HomeMy Public PortalAbout10-03-1983 043 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, OCTOBER 3, 1983 1 The Common Council of the City of Richmond, Indiana, met in regular session III 2 October 3, 1983 atthe hour of 7:30 p.m, in the Council Chambers in the 3 Municipal Building in said City. President Mills presided with the follow- 4 ing members present: Messrs. Elstro, Williams, Ms. Henry, Hankinson, Parker, 5 Carter and Paust. Absent: Welch. The following business was had, to-wit: 6 7 DEVOTIONS • 8 -. 9 Councilman Williams 'gave devotions. 10 - 11 APPROVAL OF MINUTES OF SEPTEMBER 19, 1983 12 . 13 Councilman Hankinson moved to approve the minutes of the previous meeting 14 as prepared, seconded by Councilman Parker and on unanimous voice vote 15 the motion was carried. - 16 • 17 RESOLUTIONS • 18 19 Councilman Paust moved to suspend the rules and read Resolution No. 21-1983 20 by title only, seconded by Councilman Williams and on unanimous voice vote 21 the motion was carried. 22 23 RESOLUTION NO. 21-1983 24 25 The Clerk read by title only Resolution No. 21-1983 - RESOLUTION AUTHORIZING 26 THE FILING OF AN APPLICATION WITH THE STATE OF INDIANA DEPARTMENT OF COM- III27 MERLE, FOR AN .ENTERPRISE ZONE PROGRAM. AS ENACTED BY THE 1983 GENERAL 28 ASSEMBLY OF THE STATE OF INDIANA HOUSE- ENROLLED ACT NO. 1629. 29 • 30 Director of City Planning Bob Goodwin explained the request noting we have 31 until the 15th of October to submit the application. He noted the bound- 32 aries for the- zone are set by the Chief Executive under guidelines set out, 33 by the State concerning population, area and unemployment within the zone. 34 In response to a question by Councilman Elstro,Mr. Goodwin noted businesses 35 already in existence in an enterprise zone qualify for 'portions of the 36 benefits of this zoning. 37 38 Councilman Parker stated he does have a business located in the proposed 39 area as listed in the paper and asked whether or not he should be voting 40 on this resolution. Mr. Goodwin noted the area listed in the paper was 41 merely speculation. The determination was that- Councilman Parker can' 42 vote on this resolution. 43 • • 44 Councilman Williams stated he saw where Glazer bought property in the area 45 of North "G" and 8th and he should not be allowed to park trailers in any 46 residential areas. 47 . 48. Councilman Hankinson moved for adoption of Resolution No. 21-1983, seconded . 49 by Councilman 'Paust and on unanimous voice vote the motion was carried. 50 51 REPORT CHANGE IN CABLE TV MANAGEMENT III 52 53 Ms. Marilyn.'Young,:.rNorthern Indiana: Area .Manager for- Telecommunications, Inc. 54 2704' Central Court; Indianapolis,' IN, stated: there was a lack of communica- 55 tion in their company and the local manager has been:: terminated which 'they 56 feel will be best for all concerned. They have been doing a lot of work in 57 the community and eliminating problems as they find them. : They recognize 58 they have problems. Mr. Larry Gross, area engineer, was present and took 59 notes of the-problems from Council. The group and-..corporate engineers will 60 be here on Wednesday and Thursday of this week' to assess problems they: are 61 aware of.' Hopefully the problems can be corrected all at once. 62 63 President Mills stated rate increases for Cable: TV has been with the Board 64 of Works; however, under the-hew home rule, Council will determine whether 74 3� 7 . Common Council Minutes Cont'd. October 3, 1983 Page 2 1 or not any increase is granted. Ms. Young stated she does not intend to 2 ask-for a rate increaseuntil the problems are solved. Telecommunications 3 wants to standarize the programming throughout the United States among 4 their 500 systems. 5 6 Councilman Parker stated the west side has had bad cable and bad cable 7 connections which the previous manager stated would be repaired and re- 8 placed. He asked if this has been done. Mr. Larry Gross, Northern Indiana 9 Area Engineer, stated they have had an on-going maintenance program concen- 10 trated on the north and west sides replacing bad cable which they hope to 11 - continue. There is a problem where the cables join on the west side. 12 13 Councilman Elstro pointed out there have been problems with Cable ever 14 since it was brought in with repair, replacement, new management, new 15 company and getting through on the telephone when there is a problem. New 16 management promises these things will be improved, but it never materializes. 17 Ms. Young requested she be given a chance to improve the situation. She 18 noted a local answering service is being used which is inadequate and she 19 hopes to better this.. Councilman Williams reported that Channel 6 all of 20 a sudden goes out. 21 22 AUDIENCE COMMENT 23 24 Mr. John Lindley, 616 South 9th Street, representing a group of other 25 taxpayers in the area, complained about South 9th Street not being swept. 26 He requested having the street swept as it is impossible to sit on the 27 front porches for the dust. He stated Councilman Elstro has been down 28 there and agrees it is in deplorable shape. Mr. Meredith will check with 29 Mr. Bill Davis at the Street Department to see if anything has been done. 30 31 COMMUNICATIONS FROM THE MAYOR 32 33 Mayor Cliff Dickman thanked Council for passing Resolution No. 21 as it 34 will be beneficial to the City if they are successful with the State. 35 36 COMMITTEE OF THE WHOLE 37 38 Committee of the Whole Chairman Parker reminded Council members of the 39 meeting of this committee on October 10 at 7:30 p.m. in the Board of Works 40 Room to review the trashand subdivision ordinances. 41 42 ORDINANCES ON 1ST READING 43 44 Councilman Paust moved to suspend the rules and read Ordinance Nos. 44-1983, 45 45-1983 and 46-1983 on first reading by title only, seconded by Councilman 46 Williams and on unanimous voice vote the motion was carried. 47 48 ORDINANCE NO. 44-1983 49 50 . The Clerk read on first reading by title only Ordinance No. 44-1983 - AN 51 ORDINANCE AMENDING TITLE III, CHAPTER 31, APPENDIX B OF THE MUNICIPAL CODE 52 OF THE CITY OF RICHMOND, INDIANA. (Gun Permits.) 53 54 Councilman Elstro moved to suspend the rules and read Ordinance No. .44- 55 1983 on second reading, seconded. by Councilman Paust and on unanimous 56 voice vote the motion was carried. 57 . 58 ,The Clerk read on second reading Ordinance No. 44=1983 59 .� 60 Speaking for Ordinance No. 44-1983 was Police Chief Charles Chris, noting 61 the state statute has been changed stating a $10.00 application fee shall 62 be collected. This ordinance is to incorporate these fees. A license is 63 currently good for two (2) years;under the new bill it is for four (4) 64 years. There being no one speaking:for or against this Ordinance, Councilman 3 Paust moved for engrossment, seconded.by Councilman Hankinson. The 111 4 motion carried. with Councilman Williams voting no. 5 6 Councilman Carter moved to suspend the rules and read Ordinance No. 44-1983 7 on third and final reading by title only, seconded by ,Councilman -Paust. 8 . Councilman Williams voted no. YPresident, Mills announced. Ordinance No, 44- 9 1983 will be back on third reading at the next meeting. 10 . 11 ORDINANCE NO. '45-1983 • 12 13 The Clerk read on first reading by title 'only Ordinance No. 45-1983 - AN 14 - ORDINANCE AMENDING CHAPTER'154 OF THE MUNICIPAL CODE, BEING ORDINANCE 15 NO. 2325-1968, COMMONLY KNOWN AS THE ZONING• ORDINANCE OF THE CITY OF 16. RICHMOND, INDIANA, PROVIDING TORTHE REZONING OF PROPERTY -LOCATED IN 17 THE 3300 BLOCK OF STATE ROAD 38 FROM A-1 AGRICULTURAL DISTRICT.TO C-4 18 GENERAL BUSINESS DISTRICT.. . 19 . . 20 Councilman Carter stated he' is a real estate agent who is involved in the 21 sale of this property and should abstain from any discussion and voting on 22 this ordinance. President Mills stated if Council has no-disagreement, he 23 will allow Councilman Carter to' abstain from this ordinance.:, 24 ' 25 Councilman Hankinson moved to suspend the rules and read Ordinance No. 45- 26 1983 on second reading, seconded by Councilman Paust and on unanimous 27 vOice vote the motion was carried. 28 • 29 The Clerk- read on second reading. Ordinance No.- 45-1983. ' . • 30 . 31 Speaking for Ordinance No. 45-1983 was Plan Director Bob Goodwin, noting 32 the Plan Commission recommended this :property be rezoned. The property 33 is located 'on State Route 38 just west of Silver -Point and the proposed 34 use is for car sales and. auction. Also speaking for this ordinance was 35 Attorney Jim Ronald, who represented the five (5) owners of this property 36 fifteen (15) years ago when they bought the acreage. The Common- Council of the City of Richmond, Indiana, met in special 2 session October . 10, 1983 at the hour of 7:15 p.m. in The Board of -Works Room 3 in the Municipal Building in said City. President Pro-Tem Parker presided 4 with the following members. present: Messrs. Elstro, Williams, Ms. Henry, 5 Hankinson, Welch and Carter. Absent: Mills and Paust. The following 6 business was had, to-wit: 7 - 8 President Pro Tem Parker announced the purpose of this meeting is for 9 Council to appoint four (4) members to an Urban Enterprise Association. 10 The Mayor will appoint five (5). members at.a later date. The recommen- 11 dation is for a Council representative of Robin Henry, two (2) citizen 12 representatives of Mamie Wright and Joln'Bown and a business represen- 13 tative of John Hitch. Councilman Williams nominated Rose Robinson, 14 noting if the zone is in the b A-d3carea, there should be two (2) or 15 three (3) blacks on the association. Councilman Welch suggested Ms. 16 Robinson could be an appointee of the Mayor. The present proposed bound- 17 aries are the river on the north, the river on the west, South "A" Street 18 on the south to 18th and north to Main, east on Main to 22nd Street and 19 north to 24th. Councilman Elstro stated he would like to see Marion 20 'Williams as Council representative instead of Robin Henry. Councilman 21 Williams declined, stating he would rather see Rose and Mamie on it. 22 23 President Pro Tem Parker stated Council will be "voting on Robin Henry 24 as Council representative as there are no other nominations and on 111 25 unanimous voice vote the appointment was approved. 26 27 President Pro Tem Parker stated Council will be voting on John 'Hitch 28 . as Business representative as there are no other nominations and on 29 unanimous voice vote the appointment was approved. 30 - 31 President Pro Tem Parker stated a vote would be held on John Brown, 32 Mamie Wright and Rose Robinson as Citizens representatives. 33 34 On a roll call vote for John Brown the following was recorded: All ayes. 35 36 Oh a roll call vote for Mamie Wright the following was recorded: All. ayes. 37 38 It was then noted the positions had been filled.
