk read on third and final reading by title only Amended Ordinance 12 No. 2-1984 - AN ORDINANCE AMENDING IN ITS ENTIRETY ORDINANCE NO. 34-1983 13 (AN ORDINANCE FIXING SALARIES AND POSITIONS FOR APPOINTED OFFICERS AND 14 EMPLOYEES OF THE CITY OF RICHMOND FOR THE FISCAL YEAR BEGINNING JANUARY 15 1, 1984 , AND ENDING DECEMBER 31, 1984) , AND APPROVING THE ADDITIONAL COM- 16 PENRATION TO CERTAIN APPOINTED OFFICIALS OF THE CITY, OTHER THAN GOVERNMENT- 17 AL, WHO PERFORM SERVICES FOR THE CITY, WHICH SERVICES ARE CONNECTED WITH 18 THE OPERATION OF MUNICIPALLY OWNED UTILITY OR FUNCTIONS. 19 20 Amended Ordinance No. 2-1984 was carried with the following vote: 21 22 Ayes: Williams, Brookbank, Hankinson, Whitesell, Parker, Bodiker, Lemoine, 23 Morris and Elstro. (9) 24 Nays: None 25 26 Councilperson Whitesell moved to suspend the rules and read by title only 27 Amended Ordinance No. 3-1984 on third and final reading, seconded by 28 Councilperson Brookbank and on unanimous voice vote the motion was carried. 29 30 The Clerk read on third and final reading by title only Amended Ordinance 31 No. 3-1984 - AN ORDINANCE TO APPROPRIATE WITHIN THE GENERAL FUND. 32 33 Amended Ordinance No. 3-1984 was carried with the following vote: 34 35 Ayes: Williams, Brookbank, Hankinson, Whitesell, Parker, Bodiker, Lemoine, 36 Morris and Elstro. (9) 37 38 Nays: None 39 40 Councilperson Williams moved that Ordinance No. 73-1983 be removed from 41 the table and be placed on second reading and to suspend the rules and 42 read by title only, seconded by Councilperson Morris and on unanimous voice 43 vote the motion was carried. 44 45 The Clerk read on second reading by title only Amended Ordinance No. 73- 46 1983 - AN ORDINANCE TO ESTABLISH A HEALTH INSURANCE FUND AND PROVIDE FOR 47 A SURVIVING SPOUSE OR RETIREE TO PARTICIPATE IN THE INSURANCE PROGRAM. 48 49 Councilperson Williams complimented the Insurance Advisory Panel for their 50 presentation on the City's Insurance program. 51 52 Councilperson Whitesell asked regarding the amendments made at the prior 53 Council meeting and the revisions proposed by the Insurance Panel. He 54 suggested that the revisions made by the Insurance were acceptable to him 55 and suggested that the Council adopt those amendments. 56 57 Councilperson Hankinson moved to amend Section 3 of Amended Ordinance No. 58 73-1983 as follows: Delete -100-percent and add 30 percent in line 3, 59 Delete (1)' Two years from the month of death if death occurred in the line 60 of duty, or (2) one year from the month of death if the death was by 61 natural causes; and, and replace it with "One year from the month of death; 62 and, seconded by Councilperson Brookbank and on uanimous voice vote the 63 motion was carried. 64 65 4841 Common Council Minutes Cont'd February 6, 1984 Page 6 • 1 Councilperson Hankinson moved to amend Section 4 of Amended Ordinance 2 No. 73-1983 as follows: Add "while on duty" after the word disabled 3 in line nine (9) and add to the end of Section 4 "participation is limited 4 to age 65 or eligibility for medicare; and," seconded by Councilperson 5 Whitesell and on unanimous voice vote the motion was carried. 6 7 Councilperson Hankinson moved to amend Section 5 of Amended Ordinance 8 No. 73-1983 as follows: Add "for coverage without furnishing evidence 9 of insurability" in line six (6) , seconded by Councilperson Whitesell 10 and on unanimous voice vote the motion was carried. 11 12 Councilperson Hankinson moved to amend Amended Ordinance No. 73-1983 13 with the addition of a new section numbered 6. Section 6 will read: 14 That any retiree or surviving spouse who is on or qualified for other 15 Group Health Insurance coverage can not participate in this fund; and, 16 seconded by Councilperson Brookbank and on unanimous voice vote the 17 motion was carried. 18 19 Councilperson Hankinson moved to amend Amended Ordinance No. 73-1983 20 with the addition of a new section numbered 7. Section 7 will read: 21 That this Ordinance be subject to acceptance by claims administrator, 22 specific deductible excess carrier and/or aggregate stop carrier, 23 seconded by Councilperson Whitesell and on unanimous voice vote the 24 motion was carried. 25 26 President Elstro announced that Amended Ordinance No. 73-1983 is on 27 Public Hearing. 28 29 Speaking for Amended Ordinance No. 73-1983 was Mark Smith, President 30 ofthe Fraternal Order of Police, 225 Crestwood Lane. Mr. Smith thanked 31 the Council for their time involved in the Ordinance and reaffirmed 32 the benefits to all City Employees 33 34 Also speaking for Amended Ordinance No. 73-1983 was Alex Kuperwicz of 35 203 South 18th Street, Richmond, Indiana. Mr. Kuperwicz thanked the 36 Insurance Panel for all their assistance and expertise in forming this 37 Ordinance. He reminded the Council that the success of the Ordinance 38 would still depend on those participating in the fund. 39 40 There was no public comment against Amended Ordinance No. 73-1983. 41 42 Councilperson Williams moved to engross Amended Ordinance No. 73-1983, 43 seconded by Councilperson Hankinson and on unanimous voice vote the 44 motion was carried. 45 46 Councilperson Williams moved to suspend the rules and move Amended 47 Ordinance No. 73-1983 to third and final reading and read by title only, 48 seconded by Councilperson Parker and on unanimous voice vote the motion 49 was carried. 50 51 The Clerk read on third and final reading by title only Amended Ordinance 52 No. 73-1983 - AN ORDINANCE TO ESTABLISH A HEALTH INSURANCE FUND AND 53 PROVIDE FOR A SURVIVING SPOUSE OR RETIREE TO PARTICIPATE IN THE INSURANCE 54 PROGRAM. 55 56 Amended Ordinance No. 73-1983 was carried with the following vote. 57 58 Ayes: Williams, Brookbank, Hankinson, Whitesell, Parker, Bodiker, Lemoine, 59 Morris and Elstro. (9) 60 Nays: None 61 62 ORDINANCES AT COMMITTEE OF THE WHOLE 63 64 President Elstro commented on Ordinance No. 43-1983 still remaining 65 in the Committee of the Whole and that action will be takin in the future. 31"0 / Common Council Minutes Cont'd February 6, 1984 Page 7 1 UNFINISHED BUSINESS 2 3 Controller, Cathy Maness, read the letter from Chief Nimitz regarding the 4 transfer within his budget. The letter stated that excess funds in 5 Services Personal were due to being five (5) officers, short since the first 6 of this year. These funds will be tranferred into Other Equipment to 7 replace old and outdated equipment and into Other Administrative Expense 8 for investigative funding. 9 10 President Elstro announced to the Council that the next Council Meeting 11 will be on February 21, 1984 instead of February 20, 1984 since that date 12 is a Holiday.
