PROCEEDINGS OF THE COMMON. COUNCIL OF THE
CITY OF RICHMOND, INDIANA, JUNE 6,- 1983
1 The Common Council of the City of. Richmond,. Indiana, met ,:in .regular
2 session June 6, 1983 .at the hour of 7:30 p.m. in the 'Coun_ cil Chambers
3 in the Municipal Building in said City. President Mills presided with
4 the following members present.: . Messrs. Elstro,. Williams, Ms. Henry,
5 Welch, Parker, Carter and Paust. Absent: . Hankinson. The following
6 business was had, to-wit:

14 Councilman Welch moved to approve the minutes of the last regular meeting
15 and special meeting as prepared, seconded by Councilman Paust and on
16 unanimous voice vote the motion was carried.

20 Mr. Allen Moore, 6870 Guy Murray Road, New Paris,.-Oh.io, .representing
21 Chemical Workers Local 623, asked. why Resolution. No. 7 does .not appear on
22 the agenda. President Mills s'tated, Resolution No. 7 was passed at the
23 last meeting. He explained that the matter of, Economic Development bonds
24 for Procom mow goes back to. the Economic Development .Commission for them
25 to held a public hearing. .If .their recommendation. is favorable, an ordi-
ill26 nance will come before Common Council. ..On .second reading this ordinance
27 will be on public hearing for anyone to speak for or against. Mr. Moore
28 stated they were under the impression that the bonds would be for an
29 empty building arid ,the building is not empty. .Procom is running the lines.
30 President Mills stated the resolution-was an inducement resolution for
31 economic development bonds. ' Mr. .Moore--requested.the minutes of the meeting
32 concerning this resolution.be read. President Mills read that portion 'of
33 the minutes._ Councilman.Williams stated the Council does not have juris-
34 diction over what they do .wi.th that building, but they do have jurisdiction
35 over the bonds. Mr. Moore was told to watch the paper or call to find out
36 when this .issue may be coming back to Council.

49 Councilman Welch explained the purpose of this resolution is to authorize
50 the general manager of RP&L to 'enter into an agreement with Wayne County
III51 REMC and Public Service Company of Indiana over territories that will be
52 served by the utilities and to sign agreements with those companies for
- 53 - the service territories mapped out and agreed to by those utilities.

55 Councilman Paust moved for adoption of Resolution No. 10-1983, seconded by
56 ' Councilman Carter and on unanimous voice vote the 'motion was carried.

58 • REPORT FOR THE BOARD OF WORKS

60 .Councilman.Parker stated he noted in the Board of Works minutes that the
61 state- had requested removal of the stop light at 16th and National Road
62 West and the Board had rejected this request. He noted he also is against
63 the removal of this light and would like to be kept informed of the status
,64 of this request.

1 Councilman Elstro has set next Monday night at 6:00 p.m. for Council to
2 tour the Sanitary Department.

12 Councilman Carter stated that Ordinance No.. 21-1983 has to do with Heritage
13 Regency, Inc. and the bonds that have been issued pertaining to the con-
14 struction of that facility. He has a financial interest in_ that facility
15 -_ -. and will not be making any_ comments or voting on this issue. President
16 Mills requested approval of Council and on unanimous voice vote the approval
17 was given.

22 DEVELOPMENT REVENUE BONDS, SERIES A (HERITAGE REGENCY, INC. PROJECT)" IN
23 ' COUPON FORM, AND AUTHORIZING OTHER ACTIONS IN RESPECT THERETO.

31 President Millsaannounced Ordinance No. 21-1983 is on public hearing.
32 Speaking for this Ordinance was Attorney Kent Klinge, representing Heritage
33 Regency, Inc. 'and -Merchants National Bank. This bond issue was approved in
34 February -and-closed in March. When bond counsel ordered the bonds, they
35 ordered bare bonds which is a single form bond. When Merchants Bank, as
36 . trustee, sold the bonds to investors, the investors preferred to have
37 coupons on the bottom of the bonds. This ordinance provides for this. -

39 Councilman Welch moved for engrossment, seconded by Councilman Paust and
40 ' on unanimous voice vote the motion-was carried. -

42 Councilman Weldh moved to suspend- the rules and read Ordinance No. 21-1983
43 on third and final reading by title only, seconded by Councilman Parker
44 and on unanimous voice vote the motion was carried.

17 Speaking for this Ordinance was Attorney Robert Burton, 25 No, '7th' Street,.
18 . representing Knoblers, owners of the property. The Golden Rule Nursing
19 Home has 110._beds and desire to .add on- another 66 beds for which they have-
20 - State Board of Health approval. .. The addition would be-to the south of the
21 existing building-. - .He-.presented a letter. from the Wayne County Sheriff
22 - concerning traffic: Surveyor John Beals, Contractors Don and Ron Chance
• 23 and Al- Knobler were-present to. answer'any. questions. Also -speaking in
24 favor of this Ordinance- was :Dr. Francis Warrick noting the need for further
25 nursing home care. He has had patients at Golden--Rule and can attest to
2.6 the fine care they-have: received. He urged Council. to. consider favorably

27 this Ordinance. .. Also .speaking was .Mr. Sam Knobler, .management of u Golden
28 _ Rule for the. past eight . (8) years, who noted the project also is for dining
29 room space,..physical & speech therapy and educational & recreational areas.
30 He noted they will cooperate with the neighbors. . .

32 'Speaking against -Ordinance No. 24-1983 was Mr. Arthur. Clouse., 2297: Straight- ,
- 33 line , Pike, stating the neighbors had put in a sanitary sewer under the
34 Barrett Law.. At that -time the' neighbors tried to get the nursing home .to •
35 ego on it with them, and the nursing home said they didn't need it. When
36 they built. the second building, they hooked, onto the sewer. He further
' 37 stated the nursing home built a' s,ewer- across the road and is running all
38 of their water into the ditch. There is a water problem in the area. All
39 this should be corrected and, if they hook onto the Barrett Law sewer this

40 time, he feels they should pay their share.

46 Councilman Williams moved to suspend the rules and read Ordinance No. 24-
47 1983 on third and final reading by title only,. seconded by Councilman
48 Welch and on unanimous voice vote the motion was carried. .

50 Councilman-Williams noted stipulations were put on this recommendation
51 from the Plan Commission. The -Clerk read the stipulations In the Ordinance.

10 President Mills announced Ordinance No. 25-1983 is on public hearing.
11 Speaking for this Ordinance was Attorney Bob Bever, 400 First National
12 Bank, representing Rodefeld Co. , Inc. , noting this is a sliver of land
13 which was left out of the master zoning plan and is surrounded by com-
14 mercial zoning. He stated Mr. Bob Rodefeld is present to answer any
15 questions.

17 Councilman Elstro moved for engrossment of Ordinance-No. 25-1983,
18 seconded by Councilman Welch and on unanimous voice vote the motion
19 was carried.
