AN ORDINANCE OF THE TOWN COMMISSION OF THE TOWN OF GULF
STREAM, PALM BEACH COUNTY, FLORIDA, AMENDING CHAPTER 38
RELATING TO WATERWAYS AT ARTICLE III WATERCRAFT BY RESCINDING
SECTION 37 -72 PERMIT FOR DOCKING AND RENUMBERING SECTIONS 38 -73
THROUGH 38 -76; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL
OF ORDINANCES IN CONFLICT; PROVIDING FOR CODIFICATION;
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE TOWN COMMISSION OF THE TOWN OF GULF
STREAM, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Section 1. Section 38 -72 of the Town Code of Ordinances entitled "Permit for
docking" is hereby rescinded.
Section 2. Section 38 -73 of the Town Code of Ordinances entitled "Anchoring or
mooring" is hereby renumbered as Section 38 -72.
Section 3. Section 38 -74 of the Town Code of Ordinances entitled "Maintenance
restrictions" is hereby renumbered as Section 38 -73.
Section 4. Section 38 -75 of the Town Code of Ordinances entitled "Speed" is
hereby renumbered as Section 38 -74.
Section 5. Section 38 -76 of the Town Code of Ordinances entitled "Disposal of
wastes prohibited" is hereby renumbered as Section 38 -75.
Section 6. Severability.
If any provision of this Ordinance or the application thereof is held invalid, such
invalidity shall not affect the other provisions or applications and to this end the
provisions of this Ordinance are hereby declared severable.
Section 7. Repeal of Ordinances in Conflict.
All other ordinances of the Town of Gulf Stream, Florida, or parts thereof which
Conflict with this or any part of this Ordinance are hereby repealed.
Section 8. Codification.
This Ordinance shall be codified and made a part of the official Code of
Ordinances of the Town of Gulf Stream.
Section 9. Effective Date.
This Ordinance shall take effect immediately upon its passage on second reading
and adoption.
PASSED AND ADOPTED in a regular, adjourned session on first reading
